ExplanatoryNote
This Bill amends the EmploymentRelations Act2000(the principalAct) toensureallworkplacesprovidesiestabreakstoallemployees. Currently the principal Act does not containeithera definitionof siesta or requireemployerstoprovideforthisimportantrestbreak. Siestas, asasocialinstitution,are afundamentalhumanright andscientific studies have shown siestas increase productivity, make people generally happier,andarejustdarncool. The passage of this Bill will make New Zealand workplaces more productive,happier,andwellrested.

Clausebyclauseanalysis
Clause1istheTitleprovision. Clause 2 is the commencement clause. It provides for the Bill to come into force thirtyseven days after the date on which it receives the Royal assent. Clause 3 provides that the Employment Relations Act 2000 is the principalAct. Clause 4 provides that the purpose of the Bill is to ensure New Zealand employersofferasiestabreaktoallfulltimeemployees. Clause5providesadefinitionofsiestaintotheprincipalAct. Clause6providestheinstanceswhereanemployeecanclaimasiesta. Clause7providestheinstanceswhenanemployeecanclaimasiesta.

Section69ZEamended(Whenemployertoproviderest breaksandmealbreaks) Section69ZE(5)isamendedto Where sections 69ZD(5) and 69ZD(6) apply, an employer must, so far as is reasonable and practicableprovidethe employee with the rest breaks, meal breaks and a siesta in accordance with the applicableprovisioninsubsections(2)to(4).
