22-28 April @ Patong Beach, Phuket Phuket Gay Pride Festival 2013. The event is supported by local gayowned businesses as well as the gay communities in Bangkok and Pattaya. This year there will be a parade through the streets of Patong on the 27th of April as well as other activities such as street parties in Paradise Complex, bowling and volleyball competitions, fund raising and a charity auction. Songkran Festival
10-15 April @ Phuket Songkran is is the traditional start of the Buddhist New Year as well as the end of the dry season. A national holiday, the festival sees a ritual washing of Buddha images and bathing. It has evolved into a loud, boisterous and fun festival that features water throwing in the streets. Bill Barnett
Property columnist and founder and Managing Director of C9 Hotelworks reveals how one book inspired a life-changing trip to Asia, where hes lived for nearly three decades.
How long have you been in Phuket? Ive lived in Phuket for 10 years and have been in Asia for 28 years. Tell us about your background and how you came to live in Asia. I grew up in the suburbs of Los Angeles. In my early 20s I was in the music business, working as a tour manager and also at Capitol Records in the PR department as a messenger. I started writing record reviews. It was my passion. Later, I was living in Hawaii and read a book called 'Lost in the Sepik River' about Michael Rockefeller, an American who went missing in Papua New Guinea. It was one of those Jerry Maguire moments of clarity and I became possessed with thoughts of moving there. I was hired by a guy who ran white-water rafting and jungle trekking tours and exported native art from the highlands of New Guinea. From there, I showed up in the Philippines when Marcos was in the middle of Peoples Power. I was the first American hotel manager to work in Vietnam after the war, in the early 1990s during the US embargo. There was no banking system, there were no credit cards allowed, and our phones were tapped. I was in Saigon then went to Hue. Probably one of the best jobs Ive ever had, it was fabulous. I worked for a hotel chain out of Hong Kong, a company called Century Hotels; I was their point man for any new market they entered. They sent me to any place in Asia they wanted to set up. I was in Hong Kong almost nine years, in and out. After briefly working in Singapore, I was recruited to work as Deputy Managing Director at Laguna Phuket in 2002. It was a big complex, I had a lot of scope, and we kind of fell into doing the property thing. We started selling houses and the boom started. We went from 20 million to a billion baht in real estate in a year. Tell us more about your business. After working with Laguna, I started my own business, C9. Our profile over time has evolved. Early on it was more asset management and development consultancy. Now its shifted to more market research and feasibility work. We do a lot of work offshore, mainly in Asia: Bali, Hong Kong, Sri Lanka, Singapore. Were working on a handful of significant mixed-use hotel and residential projects in Thailand. Its a small operation with three analysts, a PA and myself. On your own blog, The Phuket Insider, and in the media, you sometimes write the not-so-sunny sides of Phuket, such as problems with infrastructure. Do you ever get any flack for it? From time to time, yes, but you have to do it balanced. You dont have to do a rant but you need to draw attention to the issues. Were not brokers, but independent consultants. Ill tell the client if a projects not going to work. Youve got to show the good and the bad. Its good to pitch, but its good to be real too. What do you see as Phukets challenges as a tourist and investment destination? Phukets challenges are not unique. Every Asian resort destination, Pattaya and Bali included, are becoming urban centres: its not about the beach any more. Theres population pressure, mass tourism issues. Another danger is the mindset of numbers-driven growth; when it flattens theres potential for it to turn ugly. What are the most positive developments youre seeing in Phuket now? Its the spirit of the entrepreneurs who are coming in. There are a lot of people doing impressive things here, like Klaus Hebben who built Thanyapura with its organic farm, school and a whole facility that attracts sports people to Phuket. Hes certainly raised the bar here. Right now were seeing some major investors coming back to Phuket. Whereabouts do you live in Phuket? I live in Laguna Village because its near the office. I cant imagine commuting. At one time I lived in Kathu and realised I was spending more time with my car than with my family. Its all about location. Do you own a house or do you rent? What influenced your choice? I own our house I put my money where my mouth is. I promote Phuket property so Im going to buy Phuket property. This is the fourth house Ive bought here. What do you think the future holds for you? You have to keep evolving, keep changing, re-evaluate what youre doing. You cant be stagnant. When business slowed down in Thailand in 2008 we had to go and remake ourselves overseas. Having an international business based in Phuket is a blessing and also a curse: you have a great lifestyle but you also have to present yourself. People see you as some guy on an island and think Wheres Phuket? Credibility is important and thats a challenge. You have to stay on top of things and present a global view and that takes work.

