Crew Club contribution to help
renovate new space in Reeves building

The owners of the Crew Club, a D.C. health club
and sauna that caters to gay men, presented the
D.C. Center for the LGBT Community with a $25,000
donation on Tuesday at a reception to kick-off a
fundraising drive to help nance the centers move
to a new home.
Center Vice President Michelle Ross, who heads the
centers relocation committee, said the donation by
the Crew Club through it co-owners D.C. Allen and
his husband, Ken Flick, provides a major boost in
raising the estimated $75,000 needed to renovate the
LGBT Centers new space in the citys Reeves Center
municipal building at 14th and U streets, N.W.
Ross and D.C. Center President Michael Sessa have
said the 15-year lease the Center just signed with the
city to rent space in the highly desirable location at the
Reeves Center required that they accept the space
as is and pay for getting it ready for occupancy.
Although the renovation work needed is more
extensive than originally anticipated, the two said
community supporters like Allen and Flick and other
donors along with supporters who are providing pro
bono work related to the renovation should make it

Justices records offer tantalizing
hints as to how they might decide
DOMA, Prop 8 cases

The nine members of the U.S. Supreme Court are
expected to reach a decision by the end of June
in two high-prole LGBT rights cases on which
they heard oral arguments last week challenging
Californias Proposition 8 and the federal Defense
of Marriage Act.
The justices could reach any number of decisions
on either or both of the cases upholding the
anti-gay measures, dismissing the cases for lack
of standing or jurisdiction, striking down Prop 8
and DOMA on grounds they violate the rights of
same-sex couples under the U.S. Constitution or
even issuing a national ruling in favor of marriage
equality.
Predicting how they might rule is tricky. But
several of the justices made statements and asked
questions during the oral arguments that offered
some hints. Perhaps more signicantly, many of
them have a record of ruling in gay rights cases
that might indicate their leanings on marriage.
The Washington Blade has compiled proles of
the justices to assess how they might rule in the
two marriage cases before them.
In addition to examining their comments
during the arguments, the Blade has looked
at how they ruled in other high-prole gay
rights cases. One is the 1996 case of Romer v.
Evans in which the Supreme Court struck down

Atty genl asks appeals
court for re-hearing of case

Virginia Attorney General Kenneth
Cuccinelli has led a petition with the
4th Circuit U.S. Court of Appeals in
Richmond asking the full 15-judge court
to reconsider a decision by a three-
judge panel last month that overturned
the states sodomy law.
The three-judge panel ruled 2-1 on
March 12 that a section of Virginias
Crimes Against Nature statute that
outlaws sodomy between consenting
adults, gay or straight, is unconstitutional
based on a U.S. Supreme Court decision
in 2003 known as Lawrence v. Texas.
A clerk with the 4th Circuit appeals
court said a representative of the
Virginia Attorney Generals ofce led
the petition on Cuccinellis behalf on
March 26. The petition requests what is
known as an en banc hearing before the
full 15 judges to reconsider the earlier
ruling by the three-judge panel.
We certainly hope they wont, said
Claire Gastanaga, executive director of
the ACLU of Virginia, which led a friend
of the court brief urging the three-judge
panel to overturn the state sodomy law.
We think its a situation in which everybody
agrees that the statute is unconstitutional,
Gastanaga told the Blade.
Greg Nevins, an attorney with the
LGBT litigation group Lambda Legal
Defense and Education Fund, which
joined the ACLU in ling the friend of
the court brief calling for overturning
the Virginia sodomy law, said requests
for en banc hearings are turned down
most of the time.
He quoted a federal appeals court
rule as stating, Although petitions
for rehearing are led in a great many
cases, few are granted.
Brian Gottstein, a spokesperson for
Cuccinelli, said in an email that his ofce
would respond on Wednesday to a
request by the Blade for comment on why
Cuccinelli decided to contest the court ruling.
Like most people, we think the court
made the right decision, said James
Parrish, executive director of the LGBT
advocacy group Equality Virginia.
We think what needs to happen is
the General Assembly needs to remove
the current sodomy law that has been
declared unconstitutional, he said.

Choi convicted in
White House protest case
A federal judge last week found gay former Army Lt. Dan
Choi guilty of a misdemeanor offense of disobeying a lawful
order by police to disperse from the White House fence during
a November 2010 protest against Dont Ask, Dont Tell.
U.S. District Court Magistrate Judge John Facciola
issued his verdict and sentenced Choi to a $100 ne on the
last day of a non-jury trial in a case that has dragged on for
two-and-a-half years.
Choi and 12 others had handcuffed themselves to
the White House fence at a time when the activists said
President Obama and Congress werent doing enough to
advance legislation to repeal the Dont Ask, Dont Tell
law that barred gays from serving openly in the military.
The verdict and sentence came after an emotionally
distraught Choi broke down and cried repeatedly during
the ve-hour court session on Thursday as more than
50 friends and supporters, many of whom came from
throughout the country, looked on in a packed courtroom.
Choi began the days activities by leading a contingent
of supporters to the White House, where they stood at the
site of the White House fence before walking about a mile
to the courthouse.
He and several of his supporters who are military veterans
arrived at the courthouse wearing their military uniforms.
I apologize for my emotions but I dont apologize
for my humanity, Choi told Facciola as he represented
himself without an attorney.

Legal experts to analyze
Prop 8, DOMA cases

Former Acting U.S. Solicitor General Walter Dellinger
and nationally recognized LGBT rights attorney Paul M.
Smith are scheduled to speak at a forum in D.C. on April
15 titled, After the Arguments: DOMA and Prop 8.
The D.C. chapter of the National Lesbian and Gay
Journalists Association and the Human Rights Campaign are
hosting the event, which will take place from 8 a.m. to 10 a.m.
at the HRC building at 1640 Rhode Island Ave., N.W.
Commentator Jonathan Capehart of the Washington
Post, whos gay, will serve as moderator.
Dellinger argued numerous cases before the Supreme
Court in his role as acting Solicitor General during the Clinton
administration and argued additional cases before the high
court during the past four years. Smith, who heads the
Supreme Court Practice Division at the D.C. law rm Jenner
and Block, successfully argued the Supreme Court case
Lawrence v. Texas, which overturned state sodomy laws.
Organizers say the April 15 forum will analyze the
arguments last week before the Supreme Court on
the Prop 8 and DOMA cases and discuss the possible
outcomes for both cases.

GWU launches LGBT
health graduate program

George Washington University announced last week that
its Columbian College of Arts and Sciences has launched a
new graduate certicate program in LGBT health.
In a statement, the university said the new program will
train current and future healthcare leaders and policy
advocates on issues relating to the health and well-being
of the lesbian, gay, bisexual and transgender community.
The program is scheduled to enroll its rst contingent
of students in June, according to the university. It will
include courses that focus on a wide range of issues,
including psychological, medical, legal and policy related
developments. A hybrid curriculum of on-campus and
online offerings will include topics such as transgender
care, marriage equality, and advocacy for underserved
populations, the statement says.

Advocating for
competent care in city

More than 100 people attended a
rally in Columbia Heights last Saturday
in support of equal access to health care
for transgender people.
We are here today to advocate for
trans competent health care providers
and for health care for the transgender
community, organizer Bryce Jordan
Celotto said.
Nico Quintana, who came out as trans
when he was 19, binded his chest for
10 years because his health insurance
providers did not cover transition-
related care.
He received a double mastectomy
at an outpatient facility last year after
saving more than $7,000, but developed
an infection in his chest after the surgery.
Quintana was hospitalized three times
and he said the personnel who
admitted him to the hospital asked
whether he was a man or a woman
before they processed him.
No one should have to think about
that when theyre dying, he said.
A 2011 study from the National
Center for Transgender Equality and
the National Gay and Lesbian Task
Force noted 28 percent of respondents
said they experienced harassment while
in a doctors ofce or another health
care setting. Forty-eight percent of
respondents postponed medical care
because they could not afford it.
Nearly a fth of survey participants
said a doctor or other health care
provider refused to treat them because
of their gender identity and expression.
The study notes this gure is higher
among trans people of color.
Its a sad state of affairs when the
number one prerequisite for a good
health care [provider] is that theyre
nice, said Thomas Coughlin of
Whitman-Walker Health. He noted
clients drive up to six hours to access
trans-specic care at his agency. One
of our goals is to educate people about
trans care and trans-sensitive health.
Andy Bowen of the D.C. Trans Coalition
and others who spoke at the rally
applauded the D.C. governments efforts
to address health care and employment
disparities among trans Washingtonians.
Then-Mayor Anthony Williams in 2005
signed a bill that added gender identity
and expression to the D.C. Human
Rights Law. The Metropolitan Police
Department and the D.C. Department
of Corrections have also released trans
sensitivity guidelines.
More than 70 people have graduated
from the Project Empowerment program
the D.C. Department of Employment
Services launched in 2011 as a way to
help reduce unemployment and poverty
rates among trans Washingtonians. The
citys insurance regulator last month also
claried existing regulations to say health
insurance providers cannot discriminate
against their trans policy holders.
Mayor Vincent Gray and other D.C.
ofcials last September unveiled the
countrys rst publicly funded campaign
to combat anti-trans discrimination,
but advocates stressed they need to
do more to improve access to health
care and reduce economic disparities
among trans Washingtonians.
Tyra Hunter died from injuries she
sustained during a 1995 car accident
after emergency medical personnel who
responded to the scene declined to treat
her once they discovered she was trans.
D.C. Fire Chief Kenneth Ellerbe last fall
apologized to Hunters family on behalf
of the department during a Transgender
Day of Remembrance commemoration
at the Metropolitan Community Church
in Northwest Washington.
Bowen urged D.C. Medicare, Alliance
and other publicly funded health plans
to cover trans-specic health care needs,
such as hormones, and procedures.
The JaParker Deoni Jones Birth
Certicate Equality Amendment Act of
2013, which is named for the trans woman
whom Gary Niles Montgomery allegedly
stabbed to death at a Northeast D.C.
bus stop in February 2012, would allow
Washingtonians to legally change the
gender on their birth certicates without
sex-reassignment surgery.
The D.C. Council has scheduled a May
16 hearing on the proposal, but Casa
Ruby CEO Ruby Corado said during
the rally that the city needs to enforce
existing laws designed to protect trans
Washingtonians from discrimination.
People have rights here, she said.

We decided it was important for the
center to be there for all of us in the
community, Allen told the Blade.
Allen said he and Flick have been
impressed with the centers varied
programs that help support a diverse
cross section of the LGBT community,
including programs for LGBT military
veterans and LGBT immigrants and
those seeking U.S. political asylum.
Sports and career development
programs as well as addiction and
recovery related efforts, including the
centers longstanding crystal meth
program, are among many other center
activities, Allen said.
We felt it was extremely important
that this not drag on and that they start
their renovation and get in there as
soon as possible, he said.
Ross is urging members of the
community to visit the centers website
for details of the renovation plans,
including oor plans and drawings
prepared by an architect and interior
designer who are helping with the
project. The renovation plans can be
viewed at www.thedccenter.org/home.
The need to nd a new home for the
center surfaced after center ofcials
were told they would have to leave
their current space at 1318 U St., N.W.,
because the building in which they are
located will soon be taken down to make
way for a new high-rise ofce building.
The renovation and design plans
shown on the centers website call for
naming rooms after large donors and
displaying permanent plaques on the
walls of the new space bearing the
names of contributors.

