The facts supporting this belief are as follows: On July 10, 2013 at approximately 3:30 a.m., the defendant was driving a Ford 500 with three passengers. While pursuing the motor vehicle being driven by T.J. at a high rate of speed, the three passengers with the defendant shot multiple times at the vehicle being driven by T.J. In the vehicle with T.J. were S.F., T.S. and T.S. One of the bullets shot from the car the defendant was driving struck and killed nine year old T.S.
