STATEMENT OF PROBABLE CAUSE (Amended) Your complainant is Richard J. Dusterhoft, an Assistant Ramsey County Attorney. He bases this amended complaint on police, fire and medical examiner reports and states that the following is true, correct, and establishes probable cause: Jeffery Dale Trevino, the defendant, and his wife, Kira Steger, lived in a rental house at 570 East Iowa Street in Saint Paul, Ramsey County, Minnesota, with a roommate, MR, who occupied the basement of the house. Ms. Steger had complained to friends and family about her marriage and her husband, and told friends she was contemplating divorce. Steger, Trevino and their roommate gave notice on January 31, 2013 of their intent to vacate the property by April 1, 2013. Ms. Steger had looked at apartments for herself, without Trevino. She apparently stayed over at friends houses on some occasions and was not including her husband in social and family activities. Friends of Steger later told police that Steger had said she was trying to get away from Trevino but that Trevino didnt get it and kept trying to find ways to stay together. On the evening of Thursday, February 21, 2013, Mr. Trevino met Ms. Steger at the Mall of America (MOA) where she had just gotten off work. The two had dinner and spent some time at the bowling alley in the mall. Surveillance video showed the two leaving the MOA together that evening. In the video, Mr. Trevino is wearing an Arkansas Razorbacks sweatshirt. This video is the last time Ms. Steger is seen alive. Police later learned that while at the MOA with Trevino, Steger had exchanged numerous text messages with a male. Police later confirmed that the male had been on his way to Colorado and was in South Dakota on the night of February 21-22, 2013. Ms. Steger and this male had engaged in a romantic relationship and that relationship would have been evident from those text messages. Jeffery Trevino had also complained about the relationship with his wife to his friends. He had made no plans for a residence after April 1 because, he told friends, because he hoped that he and Steger would reconcile. One friend of Trevino said that Trevino was suspicious of Steger and had been checking up on her. The friend said that Trevino had driven by Stegers gym to check if her car was there. The friend told police that Trevino had been checking Stegers credit card statements and had learned that she had been at a bar and not where she had told Trevino she was. The friend said that Trevino was stressed and consumed with what Steger was doing. On February 22, 2013, when Steger was missing, the friend suggested that Trevino try to locate Steger by accessing her I-Phone account but Trevino wanted to wait. The friend said that he and Trevino played video games on line the night of February 22-23, 2013 from 2200 to 0100 hours. The friend told police he thought it was odd that Trevino would be playing games while his wife was missing. On Sunday, February 24, 2013 at 1025 hours, Mr. Trevino called the Saint Paul Police Department to report that his wife was missing. He told investigators about their trip to the MOA and that upon returning home they watched a movie and Ms. Steger fell asleep. He said that he knew she had an appointment the next day and was out of gas, so he went to the gas station in her vehicle to get gas for her. He told investigators that on the morning of February 22, 2013, between 0830 and 0900 hours she left the residence in her vehicle, a white Chevy Cobalt. Mr. Trevino said that his understanding was that Ms. Steger planned to go to her gym in New Brighton, tanning in Roseville, to make a bank deposit for work and to interview potential employees at work later that day. He told investigators that he was home all day until he left to get his daughter that afternoon. Also on February 24, 2013, after calling police, Mr. Trevino called Ms. Stegers mother, Marcie, who lives in Wisconsin. He started the conversation by asking are you sitting down?, and then told her that Kira was missing. Marcie Steger also called police. arrived at 570 East Iowa while investigators were inside speaking with Mr. Trevino. The investigators described Trevino as being upset that more officers had arrived. At the end of the conversations with investigators, as they were leaving, Trevino asked what he was supposed to do with Stegers belongings. The investigators thought this was an odd question as, at that point Ms. Steger had only been missing just over 48 hours, their notice to vacate was not until April 1, and the question suggested that Trevino did not expect his wife to return. Bank records and surveillance video confirm that at 0213 hours on February 22, 2013, the defendant did put gas in the Chevy Cobalt at a gas station near their residence. Suveillance video shows the vehicle leave the gas station and turn toward the interstate and not in the direction that would be the most direct route back to 570 East Iowa Avenue. Bank records and surveillance video show the defendant purchasing gas for his own vehicle, a Honda CRV, and then getting cash from the ATM, at the same gas station, at 0805 hours that same morning. Mr. Trevino did not mention this transaction to investigators. In the video of the ATM transaction, Trevino was wearing a different sweatshirt from the one he was wearing in the earlier MOA video. This later shirt has a distinctive logo. Ms. Steger did not to go to her gym, to the tanning salon, or to work on February 22, 2013. She did not go to work as scheduled on February 23, 2013. Co-workers described this as highly unusual. The last use of Ms. Stegers cell phone number in February was at 2200 hours on February 21, 2013. Investigators learned that Ms. Steger was scheduled for a phone interview for a potential new job on February 22, 2013. The interview date had been changed several times by both the interviewer and by Ms. Steger but each time Ms. Steger had been in contact with the interviewer in advance. Ms. Steger did not call as scheduled for the interview, and had made no contact to change the time in advance. She had not called after the scheduled time either. A friend of Ms. Stegers told investigators that Ms. Steger believed her husband had been following her. Steger told the friend that Mr. Trevino knew Steger had been at a bar with friends and Steger had no idea how Trevino knew this. On Monday, February 25, 2013 MOA security located Ms. Trevinos Chevy Cobalt in the MOA parking ramp, backed into a spot against the far western edge of the parking ramp. Investigators found Ms. Stegers blood in the