Live at EEE Hartford, Connecticut 3. ‘The Respondent is the City of Hartford, Department of Publie Works (“DPW”) Director Kevin Burnham, DPW Deputy Direetor Rhonda Carroll, DPW Senior Project Manager India Cicero, and DPW Director of Architects Tony Matta. The City of Hartford's address is 550 Main Street, Hartford, Connecticut. 4, Bor the most of the past 180 days, I have been constantly discriminated and retaliated against sive Twas physically ns EE I 2 (2 2225¢ episode of discrimination and retaliation occurring on June 7, 2013. This retaliation has consisted of my employer forcing me to do work not in my job description, my employer not paying me appropriately for the work that I do, my employer giving me poor performance ratings, threatening my job, my employer creating a hostile work environment for me and dumbing-down my work. These combined, explained in detail below, form the basis of this complaint. 5, [believe that my ethnicity and national origin (Puerto Rican), my color (black), and my gender (female) and my asserting my First Amendment rights in speaking out against the discrimination that I have faced, were in part factors in this discrimination. 1 believe that the Respondent violated the following Connecticut General Statutes and Acts of Congress listed below: CGS. §31-75 CGS. §46a-58(a) C.GS. §46a-60(a)(1) C.GS. §462-60(a)(4) CGS. §460-60(a)(8) CGS. §460-64(@)(1) CGS, §460-64(a)(2) ‘The Equal Pay Act of 1963 Title VI of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000E and ‘The Civil Rights Act of 1991 (15 or more employees) COMPLAIN FC I moved into the former Energy Manager Mr. Donald Blakelock's desk on the fourth floor of 525 Main Street, Hartford, CT. On January 10, 2013, T began to clean out his desk and computer I inherited. 2. searched Mr. Blakelock’s computer for his energy data files, and instead I found on his city-owned work computer pornographic images of young women. 3. This discovery of pomographic images made me deeply uncomfortable as a woman, and { scrubbed the keyboard and chair and computer and whole area because it felt unsanitary and it made se feel unwelcome, 4, showed some of the images to Tiana Glass, a co-worker in DPW and asked her if it ‘was normal in DPW to experience this. She said “Oh my God!” She was shocked by this. 5. Leould not find any of the energy files Mr. Blakelook had worked on. I called Metro Hartford Information Services (MHIS) to see if MHIS could retrieve any energy data from Mr. Blakelock’s computer. 6. OnFriday, January 11, 2013, Paul Salo from MHIS visited my cubicle and erased the pomographic images from my computer, He could not retrieve any energy data files. Paul Salo was shocked by the pomographic images, and noted “Oh, that's how he spent his time.” 7. As Twas cleaning out Mr. Blakelock’s desk and organizing the paper files Mr. Blakelock left, [ found time cards, pay stubs and other information indicating Mr. Blakelock held a second job at Home Depot. The information showed Mr, Blakelock left his DPW position several hours early on an almost-daily basis to work at his second job. 8. [brought this new information to Mr. Burnham's ditect attention on Tuesday, January 15, 2013. He was shocked by this, and I don't think he knew what to say, I do not know what Mr. Burnham did with this information, but [ never heard anything from him about it.I did not save any of this paperwork showing Mr. Blakelock's second job, [did not realize that by bringing this to Mr. Burnham, I was blowing a whistle on poor management and oversight of Mr, Blakelock, and that because he had gotten away with it for so long, the discovery of his moonlighting reflected poorly on the management team who oversaw Mr. Blakelock. 10. On January 9, 2013 at 11:36 AM, Jared Kupiec sent me an email, ce'ed to Mr. Burnham, noting I was in a new position, and asking me to “tackle the development of a comprehensive, long- term energy plan/strategy.” 11. A true and correct copy of this email is attached as Exbibit 1 12. On Wednesday, January 9, 2013 at 12:32 pm, Mr. Burnham's assistant set up a meeting for January 23, 2013 with myself, Mr, Burhman and Councilman Macdonald to review solar energy opportunities. 13. Atrue and correct copy of this email exchange is attached as Exhibit 2. 14, It was clear that everyone around me in DPW understood my role to be Energy Manager, which was Mr. Blakelock's title. 15. As part of my duties, Councilman Macdonald directed energy companies to meet with me. 16. On Wednesday, January 9, 2013 at 5:06 pm, Councilman Macdonald directed Victory Energy Solutions! Raquel Kennedy to meet with me along with Diana McCarthy of CL&P, whom I met with on January 11, 2013. 17. Attrue and correct copy of this email is attached as Exhibit 3. 18, On Friday, January 11, 2013, I met with Mr, Burnham on energy issues, and he said that I should ask Mr. Kupiee if he received any energy-related emails on Don Blakelock’s behalf. I did as asked. Mr, Kupiec responded on January 13, 2013 at 10:33 am that he had sent me all the data he had received, including documents from Tom Swarr and others. 19. — Atrue and correct copy of this email chain of correspondence is attached as Exhibit 4. 20. On Tuesday, January 15, 2013, I met with Mr. Burnham to discuss my role as Energy Project Manager and my salary. I told Mr. Buraham I found myself assuming many of the same responsibilities as Mr. Blakelock. I followed-up our conversation with an e-mail on January 17, 2013 at 8:51 am, and I said I looked forward to diseussing my compensation with Mr. Burnham in the future. 21, A true and correct copy of this email chain of correspondence is attached as Exhibit 5. 22, On Wednesday, January 16, 2013 at 10:18 am, Mr. Kupiec, in email communication with a vendor again identified me as the person who “manages energy policy for us.” 23, Atrue and correct copy of this email chain of correspondence is attached as Exhibit 6. 24. On or about January 23, 2013, I tried to have a conversation with Mr. Matta about my compensation for being the Energy Project Manager. I told Mr, Matta 1 was willing to accept $70,000.00. 25. Mr. Matta told me verbally I would get a raise to $60,000.00. 26. — This raise never materialized. 27. As part of my duties as Energy Project Manager, I was scheduled to meet again with Councilman David MacDonald on Wednesday, January 23, 2013 to provide him with updates of potential solar roof energy opportunities that I had researched, available to the City (see Exhibit 3) 28. On January 23, Councilman Macdonald and I met with Mr. Burnham and Mr, Matta to discuss potential solar opportunities is recognized as the Zero Renewable Energy Credits (ZREC) program. 29, Atrue and correct copy of the agenda that I prepared for this meeting is attached as Exhibit 7. 30, Inmy role as Energy Manager, Mr. Matta asked me questions about how other cities handled energy policy issues. For example, on Wednesday, January 23, 2013 at 9:42 am, Mr. Matta asked me to determine what other similar cities used Utility Management Software. 31. A true and correct copy of this email is attached as Exhibit 8. 32. On January 24, 2013 at 7:48 am, Mr. Matta sent me an email congratulating me on a great job at the ZREC meeting with Councilman Macdonald, He wrote: “We're off to a great start on energy issues.” 33, A true and correct copy of this email is attached as Exhibit 9. 34. On Thursday, January 24, 2013 at 8:01am, Mr. Matta invited me to a Special Education Committee meeting for January 28, 2013 at 5:30 pm. This email contained job duties related directly to my role as Energy Manager. 35. A true and correct copy of this email is attached as Exhibit 10. 36. On Wednesday, Jarmary 30, 2013 at 4:21 pm Mr. Kupiec asked me if I wanted to work with an energy supplier. That he gave me the discretion to determine if | wanted to pursue this contact showed how the City assigned me management duties, yet I was not remunerated for such diseretion. 37. A true and correct copy of that email is attached as Exhibit 11 38. On Friday, February 1, 2013 at 6:12 pm, Mr. Kupiec congratulated me on “Good work” with a vendor 39. A true and comeet copy of that emnail is attached as Exhibit 12. 40. On Monday, February 4, 2013 at 4:49 pm, as part of my job as Energy Manager, I emailed Mr. Burnham and Mr, Matta about setting up a meeting with a third party energy supplier. AL. Per the request of both Councilman Macdonald and DPW, I communicated and met directly with Councilman Macdonald about energy-related issues. 43. On Tuesday, February 5, 2013 at 9:45 am, I emailed him about a potential energy reduction pledge that could make its way to City Council, among other energy related issues. 44, A true and correct copy of this email is attached as Exhibit 14. 45, My role as Energy Project Manager demanded I communicate and schedule meetings directly with vendors. 46. On Thursday, February 14, 2013, at 11:18 aml reached out to CL&P/Northeast Utilities ‘Company as part of my task to draft the Strategic Energy Plan. 47. Atrue and correct copy of this email is attached as Exhibit 15. 48. On Wednesday, February 20, 2013 at 8:55 am, I communicated with another vendor, Automated Logic, regarding Energy Reporting systems. 