On-the-water, Cape Panwa Hotel Phuket Raceweek continues to hit the high notes with an exciting race programme. In July, the consistent good winds makes Phuket's East Coast the best place for racing, and Principal Race Officer Simon James is planning a variety of short and island courses, making it competitive and fun for all the classes. Run over six or seven classes including Racing, Multihull, Cruising and Bareboat Charter, Phuket Raceweek has gained a reputation for its competitive racing for the serious boats and fun courses around the islands for the less serious racers. And in keeping with tradition the regatta will host the best Classic Class in South East Asian waters. What's unique about Phuket Raceweek is the race area. The East Coast delivers good winds at this time of year and the racing area allows for a variety of race courses something to suit all boats. Aerial Photo: The Surin Phuket iPad interactive virtual tour presentation
Over the years Helicam Co Ltd has photographed many resort hotels and beautiful properties. However nothing compares to The Surin Phuket, a 5-star luxury beach resort located on the tranquil Pansea Beach on the west coast of Phuket. The resort has a total of 103 hillside and beachfront cottages and suites all discreetly built into a carefully conserved landscape, amidst coconut trees and gently sloping down to meet a small coral reef. General Manager of the Surin Phuket, Mr. Antonio Saponara, commissioned Helicam to obtain aerial images and an interactive virtual tour featuring the entire resort. To achieve the aerial images the Helicam crew, Khun Phil, launches the latest addition to the fleet, a machine that uses onboard avionics / GPS navigation to actually fly without a pilot, now the Helicam camera operator is able to take the aerial photography single handed with pin-point accuracy. For the virtual tour, the crew proceeds on the ground using a DSLR camera fitted with a fisheye lens to take the HDR (High Dynamic Range) multiple-exposure images that will make every 360 degree location. The post production is done back at the Helicam office by the studio professionals, khun Mhu & khun Pon. Ingredients
For marinated 30 gm Garlic, chopped 30 ml extra virgin olive oil tsp ground cumin 30 gm parsley, chopped 30 gm coriander root, chopped 30 gm ginger, peeled and chopped 3 pcs tiger prawns, peeled Mediterranean Rice Pilaf 1 tbsp olive oil 20 gm garlic clove, minced 40 gm multi-grain blend (rice) 2 tbsp almond powder 30 gm spinach (only leaf ) 20 gm onions, chopped 1 block Himalayan pink salt to serve and place in a bowl, then marinate with olive oil, cumin, parsley, coriander and ginger, and then combine gently with your hands. Once the block is ready to go, place the shrimps on top of the block and be ready to turn them after a minute. They will cook fast. For the rice Heat olive oil in a 10-inch skillet over medium heat. Add garlic and onion then cook until soft, about 3 minutes. Add prepared multi-grain blend, almonds and spinach with salt and pepper. Cook until heated through put in a small bowl and serve together with tiger prawns.
Method
Preheat your salt block; this will take about 35-45 minutes. You will know its hot enough when you can only hold your hand above it for 2-3 seconds. While heating the block, clean & peel your shrimps

This month the Phuket Hot List takes another close look into one of our favourite places on the island. Weve been keeping our eyes and ears alert to the island buzz to discover whats new, as well as revisiting those sometimes-overlooked spots that remain simmering hot over time. This month, were strolling the sands of stylish Surin Beach in search of the best spots to dine, play, and celebrate the tropical life.
Good value is sometimes elusive at Surin, so we perked up upon seeing the 99 baht happy-hour cocktail sign in front of the long-running beachfront Nok Seafood restaurant. The food is fairly well priced, too, with a great selection of tasty Thai seafood dishes, plus some decent pizza for those who pine for a European meal. The casual setting, wooden tables on a sandy floor shaded by white parasols and screw pines, is pretty much the postcard-perfect tropical scene. Here, happily, happy hour extends into three, from 4pm-7pm, with 50-baht glasses of Chang beer also on offer. Off the beach, a Hollywood celebrity chef has been making waves since his recent arrival at Surin Gate Kitchen, especially with his four-course set dinner on Wednesdays for 750 baht that has had Phuket foodies scrambling to book a table. Cudos, meanwhile, has been chalking up some kudos of its own, with its terrific tapas, Australian beef, duck breast and other hearty specialties, all in a swanky setting reminiscent of a classic big-city eatery. Its elegant interior and stylish walled garden makes this a perfect place for either a power lunch or a mad martini night on the weekend. Be sure to save some space for the divine crme brle or chocolate tart with mixed berry compote.