Kirk is 50th senator to back
marriage, 2nd among GOP

Illinois Sen. Mark Kirk on Tuesday
became the 50th sitting U.S. senator
- and the second Republican in the
chamber after Ohio Sen. Rob Portman
- to back same-sex marriage.
The announcement came on the
heels of one from U.S. Sen. Tom Carper
(D-Del.), who became the 48th Democrat
in the Senate to back gay nuptials.
Lawmakers in Delaware and Illinois are
mulling legislation that would extend
marriage rights to same-sex couples
this year, and both announcements
could reignite momentum for marriage
equality in those states.
When I climbed the Capitol steps
in January, Kirk wrote on his blog, I
promised myself that I would return
to the Senate with an open mind and
greater respect for others.
Same-sex couples should have the
right to civil marriage, the statement
continues. Our time on this Earth is
limited, I know that better than most.
Life comes down to who you love and
who loves you back -- government has
no place in the middle.
Kirk was absent from the Senate for
nearly one year after suffering a stroke
in January 2012, which he alluded to in
Tuesdays marriage pronouncement.
Kirk has been a long-time supporter
of some LGBT legislation, backing
employment protection legislation
since he arrived in the U.S. House of
Representatives in 2001.
He initially opposed U.S. House efforts
to repeal Dont Ask, Dont Tell during
his 2010 Senate run. However, after the
election, Kirk who replaced pro-gay
appointee Roland Burris became a
yes vote in that chamber, helping push
the repeal to passage.
With the Republican logjam on
marriage equality now ofcially broken,
we encourage Senator Kirks fellow
Republicans in the Senate and his
colleagues in the House to join him,
Senator Portman, Congressman Hanna,
and Congresswoman Ros-Lehtinen on
the right side of history, Log Cabin
Republicans executive director, Gregory
T. Angelo, said in a statement.
With Senator Kirks support, the
U.S. Senate is now ready to move to
the right side of history in support of
same-sex couples freedom to marry,
wrote Freedom to Marry President
Evan Wolfson in response to the
announcement. Just as we have seen
a majority of Americans embrace the
freedom to marry, so the Senate is now
on the verge of a majority for marriage.
Carper made his announcement on
Facebook.
As our society has changed and
evolved, so too has the publics opinion
on gay marriage and so has mine,
he wrote on his Facebook page. I
pray every day for God to grant me the
wisdom to do what is right. Through my
prayers and conversations with my family
and countless friends and Delawareans,
Ive been reminded of the power of one
of my core values: the Golden Rule. It
calls on us to treat others as we want to
be treated. That means, to me, that all
Americans ultimately should be free to
marry the people they love and intend to
share their lives with, regardless of their
sexual orientation, and thats why today,
after a great deal of soul searching, Im
endorsing marriage equality.
HRC sparks transgender ag ap
WASHINGTON LGBT rights advocates have criticized the Human Rights
Campaign after a staffer reportedly asked a man not to waive a transgender
ag during a pro-gay marriage rally outside the U.S. Supreme Court on March
27.
Former National Stonewall Democrats Executive Director Jerame Davis
wrote on Bilerico that he witnessed an HRC staffer and another person
having a less-than-friendly discussion. Jerssay Arredondo of United
We Dreams Queer Undocumented Immigrant Project also claimed the
organization removed references to his immigration status from the speech
he gave at the same rally.
We apologize for having caused harm to the individuals involved, rally
organizers said in a statement.
HRC also responded to the controversy.
It is not true to suggest that any person or organization was told their
ag was less important than another, it said in a press release. This did not
occur and no HRC staff member would ever tolerate such behavior.
Rutgers basketball coach red
PISCATAWAY, N.J. Rutgers University on Wednesday red its mens
basketball coach after ESPN aired portions of a video that shows him using
anti-gay slurs against his players.
The 40-minute clip the network aired on Tuesday shows Mike Rice calling
his players a fucking fairy and a fucking faggot during practice. The
video also shows him throwing basketballs at their heads and pushing them.
Rutgers suspended Rice last December for three games and ned him
$50,000. The Star-Ledger reported athletic director Tim Pernetti said the gay
slur was at the core of the suspension.
New Jersey Gov. Chris Christie and the Human Rights Campaign are
among those who criticized Rices comments.
Proposed Fla. DP registry advances
TALLAHASSEE, Fla. A Florida Senate committee on Monday approved
a bill that would create a statewide domestic partnership registry.
The Florida Senate Committee on Children, Families and Elders Affairs
backed Senate Bill 196 that state Sen. Eleanor Sobel (D-Miami) by a 5-4 vote
margin.
This is the rst time the Florida Legislature has ever voted to recognize
same-sex relationships and provide protections for committed couples all
over the state of Florida who cannot or choose not to be married, Mallory
Wells, public policy director of Equality Florida, told the Tampa Bay Times. It
certainly is a historic day for us.
Roughly 50 percent of Floridians now live in jurisdictions with domestic
partner registries. It appears unlikely the proposal will pass this year in the
state legislature.
Shocked: I am not homophobic
NEW YORK Folk singer Michelle Shocked told CNNs Piers Morgan on
Monday she is not homophobic.
Her comments come slightly more than two weeks after she sparked a
restorm of controversy with an anti-gay tirade during a San Francisco concert
that was the rst stop on her 11-city U.S. tour. Venues in California, Oregon,
Washington and Illinois at which Shocked had been scheduled to perform
cancelled her appearances.
Shocked, who once came out as bisexual, told Morgan she also supports
same-sex marriage.

For years, lesbian couple
sought legal recognition

For lesbian activists Robin Tyler and
Diane Olson, who have been a couple
for more than 19 years, last weeks
Supreme Court hearing on Californias
Proposition 8 had a special meaning.
In February 2004, Tyler and Olson were
among the rst two couples to le a lawsuit
challenging the California law prohibiting
same-sex couples from marrying. The
lawsuit led to the California Supreme
Courts decision in 2008 declaring that
same-sex marriages must be recognized
under the states constitution.
The two were among the 18,000
same-sex couples to marry in California
before marriage equality opponents
placed Prop 8 on the ballot that same
year. Upon its approval by voters in
November 2008, recognition of all
subsequent same-sex nuptials ended.
Marriage equality activists, however,
responded by ling another lawsuit
challenging Prop 8, which took the ght
to the U.S. Supreme Court.
As Tyler and Olson sat in the Supreme
Court chambers on March 26 watching
the attorneys argue for and against
whether Prop 8 should be declared
unconstitutional, each said they couldnt
help but recall how it all started for them
12 years earlier in Beverly Hills, where
Olson was raised.
What happened is starting in 2001
Diane and I would goto the Beverly
Hills courthouse every year to try to get
a marriage license, Tyler said. And of
course they turned us down.
Added Tyler, The rst year we almost
got arrested because MCC brought a
cake and they said we couldnt serve a
cake on the sidewalk. She was referring
to the LGBT supportive Metropolitan
Community Church, a longtime
advocate for marriage equality.
Tyler, an out lesbian comic and
entertainer since the 1970s, served as
an organizer for the 1979 LGBT march
on Washington and two subsequent
LGBT marches on Washington in 1987
and 1993. At all three marches, Tyler
helped organize same-sex marriage
rallies outside the IRS headquarters
in downtown D.C., in which hundreds
of same-sex couples participated in
marriage ceremonies they considered
symbolic but that had no legal
recognition.
With that as a backdrop, Tyler said the
proverbial last straw happened to her
and Olson in 2004 shortly before she
and Olson planned their annual ritual of
going to the Beverly Hills courthouse to
request a marriage license on or around
Valentines Day. At the time, the two had
been a couple for 10 years.
I was going to be 65, she said. So I
called the American Federation of Radio
and Television Artists. Ive been in the
union for years because I was a comic.
And I say, you know, I can purchase
domestic partnership insurance for
Diane, Tyler recalled.
But when I retired they said no you
are not. And I said why not? Tyler told
the Blade. And they said because
youre not married. And I said we cant
get married. And the woman said to
me, Thats just the way it is, hon. And
she hung up on me.
Tyler said she immediately called
Gloria Allred, a nationally recognized
civil rights lawyer based in Los Angeles,
whose clients have been among some
of the most famous Hollywood gures.
Tyler said she and Allred had been
friends for a long time.
And the next morning she called
and said you know what? Im going to
take the case. Im going to sue for your
right to get married to Diane and Im
going to do it pro bono, Tyler said.
At Allreds suggestion, Tyler and
Olson agreed to invite Rev. Troy Perry,
head of the MCC churches, and his
husband, Philip De Blieck, who he
married in Canada, to be a party to
the suit.
Since Valentines Day fell on a Saturday
in 2004, Tyler said the two couples and
Allred decided to go to the Beverly Hills
courthouse that year on Feb. 12.
They handed us this little thing like
they did every year you know, you
cant get married because marriage
is a between a man and a woman,
said Tyler. Gloria was with us and we
walked outside and had a huge press
conference, and Gloria announced our
right to marry.

Medicare asked to review trans policy
Medicare is being asked to review a policy that prohibits transgender
people from receiving coverage for gender reassignment surgery.
Last week, a quartet of LGBT rights groups the National Center
for Lesbian Rights, the American Civil Liberties Union, Gay & Lesbian
Advocates & Defenders and civil rights attorney Mary Lou Boelcke led
an administrative challenge to eliminate Medicares ban on coverage for the
procedure.
Joshua Block, a staff attorney with the ACLUs LGBT Project, said the
challenge was led because a policy change is overdue.
It is completely out of line with any scientic or medical evidence or
standards of practice, Block said. There are people out there who are in
desperate need of the surgery. Their doctors have told them they need the
surgery. And theyre being told its not covered because it was allegedly
experimental 30 years ago.
The challenge, sent on March 26, was led on behalf of Denee Mallon,
a transgender woman in Albuquerque, New Mexico. A Medicare recipient
whos age 73, Mallon was recommended to have gender reassignment
surgery by doctors to treat her gender dysphoria.
A veteran of the U.S Army, Mallon joined the the service when she was 17
and worked as a forensics investigator for a city police department. She was
later diagnosed with gender identity disorder.
Mara Keisling, executive director of the National Center for Transgender
Equality, said shes very excited about the challenge.
Americans, in general, are really tired of health care decisions being
made by legislators and bureaucrats and insurance companies, Keisling
said. Most of us believe that health care decisions should be made by
patients and doctors, and the medical community is pretty unied. This is a
legitimately necessary surgery.
Keisling said NCTE isnt directly involved in the challenge because it
involves lawyers representing clients, and the organization doesnt provide
those legal services.
The ban, which is codied as National Coverage Determination 140.3, was
put in place in 1981 during the Reagan administration. Keisling said the ban
was put in place as a result of the stigma on transgender people at the time
and lobbying from insurance groups.
The National Coverage Determination from 1981 spells out why transgender
people are unable to receive this coverage under Medicare.
Transsexual surgery for sex reassignment of transsexuals is controversial,
the regulation states. Because of the lack of well controlled, long term studies
of the safety and effectiveness of the surgical procedures and attendant
therapies for transsexualism, the treatment is considered experimental.
Moreover, there is a high rate of serious complications for these surgical
procedures. For these reasons, transsexual surgery is not covered.
Despite this policy, the American Medical Association and the American
Psychological Society support gender reassignment surgery for transgender
people.

