AMENDMENT TOSYNOPSIS OF LEASING AGREEMENT PT.

DONGBANG DEVELOPMENT WISMA KORINDO (731A/DD-BM/LA/XI/10) This Amendment to Synopsis of Leasing Agreement No. 731/DD-BM/LA/XI/10 (the Amendment) is made on the of January 2013, by and between: 1. PT. DONGBANG DEVELOPMENT, a limited liability company duly established and existing under the laws of the Republic of Indonesia, having its address at Wisma Korindo 10th Floor, Jl. MT. HaryonoKav. 62, Jakarta 12780 (hereinafter referred to as the LESSOR); 2. PT. BUCYRUS INDONESIA, a limited liability company duly established and existing under the laws of the Republic of Indonesia, having its address at Wisma Korindo 4th Floor, Jl. MT. HaryonoKav. 62, Jakarta 12780 (hereinafter referred to as the LESSEE). The LESSOR and the LESSEE herein collectively referred to as the Parties and separately as the Party. WITNESSETH A. Whereas, the LESSOR and PT. OnjayaKokoh, a limited liability company duly established and existing under the laws of the Republic of Indonesia (hereinafter referred to as PT. OnjayaKokoh) have entered into Leasing Agreement No. 731/DD-BM/LA/XI/10 dated 17th of January 2011 (hereinafter referred to as the Agreement) and the Synopsis of Leasing Agreement No. 731/DD-BM/LA/XI/10 dated 17th of January 2011 (hereinafter referred to as the Synopsis); B. Whereas, the Parties and PT. OnjayaKokoh have entered into Novation of Contract dated 10th of February 2011 concerning the novation and transfer of rights and obligations of PT. OnjayaKokoh as stipulated in the Agreement and the Synopsis to the LESSEE; C. Whereas, through its letter No. 001/JKT-SUP/PRC/I/2013 dated 15th of January 2013 (which copy is attached in Annex I of this Amendment), the LESSEE has requested to extend the period of lease as stipulated in the Agreement and the Synopsis for 2 (two) months; D. Whereas, the Parties desire to extend the period of lease for 2 (two) months with this Amendment. NOW THEREFORE, in consideration of the mutual covenants and premises herein contained, the Parties hereby agree to enter into this Amendment with the following terms and conditions: Article 1 SCOPE OF AMENDMENT 1. The Parties agree to extend the period of lease for 2 (two) months and,therefore, to amend and changethe Articles 6, 8 and 16 of the Synopsis into as follows: 6. 2. Except as changed by this Amendment, any and all provisions of the Agreement and the Synopsis shall remain valid, continue in effect according to its terms and bind the Parties. Article 2 MISCELLANEOUS 1. The Parties agree that this Amendment, together with the Annex I of this Amendment and/or any other documents as referred herein areconstitutes the final, complete and exclusive statement of the Agreement and the attachment between the Parties pertaining to their subject matter and supersedes any and all prior understandings or agreements of the Parties. 2. The Parties agree that this Amendment shall be regarded as an integral part of the Agreement, Synopsisand/or any of its addendum and/or amendments which have been signed by the Parties.
