Hi All,

Today I had a brief meeting with our friend and following are some of the key points discussed The report primarily was compiled by our friend in the end and was endorsed by the chairman after incorporating the feedback that chairman had. However, one of the member (former ambassador) was not in agreement with the two members and said that after reviewing he might write a note of dissent. Unfortunately, his brother passed away in late October and therefore he was away and unavailable and after couple of weeks he started writing the note.

The two members were excepting a short note of dissent that excluded Save the Children. However, few days back they received a note of dissent that in itself is a full report as it is a 73 pager note.

Legally speaking, if commission wanted to issue the report they were bound to include the note. However, the note of dissent is a very strong one and is a full report almost. Very importantly, the note of dissent criticizes the two panel members were being soft on certain institutions (including Save the Children) The commission simply could not issue the report with that note and therefore now they are working on developing counter arguments on the note; however, it is taking them a lot of time and so far they have reached to just 16 pages.

The commission needs to have a lot of comments removed from the note before it is in a shape that the report could be shared otherwise it can jeopardize the integrity of the members of commission. The third member is being very staunch in his ideas and not willing to change his stance and therefore the other two members have to work extra hard to factually prove wrong a lot of things that this third member is saying. With regards to Save the Children, the note says that CIA was working through Save the Children and had its operatives embedded in the organization. The Haripur house was taken to collect the DNA residue to continue looking for the trail of the deceased. Once that job was done, the house was vacated. Afridis statement, though might be inconsistent, also indicates the same thing that Save the Children is working on behalf of CIA.

The fourth member of the commission (Abbas Ali Khan) also is not content with the report, but rather coming with a note, has decided to stay in US, that he went to on pretext of medical grounds. He is not willing to sign the report in the current shape but also does not want to put in a note of dissent and therefore continues to prolong his stay in US.

With these two members out, commission is no position to submit the report to the government.

As a way forward, the two members will work with the third member and try to come to a point where the note is significantly reduced and number of comments are taken out from the report. This very well take some time and if all goes well then commission might be able to submit the report by next month. However, with current contents, it might never be To my question on so what Save the Children should do in this case? His reply was, that we need to work with MOI and EAD to build relationships and confidence. It would take few months for Save the Children to be back to complete normalcy. His opinion was that it might take 5 to 8 months for that to happen.

Hi All Here is an update of todays events:

Hassan and I reviewed the documents handed to us by our friend yesterday evening. The review took place at Hassans house, where we prepared the questions. The documents and questions were handed to our friend in the afternoon and they are no longer in our possession.

Overall there was not much new in the documents that we havent seen or heard before. The biggest inconsistency between Afridis signed statement and the written recording of his questioning by the Commission is that when he spoke to the commission he explained the sequence of events as happening one year later (starting November 2009 instead of November 2008). Of course Michael McGrath had already left Pakistan at this time. The curious thing is that he made a once in a lifetime trip to the US for three months in 2009 which he talks about in both versions. In one version his contacts with SC happened before it while in the second they happen after it which really means his testimony is for the birds. From his statements it seems that he wasnt tortured (he describes his treatment by ISI to the commission). This would explain a lot. In other words, his original statement suited ISI very well so they didnt bother to dig deeper for the truth. On my instructions Hassan asked General Nadeem to give an honest assessment as to what he thinks our chances are of surviving this. He said he felt confident that with the answers we will give to the questions proposed, he could convince the other commission members to go with the facts rather than the content of Afridis statement. Im not sure I share his optimism but we will see.

He also advised to fight the expulsion of our expats. He felt if we did not do this and the expats left that the ISI would then move quickly to close down the country program before the Commission report comes out.

I contacted the Dutch Embassy, ECHO/EU, the Swedish Embassy and the British High Commission to get them to intervene. As a result the British High Commission are jumping in to action and will decide first thing Thursday morning who to approach in the government (either MoI or MoFA). None of the Ambassadors are around at the moment but the Acting Dutch Ambassador got together with the acting EU delegate this evening and have even brought in the Dutch Ambassador. They have already contacted the adviser to President Zardari who is concerned and asked them to provide details of the scale of SCs activities in country, staff size and beneficiary numbers. I have already provided this information to them and advised them to coordinate with the British in the morning. I have yet to hear back from the Swedes but I only emailed them at 5.00pm this evening. A member of the special branch visited our office at 5.30pm this evening and spoke to me. He was polite and wanted to know how we were getting on with our plans to evacuate our staff. I told him we had asked in writing for an extension and we had no plans to evacuate until we got an answer. He suggested that I go and see the Assistant General of Islamabad Police on Thursday morning. I will be called when he is available and intend to go and discuss the situation with him.
An update of tomorrows events will be given on the CMT call tomorrow.