GOP star apologizes amid
restorm of controversy
A Baltimore neurosurgeon who is
considered a rising star in Republican
political circles sparked outrage this
week when he said gays, pedophiles and
those who engage in bestiality cannot
change the denition of marriage.
My thoughts are that marriage is
between a man and a woman, Dr. Ben
Carson, director of Johns Hopkins Hospitals
Division of Pediatric Neurosurgery, said
during an interview with Fox News host
Sean Hannity. Its a well-established
fundamental pillar of society. And no group,
be they gays, be they NAMBLA (North
American Man/Boy Love Association,) be
they people who believe in bestiality it
doesnt matter what they are. They dont
get to change the denition.
LGBT rights advocates were quick to
criticize Carson for his comments.
Ben Carson clearly has no concept
of gay and lesbian people who have
formed loving, committed couples and
families, GLAAD Director of News and
Faith Initiatives Ross Murray told the
Washington Blade, noting the media
watchdog group has added him to its
Commentator Accountability Project
that documents public gures who
have made anti-LGBT statements. Hes
not an expert, but merely an anti-gay
uninformed talking head.
Carson, who in 1987 became the
rst surgeon to successfully separate
conjoined twins, delivered the keynote
address at the National Prayer Breakfast
in D.C. in February. He also spoke at the
Conservative Political Action Committees
annual conference that took place at
National Harbor earlier this month.
A group of Johns Hopkins University
School of Medicine students and
faculty members have urged the
university to replace Carson as this
years commencement speaker over the
controversy.
Carson told the Baltimore Sun he would
be happy to withdraw if they think me
being there is going to be a problem.
He also apologized for his comments
to Hannity during his interview with the
newspaper and other media outlets.
You know, as a Christian, you know,
I have a duty to love all people and that
includes people who have other sexual
orientations, and I certainly do, and never
had any intention of offending anyone,
Carson told MSNBC host Andrea Mitchell.
If anybody was offended, I apologize to
you. But what I was basically saying is that
there is no group. I wasnt equating those
things, I dont think theyre equal.
Rep. Salmon opposes
marriage equality
The gay son of an Arizona congressman
who said he remains opposed to same-
sex marriage told the Washington Blade
on Tuesday his fathers viewpoints did
not come as a surprise.
Its nothing I didnt already know,
said Matt R. Salmon.
U.S. Rep. Matt J. Salmon, who
represents most of Phoenixs eastern
suburbs, said during an interview with
a local television station that aired over
the weekend he believes marriage
is between a man and a woman. He
stressed his son is by far one of the
most important people in my life.
I love him more than I can say,
the Republican congressman said. It
doesnt mean that I dont have respect,
it doesnt mean that I dont sympathize
with some of the issues. It just means I
havent evolved to that stage.
His comments came less than a week
after the U.S. Supreme Court heard
oral arguments in cases that challenge
the constitutionality of Californias
Proposition 8 and the Defense of
Marriage Act.
Matt R. Salmon, a former president
of Arizona Log Cabin Republicans
who once dated the second cousin of
U.S. Sen. Jeff Flake (R-Ariz.,) defended
his father against criticism from those
within the LGBT community whom he
describes as incredibly intolerant. He
said the congressman received a lot
of hateful comments on his Facebook
page after the interview aired.
People seem to be trying so hard to
analyze where its coming from, but really
he was quite straight-forward, Salmon
said. My father loves me very much and
he supports me and he respects me.
Hes very much there for me as one of my
closest friends. I think that was obvious in
everything that he had to say.
He further discussed his fathers
position on marriage.
He doesnt see it as not allowing
his son to be with the person he loves
because he knows that regardless of
where marriage is, Im going to be
with the person that I love, he said.
Whether I can legally marry in Arizona
or not, its not going to change that fact
and my father knows that and he accepts
my desire to be with the man that I love.
As far as it goes with marriage for him its
a matter of what marriage means to him
to him marriage is dened as between
a man and a woman. It has nothing
to do with the way he views a persons
relationship, and thats the thing that I
think is hard for people to understand.
The congressmans comments come
less than a month after Ohio Sen. Rob
Portman became the rst Republican
U.S. senator to publicly endorse marriage
rights for same-sex couples. Illinois Sen.
Mark Kirk on Tuesday became the second
GOP senator to support the issue.
An ABC News/Washington Post
poll last month shows 52 percent
of Republicans and GOP-leaning
independents who are between 18-49
back nuptials for gays and lesbians.
Matt R. Salmon said he feels his father,
who voted for DOMA in 1996, would
evolve to support same-sex marriage.
The congressmans wife in 2006 led
the effort in support of an unsuccessful
amendment that would have banned
marriages and civil unions for gays and
lesbians in Arizona. Arizona voters in
2008 approved a constitutional same-
sex marriage ban, but Matt R. Salmon
said in an It Gets Better video he
lmed two years later that his mother
really didnt have much to do with the
campaign in support of it.
My mom told me that she stopped
being involved because of me, he said
in response to the Blades question about
whether he thinks his parents would
once again become involved in anti-
gay political efforts. I dont know if they
would support it, but I know they wouldnt
actively do anything for the movement.

have prohibited municipalities from
passing non-discrimination ordinances
protecting LGBT people. Another is the
2003 case of Lawrence v. Texas in which
the Supreme Court struck down state
sodomy laws.
The Blade also looked at the court
ruling in the 2010 case of Christian Legal
Society v. Martinez. In that case, the court
upheld the Hastings College of Laws non-

The chief justice of the Supreme Court
seemed skeptical during oral arguments
that Prop 8 and DOMA should be struck
down as unconstitutional. He also
seemed dismissive of the notion that
LGBT people lack political power.
In an exchange with attorney Robbie
Kaplan, Chief Justice John Roberts
disputed that gay people lack political
power a characteristic that the court has
considered in weighing whether a group
should be considered a suspect class.
As far as I can tell, political gures
are falling over themselves to endorse
your side of the case, Roberts said.
The chief justice was likely referring to
the trend of U.S. senators announcing
their support for marriage equality,
which just this week added Sens. Bob
Casey (D-Pa.), Tom Carper (D-Del.) and
Mark Kirk (R-Ill.). When Kaplan pointed
out that no group has been subject
to referenda in recent years like gay
people, Roberts seemed unmoved.
You just referred to a sea change in
peoples understandings and values from
1996, when DOMA was enacted, and Im
just trying to see where that comes from,
if not from the political effectiveness of
groups on your side, Roberts said.
Roberts, who was appointed by
President George W. Bush, hasnt ruled
on many gay rights cases during his time
on the bench. Still, Roberts ruled as part
of the dissent that deemed exclusion of
LGBT students was acceptable in the
Christian Legal Society case.
On the other hand, Roberts in 1996
helped gay rights activists as part of his
law rms pro bono work in preparation
for the Romer case. He also has a lesbian
cousin, Jean Podrasky, who attended
arguments on Prop 8.
Suzanne Goldberg, a lesbian and co-
director of Columbia Universitys Center
for Gender & Sexuality Law, pointed
to another comment Roberts made
indicating a parent forcing a child to
make friends with another child changes
the denition of friendship.
It suggested that he might be less
open to recognizing marriage rights for
same-sex couples than the Olson-Boies
team had anticipated, Goldberg said.

Associate Justice Antonin Scalia, viewed
by many as the most anti-gay of the
justices, mused that being raised by gay
parents may not be good for a child an
argument made by many anti-gay groups.
If you redene marriage to include
same-sex couples, you must permit
adoption by same-sex couples, and
theres considerable disagreement
among sociologists as to what the
consequences of raising a child in a
single-sex family, whether that is harmful
to the child or not, Scalia said. Some
states do not permit adoption by same-
sex couples for that reason.
Those words are consistent with anti-
gay views that Scalia has expressed in
the past. Most notably, speaking at
Princeton in December, Scalia compared
bans on sodomy to laws against murder,
saying, If we cannot have moral
feelings against homosexuality, can we
have it against murder? Can we have it
against other things?
Since his conrmation to the court,
Scalia has not only made anti-gay
rulings, but has taken the lead on the
opinions. The Reagan-appointed justice
wrote the dissenting opinions in the
Romer and Lawrence cases and joined
with other dissenting justices in ruling
for LGBT exclusion in the Christian
Legal Society case.
Doug NeJaime, whos gay and a
professor at Loyola Law School, said
Scalia is likely to rule to uphold Prop 8
and the Defense of Marriage Act.
Justice Scalia has made clear in
earlier opinions ... that legislation can be
justied merely by moral disapproval of
homosexuality, even though a majority
of the court has rejected that position,
NeJaime said. Moreover, under his
theory of constitutional interpretation,
he does not believe that lesbians and
gay men have a constitutional basis for
their claims in these cases.

The justice whos being most closely
watched because of his reputation for
being a swing vote and his previous
rulings in favor of gay rights conveyed
mixed sentiments during the arguments.

contemplated the effect that
overturning or sustaining Prop 8 would
have on children based on the newness
of same-sex marriage.
We have ve years of information
to weigh against 2,000 years of history
or more, Kennedy said. On the other
hand, there is ... what could be a legal
injury, and thats the voice of these
children. There are some 40,000 children
in California ... that live with same-sex
parents, and they want their parents to
have full recognition and full status.
A Reagan appointee, Kennedy
authored the majority opinions in the
Romer and Lawrence cases that struck
down anti-gay measures in those
lawsuits. In the Christian Legal Society
case, Kennedy also ruled in favor of
requiring student groups to be open to
all students regardless of LGBT status.
Thats what makes Kennedys
comment questioning the Ninth
Circuit ruling against Prop 8, which was
largely based on his opinion in Romer,
particularly noteworthy.
The rationale of the Ninth Circuit
was much more narrow, Kennedy said.
It basically said that California, which
has been more generous, more open to
protecting same-sex couples than almost
any state in the union, just didnt go far
enough, and its being penalized for
not going far enough. Thats a very odd
rationale on which to sustain this opinion.
Nan Hunter, a lesbian law professor at
Georgetown University, said the single
most powerful vibe she received from
Kennedy during arguments was his
ambivalence.
My best guess is that in the Perry
case, he will rule in some way that avoids
discussion of Prop 8s constitutionality
and that in the Windsor case, he will
conclude that DOMA is unconstitutional,
but his opinion may invoke federalism
as much as it does the Equal Protection
Clause, Hunter said.