49. A true and cottect copy of this email chain of correspondence is attached as Exhibit 16. 50. On Thursday, February 21, 2013 at 2:25 pm, I reached out to Mr. Burnham to follow up on my email of Thursday, January 17, 2013 (Exhibit 5), seeking to discuss my compensation with DPW. His assistant informed me he was on vacation and would respond when he returned, 51 ‘A true and correct copy of this email is attached as Exhibit 17. 52. Mr. Burnham never responded to this email, nor followed up with me upon his return from vacation. 53. On Thursday, February 21, 2013 at 5:30 pm, T sent an email to Mr. Bumbam and Mr. Matta explaining Mayor Segarra sought an update on the potential energy plans for the City, as these plans related to Governor Malloy's 2013 statewide Energy Plan, I explained the three of us should meet before talking with the Mayor. 54. A true and correct copy of this email is attached as Exhibit 18. 55. Onor about Monday, February 25, 2013, I asked Mr. Matta for an update regarding my raise and he informed me Mr. Burnham said I would get a raise to $50,000. 56. This was frustrating to hear that I had been promised $60,000.00, and now my raise had been reduced by $10,000.00, yet I knew I was doing the same work as my white male predecessor. 57. This raise has never materialized. 58. It was frustrating and aggravating to me to know that I, a black Puerto Rican female, was doing the work I was assigned to, but not receiving the same pay as my white male predecessor. 59. As Energy Project Manager, Mr. Matta tasked me with working on Purchase Orders, as in his email of Monday, February 25, 2013 at 8:09 am. 60. A true and correct copy of this email is attached as Exhibit 19. 61. Stacey Willis is a DPW clerk, classified as an Administrative Assistant. One of her main functions is to process energy bills. The City's Department of Human Resources has fabeled her an Administrative Assistant. 62, Atrue and correct of her job description is attached as Exhibit 20, 63. ‘The City's Department of Human Resources has also labeled her an Administrative ‘Analyst. 64, Atrue and correct copy of this job description is attached as Exhibit 21, 65. Aregular business practice in DPW was for Stacey Willis and Jose Carrasco, another clerk who processes energy bills, to provide Don Blakelock with copies and monthly reports of the energy bills they processed. 66. InFebruary, India Ciceto, Stacey Willis’ supervisor, began providing me with copies of these processed energy bill reports for my own analysis, as Energy Project Manager. 67. On Monday, February 25 at 10:45 am, I again followed-up with Mr, Burnham: on my previous email communications of January 17, 2013 and February 21, 2013, seeking to discuss my compensation at DPW. 68, A teue and correct copy of this email is attached as Exhibit 22. 69. Mr. Burnham never responded to this email, and 1 grew frustrated at the lack of communication from DPW regarding my salary. DPW did not seem to care or be concerned about my morale, and the fact that was doing my white male predecessor's job, and well, but was not getting paid was making me angry and frustrated. 70, An architecture firm sought to meet with the City of Hartford to discuss the history of an energy incentive study, and on Thursday, February 28, 2013 at 8:25 am, DPW Architect Dan Haim forwarded the request to me, among others, explaining to the architecture firm that “T am not nearly as familiar with the energy incentive program as the other participants.” 71, Atrue and correct copy of Mr. Haim's email is attached as Exhibit 23, 72. On Tuesday, March 5, 2013 at 9:36 am, I asked Mr, Matta to email me a copy of my job deseription from December 17, 2012, which he and Mr. Burnham had initially provided me with. He did so, confirming that this was my role and my position in DPW. 73. Atrue and conrect copy of this email exchange confirming my roles and responsibilities in DPW is attached as Exhibit 24. 74, Part of my job as Bnergy Project Manager was to educate City Department Directors on energy issues. 75. To convey a clear message, knew I could lear from the key players in the energy field 76. [researched various industry groups and attended energy-related conferences and workshops as much as T could, At the CT Power and Energy Society Conference, I met Governor Malloy's Energy Commissioners and introduced myself to solar installation vendors~ representing the City in this high-level meeting regarding energy management. 77. Tbegan attending West Hartford's Clean Energy Task Force meetings. I reached out and met with other governmental groups such as the State Department of Energy and Environmental Protection, the CT Conference of Municipalities, the Office of Energy Efficiency Businesses and PURA (Public Utility Regulatory Authority) Commission, I also reached out to the Federal Department of Environmental Protection and the Federal Department of Energy. 78. Twas instructed by Mr, Matta to meet with equipment suppliers such as Automated Logie, Strategic Building Solutions, to keep abteast of new products and current energy work that we would be collaborating on, 79. researched and submitted grants, rebates and national award programs on energy efficiency and environmental sustainability. 80. When potential energy vendors contacted the City, DPW and other departments would direct them to speak to me because of my task as Energy Project Manager. For example, I began arranging meetings with potential vendors such as Johnson Controls & Noresco, 81. [decided to follow-up with one of the vendors, Paul Popinchalk of Celtic Fnergy, after seeing him at a PURA meeting and at the West Hartford Clean Energy Task Force meeting, of which Paul was a member of. 82. After attending the West Hartford Clean Energy Task Force mecting, Paul tokd me about the Clean Energy Finance and Investment Authority (CEFIA). At his suggestion, I attended a workshop on CEFIA's energy efficiency financing opportunities for municipalities. ‘This set in motion a project that Mr, Blakelock had never been able to accomplish, a potential CL&P grant using ZREC etedits to retrofit a school building with solar panels. 83. My desire to learn more, fueled my interest to meet with other potential partners such as CL&P and the Connecticut Conference of Municipalities. The more conferences I attended and the more contacts I established, the more I assembled pieces of the puzzle. 84, Despite my numerous requests to meet with Mr. Burnham about my compensation, he never responded to me. | felt like this action was not him just ignoring, but discriminating against me in the male dominated world of the DPW. If Twas a white man, Mr, Bumham would have met with me, 85. On Mareh 7, 2013, at 2:00pm, I met with Mayor Segarra to get his feed-back in reference to a Green Action Team meeting that occurred earlier that day. After getting feed-back on GAT items, [used the opportunity to discuss my eurrent position as a Policy & Research Analyst and ry Project Manager in DPW. 86. Since [had a good working relationship with the Mayor previously, and he was one of the people who initiated my transfer to DPW, my professional judgment led me to believe it was appropriate to discuss with him the imbalance in my responsibilities and discriminatory compensation in DPW. 87. [also took the opportunity to explain to him some of the travails I had encountered, including my discomfort with my discoveries of the pornography on the computer and of the evidence showing Don Blakelock was working at Home Depot on City time. 88. I gave hima copy of Don Blakelock’s job description, where T numbered his roles and responsbilities, and compared it with my roles and responsibilities as Energy Project Manager and Energy Policy Researcher and Analyst. 89. [prepared a short video demonstrating how my and Mrr. Blakelock's roles overlapped, and showed this to the Mayor, to convince him I deserved more compensation. 90, A true and correct copy of screenshots of the video are attached as Exhibit 25. 91. Linformed the Mayor how much I welcomed the new opportunity and enjoyed the work Iwas doing as Energy Project Manager, but did not comprehend why I was not being compensated accordingly given that my duties overlapped exactly with Mr. Blakelock’s job description, 92. Itseemed clear to me at that time that DPW was discriminating against ne. 93. 1 did not realize at the time that by bringing my concems to the Mayor, someone whotn I knew and trusted, that DPW would use it as an opportunity to retaliate against me. 1 think it was perceived in DPW management that this conversation with the Mayor made me a disloyal snitch. 94, On Monday, March 11, 2013, the DPW instituted a new policy requiting all DPW employees to sign in and out if they were going fo be gone for more than 15 minutes. I took this remedial measure as a sign that the Mayor had listened to me in the March 7, 2013 meeting, and had spoken with DPW management, including Mr. Burnham, about the situation. It appeared to me DPW now sought to insure that no one else was cheating the City out of time. 95. However, after my March 7, 2013 meeting with the Mayor, the DPW, Mr. Burnham, Mr Matta, Rhonda Carroll and India Cicero began to retaliate against me, and created a hostile work environment for me. This added to my stress and frustration at not being paid what my white male predecessor was being paid. 96. On March 12, 2013, Mr. Matta and DPW Senior Project Manager India Cicero met with me to outline new roles and responsibilities for me. 97. Atrue and correct copy of these roles and responsibilities is attached as Exhibit 26. 