The Circuit Attorney of the City of St. Louis, State of Missouri, upon information and belief, charges that Count 1: Assault/attempt Assault 1st Degree On Law Enforcement Officer (Class A FELONY) RSMo 565.081 FROM 2/20/2013 at 10:45 PM TO 2/20/2013 at 10:50 PM Place: 9xx ELIAS AVE (SCC 13100) The defendant, in violation of Section 565.083, RSMo, committed the class A felony of assault of a law enforcement officer in the first degree, punishable upon conviction under Section 558.011, RSMo, in that on or about February 20, 2013, in the City of St. Louis, State of Missouri, xxx was a law enforcement officer, defendant knew xxx was a law enforcement officer, and attempted to kill or to cause serious physical injury to him, by shooting him.

The defendant, in violation of 571.070, RSMo, committed the class C felony of unlawful possession of a firearm, punishable under Sections 558.011 and 560.011, RSMo, in that on or about February 20, 2013, in the City of St. Louis, State of Missouri, the defendant knowingly possessed a .25 Raben semi-automatic pistol, a firearm, and on August 30, 2010, the defendant was convicted of the felonies of three counts of Statutory Sodomy in the first degree in the City of St. Louis, State of Missouri.

Count 6: Possession Of Controlled Substance Except 35 Grams Or Less Of Marijuana (Class C FELONY) RSMo 195.202 ON 2/20/2013 Time: Place: 9xx ELIAS AVE (SCC 32450) The defendant, in violation of Section 195.202, RSMo, committed the class C felony of possession of a controlled substance, punishable upon conviction under Sections 558.011 and 560.011, RSMo, in that on or about February 20, 2013, in the City of St. Louis, State of Missouri, the defendant possessed cocaine base, a controlled substance, knowing of its presence and nature.

2. The facts supporting this belief are as follows: Officers xxx and xxx responded to an active alarm at 9xx Elias Ave. The officers were dressed in full uniform at the time. The officers illuminated a spot light on the residence. The officers knocked on the front door of the residence which is located on the side of the house and no one responded. The officers saw a light on in the rear of the residence and smoke coming from a chimney. As the officers were walking to the rear of the residence, the defendant appeared from the rear of the residence and fired a pistol at the officers several times. Officer xxx was struck in the leg and Officer xxx was struck in her foot. The officers returned fire and struck the defendant. The defendant returned to the basement of the house. Other police officers arrived and discovered the defendant was in possession of off-white chunks later identified by the St. Louis Police Department Lab as cocaine base. On August 30, 2010, the defendant plead guilty to three counts of Statutory Sodomy in the first degree in the City of St. Louis, State of Missouri under cause number 22061-01031.
