Thelawabhorsawrongwithoutaremedy.Inmyopinion,aCityvendorcanbeinvestigatedbytheCity underthefollowingcircumstances: 1.ThevendorhasbeenemployedbytheCitytoperformwhatwouldbeconsideredanimportant public/municipalfunction 2.theallegedviolationoccursduringthescopeandcourseofthatemploymentand 3.theallegedviolationwasdirectedagainstaCityemployee. Toopineotherwisewouldpermitavendorwho,inessence,actsasaCityemployeetoexposetheCityto unfetteredcivilliabilitywithoutconsequence. ThesecondquestionposedinyouremailconcernsCitypolicy.TheCitypolicyinthismatterisasfollows: ...[A]llcomplaints,regardlessoftheirnatureororigin,willbeinvestigated.Everyinvestigationwill betreatedwiththehighestdegreeofconfidentialitypossibleunderthecircumstancesandevery employeewhohasknowledgeorissuspectedtohaveknowledgewillbeexpectedtogive testimony....