98. Atthis meeting, Mr. Matta and Ms, Cicero instructed me to no longer use the Energy Project Manager title. 99, ‘They told me that specific title had shifted to Dan Haim, a DPW City Architect III. Mr. Haim is a white male with no background in energy policy or environmental studies, and he has admitted to me and others that he has no energy policy or environmental studies work experience. The DPW's shift to him of my duties signaled a racial and gender proference that is part of the discrimination against me, 100. Stripping me of this title was in direct retaliation for my conversation with the Mayor, Seven days earlier, on March 5, 2013, (Exhibit 24) Mr. Matta confirmed I was the Energy Project Manager. After my conversation with the Mayor, DPW director Kevin Burnham and Deputy Director Rhonda Carroll wrongly attempted to punish me for my bringing to light the discrimination I was dealing with as a woman of color, and I was essentially demoted, and { was entered into a hostile work environment . 101, Mr. Matta and Ms, Cicero informed me per the specific request of DPW Deputy Director, Rhonda Carroll, my primary role as Policy and Research Analyst would be to review and process energy bills, when previously, I had been given the reports of clerks who processed bills to analyze the bills. 102. This dumping of clerical work on me was in direct retaliation for my attempts to achieve gender and racial pay equality 103. Upon information and belief, Mr. Burnham, Ms. Carroll, Mr. Matta and Ms. Cicero discussed how to punish me for my perceived transgression of discussing with the Mayor my pay problems within DPW. 104, Mr. Matta and Ms. Cicero further informed me that should I have a problem to report it directly to them and not to the Mayor's Office, 105. A true and correct copy of the minutes of this meeting produced by Mr, Matta, indicating this shift in duties is attached as Exhibit 27. 106, At this meeting, Ms. Cicero told me the City let Mr. Blakelock go because he was not doing his job of processing energy bills. For the three months prior to my conversation with the Mayor, DPW never mentioned to me at all that Mr. Blakelock processed energy bills, or that I would have to process energy bills as part of my job description. In fact, Lhad discussions with vendors about ways to utilize technology to help the City save money in processing enesgy bills. Yet now, DPW assigned me busy work not compatible with my educational background because I sought to curb the discrimination Iwas enduring. 107. After this meeting, I began keeping a diary of notes, because I was frustrated by this situation, It was clear to me J was being retaliated against and harassed for secking gender and racial pay equality in the workplace. 108. In my notes from March 12, 2013, I wrote that Ms. Cicero told me the City let Mr. Blakelock go because he was not doing his job of processing energy bills. 109. A true and correct transcription of my conversation notes, beginning on March 12, 2013, is attached as Exhibit 28 110. On Wednesday, March 13, 2013 at 8:42 am, I emailed Mayor Segarra wondering if there vas a misunderstanding in DPW's reassignment of my roles and responsibilities. 1 wrote: “T do not ‘want to relinguish any of the current responsibilities that come with my position. J have been performing all of these ata high level and I am grateful for the opportunity. The issue has never been the responsibilities, itis instead that I have not been compensated accordingly.” 111, Attrue and correct copy of this email is attached as Exhibit 29. 112. The Mayor never responded to my email, and the retaliation and harassment and hostile work environment has worsened since that point. 113. On March 14, 2013, I presented an energy project update to Mr. Burnham, Mr. Matta and Mr. Haim, 114, A true and correct copy of the agenda for the Energy Updates meeting from March 14, 2013 is attached as Exhibit 30. 115. When I concluded that presentation, I gave Mr. Burnham and Mr, Matta the same presentation I gave the Mayor on March 7, 2013 (see Exhibit 25). 116. Tagain asked for a salary and for compensation comparable to that of Mr. Blakelock, the white male who preceded me in this task and the fact that my raise had never materialized. Mr. Burnham indicated I did not have the role of Energy Project Manager anymore. 117. Atthis meeting, I said that if they were not going to compensate me for the work that did which overlapped exactly with with Mr, Blakelock's responsibilities then, they still needed to review a fair salary compensation for me. 118, I shared with them the fact that City employees whose main task is solely to process energy bills for example one such employee for DPW- Stacey Willis, and for the Board of Education- Flizabeth Demonte, make $57,000 and $58,000 annually; $13,000 and $14,000 more than I make. 119. Atrue and correct copy of Elizabeth Demonte's job description is attached as Exhibit 31, Stacey Wil is! job descriptions are attached as Exhibit 20 and 21 120, Mr. Bumham told me my job duties were primarily focused on energy bills, as an invoicing clerk, I was certain DPW assigned me the clerk duties in retaliation for my speaking out against the discrimination, and I still was not being compensated at a level of other clerks whose main responsibility itis to process energy bills. 121, On Thursday, March 14, 2013 at 8:10 am, I received an email from Mr, Matta allowing me to continue to participate in the Green Action Team. 122. A true and correct copy of this email is attached as Exhibit 32. 123. On Friday, March 15, 2013 at 3:45 pm, Mr. Matta sent me a copy of my new roles and responsibilities as detailed in the March 12, 2013 meeting, and minutes from the March 12, 2013 meeting. These both stress that my new job is to review and process energy bills. 124. A true and correct copy of this email is attached as Exhibit 33. 125. Awhite man would not have been demoted from the role of Energy Project Manager and assigned clerical tasks inconsistent with his educational background in retaliation for discussing the DPW's failure to compensate him adequately for his work as Energy Project Manager, 126. This situation was stressful, and began to impact my health and well-being. 127. I did not realize at the time when I spoke with the Mayor on March 7, 2013, that the DPW would retaliate against me for seeking to get adequate compensation for the work I was doing, It is my firm belief that I am now in danger of being terminated. 128. DPW continues to retaliate against me, harass me, humiliate me, and subject me to a hostile work environment. This undue stress is damaging to me, 129. On Friday, March 15, 2013 at 2:06 pm, consistent with my reassignment, when an energy vendor contacted me, I directed them to Dan Haim and explained that some of my responsibilities as Energy Project Manager had been sent to him. 130. Atrue and correct copy of my email correspondence with the vendor is attached as Exhibit 34. 131. [felt humiliated and powerless to have to tell people J respected (and whose respect L folt | had earned) that I had lost professional responsibilities. Yet I could not explain to them the real reason I had lost these responsibilities. If Thad explained to vendors how my DPW supervisors retaliated against me because T told the Mayor I was not being paid equitably in line with my my white male predecessor, who viewed pornography and worked at Home Depot on City time, it would have damaged the City's ability to do business with these vendors. 132. Tried to maintain professionalism despite the hostility 1 was experiencing from my supervisors. 133. On Tuesday, March 19, 2013, I met with Stacey Willis so she could train me in bill processing, She told me Mr, Blakelock never processed energy bills, nor was he assigned to. He only analyzed them. See Exhibit 28, Her statements contradicted India Cicero's statement from March 12 that Don Blakelock was fired for not processing energy bills. 134. Uncove 1g misrepresentations from my supervisors made me feel even more that I was being targeted for my efforts at pay equality. 135. On Wednesday, March 20, 2013 at 3:08 pm, Tom Swarr, an energy efficiency expert and community stakeholder, unaware of my demotion, sent me an email saying: “you are already ahead of Don's efforts! Hang in there.” 136. A true and correct copy of this email is attached as Exhibit 35 137. On Wednesday, March 27, 2013, I called a meeting with Jose Sanchez, the City's Budget Director, along with Mr. Burnham, Mr, Matta and others to discuss the CEFIA solar panel grants. At the conclusion of the meeting, Mr. Sanchez said he saw my salary in the budget documents, and he said that my compensation did not adequately reflect my skill level. However, Mr. Sanchez said there was nothing he could do to help increase my compensation, (See conversation notes in Exhibit 28) 138. At my 90 day job review on March 28, 2013, Mr. Matta graded my performance a three out of five (five being the highest). 