Basic beachwear, sarongs and gaudy cover-ups are as easy to find here as anywhere else on the island, but Surin also brings more elegant tropical fashions to the more discerning sunseeker set. Paul Ropp features handmade Balinese clothing, shoes and jewellery that are quite simply wearable works of art. The silks and cottons are a vision
of intricacy, rich colour and tropical flair, from chic chiffon lingerie to cotton and silk tops with exquisite embroidery. Looking beach-ready fabulous doesnt come cheap. Just across the road is Island Bliss, with cotton and silk leisurewear by Australian designer Cassandra McMillan, whos extended her range into this bright and friendly Phuket shop after years in Phnom Penh. Her attention to detail and eye for colour add a lavish touch to a distinctly Bohemian style. Sukko means "Beyond Happiness". My first feeling when I stepped through the impressive gates of Sukko Spa was, "Im in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, influenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.
Chilled out by the soothing background music, my mind was filled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the Flower Floating Ritual similar to Loy Kratong, where the idea is to float away past stresses and wish for luck and joy from that moment on. A variety of 40 spa treatments prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory is offered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukkos own herb garden and picked just for your treatment, ensuring they are as fresh as can be. I was pampered with the Be Balanced package; a 3-hour experience that left me feeling relaxed and refreshed. This 3-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by Sukko Synergy Body Massage (see description opposite). Is this pressure okay? Too strong? How are you feeling? my therapist asked me from time to time. Mmmperfect were the only responses that seemed to suit how I felt. Sukko Spas restaurant, Suk Savoey Spa Cuisine, presents a unique concept: "Menu by Blood Types" and "Menu by Elements". What was behind your decision to set up your business in Phuket and why this particular business? Sukko was established in 2005 with a vision to present Thai culture to the world, while also fulfilling the needs of Phuket's tourism industry. Where are you from? Being a true Phuket local is in part what inspired me to start Sukko as a window here in our home to display the pride of Thai wisdom through professional spa management. Whats special or different about Sukko? What are its unique points? Sukkos treatments are developed on the basis of ancient Thai medicinal knowledge, guided by the standards and ethics of certified traditional Thai doctors and herbalists. With herbal recipes handed down through generations, we can ensure that products our guests experience during this period of cleansing and relaxation are free of petrochemicals, synthetic perfumes or colours, meeting each individual's needs. Delivering these treatments are certified therapists, all of whom have undergone 800 hours of training from the Sukko Spa Academy, certified by the Thai Ministry of Education. What do you see as your biggest successes to date? The great feedback from our customers and the many prestigious awards that we have received. Is Sukko involved in any CSR (Corporate Social Responsibility) programmes? If so, please outline briefly. We believe that as a business operating in Phuket, it is crucial that we live as a part of the community and positively contribute to the development of our home. Since our conception, Sukko has been continuously involved with numerous yearly CSR activities such as blood donation and mangrove tree planting outings, as well as numerous donations to causes with our staff and friends of Sukko. Songkran in Phuket
No visitor who has ever been here during the month of April can have avoided coming into contact with the enchanting, hilarious, and occasionally exasperating and downright dangerous watery explosion of public celebration which is Songkran.
Thailand's most celebrated festival is Songkran the Thai new year. It starts on April 13 and lasts for between three and ten days, depending on where youre resident. For most, its lots of fun and an excuse to cool off at what is usually the hottest time of the year. However, theres a deeper significance to Songkran which is rooted in our history and in our beliefs. Allow us to tell you about this. Perhaps it will enhance your enjoyment of the event. The word Songkran is from the Sanskrit Sangkranti, which h means to move upwards or to be about to change. On the eve of the festival, Thais spring clean their homes, symbolically expelling any bad luck from the old year r and prepare for good fortune in the new. Food and other contributions are offered to the monks at the temple early on the morning of the 13th, after which there are ceremonial prayers. Water is also poured on the ground, or on the roots of an ancient tree, symbolising a blessing to ancestors. y Thais who have moved from their home towns always try to return to their families for Songkran and all forms of y transport are booked solid. For this reason you should try e to avoid travelling before, during or immediately after the holiday, particularly by bus or train.