In accordance with his custom,
Associate Justice Clarence Thomas
remained silent for the duration of oral
arguments in the marriage cases.
Thomas is known for not asking
questions. In January, after seven years
of silence, the George H.W. Bush-
appointed justice made news when he
broke his tradition and cracked a joke
about the competency of an attorney
during a case unrelated to marriage.
But Thomas has a history of taking the
anti-gay side. He ruled in the dissent
in the Romer and Lawrence cases and
ruled for LGBT exclusion in the Christian
Legal Society case.
Chris Stoll, a senior staff attorney for the
National Center for Lesbian Rights, said
oral arguments dont offer any information
on how Thomas might rule, but noted the
justices history of anti-gay opinions.
He is quite conservative and
historically has voted with the other
conservative justices in cases involving
LGBT equality, Stoll said.

Associate Justice Ruth Bader Ginsburg
said the 1996 law creates two different
kinds of unions for same-sex and
opposite-sex couples: the full marriage,
and then this sort of skim milk marriage.
While questioning attorney Paul
Clement, Ginsburg more distinctly
articulated the problems for gay couples
under DOMA by enumerating benets
denied to them under the law.
The problem is if we are totally for the
states decision that there is a marriage
between two people, for the federal
government then to come in to say no
joint return, no marital deduction, no Social
Security benets; your spouse is very sick
but you cant get leave; people if that
set of attributes, one might well ask, what
kind of marriage is this? Ginsburg said.
Ginsburg also has a history suggesting
shed be willing to rule against Prop 8 and
DOMA. The Clinton-appointed justice
ruled in favor of LGBT advocates in the
Romer, Lawrence and Christian Legal
Society cases. Prior to her conrmation
as a Supreme Court justice, Ginsburg
was a womens rights advocate and co-
founder of the womens rights project at
the American Civil Liberties Union.
David Gans, civil rights director
for the progressive Constitutional
Accountability Center, said he considers
Ginsburg a likely vote to strike down
DOMA and Prop 8 based on her history
of rulings and comments made in court.
I think her comments tended to be
across the board very skeptical of the
justications offered, and, of course,
her record, both as an advocate and
justice is to honor the constitutional
guarantee of equal protection applies
to all persons, Gans said.

The other Clinton appointee on the
bench also made comments during the
Prop 8 arguments suggesting he might rule
in favor of marriage rights for gay couples.
Associate Justice Stephen Breyer was
dismissive of Coopers assertion that
marriage is for procreation, observing
California allows straight couples who
cannot have children to marry.
What precisely is the way in which
allowing gay couples to marry would
interfere with the vision of marriage as
procreation of children that allowing
sterile couples of different sexes to
marry would not? Breyer said. I mean,
there are lots of people who get married
who cant have children.
And Breyers earlier rulings suggest
he would be amenable to striking
down Prop 8 and DOMA. Breyer joined
Kennedy and other justices in the pro-
gay rulings for Romer and Lawrence
and sided with LGBT inclusion in the
Christian Legal Society Case.
Gans said Breyers comments during
the Prop 8 arguments indicate his rulings
on the anti-gay measures will likely be
consistent with his earlier decisions.

Alito expressed concerns about same-
sex marriage, quipping that its newer
than cell phones or the Internet.
Same-sex marriage is very new,
Alito said. I think it was rst adopted in
the Netherlands in 2000. So there isnt a
lot of data about its effect. And it may turn
out to be a good thing; it may turn out not
to be a good thing, as the supporters of
Proposition 8 apparently believe.
An appointee of President George
W. Bush, Alito hasnt been on the court
long enough to have ruled in the earlier
landmark Lawrence and Romer cases.
But he wrote the dissenting opinion in
favor of LGBT exclusion in the Christian
Legal Society case.
Lavi Soloway, a gay immigration attorney
and co-founder of Stop the Deportations,
said he expects Alito to be consistent and
issue an anti-gay decision in the cases
before him taking note of the exchange
in the Prop 8 case.
This line of thinking was disappointing;
it not only belittled the ght for equality,
but suggested that Justice Alito would
rst need to be convinced of the effects
of same-sex marriage before he could
determine whether gay and lesbian
Americans have a constitutionally
protected right to marry, Soloway said.
This exchange suggested to me that
Alito will most likely vote to uphold Prop
8, preferring that legislatures continue to
wrestle with this issue.
Associate Justice Sonia Sotomayor

Another justice this one appointed
by President Obama asked some of the
most pointed questions about whether
theres any reason anti-gay laws could
survive the courts lowest standard of review.

pressed attorney Charles Cooper on
whether he could conceive of anti-gay
laws on other issues other than marriage
that could survive rational basis review.
The answer from Cooper was that he
could not.
If that is true, then why arent they
a class? Sotomayor responded. If
theyre a class that makes any other
discrimination improper, irrational, then
why arent we treating them as a class
for this one thing?
Sotomayors response suggests
she might agree with the Obama
administration that laws related to
sexual orientation should be subjected
to heightened scrutiny, or a greater
assumption theyre unconstitutional.
A newcomer to the court, Sotomayor
hasnt had the opportunity to rule on
many of the earlier LGBT rights cases
that have come before the bench. But
in the Christian Legal Society case,
she joined four other justices in ruling
student groups had to accept all
students regardless of LGBT status.
Notably, Sotomayor was the only one
among nine justices who responded
to a letter from a North Carolina 6th
grader named Cameron urging justices
to rule in favor of marriage equality. The
justice said she had no comment on the
marriage cases, but urged Cameron to
keep dreaming big.

expectations for how shed rule on DOMA.
She seemed perplexed and
unpersuaded by Coopers argument that
excluding gay people from marriage
somehow promotes responsible

Yet another justice appointed by
President Obama seemed skeptical
about arguments presented by
proponents of Prop 8 and DOMA.
Associate Justice Elena Kagan
suggested to attorney Paul Clement
that Congress may have had another
motive other than uniformity when it
determined to pass the anti-gay law.
This was a real difference in the
uniformity that the federal government
was pursuing, Kagan said. And
it suggests that maybe something
maybe Congress had something
different in mind than uniformity.
Clement offered a lengthy response
in which he talked about federal bans on
polygamy and laws after the Civil War
allowing freed slaves to marry. But Kagan
responded by reading from the House
report on DOMA, which states the law was
passed to reect an honor of collective
moral judgment and to express
moral disapproval of homosexuality
deemed a gotcha moment that elicited
laughter from those in the courtroom.
During the Prop 8 arguments, Kagan was
also skeptical of Coopers argument that
the purpose of marriage is procreation and
asked for a legitimate reason for excluding
same-sex couples from marriage.
Is there any reason that you have
for excluding them? Kagan said. In
other words, youre saying, well, if we allow
same-sex couples to marry, it doesnt serve
the states interest. But do you go further
and say that it harms any state interest?
Like Sotomayor, Kagan is a relative
newcomer to the court and hasnt had
the opportunity to rule on gay cases.
During her conrmation hearing, Kagan
wouldnt say whether the she thinks the
U.S. Constitution guarantees same-sex
couples the right to marry.
Still, Loyolas NeJaime said Kagan
seemed bothered during oral arguments
by equal protections concerns presented
by Prop 8 and DOMA.
Given her lengthy questions about the
relationship between age and procreative
ability, she seems unconvinced by the
responsible procreation rationale for
same-sex marriage bans, NeJaime said.
And given her reading of the House
report on DOMA regarding the moral
disapproval of homosexuality, she is
suggesting that the law may not survive
rational basis review.

June rulings expected in DOMA, Prop 8 cases
GLCCB launches welcome center
The Gay, Lesbian, Bisexual, Transgender Community Center of Baltimore
and Maryland (GLCCB) opened its ground oor to the public on Monday as
a Welcome, Information and Drop-In Center. The space will be open from
noon-6 p.m. on Mondays, Wednesdays, Thursdays and Fridays and from
noon-3 p.m. on Tuesdays.
The space will house a modern computer lab and a free bookstore with
mostly LGBT-themed books. The center encourages the community to come
by, read a book, do school work or use the Internet and Wi-Fi in a welcoming
environment.
The Welcome and Information Center is a step in the right direction for
the GLCCB and for the LGBT community, said Matthew Thorn, interim
executive director.
Staff and volunteers will be on hand to direct visitors and callers to support
services and community resources as well as provide information on Baltimore
businesses and social events.

diagnosed with terminal cancer.

Gay, bi men rank health concerns
CHICAGO In a survey conducted among gay and bi men in New York at
various bathhouses and gay bars, it has been found that HIV and STDs are the top
health concern. Tied for second were mental health and drug/alcohol use.
Hunger Colleges Center for HIV Educational Studies and Training (CHEST)
conducted the study of 660 men in 2011 to see if anecdotal concerns about HIV
prevention fatigue, in which its assumed that safer sex admonitions have become
diluted over time, was a real problem, researchers said. The Windy City Times
and others reported on the ndings from a CHEST-issued press release.
Those surveyed were asked to rank HIV/STDs, mental health, smoking, body
image and drug/alcohol use. The study is titled Perceived importance of ve
different health issues for gay and bisexual men: Implications for new directions in
health education and prevention and will be published in an upcoming issue of
the American Journal of Mens Health.

N.J. considers ban on reparative therapy
ASBURY PARK, N.J. A bill outlawing reparative therapy for gays under age 18 is
heading to the New Jersey Senate for a vote after the states Health, Human Services
and Senior Citizens Committee passed it by a 7-1 vote last month, USA Today reported.
The American Psychological Association, American Psychiatric Association, the
American Academy of Pediatrics and the American Medical Association are among the
national organizations that either oppose or warn against reparative therapy. No major
medical organization endorses the idea that being gay or lesbian is abnormal or a mental
disorder that can be changed or suppressed, the article said.
New Jerseys Senate committee hearing comes four months after the Southern Poverty
Law Center sued Jews Offering New Alternatives for Healing, in Jersey City, on behalf of
four men who claimed to have gone through rituals to rid them of their homosexuality.
The rituals included bodywork, or being forced to undress and show their genitals
to a counselor, Jewish Queer Youth co-executive director Mordechai Levovitz testied
according to USA Todays article.
California passed a bill banning conversion therapy last year, but an appeals court
ruled the ban violates the First Amendment.
Its a culture war issue, Dr. Jack Drescher, a psychiatrist, told USA Today. Reparative
therapy, he said, is a niche market that really takes advantage of unhappy people.
Gay parents held to tougher standard: study
NEW YORK Same-sex parents are judged more harshly than straight parents, Health
Daily News reported last week citing a new study from the March issue of Journal of GLBT
Family Studies.
Researchers examined peoples responses to the actions of gay and straight parents,
and found that gay parents were much more likely to be viewed negatively in identical
situations involving poor parenting behaviors.
We noted that when parents displayed favorable parenting behaviors like comforting
an upset child, gay and straight parents were judged in a similar, positive manner, Sean
Massey, of the interdisciplinary research group for the study of sexuality and gender at
Binghamton University, in New York, said in a university news release.
However, if parents got frustrated raised their voice or slapped their child on the
hand the gay parents were judged more negatively than the straight parents, Massey,
a research associate professor, was quoted as saying.
Coulter: bathhouses should be taxed
NEW YORK Conservative columnist and provocateur Ann Coulter suggested last
weekend that gay bathhouses should be taxed because AIDS is expensive. And if Im
paying for it, how about discouraging that behavior, The Daily Caller and other media
outlets reported on the exchange.
Coulter, promoting her new book Mugged: Racial Demagoguery from the Seventies to
Obama made the comments on Geraldo at Large on the Fox News Channel. She said people
who support taxes on obesity and smoking are hypocritical to not also back taxes on gay sex.