139. A true and correct copy of the performance review completed by Mr, Matta is attached as Exhibit 36, 140. Nowhere in this review does it say that I work under the auspices of three competing job descriptions, 141, Mr, Matta told me I had problem prioritizing getting work done, and I thought this was ‘unfair, and I thought that my supervisors were beginning to create a paper trail to justify firing me. 142. [informed Mr. Matta the evaluation did not reflect the fact that I had received three different job descriptions since I began on December 17, 2012. 143. Mr. Matta said I needed to focus on DPW issues. I received low scores for not focusing ‘on DPW issues. This low score was more retaliation because [ objected fo the energy billing duties that were not listed in my December 2012 job when the Mayor transferred me. 144. DPW assigned me the energy billing duties as punishment for me exercising my First ‘Amendment rights in discussing the issues of the discrimination and harassment I was dealing with. 145. When discussing roles and responsibilities in DPW on March 28, 2013, Mr. Matta said to me: “I'm sort of kind of like your master.” 146. took extreme offense to this statement, as Mr. Matta would never likely make this statement to a white male in the DPW. 147, asked him directly ifhis position as master meant I was a slave, 148. He said no. 149, I did not feel I was being treated fairly, and | felt that this hostile work environment was unfair and unnecessary, 150. {twas here that I began to feel like DPW was also targeting me because of my age. Iam one of the youngest people in this DPW office, and I felt like Mr. Matta and others perceive me as ignorant or too youthful to understand how the real world works. 151. Mr, Matta would not have said to someone his own age that he was their master. 152, During this meeting, Mr, Matta informed me that as an employee, I was on probation for year. (See conversation notes, Exhibit 28). To me, 12 months of probation meant the City and DPW had an easier opportunity to terminate me. 153. Mr. Matta suggested T could improve my poor performance by teaming up with the Energy Project Manager, Dan Haim, a white male who is older than me. In reality, Mr. Haim often comes to me for help on energy issues, At the risk of repetition, Mr. Haim does not posses a background in energy nor in environmental studies. 154, Later, on April 9, 2013, Mr. Haim told me directly not to rofer to him as Energy Project “Manager because people will assume he has an energy background. 155, Itastonished me that he, as an older white male within the DPW, could object to and determine what titles he would wear during the course of his employment, while my title was malleable, and I was forbidden by my superiors from using certain titles in reference to my job. 156. [began to get trained to do energy billing. This was a stressful process, because I have a master’s degree and was being assigned clerical work, and every moment I was being trained, T was being retaliated against for my pointing out my gender pay discrimination, 157. It seemed to me that India Cicero sought to make the training hostile. 158. On Tuesday, April 2, 2013 at 1:44 pm, Ms, Cicero, who was now my new direct supervisor for energy billing, wrote a stern email critical of my approach (o traning and billing. 159, A true and correct copy of this email is attached as Exhibit 37. 160. On Wednesday, April 3, 2013 at 2:32 pm, I informed another person I was not longer Energy Policy Manager, but that Dan Haim was. 161. Atrue and correct copy of this email is attached as Exhibit 38. 162, Every time I had to do this, 1 grew frustrated, angry, and stressed that I had been retaliated against for seeking to fair and adequate compensation that white men would get. 163, At seemingly every opportunity, I have been given implausible deadlines to meet, and trivial requests are put on high priority in what I perceive as an attempt to ereate a paper trail against me to justify termination, 164, For example, on March 28, 2013, at 10:45 AM, India Cicero asked me a question about the billing on parking deck lights at the Hartford Public Library, and demanded an answer by the end of the moming. Unfortunately, for issues like this, I have to wait for the energy suppliers, like Northeast Utilities, to provide an answer, I could not reply until April 4, 2013, and at which time, I did explain the situation, Furthermore, when I spoke with the person who had asked about the parking deck question, he said the information was not urgent, as opposed to how it was relayed to me by Ms. Cicero. 165. Atrue and correct copy of this email interaction from March 28 through April 4, 2013 is attached as Exhibit 39. 166. Again, I caught India Cicero in a misrepresentation, and this made me feel like the clerk training and the new job description had no justification other than to harass ine and retaliate against me 167. Despite the hostile atmosphere, [attempted to perform my job diligently and professionally, and often stayed late to complete all of my responsibilities. On April 4, 2013, I sent my last email at 7:12 pm, one which directs yet another energy-related issue to Dan Haim. 168. A true and conrect copy of this email is aliached as Exhibit 40. 169, At this point, a problem arose with my timesheets, After ‘he transferred me to DPW, Mr. Bumham and his staff never transferred my time reporting, so that as of Monday, April 8, 2013 at 1:22 pm, I was still on the ffp2yroll, and submitting timesheets to the Office 170. A teue and correct copy of the email exchange with Mr. Kupiec explaining this is attached as Exhibit 41 171. This indicated to me that Mr, Burnham had no intention whatsoever of dealing with my pay. He had been directed by the Mayor's office to deal with my pay and move my salary over to the DPW budget, but never did so, An older white man would not have faced this issue. 172. As part of my duties as Energy Manager, I was directed to create a Clean Energy Tasle Force, Ittook several months, but I did it, and the first meeting was set for April 29, 2013. 173. On April 8, 2013 at 4:20 pm, I communicated with Councilman MacDonald on the issue, and again, I indicated Dan Haim was now the Energy Manager. 174, A true and correct copy of this email is attached as Exhibit 42. 175. introduced via emai] Councilman MacDonald to Dam Haim on Monday, April 8, 2013 at 4:33 pm. 176, Atrue and correct copy of this email is attached as Exhibit 43. 177. Again, this was humiliating to have to tell Councilman Macdonald that I had been stripped of roles, and it made me feel less esteemed in the eyes of a respected elected official. 178. Since DPW assigned me the new primary job focus of processing energy bills, I was unclear about how to handle my responsibilities for researching energy policy. 179. On April 10, 2013, Mr. Matta congratulated me on facilitating a marketing and energy efficiency meeting with various stakeholders. I considered this to be part of my energy policy job. See conversation notes in Exhibit 28. 180. [thas been frustrating and stressful to receive good feedback on occasion, but to then be harassed and targeted. It is diffieult because I never know what reaction my work will elicit, even though I do not feel the quality of my work changes. 181. OnApril 12, 2013 at 3:14 pm, [tried to reschedule bill processing training with India Cicero, At the same time, I asked for clarification on my roles and responsibilities. She responded later that afternoon, and misspelled my name. 182. A true and correct copy of this email exchange is attached as Exhibit 44, 183. Shortly thereafter, I contacted Mr. Kupiee and the Mayor about having to process energy bills because I felt like the constant pressure from Ms. Cicero to process energy bills was harassment and retaliation and not part of my role in DP 184, On April 12, 2013 at 3:53 pm, I emailed Mr, Kupiec and Mayor Segarra asking if the Mayor transferred me to DPW to primarily process energy bills. 185. Mr. Kupiec emailed the DPW telling Mr. Bumham I was not to process energy bills and that processing energy bills was not my priority. 186, A true and correct copy of this e-mail is seen attached as Exhibit 45. 187. Mr. Kupiee also noted that I was not to do Don Blakelock's job either. However, DPW assigned his work to me when I was transferred to DPW. 188. Mr. Kupiec explained to me Mr, Burnham was the department director, and he helped formulate my job description, However, Mr. Burnham's disregard of Mr. Kupiee's orders that I not process energy bills is part ofthis pattem of harassment and disrespect and discrimination. They would not treat an older white man like this. 189. On or about April 16, 2013, I asked Mr. Matta about my raise. He indicated that having, a copy of my work performance evaluation would help them better determine my salary raise. 