In many town towns and villages, a Buddha image is carried in a processio procession through the streets and people sprinkle water upon it, to show their respect. In the southern provinces, villa village elders are invited to the temple and young people splash water on their heads, signaling their blessings of health and long life. The elders respond by wishing th the young, vigour, wealth and happiness. In another delightful de custom, Thais visit their elderly relatives bring bringing them new clothes for the coming year. Increasingly, urban u Thais have come to celebrate the holiday in a frenzy of water-throwing. Nobody is immune. One of my fondest memories of Songkran is of an immaculat immaculately uniformed policeman (theyre normally very much on their dignity) smiling good-naturedly as he paused to empty water from his highly polished boots. Unfortu Unfortunately these high jinks can get out of hand. Motoris Motorised gangs equipped with high pressure water cannon cannons, iced water and lots of enthusiasm, would get each othe other (and anybody else) wet, in running battles throug through the streets. Unfortunately, speeding traffic, wet roads roa and alcoholic bravado make for a dangerous cocktail. co In the recent past the holidays have been marred by tragic loss of life and injury. Inevitably the authorities authoritie have had to move in to safeguard people. Thailands New Year celebration is a wet and wild event throughout the country, but the Phuket version is the most international and perhaps the most boisterous of all. Tourists, expats and Thais alike arm themselves to the teeth with water guns, powder and buckets and let loose for three days of heavy dousing (and, it must be said, some heavy drinking too). Water battles take place along all the main roads throughout the island, and pickup trucks turn into roving water-war vehicles overloaded with people who splash everyone they pass by as they cruise the soggy streets. Patong is host to the most frenzied Songkran celebrations, while Phuket City comes in at a close second. In addition to days of street parties, there are
a number of traditional activities to join as well. At the time of writing the full schedule of events had not yet been finalised, but confirmed activities include a meritmaking ceremony at Queen Sirikit park in Phuket City on the morning of April 13 and festivities at Saphan Hin park on each day of Songkran from 9am to 6pm. More sacred aspects of the festival that can be seen around the island include processions of Buddha images and ceremonies to pay homage to elders with scented lustral water. Forget about getting anywhere on these days without getting soaked, especially if youre on a motorbike. And no ones immune to a drenching, not even officials on duty. There really is no way of avoiding a soaking, unless you stay in your hotel. Our advice is, If you cant beat them, join them. Dont forget to put wallets, mobile 'phones, cigarettes, lighters etc in a plastic bag.

Trust Accounts, Deposits, Reservations, Purchase Monies and Sales Proceeds Keeping your monies safe - When does Trust really mean Trust?
In real estate transactions, but also in other transactions in Thailand, clients often place trust in their advisers, or a third party to take care of their monies pending completion of a transaction on a premise that they believe or may have been led to believe that their monies are safe. However, the true legal position in Thailand is not the same as many other jurisdictions that foreign clients, or Thai clients overseas, may be used to. Examples of where the placing of monies in an adviser or other third partys account may be where a client wishes to place a deposit on a property, or wishes to bring monies into Thailand for a purchase, but does not have a bank account in Thailand, which is not unusual for many transactions involving foreigners, or wishes to make staged payments to a contractor building a property or simply wishes to use the account before splitting the monies to be paid to several different parties. All clients should heed warnings on simply trusting their advisers or third parties with monies, in perhaps a mistaken belief that the monies are subject to specific regulation or safeguards. Many times it is simply the health and trustworthiness of the third party that governs the safety of the monies, and not any overriding protective legislation. Real Escrow v Fake Escrow Escrow is a word that is so wide in its potential meaning that it can be used with the effect of misleading clients with regards to the legal status of their monies. In Thailand, there is an Escrow Act of 2008, which in relation to real estate transactions was updated through notification to clarify procedures relating to land. To use real escrow in Thailand for a real estate transaction:
1. A licensed Escrow Agent must be appointed This costs the parties additional monies in terms of transaction fees, and the only potential licensed agents appear to be financial institutions (i.e. banks) whose procedures are generally not known for speed in relation to what may be a time sensitive real estate transaction. 2. The Land Office must be notified If the transaction involves the Land Office, then it must be notified of the transaction so that it does not transfer or register an interest, other than as specified under the Escrow Agreement. However, the Land Office has to consult with the escrow agent and review the agreement. The potential issue here is that even if a transaction has been agreed, the Land Office could object or be unable to commit to interpreting a provision of the Escrow Agreement. The potential solutions to these issues are: (a) place monies under a different legal regime in another country. Use the escrow mechanisms of that regime to govern release and receipt of the monies. (b) structure the transaction so that deposit monies and balance are paid on the same day. This is not always convenient or practical in a deal where properties need to be secured or taken off the market. Law Firms; Lawyers; Advisory and Consultancy Companies Regulation In many jurisdictions, business people are used to a regime applying to their law firms or advisory and consulting firms relating to a client account. Client monies are placed in a Client Account or Trust Account which a governing body in that jurisdiction, such as a Law Society, regularly inspect and check for discrepancies. Even a mistaken transfer of a small sum of monies from a client account to an operational account can result in quite severe sanctions for lawyers and law firms. This provides clients with a security blanket of trust when depositing monies into law firms trust accounts. In Thailand, Thai lawyers are subject to the rules of the Law Society of Thailand too, in addition to general law such as anti-corruption rules and other quite detailed provisions. Many firms, however, are not set up in a way where their bank accounts are inspected, audited or subject to any scrutiny at all in relation to the matter of client monies. There are, of course, many exceptions to this rule, as some of the larger international firms have quite complicated, international methods of dealing with client monies in accordance with their global brand standards and practices. Other smaller firms may have IT systems and accounting systems, which are cleverly designed to ensure client monies are placed in a protected and transparent account. Some clients may, therefore, have only the word or assurance of a firm that, if monies are placed into the firms account, they are safe. Any use of the word trust must be interpreted as trust on word as there is no Trust Law regime in Thailand. Once monies are in another persons bank account, the monies belong to the bank but are subject to the call of the named person or entity that owns the account. For many people P their dream holiday on the island is all about beach, beach and more beach, fo followed by fine dining and late night partying. Who could blame them? These days though, we find that visitors are increasingly adventurous and for this re reason we at WINDOW on Phuket have put together a selection of more exotic and unusual activities. Explore the island There are many companies who offer island tours and these are a convenient and inexpensive way of seeing more of your holiday destination. However, if you have the time why not rent a motorcycle or car, and do a little exploring on your own? Your hotel or tour guide will be able to give you a road map, but you cant really get lost. This is an island so if you keep going youll eventually get back where you started! Follow the winding coast roads and discover isolated beaches which you can have all to yourself. Head inland and visit small farming communities where people still live in much the same way as they have for hundreds of years. Please remember that you must wear a crash helmet on a motorcycle. For those of you who are visiting from Europe or the United States please also note that we drive on the left here! Motorcycle rentals start at 150 baht per day and small jeeps are available from 900 baht per day. If you rent for a week or longer youll be able to negotiate a better rate. Join Songkran festival in Phuket No visitor who has ever been here during the month of April can have avoided coming into contact with the enchanting, hilarious, and occasionally exasperating and downright dangerous watery explosion of public celebration which is Songkran. Thailand's most celebrated festival is Songkran the Thai new year. It starts on April 13 and lasts for between three and ten days, depending on where youre resident. For most, its lots of fun and an excuse to cool off at what is usually the hottest time of the year. A mass water throwing in Phuket is generally confined to a single day (13 April), and to specific zones in Phuket City at Saphan Hin and at Rawai Beach, Kata/Karon Beaches, Nai Yang Beach, Surin Beach and Patong Beach, Songkran in Patong usually begins the evening before April 12, when normal activities in the bars cease, and the world's biggest water carnival begins. If youre staying in one of the tourist centres like Patong, there really is no way of avoiding a soaking, unless you stay in your hotel. Phuket Butterfly Garden and Insect World This is a place of endless educational possibilities. Here you can learn more about the miraculous miniature world of insects and butterflies. Relax in the garden where there are literally thousands of butterflies filling the air or busy seeking pollen among the tropical blooms. Located in Soi Paneung in the Sam Kong area, the garden is a five minute drive from Tesco Lotus. Take the road towards Phuket City and its on the left-hand side.