Lets face it, the real
stigma is about sex
In gay bathhouses, saunas, membership-
only gyms and clubs, there is plenty of
stigma to go around. Its one of those I
would never go to one of those places
until you enter a steam room and bump
into someone you know. Still, you wont
talk about it, at least publicly. Theres stigma
with AIDS. And theres also stigma with
bathhouses. What we really are talking
about is stigma and sex.
This week, D.C. Allen, the owner of Crew
Club, a gay private membership gym and
club in Washington, once again acted
beyond the call of duty: He donated $25,000
to the D.C. Center for the LGBT Community
to help defray the cost of renovating the
Centers new space at the Reeves Center
on 14th Street.
We can only hope that other members
of the D.C. community follow Allens lead
and match his generous contribution.
(Full disclosure: I serve on the relocation
committee for the Center and know the
challenges of nding a permanent space
for the community, not to mention funding.)
Through the Crew Club, Allen has
supported several safe-sex campaigns
and helped make available health-related
information. In fact, most gay membership-
only gyms and clubs conduct free HIV
testing on-site for both members and non-
members.
If theres an outbreak of syphilis in the city,
after the D.C. Department of Health alerts
the Centers for Disease Control, the staff
contacts D.C. Allen because of his record
of alerting the gay community right away to
help prevent Sexually Transmitted Diseases
(STD) epidemics.
In last weeks column, I wrote that every
gay-dating website and app should include
a health alert, with health as one of
the most prominent navigation buttons.
The Crew Club already has health on its
homepage.
A year ago, the Capital Area Gay and
Lesbian Chamber of Commerce honored
D.C. Allen with its Business Leadership
Award. Allen also helped create the Gay
& Lesbian Liaison Unit (GLLU) of the D.C.
Metropolitan Police Department.
In 2005, Allen was honored by the
Greater Washington, D.C., STD Community
Coalition for making a signicant difference
in getting the word out about a syphilis
outbreak to gay, bisexual and men who
have sex with men. When the director of the
D.C. Department of Health presented the
award, he pointed out Allen had stepped
up to the plate by putting his money where
his mouth is.
Allen refuses to place a stigma on sex.
You also get the feeling he wants every
customer to enjoy a great experience,
leaving happier than when he arrived. If you
ever walk past the Crew Club, you will see a
lot of happy faces.
A little history of bathhouses: For a
few thousand years, they denitely had a
stronghold in the community. There are
gay bathhouses and there are straight
bathhouses. There are Russian bathhouses
and youd nd them lining New Yorks
beaches. There are gay bathhouses in
numerous countries. China has them,
including in its capital of Beijing. In some
countries, bathhouses serve alcohol and
have full restaurants.
The rst raid on a bathhouse happened
in 1903, when New York Police raided the
Aniston Hotel Baths and arrested 26 men.
Twelve were tried for sodomy and seven
given prison terms of four to 20 years.
In the 1970s, The Divine Miss M, singer
Bette Midler, and songwriter and pianist
Barry Manilow launched their careers at
the world-famous Continental Baths, also
in New York City. There, Midler earned
her nickname Bathhouse Betty. In 1980,
the Saint Marks Baths used its premises
for voter registration, in concert with the
League of Women Voters.
Yet today bathhouses still are stigmatized.
Why does sex still carry a stigma? (I will know
I have made my point if someone contacts
me and says, I really wish you would have
used the term health club instead of
bathhouse.
Quite frankly, before AIDS, going to a
bathhouse was not only considered socially
acceptable, but encouraged as a gathering
place. A bathhouse offered a place where it
is safe to be gay. The movement to secure
civil rights for gays got help from meetings in
bathhouses. Bathhouses have transformed
many young gay lives by banishing shame
and offering them an accepting community.
I am no exception.
Bathhouses are the most honest and
real way to meet men if your intentions are
straightforward. Its either in or out, yes or
no. There is no in between. You cant get
more real than that.
D.C. Allen stands as a shining example of
how one person can truly change lives.

candidate again anticipated
The commencement of early voting
on Monday leading to an April 23 elec-
tion date will engage D.C. voters in the
Districts most inclusive electoral format.
The special election to ll a D.C. Coun-
cil At-Large seat allows all voters the op-
portunity to evaluate the candidates on a
non-partisan basis in a single election, ab-
sent the lter of a primary election deter-
mining the eventual winner due to single
party dominance. The nearly one-in-ve
independent voters registered without
political party afliation, prohibited from
voting in the Districts closed primary
system, can also participate equally.
One candidate stands out from the
current gaggle of six competitors from
three local political parties.
A leading contender among them is
again expected to garner the support
of a large number of LGBT voters, com-
prising 10 percent of District residents,
eager to reward one of the communitys
strongest allies with a long and exem-
plary history advocating for our civil
rights. The only candidate who testied
before the D.C. Council in favor of full
marriage equality, later successfully lob-
bying congressional objectors to pre-
vent legislative intervention.
This life-long registered Democrat is
casting my vote for the candidate with
an R after his name.
In the case of Patrick Mara, that letter
represents reform.
Several opponents have attempted
to nationalize the election and make
party designation a campaign issue.
D.C. residents have not been impressed.
Same with the Washington Post, ob-
serving last month in a full-throated
early endorsement that indicative of
Mr. Maras strength is the fact that the
only thing his opponents seem able to
attack is his afliation as a Republican.
A too-collegial Council has exhib-
ited an unseemly tolerance for past
and present ethical lapses, scandal
and business as usual. Voters want
windows wide letting fresh air inside
the Wilson Building. An independent-
minded, socially progressive and scally
prudent candidate not among the usual
clubhouse constituency is the best way
to crack them open.
Mara has earned high praise from
parents and education improvement
advocates since his election in Novem-
ber 2010 to the State Board of Educa-
tion representing diverse Ward 1. Mara
is widely commended for his detailed
citywide perspective on education is-
sues not limited to the parochial focus
of other candidates.
Improving the small business environ-
ment and encouraging entrepreneurship
is a cornerstone of Maras campaign. He
prompts hearty laughter at neighbor-
hood forums referencing the Districts
51st rank in business friendliness among
states. The former restaurant co-owner
knows the obstacles confronting the
main streets of commerce enlivening city
neighborhoods. Mara has discovered
that voters across D.C. understand that
broader-based employment opportuni-
ties result from improved regulatory, tax
and business growth policies that en-
courage a thriving local economy.
When Mara narrowly lost election to
an At-Large seat two years ago, I had
proffered that a vote for him is a vote
for diversity in local government and a
much-needed addition of a fresh and
independent voice on a dais lled with
long-serving entrenched members of
a single political hierarchy. Its as true
now as it was then.
In addition to the coveted newspaper
nod, Mara earned endorsements from
the Sierra Club, D.C. Chamber of Com-
merce and D.C. Realtors Association.
The latter prompted Mara to note the
cultural diversity of D.C. is at risk if we do
not protect and build affordable housing.
Working families, young people with bur-
geoning careers, artists, immigrants and a
wide range of other folks should be able
to claim a stake here in the District.
Mara enjoys signicant support
among D.C. LGBT voters. Hes earned
it with his active engagement on com-
munity issues as well as standing for
sensible reform in matters affecting the
entire city.

Historic chance to advance
self-determination in city

The LGBT community has always
been at the forefront of the ght for
D.C. democracy and for good reasons.
We have suffered under congressio-
nal mandates that targeted our ght
against HIV/AIDS and marriage equal-
ity. Now we have an opportunity to take
it one step further.
On April 23, we District voters have
an historic opportunity to make a strong
statement in our ght for self-determi-
nation. By voting yes on Referendum
8 during the April 23 special election,
we will amend the D.C. Home Rule
Charter to minimize the federal gov-
ernments control of how we spend our
local tax dollars. This effort, led by DC
Vote has the unanimous support of the
D.C. Council.
Right now, after the Council passes
our local budget, D.C. is forced to wait
to spend our tax dollars on critical pro-
grams until Congress approves it and
the process can often take months.
Support from voters for Referendum 8
would mean that after District leaders
enact a budget, Congress would only
have 30 legislative days to respond.
Untangling the Districts budget from
the federal appropriations process is an
idea whose time has come. And on April
23, we citizens can help lead the charge
for this fundamental change in our re-
lationship with Congress. And, we D.C.
residents will send a powerful message
that we should control the tax dollars
that come out of our pockets just like
every other jurisdiction in America.
But to send a strong message, we
all need to turn out to vote on April
23. We need to say in a strong voice
that the time for congressional med-
dling is over, and that the people of
the District of Columbia deserve to be
treated fairly.
Our elected leaders have fought
hard to pass budget autonomy leg-
islation on Capitol Hill, and we have
strong, bipartisan support. But sadly,
there are people in Congress who are
willing to use our city as their soap-
box. And in doing so, they have taken
away our rights to self determination.
This amendment, if adopted by voters,
would amend the charter to do what
our supporters in Congress want: give
D.C. greater budget autonomy, with-
out having to give in to blackmail by a
special interest group.
We need to send a message that only
the people we District residents voted
for have the right to determine how and
when our money is spent. On April 23,
we all have the power to win budget au-
tonomy for the District. Go out and vote
yes on Referendum 8. No one can
stop us from expressing our desire for
a measure of freedom from Congress at
the ballot box.
Sweeping ruling in our
favor appears unlikely