trunk of the vehicle. A trunk liner, also with blood on it, was found pulled out but near the vehicle. Ms. Stegers purse was found in the vehicle, along with blank court divorce forms apparently downloaded from the internet. A coworker of Ms. Steger learned that the Stegers vehicle had been located and was the first to call and inform Mr. Trevino. She told investigators that Trevino was calm and unconcerned and she felt that his reaction to his missing wifes car being found was inappropriate. She spoke with Trevino again later that afternoon and said that Trevino was not happy that Stegers disappearance was all over Facebook and that her disappearance was being blown out of proportion. Surveillance video from a neighbor of 570 East Iowa showed Kira Stegers white Chevy leaving 507 East Iowa at 0915 hours on February 22, 2013. Surveillance video at the MOA showed the vehicle entering the ramp at 0945 hours on February 22, 2013. Surveillance video shows a figure walking from the area where the vehicle was parked to the area where taxi cabs wait. A taxi cab left the MOA shortly after that figure walks to that area. Global positioning tracking data shows that that taxi went directly from the MOA to the 500 block of East Iowa Street in Saint Paul. The taxi fare was paid in cash. Security video from a residence in the 500 block of East Iowa Street shows the taxi arriving. The taxi stops just off screen but then immediately after, a figure appears

from where the taxi would have stopped. The video shows the figure walk up the driveway of 570 East Iowa. The figure turns toward the camera in the video and shows that he is wearing a shirt with a logo identical to the shirt Jeffery Trevino was wearing when he got cash from the ATM at the gas station less than two hours before. That same shirt was later recovered by police in his house. Jeffery Trevinos DNA was found on that shirt. On Monday, February 25, 2013, police executed a search warrant at 570 East Iowa. Investigators found several freshly laundered towels in the laundry room. The Arkansas Razorbacks sweatshirt that Mr. Trevino was wearing when he left the MOA on February 21, 2013 was found hanging, air dried, in the laundry room. Police found bleach stained towels in the kitchen, a mop and bucket in the hallway outside the main floor bathroom. Closer inspection found blood spatter on the side and top of the box spring in the master bedroom and on a set of shelves next to the bed. This blood was later identified as Kira Stegers. Police found blood on the back of the master bedroom door; this blood proved to be a mixture of Kira Steger and Jeffery Trevinos blood. Police noticed that the box spring had been turned around to place the area of blood spatter next to the wall, apparently to hide the blood. The bed had been moved and an item of furniture rearranged. When the furniture was returned to its original arrangement, police determined where the apparent origin of the blood would have been, next to the bed. The carpet there was cut and turned over. An area of human blood was found that had soaked completely through the carpet. The Bureau of Criminal Apprehension (BCA) has tested that blood stain but has been unable to identify a DNA profile from that blood. Scientists with the BCA have said that one possible explanation for the failure to find a DNA profile in this blood is because cleaning products can dilute and degrade blood to the point that a DNA profile cannot be obtained. However, police found Kira Stegers blood in a carpet cleaner in the house. Trevino had borrowed the carpet cleaner from Kira Stegers mother on February 20, 2013. Police also examined Jeffery Trevinos vehicle, the Honda CRX. In it, they found, written out, the address in Maple Grove of the male who Steger had seen romantically and who she had been texting the night of February 21, 2013. On the evening of February 25, 2013, police were canvassing the neighborhood around 570 East Iowa to see if any neighbors had seen anything. A homicide investigator saw Mr. Trevino standing in the street outside his house. When asked, Trevino nonchalantly said he was waiting for a ride, was going to dinner, and then would probably catch a movie. Steger and Trevinos passports, birth certificates, and marriage certificate were all found in the residence and recovered by police. No further activity by Kira Steger was found on her Facebook site, her bank accounts, and she had no contact with family or friends after the night of February 21, 2013. The roommate of Trevino and Steger was interviewed and said that he had been home on the night of February 21-22, 2013 and heard nothing unusual. He said that he saw Steger and Trevino watching a movie around 2100 to 2200 hours on February 21, 2013 when he went upstairs to the kitchen to get a soda. He said that he got on the morning of February 22, 2013, skipped a shower, and left for work at about 0630 hours. His employer and his computer records show that he did arrive at work on schedule that morning. Despite numerous attempts by police to challenge MR, he has denied hearing anything or any involvement in the disappearance or murder of Kira Steger. Police investigators have found no evidence to contradict his claims. On March 16, 2013, during a search for Kira Stegers body, her grandfather found a bag containing a bloody pillow, a pillow case, a sports bra, shirt and sponge. Kira Stegers DNA profile was identified in the blood on the pillow. The bag was found at Keller Lake Park, 1.2 miles northeast of 570 East Iowa.

On April 2, 2013, a resident cleaning up debris in the ditch near his house found Kira Stegers drivers license. The license was found at the intersection of Edgerton and Koehler Streets in Vadnais Heights, 4.5 miles north of 570 East Iowa. On May 8, 2013, a barge mechanic noticed what he believed to be a human shoulder in debris floating in the Mississippi river between Robert Street and Highway 52 in downtown Saint Paul. The Saint Paul Fire Department recovered Kira Stegers decomposed body from the river, which had to be identified using dental records. This location is as close as the Mississippi river gets to 570 East Iowa, about 5 miles directly south. Her body was examined by the Ramsey County Medical Examiners Office. Injuries to her body include a laceration just above her left eye, an injury to her upper lip, a broken index finger, and lacerations to her liver. The medical examiner has determined that her cause of death was homicide. The manner of Ms. Stegers death was homicidal violence. Additional work in this regard is ongoing.
