ABOUT OUR FIRM Overview. Silver, Voit & Thompson carries forward a tradition of excellence. A strong focus of our firm is in the area of bankruptcy, creditors' rights and business reorganization. We are considered to be one of the leading firms in the region in these areas. While the complexities of modern practice require a high degree of specialization, we do not have rigidly drawn departmental lines, and our lawyers have in most instances expertise in more than one area. We believe that our lawyers should be able to shift the emphasis of their practices to meet changes in the law, the needs of our clients and new professional interests. Legal Staff. Only the experienced and skilled lawyers of the firm guide every critical step involved in the representation of a client. At present our staff consists of six attorneys and approximately four support personnel. Biographical information on our attorneys follows.

Areas of Practice. General civil practice is the term often applied to the nature of types of work in which our firm engages. Seven areas of concentration are predominant: Bankruptcy and Creditors' Rights, Business Litigation, Corporate, Real Estate, Consumer Finance, and General Practice. Bankruptcy. The firm's bankruptcy work has earned it the reputation of being one of the leading bankruptcy firms in the region. For many years the firm has been involved in a significant way in virtually every major Chapter 11 case in the Southern District of Alabama. Although we often represent creditors and creditors committees, we are particularly recognized for our effectiveness in the Chapter 11 reorganization process, (representing secured and unsecured creditors, debtors and other parties in interest), complex litigation in the bankruptcy courts, including that related to plan confirmation, avoidance of fraudulent or preferential transfers, stay relief and dischargeability issues. Business Litigation. The handling of trials and trial related matters is an important part of our practice. A basic tenet of our trial practice is that well prepared and skilled trial lawyers can and should handle a wide variety of cases. Our docket contains many cases in which we are representing corporate clients and others in business and contract cases. Major matters we have recently concluded or are currently handling include: environmental litigation in behalf of a large multi-national oil corporation; defense of lender's liability and fraud litigation in behalf of a national bank; defense of other financial institutions charged with fraud or overreaching conduct; litigation involving landlord/tenant liability issues; defending a large national title insurer in disputes arising from claims under policies for title insurance; and enforcement of creditors rights in complex matters. Corporate. Our firm serves as general or local counsel to various local and regional companies. Aside from guiding our corporate clients and their key managers in the handling of many sensitive matters including development and enforcement of employee policies, employment law, and regulatory compliance issues, we have been effective in representing our clients in transactions involving sales or purchases of businesses, mergers, and consolidations. Real Estate. The practice of our firm in the area of real estate includes representation of clients involved in various aspects of the acquisition, financing, development, management and sale of all types of real property. A substantial part of our real estate practice is involved in the handling of real estate related workouts. In addition the firm routinely handles matters relating to the purchase and sale of large facilities including work throughout the area with respect to shopping centers of various sizes. Counseling and representing clients concerning landlord/tenant issues has enabled the firm to develop unique expertise in this area. We have also developed expertise in the area of mortgage foreclosure and redemption law.

Our firm has particular experience with environmental issues affecting real estate including those confronted with liability concerns under federal and state laws for ownership of property contaminated by hazardous substances and wastes. Our activities in this area also include the contractual protection of clients in real estate sales and leases and other commercial transactions involving real property. Probate and Estate Planning. We represent a number of high-wealth individuals and families who need estate planning advice. We have the expertise to craft sophisticated wills and trusts designed to minimize taxation and preserve assets. Consumer Finance. Our firm has a long history of representing consumer lenders in all types of litigation, and in compliance matters concerning state and federal consumer credit and debt-collection statutes and regulations. General Practice. Although it is classed as being in the general practice area, we have several clients involved in high technology fields. This involves us with computer software authors and developers, and the negotiation of contracts related to these matters. Employer/employee matters, including contracts, non-competition covenants and safety and health issues are frequently handled by the firm as well as a variety of matters arising from the handling of estates, trusts, drafting of wills and otherwise assisting individuals in planning their estates. Public Service Activities. Since its inception the firm has engaged in a wide variety of public interest and pro bono activities and the firm encourages its members to contribute their leadership skills to a wide variety of charitable, community, social service, religious and public interest activities. In addition the firm's members are regularly involved in bar association leadership activities in an effort to assist other lawyers in enhancing their skills and becoming acquainted with new developments and techniques in effectively representing their clients.
