Whereas defined pursuant to: Sec. 3. Records as property of State. (a) All records created or received by or under the authority of or coming into the custody, control, or possession of public officials of this State in the course of their public duties are the property of the State. These records may not be mutilated, destroyed, transferred, removed, or otherwise damaged or disposed of, in whole or in part, except as provided by law. Any person shall have the right of access to any public records, unless access to the records is otherwise limited or prohibited by law. Whereas defined pursuant to: Sec. 11. Violation. All records made or received by or under the authority of or coming into the custody, control or possession of public officials of this State in the course of their public duties are the property of the State and shall not be mutilated, destroyed, transferred, removed or otherwise damaged or disposed of, in whole or in part except as provided by law. Any person who knowingly and without lawful authority alters, destroys, defaces, removes, or conceals any public record commits a Class 4 felony. (Source: P.A. 92-866, eff. 1-3-03.) Whereas defined pursuant to: Sec. 5-8-1 (a)(7) provides that the term of incarceration for a Class 4 felony is ordinarily between one and three years. Whereas pursuant to: Sec. 5-9-1(a)(1) ordinarily provides for fines of up to $25,000 for felonies, except that corporations may normally be fined up to $50,000. Whereas defined pursuant to: Sec. 13. Whenever the condition of the bond of any public officer is violated, action may be instituted on the bond, and prosecuted to final judgment against the officer, and any or all of the sureties, or against one or more of them, jointly and severally, without first establishing the liability of the principal by obtaining judgment against him or her alone. All attorneys and counselors at law, judges, clerks and sheriffs, and all other officers of the several courts within this state, shall be liable to be arrested and held to bail, and shall be subject to the same legal process, and may in all respects be prosecuted and proceeded against in the same courts and in the same manner as other persons are, any law, usage or custom to the contrary notwithstanding: Provided, nevertheless, said judges, counselors or attorneys, clerks, sheriffs and other officers of said courts, shall be privileged from arrest while attending courts, and whilst going to and returning from court. Any person may arrest another when he has reasonable grounds to believe that an offense other than an ordinance violation is being committed. (Source: Laws 1963, p. 2836.) Whereas defined pursuant to: a private person does not have the authority or legal protections that are often applied to the Police. A Private Person is liable under both Civil and Criminal law for the violation of the rights of another. Reserving all Powers and having reason to believe you, officer so and so, Senator so and so, prosecutor so and so, court clerk so and so, or agent, .... Etc. have committed or are committing fraud and other felonies and high crimes which are considered federal offences, hereby place you under arrest take you into custody until such time as I may turn you over to other authorities for indictment and trial. You have the right to remain silent, anything you say may be used against you in a court of law, you have the right to council, if you cannot afford council you may be appointed one by the State. This act in accordance with the following U.S. Supreme Court Annotated Statute: Hale v. Henkel, 201 U.S. 43 at 47 (1905). "The individual may stand upon his constitutional rights as a citizen. He is entitled to carry on his private business in his own way. His power to contract is unlimited. He owes no such duty [to submit his books and papers for an examination] to the State, since he receives nothing therefrom, beyond the protection of his life and property. His rights are such as existed by the law of the land [Common Law] long antecedent to the organization of the State, and can only be taken from him by due process of law, and in accordance with the Constitution. Among his rights are a refusal to incriminate himself, and the immunity of himself and his property from arrest or seizure except under a warrant of the law. He owes nothing to the public so long as he does not trespass upon their rights."
