the plaintiff, and unto this Honorable Court, most respectfully avers: 1. That plaintiff is of legal age, Filipino citizen, single, and a resident of #143 Daing Labot Street, Daraga, Albay; 2. That defendant B, of legal age, Filipino citizen, single, a resident of #144 Daing Labot Street, Daraga, Albay, where he may be served with summons and other processes by this Honorable Court; 3. That the subject apartment was owned by the plaintiff as evidenced by Original Certificate of Title No. OT-512626 under the name of the former. Copy of the Original Certificate of Title is hereto attached as Annex A; 4. On June 25, 2009, plaintiff offered defendant to rent the said apartment with an agreement that the latter will pay A an amount of P3,000.00 per month that is good only for two (2) years. Copy of said agreement is hereto attached as Annex B; 5. That after the lapse of two (2) years, defendant has been still occupying the said premises up to present; 6. That despite repeated demands orally and in writing, defendant refused and continuously failing to vacate the said premises; 7. That as a result of the unwarranted and unjustifiable refusal of the defendant to vacate the aforesaid premises/apartment, plaintiff cannot make use of his apartment for rental Civil Case No. 12345 For: Unlawful Detainer

business up to present and suffered sleepless nights, serious anxiety in which he should be awarded the amount of P30,000.00 as moral damages, and to set an example to the public, plaintiff should be awarded exemplary damages in the amount of P30,000.00. WHEREFORE, premises considered, it is most respectfully prayed unto this Honorable Court that, after hearing, judgment be rendered as follows: 1. Ordering the defendant to vacate the subject premises/apartment; 2. Ordering the defendant to pay the amount of P3,000.00 per month as compensation for the reasonable use of the subject apartment/premises until they finally vacate the said apartment/premises; 3. Ordering the defendant to pay the plaintiff the amount of P30,000.00 as moral damages, and P30,000.00 as exemplary damages; 4. Ordering the defendant to pay the cost of the suit.
