Licensee or Reseller grants to End User a non-exclusive, nontransferable, perpetual right and license to use the Data on a single Product. 2. Ownership of Data. End User acknowledges that Reseller or Licensee or their respective licensors and/or suppliers retain all right, title and interest in an d to the original, and any copies, of Data which is incorporated into the Produc t. Without limiting the generality of the foregoing, End User agrees not to: ( i) modify, port, translate, or create derivative works of the Data; (ii) decompi le, disassemble, or reverse engineer, underlying user interface techniques or al gorithms of the Data by an means whatever, or disclose any of the foregoing; or (iii) knowingly take any action that would cause any Data to be placed in the pu blic domain. 3. CONSEQUENTIAL DAMAGE. IN NO EVENT SHALL INTRINSYC OR ITS RESELLERS OR THEIR RESPECTIVE LICENSORS OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSQU ENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OR REVENUES AND LOSS OF PROF ITS, EVEN IF LICENSEE OR RESELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DA MAGES. 4. WARNING: As essential condition of this Agreement, you End User shall conside r and accept that in spite of the accurate research, development and drawing by Licensor, the digital maps constitutes only an informative indication and not a navigation device: you can not rely in such indications as a sole information so urce for driving a vehicle or decide about your course. You shall be aware that because changes in the road infrastructure, new regulations, actual weather, con struction projects, traffic conditions or other events, the road conditions can differ from the information on the digital maps or the itinerary suggested by th e equipment can turn into impracticable or inconvenient. In consequence, Licens ee and they Licensor (a) warn you about that using the digital maps, you shall c heck the real environment to verify the accuracy of the data, before to take a d ecision based on the digital maps and/or the related information; (b) in all the measure consistent with applicable law, they disclaim express and implied warra nties, including the implied warranties of fitness for a particular purpose and merchantability, specifically stating that Licensee and their licensors can not give to you any warranty in the sense that the digital maps and/or the related i nformation contain no errors nor that the digital maps will work in any and all situation providing reliable and useful information.