190. On April 17, 2013 at 9:47 am, I continued to perform my duties as Energy Policy & Research Analyst and communicated with Councilman Macdonald's executive assistant about resolutions for the City Council 191, A true and correct copy of this email is attached as Exhibit 46. 192. On Thursday, April 18, 2013, in an updates from City Hall email, the Mayor's office highlighted my work on urban green spaces as commendable. 193. A true and correct copy of this Updates from City Hall email is attached as Exhibit 47. 194, On April 22, 2013, I met with India Cicero and Mr. Matta to discuss my energy bill processing responsibilities. They reiterated that I was not to focus on energy policy issues, in contrast to the April 12, 2013 email from Mr, Kupiec. I documented this in an email to India Cicero at 6:56 pm. 195, A true and correct copy of this email is attached as Exhibit 48. 196. As of Monday, April 22, 2013, the two time-sheet issue still had not been resolved. Mr. Kupiee had to send an email to DPW demanding DPW fix this. 197, A true and correct copy of the series of emails on this issue is attached as Fixhibit 49. 198. On Thursday, April 25, 2013 at 5:31 pm, I emailed Mr. Kupice a copy of my self evaluation that the Mayor's Office considered a performance evaluation for the work ! did in the Mayor's Oifice. I needed this to provide it to DPW for their review, in order move along the discussion of'a pay raise. In January and February of 2013, Jared Kupiee, the Mayor's Chief of Staff, asked the Mayor's staff write a performance evaluation. Mr. Kupiee left his job on June 21, 2013 without ever replying. 199. true and comect copy of this self-evaluation is attached as Exhibit 50. 200. On Thursday, April 25, 2013 at 4:36 pm, an executive for the Hartford Board of Education who I had been working with emailed me seeking to set up a meeting with vendors. I replied that I was no longer Energy Manager and had been reassigned to clerical duties. He responded that “This is not a good development. That guy Dan has too much on his plate as itis. So does Tony.” 201, A true and correct copy of this email chain of correspondence is attached as Exhibit 51, 202. It was clear to people outside the DPW that my reassignment made no sense and was poor management, and it reinforced to me that my reassignment to processing energy bills was retaliation and discrimination against me because I was a younger woman of color who hed sought equal pay. DPW continues with it o this day as part of a pattern of harassment and retaliation against me for blowing the whistle on diserimination, and my pay issues have never been addressed. 203. On April 29, 2013, I facilitated the Clean Energy Task Force's first meeting, Thad selected participants, created a meeting date, wrote an agenda and led the entire meeting. Mr. Blakelock had never done this, but I did, despite the hostile work environment I faced. Participants like Rory Gale and Paul Popinchalk wrote me emails the next day and congratulated me for my efforts. 204. True and correct copies of these emails are attached as Exhibit 52. 205. On Wednesday, May 1, 2013 at 11:20 am, India Cicero sent me a commanding email asking me about my processing of energy bills. I considered this part of the harassment, but I responded that I understood the DPW's position and I was doing my best to balance my responsibilities. 206. A true and correct copy of this email exchange is attached as Exhibit 53, 207. On Tuesday, May 7, 2013, at 4:57 pm, Mr. Matta asked me for my weekly schedule. I was sick on May 8, 2013. On Thursday, May 9, 2013 at 4:54 pm, when I still had not responded because I had been catching up on bills and CL&P trained me offsite for 2.5 hours, Mr. Matta emailed ‘me questioning my work ethie and schedule, indicating I failed to meet the previous week's deadlines for bill processing. He wrote I had didn't give him my weekly work log, and for this, he punished me by taking mo off of the ZREC/Celtic Energy site visits, a project that I had worked hard to set up. 208. I stayed at work until 7:04 pm that night, and sent him my daily activities. 209. Attrue and correct copy of this email exchange is attached as Exhibit 54. 210. Iwas angry and upset that Mr, Matta disciplined me based on a job description the ‘Mayor didn't want me to do, I felt like Mr. Matta and Ms. Cicero were manufacturing reasons to make my job performance look sub par. 211. Upon information and belief, no other similarly situated DPW employees were required to chart their activities in such @ manner, and I considered this demand part of the retaliation and hostile work environment I was suffering through. 212. On Friday, May 10, 2013 at 3:18 pm, I sent Mr, Matta my daily ledger. 213. On Monday, May 13, 2013 at 10:53 am, Mr, Matta clarified this, and told me a daily edger was not necessary, but he wanted a weekly one. He also told me that if I attend meetings, trainings, seminars and webinars, I need to obtain his pre-approval one week in advance, 214. On Monday, May 13, 2013 at 11:14 am, J responded to Mr. Matta that T had never seen any of my counterparts asking for permission to attend work meetings. 215. Tinterpreted this to mean that any time I left my cubicle for a meeting, I needed to ask permission. This edict from Mr. Matta was part of the continuing pattern of harassment and retaliation and discrimination against me. 216. A true and correct copy of this email exchange is attached as Exhibit 55. 217. On Monday, May 13, 2013 at 8:59 am, I had to ask Mr. Matta's permission to apply for a grant, something that I had been previously assigned to do. 218. A true and correct copy of this email of me asking permission to apply for a grant is attached as Exhibit 56. 219. On Monday, May 13 at 8:37 pm, Councilman Macdonald wanted an update on the Clean Energy Task Force, so his assistant scheduled a meeting with myself and Mr. Burnham. 220. Mr. Burnham's assistant canceled this meeting without my knowledge, despite the fact that I chaired the Clean Bnergy Task Force and that in January, I met freely with Councilman Macdonald, without any permission from any of my supervisors. 221. Councilman Macdonald's executive assistant Monique Daley received the cancellation, and was told by Mr, Burnham's assistant that proper protocol for a meeting update on energy was to notify Mr, Burnham and Mr, Kupiee, and then a meeting would be scheduled. 222. Atrue and correct copy of this email from Monique Daley is attached as Exhibit 57, 223. I tried to clarify this protocol with Mr. Bumham’s assistant, and she emailed me her version of the protocol. I then attempted to clarify this with Mz. Kupiec, who said that the protocol issued by Mr, Burnham's assistant was incorrect. 204. A true and correct copy of Mr, Kupiec's repudiation of Mr. Burnham's new protocol is. attached as Exhibit 58. 225, Making me jump through hurdles to do my job is part of the pattern of harassment and zetaliation and discrimination that I have been facing. Moments like this created intense stress on me, because I cannot trust my supervisors when [ understand they have ancillary motivations in their management of my work. 226. On Tuesday, May 14, 2013 at 12:36 pm, India Cicero clarified to the manager of customer accounting at Connecticut Natural Gas that I was processing energy bills. 227. A true and correct copy of this email is attached as Exhibit 59. 228. Again, this was frustrating because I knew the Mayor's Office did not want me processing energy bills, and had been told specifically by Mr. Kupiee that I was not to process energy bills, but DPW continued to fore me to do this, as part of a pattern of harassment and retaliation and discrimination. 229. On Thursday, May 16, 2013, I met with India Cicero who again told me Don Blakelock's responsibility was to process energy bills. His job description did not contain anything about bill processing, and the City was not paying him $95,000 annually to do clerical work. (See Exhibit 28 for conversation notes). 230. On Friday, May 17, 2013 at 5:08 pm, India Cicero emailed following up on our May 16, 2013 meeting, She said my work was ineomplete. I felt this email was Ms. Cicero building a paper trail against me to fire me. I tried to respond professionally, 231. A true and correct copy of this exchange is attached as Exhibit 60. 232. On Monday, May 20, 2013, at 11 a.m., Stacey Willis and India Cicero came to train me at my cubicle about the MUNIS system. When my login to the MUNIS system failed to allow me to process energy bills, India Cicero told Stacey to log in and let me work under Stacey's name. I believe that this is a violation of MES policy, and that I should not have been processing work under Stacey's name. Please see Exhibit 28 for a more complete discussion of this. 233. During this same training program, I asked India for clarification on my job duties. She told me that orders for me to process bills came from the Deputy Director, Rhonda Carroll. I responded that Stacey's job description says bill processing, mine doesn't, and Stacey gets paid more than I do, India dismissed Stacey from the conversation, and told me that my attempts to clarify my job description were sabotaging the training process. 