For a law junkie like me, attending
the Supreme Court arguments in the
challenges to Californias Proposition 8
and the so-called Defense of Marriage
Act, was like having seats on the 50-yard
line of the Super Bowl or, to put it in gay-
er terms, like being in the front row as
the curtain rises for one of the biggest
Broadway hits of all time except that it
was not just a game or a show. It was his-
tory unfolding a history that could ei-
ther accelerate our path to full equality
or create speed bumps on the road for-
ward. Although we dont yet know the
results, attending the arguments drove
home three important points.
First: Weve come a very long way in
a very short period of time. The Prop 8
argument took place exactly 10 years after
arguments were heard in Lambda Legals
Lawrence v. Texas case, which held the
countrys remaining state sodomy laws
unconstitutional. In 10 short years, we
have moved from having 13 states that
criminalized our sexual intimacy and none
that provided our relationships any form
of legal recognition to now having nine
states and the District Columbia that al-
low same-sex couples to marry and nine
more that provide same-sex couples vir-
tually all the state law rights and responsi-
bilities of marriage.
Similarly, 10 years ago polls were
nearly two-to-one against allowing
same-sex couples to marry, while a
Washington Post-ABC News poll last
month showed that support for letting
lesbian and gay couples wed has now
reached 58 percent.
Even the justices questions revealed
our immense progress. For example,
conservative Justice Alito posed a hy-
pothetical about an injured gay soldier
in a committed, loving relationship,
acknowledging both the end of the mili-
tarys ban on open service and that we
do form such relationships.
Second: This particular ght is not yet
over. Notwithstanding Time magazines
recent cover proclaiming Gay Marriage
Already Won, at least with respect to
these lawsuits, the arguments made clear
that some justices whose votes are likely
to be critical have not fully made up their
minds. What happens over the next three
months before decisions in these cases are
expected could continue to inuence their
understanding of the issues. We therefore
cannot let up in the efforts to pass mar-
riage bills in Illinois, Rhode Island, Minne-
sota and Delaware or to win a veto over-
ride in New Jersey. We must also continue
to make the case for the freedom to marry
to our friends, families, neighbors and co-
workers and in the media.
Beyond that, although I am hopeful
that there are the necessary ve votes to
strike down the provision of DOMA that
requires the federal government to ignore
legally entered marriages of same-sex
couples, it appears that the court is not yet
ready to issue a sweeping ruling requiring
all states to allow same-sex couples to
marry. Whether Supreme Court review of
the Prop 8 case is dismissed as improvi-
dently granted (reinstating the Ninth Cir-
cuits ruling) or the appeal is dismissed for
lack of standing (keeping in place the trial
courts injunction against Prop 8) or a lim-
ited victory is handed down, it looks like
the struggle to win the freedom to marry
will wage on in many parts of the country
for some time to come.
Finally: Even a sweeping victory
in these cases will not end our work.
While ending bans on same-sex cou-
ples marrying has been an important
goal for the movement, we need to con-
tinue ghting for the full civil rights of all
people, married or not, as well as for
the rights of transgender people, peo-
ple living with HIV, LGBT parents and
workers, those who are incarcerated
or poor and our youth and elders. The
good news is that winning the freedom
to marry will free up more resources for
those ongoing battles. I cant wait until
Im at the Supreme Court again to see
more of them fought.

The State Department this year has stepped
up efforts to provide LGBT-specic information
to Americans who plan to travel overseas.
We want all of our citizens to be
informed about their destinations abroad
and any particular challenges that they may
face, Janice Jacobs, assistant secretary of
state for the Bureau of Consular Affairs, said.
We want them to know about the services
that are available to them at our embassies
and consulates if problems should happen,
despite their precautions.
Jacobs comments came earlier this year
after the Bureau of Consular Affairs added
LGBT-specic information to its website
that includes travel warnings, alerts and
other country-specic advisories. These
include references to widespread anti-
gay discrimination in Ukraine, efforts to
curb the promotion of homosexuality in
Russian cities and an advisory that urges
LGBT travelers to consider exercising
caution when visiting Estonia because of
harassment and violence those who have
publicly shown affection have experienced.
The country-specic proles also
include information about HIV/AIDS travel
restrictions.
Its important that our LGBT audiences
know about the resources that we provide
to help U.S. citizens travel safe and travel
smart, Jacobs said.
Michelle Bernier-Toth, managing
director of Overseas Citizens Services at the
Bureau of Consular Affairs, further stressed
the protection of Americans is really the
departments top priority. She and other
ofcials sought recommendations and
other feedback on the Smart Traveler Day
initiative from the roughly 50 people who
attended a February meeting.
Its a start, Bernier-Toth said. Its a
recognition that this is a community that is
on the move, is traveling. Its an important
community, an important stakeholder for
us. And we are going to make it as robust
and as useful as we can possibly make it.
White House LGBT liaison Gautam
Raghavan also spoke at the gathering.
The State Department in recent years
has spoken out against anti-LGBT violence
in Honduras, Jamaica, Uganda, Zimbabwe
and other countries.
Former Secretary of State Hillary Clinton
and President Obama urged the Ugandan
government to protect the rights of its LGBT
residents following the 2011 murder of gay
activist David Kato amid the debate over the
so-called Anti-Homosexuality Bill that would
impose the death penalty against anyone
found guilty of repeated same-sex sexual acts.
Dont ever lose context of what has
been accomplished by this White House,
by this secretary of state that will continue
for four more years, said Charlie Rounds of
the Forward Motion Group, who also chairs
the International Gay and Lesbian Travel
Association Foundation. Its huge.
Uganda is among the countries that
continue to criminalize homosexuality.
Saudi Arabia and Iran are among the seven
nations that impose the death penalty upon
those found guilty of same-sex sexual acts.
Bernier-Toth told the Washington Blade
during the meeting the State Department rarely
urges an LGBT traveler not to travel to a specic
country that criminalizes homosexuality.
The decision whether to travel is
always up to the individual, she said. Our
purpose in life is to put out that information
as accurately and in a timely fashion so that
people can make those smart decisions.
IGLTA President John Tanzella added his
organization tries to work with a particular
destination through afliated hotels and
other travel-related businesses as opposed
to boycotting them.
Theres also gay and lesbian citizens
everywhere that we eventually hurt, he said.

Tourism ofcials on the Delmarva
Peninsula say they expect an inux of
visitors this summer as the Jersey Shore and
other coastal areas to the north continue to
recover from Superstorm Sandy.
This weekend was packed, Camp
Rehoboth Executive Director Steve
Elkins told the Washington Blade. It was
amazingly crowded and I saw a lot more
cars with New York and New Jersey license
plates than I see in normal times.
Sandys record storm surge inundated
Fire Island, the South Shore of Long
Island, coastal areas of New York City and
large swaths of the Jersey Shore before it
made landfall near Atlantic City, N.J., on
Oct. 29. Rehoboth Beach, Ocean City and
even Cape May did not experience any
signicant damage outside of some minor
ooding in low-lying areas, beach erosion
and downed trees.
Carol Everhart, president of the
Rehoboth Beach-Dewey Beach Chamber
of Commerce, told the Blade she is seeing
a double-digit increase in information
requests from last year.
Roughly 25 percent of the areas visitors
come from New York and New Jersey, but
Everhart said more than 20 percent of the
inquiries have come from people who live
in areas that Sandy most directly impacted.
To get these requests this early this rst
quarter is unusual, she said. We related it
to the storm.
Susan Jones, executive director of
the Ocean City Hotel, Motel, Restaurant
Association, said she has denitely seen
an increase from that particular market
and attributes it to the roughly $3 million in
advertising her group has spent in the area
over the last few years. She stressed she
expects those who would normally vacation
on the Jersey Shore or Long Island will
come to Ocean City this summer.
Beach vacationers like to have their
beach vacations, so theyre going to nd
a beach somewhere, Jones said. I would
denitely say its possible, and of course
we dont wish that on anybody. We were
fortunately spared, but I just cant even
imagine what theyre going through.
New Jersey Gov. Chris Christie last
month said the 82.5 million tourists who
visited the Garden State in 2012 generated
a record $40 billion. His administration also
announced it would launch a $25 million
marketing campaign to let potential
visitors know that the Jersey Shore will be
open for business this summer.
New York City welcomed 52 million
tourists last year in spite of Sandy that
inundated large swaths of lower Manhattan,
Staten Island, Brooklyn and Queens.
Jeff Guaracino, chief strategy ofcer of
the Atlantic City Alliance, noted the citys
casinos reopened ve days after Sandy
made landfall. He told the Blade the iconic
boardwalk is in pristine condition in spite
of media reports during and immediately
after the storm that suggested otherwise.
What we hear from the real estate agents
is that in southern New Jersey, where the
housing market is very robust and [summer
rentals are] very strong, people are looking
from other displaced towns and moving
south, Guaracino said. We understand
from the real estate [agents] that sales have
been robust for summer and that rates are
up as well. So that gives you a whole other
new tourist base for Atlantic City.
Doreen Talley, director of marketing
of the Chamber of Commerce of Greater
Cape May, told the Blade businesses in the
region at the southern tip of New Jersey
that is accessible from Lewes, Del., by ferry
were up and running business as usual
the week after Sandy made landfall.
She said occupancy rates are ahead of
where they were at this point last year.
Thats due to the fact that areas like Long
Beach Island and a few of the other towns
are not going to be able to accommodate
the visitors that theyre usually able to
because their accommodations have
decreased, Talley said.
Local tourism ofcials with whom the
Blade spoke said they expect this momentum
will continue through the summer.

Out singer brings three-man
combo for D.C. tour stop

Gay pop singer Mika was in Vancouver
when we spoke by phone two weeks
ago. He was in tour rehearsals for a
stripped-down 17-date mini tour behind
his latest album The Origin of Love,
which dropped in October.
Theres good news and bad he
is coming to Washington but the show
is sold out. Hes slated to be here
Wednesday night for a show at the
Historic Sixth & I Synagogue. A review
of his March 27 show at Los Angeless
El Rey Theatre drew raves. A blogger
(Neon Tommy) said he spent much of
the evening at the piano and, as great
as his voice may sound in recordings,
it is unbelievably smooth live and
beyond impressive.
WASHINGTON BLADE: What kind
of instrumentation will you bring?
MIKA: There are three of us playing
everything from piano to clarinet to sax
to accordion to marimba to vibraphone
we have all these different instruments
being played and were trying almost
to make it sound classically inuenced
almost. Weve done some scoring on a
lot of this stuff just for this tour.
BLADE: How do you take highly
produced dance pop and make it work
with that kind of instrumentation?
MIKA: You take it back to the way it
was written, to its most essential things.
Things start out very basically, like maybe
just piano and bass, and then build and
build until you get the more dance stuff.
But theres loads of different ways to do
it. It almost sounds more tribal on stage.
Its kind of like youre getting people up
and dancing and singing without all the
bleeps and blowups.
BLADE: Is this where you are musically
now or is it just a way to contrast it with
the touring you did last fall?
MIKA: It denitely will affect the
sound of my next record. Were testing
new songs and its already happening.
The new stuff is a lot more sparse.
BLADE: The transition in your vocals
from your natural range into falsetto
is so seamless. With many singers its
so much more pronounced. Was that
just always the way it was or have you
worked to develop and rene that?
MIKA: Its really the result of growing
up being trained by Russian classical
musicians. It was like really serious
professional singing. I can ip really
effortlessly because Ive been doing it
since I was about 11. At the same time,
my full voice range is actually quite
limited. Im technically a baritone, so
pop just doesnt work for that kind of
voice and I had to develop a way to
have more range. If you listen to Freddie
Mercury or Prince, you see how we try to
stretch it as far as you can and make it so
its almost unnoticeable.
BLADE: Now that youve been out a
while, what differences have you noticed
career-wise?
MIKA: Theres been no change
whatsoever in the people coming
to the shows. Its exactly the same
demographics I have always had
this very crazy mix. Press wise, people
talk about it, but its only one question
that comes and goes because Ive
never lied or pretended to be anything
I wasnt. I refused to label myself. And
the music hasnt changed. Beyond that,
I think theres denitely a different sort of
person now who comes up and talks to
me on the street. That happens in a very
different way. I think its made me slightly
more approachable to some people.
BLADE: Are you in a relationship now?
MIKA: Yes I am but its hard. Beyond
the traveling, this desire to constantly
be creating I think takes its toll on a
relationship. Relationships are about
stability and that isnt necessarily the most
conducive thing to the creative process.
BLADE: You have such great hair
any tips?
MIKA: Wow, relationships to hair
thats quite a change.
BLADE: Well, Im trying to move fast.
MIKA: The hair thing, I dont know. I
hate washing it. I feel like you lose a bit
of your brain or something every time
you wash it.
BLADE: How often do you wash it?
MIKA: Maybe like once a week or
something. Its kind of skanky.
BLADE: How easily do the hooks
come? Is there a large discard pile of
songs that just arent hooky enough or
can you make the hooks tighter as you
write and tweak?
MIKA? With the last record I think I
wrote 16 or 17 songs and I put out 15 so
no, theres not a lot of waste. Its a very
efcient writing process. I try to write
like a child, to write as someone whos
allowing himself to be a child. I dont
really chase hooks, but I try to capture
that feeling of being an 8- or 9-year-old
girl or boy on a holiday. Im obsessed
with the craft of thrill building.

