    This case is before the Board pursuant to a May 23, 2013, order of the United States Court of Appeals for the Second Circuit based upon the parties' stipulation.

    In the underlying stipulation,

    the parties stipulate that the respondent's conviction underlying both grounds of removability has been vacated based on ineffective representation in his criminal proceedings and that the respondent "is no longer removable based on the charges against

    him."

    In view of this

    stipulation that has been entered into by the Government, these proceedings will be terminated.

    ORDER: The respondent's removal proceedings are terminated.
