FACILITY RENTAL TERMS


The individual executing the Agreement must be at least twenty-one (21) years of age and must remain on premises for the entire duration of the rental agreement or when the event concludes, whichever comes first. Payment, in full, is due at the time the agreement is submitted. Dates/times are not considered rented until a Rental Agreement, fully executed by both parties and payment in full is received. Checks are to be made payable to Riverwood Pool or Riverwood Barn. The Barn, Kitchen Facility and the Pool are considered separate venues. If you intend to use all areas you must pay the applicable fees. Refunds are not issued due to cancellation of the event on the part of the Lessee. The Pool and the Barn share the bathroom facilities. The Lessee agrees and understands that should both venues be separately used at the same time, the bathrooms will be in use and available for all attendees of all venues. Smoking is not allowed within 150 feet of the Barn or the Pool. Alcohol is permitted with prior notification (see below) and security guard during rental at Lessees expense. No cash bar sells. Functions attended by individuals under the age of twenty-one (21) must be chaperoned by one (1) adult for every ten (10) guests under the age of twenty-one (21). Functions attended by individuals ages thirteen (13) to twenty-one (21) and scheduled in the evening hours may be required, at the discretion of the RWP Pool/Barn Management, to provide for security for the duration of the event. The cost of security will be the responsibility of the Lessee and is in addition to the aforementioned rental fees. It is the responsibility of the individual executing this Agreement to abide by all FEDERAL & STATE LAWS. Any violation(s) observed will result in the prompt termination of the event; eviction of all attendees and no refund of any monies paid. The violation(s) will also be promptly reported to the appropriate law enforcement authority. It is the responsibility of the Lessee to pay for any damage to the Facilities. Repair expenses, if any will be deducted for the Damage/Cleanup/Key Fee collected at the time this Agreement is executed. Lessee acknowledges that liability for said damages are NOT limited to the amount of the Damage/Cleanup/Key Fee BARN RENTAL- Fees include a $100.00 refundable Damage/Cleanup/Key Fee, which will be refunded if the following requirements are all adhered to: o Lessee understands and agrees not to enter the premises PRIOR to the contracted starting rental time and exit the premises ON OR BEFORE the contracted ending rental time. o All decorations, including any items used to attach the decorations (including but not limited to tape, staples, pushpins, etc) are to be removed. o All tables & chairs must be cleaned, taken down and stacked neatly against the wall closest to the bathroom, opposite the windows looking out onto the playground. o The floor must be swept clean and all debris placed in the trash receptacles provided. o All loose paper and trash must be picked up from the floor of the bathrooms, and sinks/toilets wiped clean if used. o All trash must be securely bagged and placed outside in the dumpster. Trash is to be placed INSIDE the dumpster, please do not set it alongside the dumpster or a clean up fee will be charged. o All windows & doors must be locked and the key must be returned to the lockbox attached to the front door of the Barn upon conclusion of the event. Failure to return the key to the lockbox will result in loss of the Damage/Cleanup/Key Fee. o Part or all of damage/cleanup/Key fee may be retained to correct issues. o The Barn is NOT heated or cooled. o Three (3) round tables-two (2) wooden and one (1) plastic, ten (10) plastic rectangular tables and fifty (40) plastic folding chairs are included in your rental agreement (for use in the barn ONLY). o The use of the Kitchen facility adjacent to the barn is not included with use of the Barn meeting area. Should you request use of this kitchen area arrangements will need to be made in advance and an additional rental fee of $75.00. POOL RENTAL-All RWP Swimming Pool Rules & Regulations are to be followed at all times (copy attached). Lessee has direct responsibility for ensuring all guests fully abide by the Rules & Regulations. o Lessees are not permitted to charge for admission and/or refreshments to their event. o All pool parties conducted during regular operating hours OR after hours require a minimum of one (1) dedicated lifeguard. RWP adheres to Red Cross accepted practices of posting one (1) lifeguard for every twenty-five (25) guests. The stated rental fee includes one (1) lifeguard. Lessee will be asked for an approximate headcount for the event at the time the Rental Agreement is executed and lifeguard(s) will be scheduled accordingly. o Should a determination be made, during the event that more than twenty-five (25) guests are present, additional guards will be called in and the Lessee will be subject to a charge of DOUBLE the stated rate for lifeguards. This decision/action is at the sole

discretion of Management or his/her designee. This additional fee will be due and payable immediately or the Lessee will be asked to immediately vacate the facility, with no refund of any fees whatsoever. This requirement is in place in order to provide the safest environment for our patrons/your guests. o Minimum period for a pool party is two (2) hours. Additional hours may be scheduled for additional fee at the time the Agreement is executed. o Parties conducted during regular operating hours are limited to a maximum guest count of forty (40). o Lessee understands that guests DO NOT have exclusive use of the pool for parties conducted during regular operating hours. o RWP personnel have the sole authority to cancel or stop use of the facility due to inclement weather. The decision to cancel an event due to inclement weather will occur no earlier than one (1) hour prior to the scheduled start time of the event. Should this occur, the Lessee may reschedule the event on a space/time available basis at no additional charge. Please know these decisions are not taken lightly and are made in the best interest and safety of our patrons/your guests. o All decorations, including any items used to attach the decorations (including, but not limited to tape, staples, pushpins) are to be removed. o Should inclement weather or circumstances beyond the control of Management render the pool unavailable, the barn may be substituted, if available and agreed to by all parties involved, at no additional charge. All aforementioned rules, regarding the use of the barn will apply. o Private Pool Parties are subject to additional rules, as follows: Private Pool Parties may only be scheduled after normal operating hours. During the period the pool is under cover of the dome, private pool parties may not begin before 8:00 pm. During the period the pool is NOT under the cover of the dome, private pool parties may begin upon conclusion of normal operating hours. RWP agrees that only one (1) private pool party will be booked on any given night. Lessee will have exclusive use of the pool during the private pool party period. Lessee is responsible for removing any event-related debris to the trash receptacles provided prior to exiting the premises (i.e., cups, plates, etc.). BY SIGNING BELOW, LESSEE ACKNOWLEDGES: The individual executing this agreement (hereinafter referred to as the Lessee) hereby agrees to indemnify and hold Riverwo od Plantation (hereinafter referred to as the Lessor) harmless from any and all claims or expenses arising out of Lessees use of the facilities, including, but not limited to attorneys fees, court costs and/or any other expenses incurred. Lessee represents, by executing this Agreement the adequacy of insurance coverage, should such be required. The Facility will not be used for illegal purposes, nor shall the Lessee use the Facility in any manner which is deemed to create a nuisance for the residents of Riverwood Plantation. The Lessee has received, reviewed and agreed to all the terms and conditions of this Agreement. The Lessee has received a copy of the RWP Pool Rules & Regulations.