234, She told me: “Look at what happened the last time you went out and spoke out of line.” ‘This conversation is presented in more detail in the notes in Exhibit 28. Aside from confirming that I vwas being harassed, discriminated against and retaliated against, Ms, Cicero was undermining my work as policy analyst 235. commute by bieyele regularly to my job. Bicycling is environmentally friendly, it relieves stress, and it offers me an opportunity to lead by example. During this conversation, when 1 told India T was confused about who my direct supervisor was because of ail the changes in my job description, India Cicero told me again: “You have to talkcto the direct chain of command and follow that structure, Look at what happened the last time when you didn't follow that chain of command. You just have to stop asking why, stop riding your bike around and contemplating life, looking at trees ancl stop asking why, You have to stop doing that.” Again, see Exhibit 28. 236. India Cicero would not address an older white male in this manner. She patronized me, and tried to make me feel like [ was an immature, unnecessarily rebellious adolescent who needed to grow up. 237. India Cicero's statements made it clear I was the subject of retaliation, and that this, assignment of energy bill processing was punishment, This conversation was very stressful, and left me angry, sick to my stomach, and upset. I began to experience involuntary spasms in my shoulder and back muscles whea India Cicero addressed me. I have tried to treat these with massages and acupuncture, 238, All of this has occurred because I simply wanted to get paid fairly for the job I was doing, and instead, I ended up in @ horrible situation that made me not want to go to work. 239, India Cicero ended the conversation at 11:47, and my training did not resume. I attempted to reschedule the training later that afternoon, but my request was deniee. 240. A true and correct copy of my email attempting to reschedule the training is attached as Exhibit 59. 241, On Tuesday, May 21, 2013, Mr. Matta prohibited me from attending a CPACE meeting at the state capital, pursuant to orders from Ms. Carroll. Mr. Kupeic had previously requested that I attend this meeting. (See Exhibit 28). 242. On Tuesday, May 21, 2013, Dan Haim told me that he heard something about my employment that was not positive, and he told me I should refrain from making remarks in my emails regarding my current work situation. (See Exhibit 28). 243. On Tuesday, May 21, 2013, I asked Mr, Matta what to do when the Mayor's office sends me policy questions, Mz, Matta told me “Look, I'm only trying to protect you. The rule of thumb when you receive a request from the Mayor's office is to send it to me and Kevin, and we will take care of it.” (See Exhibit 28). 244. Lean only surmise Mr, Matta sought fo protect me from the abusive retaliation and pbarassment that he participated in. I do not need protection, I need fair treatment. The fact that he considers himself able (o protect is again patronizing and shows he thinks Tam a vulnerable, young ‘woman. 245. Amonth prior, I followed his orders and sent him and Mr. Burnham the email from. Hartford Steam, yet Mr. Bumham and Mr. Matta did not act on this request, It was my job to do so, but they took these responsibilities out of my hands in retaliation for my actions. 246, Hartford Steam sent another email to the Mayor's office on May 17, and Mr, Kupiee sent it directly to me, asking me to follow up. 247. A true and correct copy of this email is attached as Exhibit 61. 248. Mr, Matta told me that this was not my concern. (See Exhibit 28). 249, Shortly after that, on May 21, 2013 at 10:09 am, Mr. Kupiec sent me an email about the Capitol Region Council of Government's Electricity Consortium (I had originally brought this to his attention). [ forwarded this to Mr, Bumham and Mr. Matta at 10:34 am, and I also responded separately and directly to Mr. Kupiec. 250. A true and correct copy of this email is attached as Exhibit 62. 251. Lwas instructed to set up a meeting with CRCOG, and I was allowed to attend it. 252. On May 16, 2013, Mr, Kupiee sent me an “FYI” email about a financing energy jency conference, Mr, Matta suggested and approved that I attend. India Cicero would only allow Dan Haim to attend. On May 22, 2013 at 11:24 am, [asked Mr. Matta and Ms. Cicero why I could not attend, and I got no response. 253. A true and correct copy of this email exchange is attached as Exhibit 63. 254, This conference was after work hours and only cost $25 to attend, Ms. Cicero's rejection of my attempt to attend this conference is part and parcel of the hostility and harassment and retaliation Thave been enduring, 255. On May 23, 2013 at 5:23 pm, India Cicero sent me an email again pointing out my deficiencies in processing energy bills, ‘This email is part of an ongoing campaign to create a paper trail to justify my termination, because I dared speak out about pay inequality and the gender discrimination T was suffering, 256. A true and correct copy of this email is attached as Exhibit 64. 287. OnFriday, May 24, 2013 at 12:33 pm, Mr. Kupiec sent out an email to Thomas Deller, the City’s director of development services, indicating to him that I was in charge of energy policy. At the same time, I was still being told by DPW that my job was processing energy bills 258. A true and correct copy of this email is attached as Exhibit 65. 259. DPW's obfuscation of the Mayor's directives regarding my position was purposeful discrimination and retaliation against me. 260. 1 took May 23 and May 24 off from work because of the stress that this situation was causing me. Ithas been impaeting my health and well being, and I needed time away to recover and face another day in this position. 261. A true and correct copy of my sick note from my counselor is attached as Exhibit 66. 262. Mr, Deller emailed me on May 28, 2013 at 8:30 am, secking to meet with me, and I asked Mr. Matta’s permission to do so. 263. A true and correct copy of this email is attached as Exhibit 67. 264. 1 was approved to meet with Mr. Deller, but Mr, Matta rejected my request to meet with Bridge Energy Services. 265. On May 28, 2013 at 5:18 pm, I responded to India Cicero's May 23, 2013 email (Exhibit 65), and again tried to clarify my roles and responsibilities. 266. A true and correct copy of this email is attached as Exhibit 68. 267. On Wednesday, May 29, 2013 at 8:36 am, I forwarded information about the next Connecticut Power and Energy Sociely meeting to Dan Haim and Mr. Matta. Previously, 1 had attended these meetings as part of my job duties as Energy Policy and Research Analyst. My inability to do this ‘now was part of the pattern of harassment and retaliation for my attempts to seck pay equality. 268. A true and correct copy of this email is attached as Exhibit 69. 269. On May 31, 2013 at 10:48 am, I was prohibited from attending the Retrocommissioning ‘meetings to update schoo! buildings with energy efficient technology. Previously, I had attended these meetings as part of my job duties as Energy Policy and Research Analyst, My inability to do this now ‘was part of the pattern of harassment and retaliation for my attempts to seek pay equality. 270. A true and correct copy of this email is attached as Exhibit 70. 271. This meeting came about because of my efforts with Paul Popinchalk, CEFIA and CL&P's grant through the ZREC credits. I worked very hard to make this happen, and DPW was actively denying me the job satisfaction of seeing my accomplishment through to the end. 272. On May 31, 2013, 1 was told by Rita, a secretary in the DPW, that I would be receiving a letter from the DPW as to my employment situation. 273. This situation has caused me significant stress and anxiety. I have never received such a letter, but hearing on different oceasions from both Mr. Haim and Rita that DPW management is talking about my employment situation concemed me. It added stress to my life, and I see itas part of this ubusive pattern of harassment, hostility and retaliation. 274. On Friday, May 31, 2013, I emailed India Cicero an update about my energy bill processing and about the MUNIS training request she sent to my calendar. ID. [also asked for guidance on how to deal with problematic billings when I need to ask permission to leave the building. 276. This was uncomfortable, and part of the hostile work environment that exists for me in DPW because I have been seeking pay equality. I had knots in my shoulder for days afterwards, as my body seems to have a visceral reaction to the stressful situations DPW puts me in 278. _Istill have not received the promised pay raise from December 2012, nor has DPW addressed my pay concerns about the clerk duties I assumed, 279. On Wednesday, June 5, 2013 at 12:14 pm, India Cicero replied to my email in Exhibit 68 that it was not a problem to process energy bills under Stacey Willis’ ID. I find it absurd that a professional needs to ask permission to perform basic job functions, and this management overreach would not be happening if ‘was an older white man, This is harassment and retaliation for fighting the gender pay discrimination I have suffered. 