How long have you been out and
who was the hardest person to tell?
Since I was 17. And hardest was my
Mom because she was the last to nd out.
Whos your LGBT hero?
The television. Yes its portrayed
our community in a negative light at
times, but at the same time it has put
the community in everyones homes.
The little boy in the closet who is
afraid to come out can see that there
are others just like him. He can see
that it is cool to be gay. It has also
helped gay become part of life,
where as before it was taboo. We
live in a great time and we are on the
edge of a movement.
Whats Washingtons best
nightspot, past or present?
Currently I would have to say Nellies
on a Saturday night. The vibe is so laid
back and fun. The fact that I DJ there
every Saturday night has nothing to
do with it. I just wish there was a dance
oor. Without a doubt Velvet Nation
was the best spot back in the day.
Describe your dream wedding.
A legal one!

What non-LGBT issue are
you most passionate about?
Health care. Why should one of the
greatest countries in the world have
to have its citizens ghting to stay
healthy? It bothers me that people
would ght harder to keep guns
around, than they do to keep their
fellow neighbor alive. The family thats
losing their son to cancer because they
cant afford treatment couldnt care less
if they had the right to own a gun.
What historical outcome
would you change?
Not sure if I would change anything.
Things happen for a reason. We
are human and we learn from
our mistakes, individually and/or
collectively. What would we learn
by skipping an event? Nothing.
Unfortunately, pain is one of the best
learning mechanisms.

Whats been the most
memorable pop culture
moment of your lifetime?
MTVs Real World. It was one of
the rst shows I watched that had
real gay people on it. It made me feel
more comfortable with being gay and
showed me that being gay could be
cool. It made me excited every time
they cast someone gay.
On what do you insist?
I insist people come out to Cherry
this year and support a great cause. Im
excited to be one of the DJs in the lineup.

What was your last Facebook
post or Tweet?
There must be free vodka at church.
(It was Easter Sunday.)
If your life were a book,
what would the title be?
I Hope No One Saw That.
(Hopefully it wont be a picture book).

If science discovered a way to
change sexual orientation, what
would you do?
Not change. Im privileged to have
a different perspective by being the
minority. Besides, gay people have
more fun in my opinion.
What do you believe in
beyond the physical world?
I believe in God and that he will take
care of those who do good to others.
Whats your advice for LGBT
movement leaders?
Keep on keeping on!
What would you walk
across hot coals for?
The next Xbox console. Yes Im a
huge geek. Get over it.
What LGBT stereotype
annoys you most?
That gays only want to party, though,
ironically thats all I seem to do.
Whats your favorite LGBT movie?

Whats the most overrated
social custom?
Kissing people on the cheek when
they greet you. I really hate that. Why
do us gays do it so much? I have
sensitive skin.
What trophy or prize
do you most covet?
Someones heart. Havent had the
opportunity to win one, but when I do,
its going to be amazing.
What do you wish
youd known at 18?
Nothing, because I feel life is all about
the journey and the learning experiences.
Why Washington?
Why not? I think I could make a
huge impact on the music scene here.
There is so much potential here. Im
so excited to see where it will go.

DJ TWiN says most of his music work came about by happenstance.
My friends would get so mad at me because wed be out at clubs in the
UK and I always knew the songs within, like, the rst 10 seconds and they
said I ruined it for them, he says.
TWiN the name was inspired by his straight twin brother whos married
with kids in Texas was in the UK for three years (2007-2010) for his day
job working for the State Department, where hes known by his birth name,
Kurt Graves. The 28-year-old New Orleans native says his friends inspired
him to get some DJ equipment and play around with it. He did and was
soon spinning at a straight bar there he frequented.
He came to Washington in late 2011 and says a visit to Nellies on a
Saturday night convinced him the popular U Street sports bar needed
a DJ. He volunteered to do it one night and quickly became a Saturday
night xture there. During a bus ride back from New York Pride last year,
he met someone from Cherry and just got elected as a board member
there. He makes his Cherry debut tonight opening for DJ Kostas at MOVA.

Gay-penned Mountaintop is
funny, spirited and serious

Early in playwright Katori Halls The
Mountaintop (now at Arena Stage),
Martin Luther King, Jr., smokes a
cigarette and audibly uses the restroom.
Quickly this iconic gure of history
is dened as very human, says the
plays director Robert OHara. This can
be hard on those who prefer that King
retain his saint-like status, but really
theres nothing to be offended about.
The works theatricality makes it clear
were not doing bio drama but rather
were asking What if? The playwright is
exploring Kings psyche.
Set in Memphis Lorraine Motel in
1968 on the last night of Kings life, Halls
play imagines an unexpected meeting
between the already legendary 39-year-
old civil rights activist and a feisty 20-year-
old maid, Camae. Their 80-minute
exchange (at turns funny, spirited and
serious) is lled with biography and
politics, prompting King to examine his
past and unnished dreams.
Arenas production (featuring Bowman
Wright as King and Joaquina Kalukango
as the maid) is in collaboration with
Houstons Alley Theatre where it played
before moving to D.C.
But being in Washington makes it
a different experience, says OHara,
whos gay. President Obama and the
Martin Luther King Memorial are here.
Dr. King made his I Have a Dream
Speech here. Washington audiences
seem more political. Arenas Kreeger
Theater is much more intimate than
the Houston venue. So much about the
production is altered because its in this
new Washington environment.
OHara was introduced to the play in
its early developmental stages. The
director originally slated to do the
workshop reading pulled out at the
last minute and I stepped in. In those
days, a lot of people were cold on the
project. But from the start, I liked how
it revealed Kings humanity and enjoyed
its explosive and erotic elements.
Soon others would agree: In 2009,
Halls play premiered in London where
it was a sleeper hit, winning that
seasons Olivier Award for best new
play. It opened on Broadway in 2011 in
a production starring big names Samuel
L. Jackson and Angela Bassett.
As an undergraduate at Tufts University,
OHara rather eetingly considered a
career in law. But by his third year, he
knew he was destined to work in theater.
OHara went on to at Columbia University
where he studied directing. His mother
wasnt thrilled and suggested her son
nd something practical to fall back on.
He did playwriting. Not exactly what
mom had in mind, but at 43, OHara has
forged a busy and productive career
involving both.
With directing you have to wait for the
phone to ring, says OHara who lives in
New York City with his longtime partner,
a psychiatrist and avid theatergoer. And
others control whether you work or not;
whereas with playwriting you can write
whenever you want. Hopefully you have
a few commissions to sustain you. I like
to alternate the two. Im happiest when I
have a couple things going on at once.

Filmfest D.C. features trans-themed content
Filmfest D.C. kicks off tonight at 7 p.m. with Underground, a lm about
the life of famous hacker Julian Assange, at Regal Cinemas Gallery Place (701
7th St., NW).
The festival continues through April 21, with 80 lms showing at eight
different theaters. One of the lms being shown questions identity and what
a couple will do for love. Laurence Anyways follows Laurence after he tells
his girlfriend that he wants to become a woman. The couple works hard to
save their relationship along with facing the phobias of their society. This lm
screens at Landmark E Street Cinema on April 17 at 8:45 p.m. and April 20 at
6 p.m. Tickets for this individual event are $12.
Attendees can buy individual tickets at each locations box ofce, or
they can purchase the Directors Package, which is 10 tickets for $95, or the

Uganda doc explores gay persecution
A screening of the documentary God Loves Uganda happens Monday night at
7:30 p.m. at Landmark E Street Cinema (555 11th St., NW).
The lm follows the American Evangelical movement in Uganda as missionaries and
evangelical leaders attempt to eliminate sexual sin and converting the population
to fundamentalist Christianity. There will be a panel discussion following the screening
with Santiago A. Canton, Rev. Kapya Kaoma and Bishop Gene Robinson.

Wright, others to appear at Rehoboth womens event
Camp Rehoboth presents Rehoboth Womens Fest starting Thursday at Atlantic
Sands (101 N Boardwalk) with a welcome party at 7 p.m.
The festival includes volunteering activities, art shows, book signings, meals and
happy hours throughout the weekend with live performances including out country
singer Chely Wright, Christine Havrilla and comic Vickie Shaw.
Tickets can be purchased for individual events and attendees can buy a $65 Fest

Another Night Out and Spring Sports Fest planned
Team D.C., a group that promotes sports and wellness in the LGBT community,
hosts a Night OUT at the Capitals Viewing Party on Saturday along with its 2013
Sports Fest on Thursday.
The Capitals Viewing Party is sponsored by D.C. IceBreakers who provide a
skate night before the party starting at 6 p.m. at the Kettler Capitals IcePlex (627 N
Glebe Rd.). Tickets arent necessary but the group asks attendees to RSVP on the
groups Facebook page. The party follows at Baileys Pub (4238 Wilson Blvd.) where
attendees will watch the Capitals take on the Florida Panthers.
The Spring Sports Fest takes place at Room & Board (1840 14th St., NW) at 6:30
p.m. on Thursday (April 11). Attendees can meet representatives from different LGBT
sports clubs as well as representatives of all the professional teams connected with
the Night OUT series. There is no cover charge.