To reference a point from an earlier email - He said to Hassan that he would provide one copy of all relevant documents (the section of the Chief Justices report relevant to us, and Afridis testimony) for a period of three days so that we could review this point per point.

I wonder about the potential for legal issues if we were found in possession of a pages from a yet unreleased report which one would assume to have Top Secret classification and involving (in the authorities parlance) a matter of National Security. Although our situation looks quite bleak we need to be careful the contacts altruism doesnt exacerbate our position and hasten the endgame even further.
Maybe we should canvas our legal advisor on this. Its important we know the content to phrase our questions accordingly but is it wise to be in possession of the documents described? Best regards,

Hi All

The SMT met this morning and for a while we considered trying to get a legal stay order on this action taken by the Ministry of Interior. However, ultimately while we felt this may provide us with a few extra days, our lawyer advised that the MOI would come back and cite reasons of national security and that would be the end of that. So (despite how satisfying it was for me to write the draft letter last night) we are going for a polite letter to ask for a three to four week extension on the deadline that would allow our expatirates and their children leave the country in an orderly manner. The reason for this is there does not seem to be any way out of this with the only possible negotiating point being the date of departure of expats. Last night I did not get the chance to speak to Qadri, who also visited our friend with Hassan, but he briefed the SMT this morning that the version of report written by the Chair of the Commission that he saw last night was completely different than the one he saw in early June. The latest one was much more strident in its condemnation of SC while the earlier one did not mention expelling the organisation from the country. Another difference was that in June there were four versions. Now there are only two versions, the consensus one of three commission members and General Nadeems one. The SMT feels that the establishment is moving forward to finally expel SC and all its registrations from the country (and we must remember here that the original ISI letter also cancelled the process of the SCI registration) and the report, which we originally thought would be our saviour, will be the tool for this expulsion. It is felt that getting the expats out now is paving the way for a more trouble free expulsion in a month or two months time as there will be no expats around to go lobbying in embassies or talk to international media etc. My own personal view is that this is a reasonable assessment of the situation. Our immediate strategy will be twofold. First as per last nights email we will do our best to work with our friend and try and get our responses in before the report is finalized. We will continue to do everything in our power to avoid the expulsion of Save the Children from Pakistan. We would encourage the Special Envoy to get here as soon as possible as the window for meeting the senior people who may be able to help us seems to be rapidly closing. Second we should prepare a plan B in the event of expulsion. This afternoon we are sitting with our lawyer to analyze the process of registering SC as a local organization (as a new member if you will). We believe that the process here can be completed in four weeks. It would be good to know from the centre and HO how feasible would it be to get this local organization recognized as a member in such a short time?

He advised the CO has received a letter stating that all Save the Children expatriate staff visas for Pakistan have been cancelled. The expatriates have 15 days to exit the country. The reasons for the letter are not particularly clear at the moment. The letter is however dated 12 days ago and staff need to leave by end August 2012. David has called an SMT meeting and will contact with additional information shortly. They were of course going to begin immediate enquiries to establish reasons and try to ward this off, or at least delay the action, by a few days.

The letter is dated 2 days after the recent issuance of the multiple entry visas for David and his family.

At present there are two expatriates David, his wife and 2 dependants and Moustafiz with his family of three in country. Three other expatriate are out of country and dont have valid visas at present. One, Alex Gray was due to receive a new visa today. Assuming the new visa is issued he will likely return as planned and simply test the water on being allowed to return.

I dont know if any other agencies have received similar notifications.

We could only speculate why this action comes now prior to the release of the report. We can assume the resource we have was probably unaware of the letter or couldnt share the details earlier for fear of jeopardising his own position.