283. I took a much needed two-week vacation from June 10 through June 25 287. [cleared my desk out before I left for vacation because I feared 1 would be terminated ‘upon my return, I fell like I had some dignity in cleaning my desk out before vacation, instead of under the scrutiny of a security guard walking me out the door if I am fired. 288. [took a personal day from DPW to meet with CHRO to file this complaint. 289. [returned from vacation, and my pay issues have not been addressed. 290, DPW's demotion and continual withdrawal of professional privileges and opportunities harms my long-term career advancement possibilities. As painful and difficult as it is to explain to my peers in the energy community about my reduced responsibilities, and as much as this harms my professional reputation, it will be more difficult to explain to future employers why much of my work experience as a policy and research analyst consists of clerical work not consistent with my masters! degree. 291. The DPW's failure to pay me appropriately for the equivalent of Don Blakelock's work that I was doing will hurt my long-term earning potential. When I go to my next potential employer, 1 will have a weaker negotiating position because DPW discriminated against me by not compensating me for work I was doing. Tasked Stacey if Don Blakolock had ever processed any energy bills and she said no, Stacey stated that she has always processed bills including energy bills. ‘Tuesday, March 26,2013 1:00pm-2:00pm Had a conversation with Tiana Glass at Woody's during out luneh hour. J expressed to Tiana how I felt that DPW was very sexist and discriminatory with women in the workplace. I told Tiana how Thad been stripped away from my title as Energy Project Manager. ‘Tiana revealed to me that when she was ttansferred fiom the Mayors Office to DPW she was also a Project Manager and over aight upon being ‘eansferred to DPW, she lost that litle although she stil assumed all if not most of the same responsibilities, Tiana said that she thought they did this because it was a way for DPW to justify her ‘not being compensated accordingly. ‘Wednesday, Mareh 27, 2013 12:30pm, From {1:00am-12:20pm, I called a meeting in Jose Sanchez's Office. Jose Sanchez. is the Budget Director for the City, Meeting attendees were Tony Matta, Dan Haim, Kevin Bumbam, Jose Sanchez, Paul Popinchalk and David Tine of Celtic Energy and Bert Hunter Chief Investment Officer forthe Clean Energy Investment Authority (CEFTA). The purpose of the meeting was to discuss the upcoming ZREC Solar PPA opportunity that CL&P would be getting ready to roll-out in June. The premise of the meeting was for specific representatives atthe City level to become informed on an opportunity to use CEELA's services at no cost to the City of Hartford to receive assistance from a company like Celtic nergy to put together a bid package for solar developers interested in a Power Purchase Agreement with the City. The meeting that I initially called together proved to be very informative. “After the meeting ended, Jose Sanchez, asked me to stay a couple of extra minutes because he had some additional questions for me, At which point it was then 12:30pm, Around this time, once everyone left, Jose asked me what role Lplayed in DPW. 1 told him that I was their Policy and Research Analyst ‘and had been transferred over to DPW to work on energy and environmental items per the Mayor's Tequest. It was supposed to be a lateral transfer but I informed him that I found myself doing the exact same work that Don Blakelock did in his capacity as Energy Manager. ‘Jose then stated that I comported myself'in a very professional manner and given the meeting that T “organized with various parties, he was impressed with my skills, Jose went on to inform me that he had becn looking at the payroll budget. In the budget he said that he hoticed that 1 was only making $45,000. 1 said, “yes, that is correct. ‘That is exactly how much make”, I explained that my duties as a Policy and Research Analyst in the Mayor's Office were different, Being transferred over to DPW under the same title did not mean that Lwas doing the same Jevel of work but rather that [had initially been assigned with more responsibilities. {informed Jose ‘that a couple of weeks earlier on March 12", Thad been told that I was no longer to be referred to as Energy Project Manager, which was a responsibility [had been assuming from December through March 12" [informed Jose that responsibility had been shifted to Dan Haim on top of his regular work, per Rhonda Caroll and Kevin Bumham's request. Jose went on to indicate that my skill evel did not appropriately measure my salary. Jose asked me if hhad met with anyone to discuss this. “yes”, Tanswered. “Ihave met with Kevin, the Mayor, Jared and Tony. My request to review my responsibilities and match it with my salary has fallen on deaf ears. No one has done anything, The ‘closest I've gotten is a statement from Kevin indicating that be would look into it” Jose thought this was “interesting”. Half way through Jose pulled up the file and looked at my pay Figure once more. | indicated to him that he should look at Stacey Will's pay. He asked me who that was, and [informed him that ske was an Administrative Assistant, whose main job was to process bills for DPW. He looked under Stacey's name and he saw that she made more than I. responded, “yes, I know that, Stacey actually makes $13,000 more than me and all she has to do is. process bills. Something which by the way I have now been asked to do”. Jose looked down at Stacey's pay rate once mote, and then asks me how much is 9x5, T said its 45. Lasked him if there was something that he wanted me to calculate. He said no, Jose then asked me about a comment that was made earlier during the meeting by one of the Celtic Energy engineers, in reference to the State's position on sole-soureing with Hydro-Quebee. He said he wanted to know why people deemed this to be a bad idea, I explained to him that the State was Considering Hydro-Quebec's generation method to the list of Class I Renewables and enviroumentalist were upset.. Linformed him that with the deregulation of the electricity market the State was looking for alteinative ways to reduce the high electricity rate that we have in CT. Hydro-Quebes however, doesn’t have a good track record because they deplete ecosystems of natural water and use it to produce electricity leaving areas dry. then went back to the subject of my current status at work as I recognized and he recognized Twas being paid less than what a DPW Clerk currently makes, Jose said there was nothing he could do, At ‘which point, our conversation concluded. ‘Thursday, March 28, 2013 3:40pm Treceived my three month performance evaluation by Tony Matta, I was told that I was to be on probation for one year. Duting the performance review Tony said, “I am sort-of kind of like your master”, [zesponded by saying, “So are you saying I'm like a slave”. Tony then clarified and said, “No ‘vehat I meant to say was that you have to report to me directly”, “When I asked Tony why did I have such a long probation period when the typical time frame is three months, Tony indicated that he himself was also on probation for one year. April 9, 2013 20:00am [walked down to Elm St. Department of Energy and Environmental Protection with Dan Fiaim to attend their Micro-grid Grant Phase TI informational session for municipalities ‘Dan instructed me to please reftain from referring to him as the Energy Project Manager because people automatically assumed that he has an energy background of which he doesn't have, Plus, he Said, “peoples” expectations and perceptions will be wrong as they will perceive me to be to be the new ‘Don Blakelock”. Dan indicated that he preferred to simply be called, “Project Manager”. He stated that he felt most comfortable with that. He said that as an Architect, he is a Project Manager for Schools and no one refers to him as Schoo! Project Manager. She stated that at this point it was Don Blakelock’s responsibility to process bills then after he left it was Stacey's responsibility to process bills. May 20, 2013 14:00am Stacey Willis along wit India Cicero came to my eubicle to review training so that {could get acquainted with the MUNIS system in order for me to process bills. Stacey sal next fo me and reviewed aaa eaded to do, while india stood up dreotly behind us and watched. Tlooked at my work training wey that [bad writen from when Stacey trained me back in (March/April), 1 Togged into MUNIS ‘pithout any problems using my regular usemame and password but 1 was unable to actually process bills, When f aliempted to do this with may password, the MUNIS system indieated that I was not vilorized to process bills. India stated that this is precisely why she was standing there to make sure aint Thad the appropriate acoess and that she would make a formal request to MHIS so that I could Sbiain access shortly, This however, was the second time Tmade India aware of this MUNIS message, In order for me to proceed with the training review, India then instructed Stacey to log into the live MUNIS system under Stacey's user ID and password. Stacey logged in, and I was told by India w» begin processing