Organist Cameron Carpenter is a
tangle of apparent contradictions.
On one hand, hes made a slightly
daring fashion sensibility a central
component of his stage persona, yet in
stage speech (banter is way too light a
term for it) and conversation, he comes
off as deadly earnest. But maybe this says
more about us why do we tend to think
that mohawks and sequins might indicate
a less-than-intellectual musical mind?
Perhaps because he takes in
some ways a rock star approach
to being a serious (Juilliard-trained)
classical musician and seems to delight
in unorthodox and even iconoclastic
approaches (his transcriptions of piano
and orchestral works to the organ have
elicited everything from critical awe to
is-this-a-joke? reactions), Carpenter is
a polarizing gure.
But get to know the queer, Berlin-
based organist, follow his career over
several years and play devils advocate
with him as weve done here and
you realize the creativity and talent
he brings to it all far supercedes the
reductions of dozens of articles and
TV proles around the world that have
reduced him to little more than a bad
boy or modern-day Liberace. Yes,
theres grumbling in more staid organ-
world circles (one often notices a trend
of rather bemused expressions when
his name is uttered), but try to think
of young organists who are sparking
the kind of raves and career he has
managed, and the list gets really, really
short. He makes his Washington-area
debut April 12 at the Strathmore.
Carpenter, in Georgia with a friend
whos having him give a private recital
at a pipe organ this person has installed
in his house, says he feels little pressure
generally speaking. We chatted for
about an hour in mid-March by phone.
I am conscious of it at times and I
sometimes have the sudden realization of
deadlines coming up but though this may
sound supremely arrogant, when I later
manage to pull it off, I realize I should never
have had any self doubt. I think this theory
is sound I try to stay away from getting
too caught up in pressure and luckily I
dont get stage fright.
Carpenter remains a recurring
theme frustrated by constantly
having to adapt to the organs in various
concert halls around the world. Purists
are skeptical, but Carpenter expects
a touring organ hes been working
on for several years will be built and
launched next year.
Of the grand tradition of grand
organ building, Carpenter says what
hes trying to do doesnt diminish those
achievements.
Its not how many rooms full of
wooden pipes there are or how many
degrees someone has or how many
works one has written for the organ,
he says. Its only interesting in terms
of human emotion and how it makes us
feel to be alive.
He says constantly having to get
accustomed to new organs has become
maddening.
The closest analogy I can come up
with is if you made a lm and every time
you screened it, you had to recut the
edit. Theres a staggering amount of
work that goes into each minute of lm.
It would be almost unsustainable. Thats
why touring for me is so very hard.
Although its highly likely to change
Carpenter has been known to have
programs printed, then play nothing
listed on them he says his Strathmore
performance may contain an organ
adaptation of Leonard Bernsteins
Candide Overture, perhaps some
Marcel Dupre variations, a reimagining
of a scherzo by Tchaikovsky and maybe
some Liszt Transcendental Etudes.
It all depends on the organ, which is
as yet unknown, he says.
Carpenter says he cant relay details
just yet, but an announcement about
a new recording deal is imminent. His
last album was 2010s Cameron Live!
release (a CD/DVD double album).
A feature-length documentary on his
life and work is also very much in the
planning stages, he says.
I dont really see myself as someday
having a recorded legacy of 70 CDs, but I
do think it would be great if each of them
is something really personal and strong.
Ive also wanted to wait until the right
recording instrument would be available
so Ive been focusing most of my energy
on that for now. I dont have any particular
compulsion to record just for its own sake.
He says he appreciates media coverage
immensely so objecting to supercial
comparisons of performers from bygone
eras isnt necessarily a bad thing.
It is kind of knee-jerk and wildly
reductive, but they cant be blamed
for trying to sell tickets, he says. I
wouldnt mind if I never hear the phrase
bad boy of the organ ever again but its
a sad truism I guess.
And of the Mohawk hes been
sporting of late, Carpenter says its here
to stay at least for now.
I think Ive settled on something that
hits a visual balance of elegance and
style. Its also the haircut of a warrior
which is not inappropriate.

Years ago, before I started writing for
the Blade, I read Ruth Reichls Garlic and
Sapphires: The Secret Life of a Critic in
Disguise. I found myself chuckling as this
world renowned food critic for the New
York Times created extravagant costumes
so that she wouldnt be recognized in
New Yorks nest restaurants.
All so she could have an authentic
experience at every restaurant in which she
dined. While I dont go to this extreme, and I
doubt anyone would recognize me anyway,
I usually try to remain anonymous so that I
get the same dining experience any reader
would receive. I never put my name on
the reservation, I never conduct in person
interviews and I never pay with my credit
card. This time, however, was a little bit
different because the publicist for Jardenea
(2430 Pennsylvania Ave.) contacted me and
invited me in for a meal. I hesitated at rst,
but then decided to accept.
Jardenea is a new farm-to-fork
concept restaurant in the newly
renovated Melrose Hotel and on March
22, its staff launched a new spring
menu. The focus is inventive and fresh
ingredients sourced from local growers
and farmers. The culinary director of the
Remington Hotels, Ted Peters, selected
young-but-experienced Nate Lindsay
as the executive chef. When he came
out to the table to speak with us, you
could tell that he was passionate about
the food he was about to serve and the
concept of the restaurant.
I was planning on treating this
article as I do all my others: go to the
restaurant, sample as many items as
possible and see what the overall
experience feels like before putting
pen to paper (yes, I actually do write
out each article before typing it). When
I approached the restaurant and the
maitre de recognized me and brought
us to his nest table, I knew things
were going to be a little different. From
that moment on there were no fewer
than three people bustling around our
table of four bringing us food, lling up
water glasses or pouring us wine. This
quiet, unassuming hotel restaurant was
suddenly bustling with action.
From the small plate menu, we
selected ve items: The Chesapeake
Bay Crab Bisque, The Jardenea Caesar,
the Maryland Crab cake, the cast iron
seared Maine Scallops and the lamb
meatball sampler. We paired our
appetizers with a delicious red wine
from local Virginia Vineyard, Breaux.
The Caesar salad, which I was told by my
dining companion was delicious, was
also incredibly artistic in its presentation
with a large circular crouton surrounding
the lettuce. The crab cakes were crabby,
not cakey, exactly as I like them, and the
lamb meatballs were a delight when
dipped in the sweet stone fruit chutney.
Above all else, the freshness of all the
ingredients and the avors was evident.

Lesbian writer surprised
by her urge to return
to country roots
It may have seemed like the kind of
idle conversation that friends have when
theyve known one another for ages, but
Melanie Hoffert was dead serious when
she told her friend, Melissa, that they
should return together to the prairie.
Hoffert, in her new memoir Prairie
Silence, surprised herself with her
longing for home. Shed hated growing
up on an isolated farm in North Dakota,
10 miles from grocery stores, three
miles from playmates, a half days drive
to a major city. She hated small-town
life then but, sitting in a cold ofce in
Minneapolis, she realized how much
she missed the farm and, most of all,
harvest time.
So she took a leave of absence from the
job she loved. She wanted to be a farmer
again. She wanted to touch the past.
But in reconnecting with memories of
vast openness and the kind of silence
that comes when neighbors are miles
apart, Hoffert also rediscovered who
she was, years ago. She knew at a young
age that she was different from other
girls: she gured shed eventually kiss
a boy, but she yearned for another kind
of love. She dreamed of holding hands
with a woman and she became smitten
with her best high school friend, Jessica.
Hoffert knew she couldnt talk about
that to anyone on the prairie. That sort
of thing just wasnt discussed.
Coming home to North Dakota,
she remembered that puppy love.
She remembered how Jessica led her
to Jesus, and the turmoil it created
when she was told that homosexuality
was a sin. She recalled her family and
marveled at how much had changed.
And she remembered neighbors: the
ones who asked if she found a fella
yet; corn farmers, homesteaders and
homemakers, caretakers of the land.
When it comes to this books title,
Prairie Silence couldnt be more apt.
Author Melanie Hoffert has written a
sure love letter to a land and its people,
but its love spurned and unrequited, as
well as love held fast. In between Hofferts
sweet-yet-angst-driven memories and
her journey of self-rediscovery, readers
are treated to quiet reverence for a
disappearing way of life, for faith that just
couldnt last and for folks who to her
surprise never discouraged Hoffert
from being who she was.
This is a gorgeous book that evokes
quiet country mornings and loud self-
examination, and this former farm
girl enjoyed it thoroughly. If you once
believed that you cant truly ever go
home again, Prairie Silence is a book
youll be eager to read.

What every association and
owner should know

Many urban dwellers are waking up to
the concerns surrounding secondhand
smoke in their apartment cooperatives
and condo buildings. To date, approxi-
mately half of all states (including D.C.)
have passed comprehensive smoke-free
laws. However, these laws typically exempt
a persons home. There is no effort on the
horizon to ban smoking in all multiple family
dwellings in D.C. This situation could create
a dilemma for non-smokers trying to coexist
with smokers in a residential environment.
Nationwide, the number of residential
buildings becoming voluntarily smoke-free
appears to be growing.
The secondhand smoke issue is usu-
ally raised when a resident complains
about the smell of smoke entering his or
her apartment from other apartments or
areas within the building. Attempting to
address those complaints, building man-
agement will often undertake an investiga-
tion or some corrective action to address
the smoke odors. Often, these initial efforts
may fall short and residents will contend
that only a full building-wide smoking ban
can resolve the problem.
The rst step for any coop or condo
when facing this issue is to review the build-
ings governing documents for any provi-
sions pertaining to smoking. If a board de-
termines a smoking ban to be in the best
interest of the building, the most effective
way to do so is through an amendment to
the governing documents. A court is more
likely to uphold a smoking restriction adopt-
ed by a supermajority of apartment owners
rather than by simple board action.
At this point, there is only one local case
involving smoking in the cooperative envi-
ronment. In David Schuman v. Greenbelt
Homes, Inc. (a 2011 Prince Georges County,
Md. Circuit Court case now on appeal), a
non-smoking cooperative townhouse owner
sued building management and his neigh-
bor on the grounds that secondhand smoke
from his neighbor violated the nuisance
clause of his mutual ownership contract. The
non-smoking owner claimed that he suffered
from coughing, sneezing, congestion and
watery eyes for years due to the secondhand
smoke. In an attempt to alleviate the prob-
lem, the management company caulked
around baseboards, plumbing and electrical
outlets in both homes. Such efforts did not
satisfy the non-smoking owner.
However, the Circuit Court ruled in favor
of the management company, noting that
not all nuisances are necessarily action-
able and that the matter was more appro-
priate for the state legislature. While a sig-
nicant body of legal analysis does not yet
exist in the D.C. area, courts in other jurisdic-
tions have already begun addressing and
analyzing the issues surrounding commu-
nity smoking bans. The underlying conclu-
sion is that boards and managers need to
be alert to secondhand smoke complaints
because cooperatives and condos can be
held legally accountable for failing to ad-
dress smoking-related concerns.