the bills in front of her using Stacoy’s logein, Tthen proceeded to enter several bills. T began processing CL&P bills. However, as soon as {began entering the CA? bills Twas told by Tada that the CLEP batch could not be processed without having all of the original pages. The C&P bills each have page numbers listed on the top. Ifthe bill pages exceed more than one, then on the top of the bill i will read for instance, ‘page 1 of 4, Given that the CL&P bills I wes working with were aly page 1 or page 2, when some xead page 1 of 4, India asked me what happened to the other bill pages. Pesploined to India that I did not include the other pages for dhe ills because wo did not need hem, Sho nsleod me why did T remove those bills and I explained that the most important part of the bill n sonny cases was te frst page, ‘The first page ofthe bills include the entire summary, the other pats of the bill simply have a barcode and only state for exemple, whether or not you want to begin receiving bills electronically. informed her that singe weithe City didn’t want to start receiving bills tlectronically Thad thus placed those CL&P pages in the reeycling bin because they possessed no ace data but rather general info. on choosing electronic billing, India then asked me who instructed me to do this, and I informed her that T was not told otherwise. T reminded India that it was never explained to me that I needed to keep every single page of the CLAP bills because the City needed f0 fave all the pages sedaned. It was only at this point that India explained that we needed all pages of bills because Padina would not accept the processed bills without all of the scanned pages. Padma reviews bills processing after its’ entered. J this case, since the extra CL&P bill pages for each bill was now unavailable, India then suggested we move te the next batch of bills, which were the MDC bills. And so, on T went, entering the ‘MDC Fills. Stacey logged into live MUNIS again with her username and password, 11:20am- Tegan entering MDC bills and on the second bill that 1 entered, I asked India if would now be helping Stacey do her work by processing these energy bills. India said why axe you brining this wp? TE is the Deputy Directors instructions for you to have your job as primarily focusing on processing energy bills. 1 told India that before I got here Stacey had been processing these exact same bills. Yasked India what ponte reason for siving me this responsibility. I asked India was it because Stacey was overwhelmes!? india said, “No, that was not the reason for assigning you with that task, India indicated that 1 was how to process bills because that was my priority. She went on to say, “Who ever comes in to DEW fo wrork on energy wilt have to do this work, This work of processing energy bills was never Stacey's to begin with”. 1 thon suid to India that I've read Stacey's job description and in her job description it states that she is to process bills. In my job description as Policy and Research Analyst for DPW it does not say this. 1 feuher explained that Don Blalelock analyzed bills in the very same way that sow am analyzing Bills. Don however did not process bills. 1 zsked India again why I was being asked todo this. T explained to Tia that this was not the ditective reccived from the Mayor's Office. India then asked me, “ Who do you now work for?” , “You now work for the Department of Public Works. You are to process chtizy Fitts, this is the directive you roeived ftom the Deputy Director and you are to fellow i. Are you seriously having this conversation right now to stall this process, because you don’t want to do your, ork! You haven't worked on anything other than attending webinars and a couple of conferences. [then responded, “Well honestly Tam a little confused about who is my direct supervisor. Butin this time Tam asked fo processed an exorbitant amount of energy bills. India we aren’t talking about one or two batches of bills. We are talking about pundreds and thousands of energy bills that need to get processed, which I am now asked to take care of. India then responded, “I's really quite easy, all you have to do is sit down and get it done. It doesn’t take a lot of time, you just have to do it.” { responded, “India {recognize I now have to do this per DPW's request, and I will do what is asked of tne but Twant to understand why this is being tequested of me? It’s impossible to work on processing ail of the energy bills and simultaneously work on poliey. Why is ths being sequested of me?” India then said, “Again, this is not for me to answer. Anyhow, what happens if you don’t get an actual answer until say six months from now, or a year from now. Or how about if you never get an answer at all” said, “But why will [never get an answer?” India, “You have to talk to the direct chain of command and follow that structure. Look at what happened last time when you dida’t follow that chain of command, You just have to stop asking why, stop riding your bike around and contemplating life, looking a trees and asking why. You have to stop doing that.” responded, “But this was not my original description. My jab deseription that is currently documented and registered in the City of Hartford's Human Resources Department does not say that ny priority is to process bills. Hartford, CT 06103 (860) 757-9959 February 4, 2013 Honorable Shawn Wooden, Council President, and Members of the Court of Common Council City of Hartford 550 Main Street Hartford, CT 06103 RE: City of Hartford's Commitment to the Clean Energy Communities Program Dear Council President Wooden: Attached for your consideration is a resolution for the City of Hartford to participate in the Clean Energy Communities Program, which calls for a 20% reduction of municipal building energy consumption by 2018. “This program is to be implemented in an effort to help reduce both costs and pollution, which are attributed to generation and use of energy. The City’s direct participation in this program Is intended to help us move forward in creating a Strategic Energy Plan for Hartford, by assembling a Clean Energy Task Force Work Group. This will also propel the City to research and investigate options for the purchase of Renewable Energy Certificates, on site renewable clean energy installations, and funding opportunities to achieve the 20% commitment. This is an important initiative that will show that the City of Hartford is not only concerned about the impact of energy generation and cost, but Is also taking the lead in a program to help mitigate the problems caused by current methods of energy generation and usage. Being on board with this program allows the City to be eligible for Bright Ideas Grants from the Connecticut Energy Efficiency Fund and Companies under the Clean Energy Communities Program. The successful implementation of this program will benefit all of our City’s residents. I respectfully request action by the Court of Common Council at your meeting for February 11, 2013. Segarra Mayor RESOLUTION PROPOSING COMMITMENT TO ‘THE CLEAN ENERGY COMMUNITIES PROGRAM WHEREAS, the Hartford City Council promotes conservation, energy efficiency and the study of the use of clean energy sources; and WHEREAS, electricity generation produces more harmful ar pollution than any other single human activity and emission from traditional methods trigger asthma attacks and contribute to other respiratory illnesses, as well as contribute significantly to climate change; and WHEREAS, the City of Hartford passed a resolution on January 9, 2006, to join the Connecticut Clean Eneray Communities program and committed the Town to purchase 20% of ts electricity needs from clean energy sources by the year 2010; and WHEREAS, today, the City of Hartford agrees to take on anew challenge put forth by the Clean nergy Communities program to reduce its municipal building energy consumption 2004 by the year 2018, with technical assistance by CL&P program administrators of the EnerBy efficiency Fund, and commits to benchmarking Town buildings’ energy usage and developing @ Municipal Action Plan (MAP) for the Town to reduce energy consumption; and WHEREAS, the City of Hartford pledges to maintain its commitment to voluntarily purchase dv of ts municipal building electricity from clean, renewable energy sources by the year 2018, aint, technical assistance from the Clean Energy Finance & Investment Authority, and will investigate all options for meeting that goal and beginning the purchases as soon a possible, ncuding purchasing RECS (Renewable Energy Certificates) and installing local clean eneray installations; and NOW, THEREFORE, BE IT RESOLVED that the City of Hartford hereby makes its commitment fo the Clean Energy Communities Program by affirming its Clean Energy Communities Municipal Pledge and will track and report progress towards these goals and will continue to promote energy efficiency and clean, renewable technologies in the community. By doing so, the City of Hrtlerd is eligible to receive incentives that may include free clean encray systems and up to two $15,000 Bright Idea Grants per fiscal year that can be used toward ‘energy-saving projects.
