AHMEDABAD, SEP 27: Gujarati community leaders, working closely with the rescue and relief operations at the Nairobi mall which came under terror attack last Saturday, have put the death toll of Indians in the massacre at over 50, out of a total death toll of 130. Gujaratis accounted for at least 35 of these deaths, reliable sources told over telephone even as the process of removal of rubble of the partially collapsed mall, under which more victims may be buried, continued on Thursday. The Red Cross said 71 persons, who may have been in the mall when the assault began, remain unaccounted for. Kenyan officials put the death toll at 72, including 61 civilians, six security agents and five terrorists. They indicated the toll could rise as there might be bodies trapped inside the collapsed building. Reason, to counter the ever sagging popularity of Congress led UPA government. Interesting unfolding of events, Rahul Gandhi emerges as a storm trooper blasting his way into a press conference. He issues his statement on the Ordinance for convicted law makers. Calls it nonsense and walks away. He would have torn the nonsense ordinance if he had that in his hand. Soon after he leaves satisfied that he did his part well and effectively. Read his words, "Now, I will tell you what my opinion on the ordinance is. It is complete nonsense; it should be torn up and thrown away. It is my personal opinion." Watching closely the Congress Yuvraj, a pattern in his antics is clearly visible. He is prone to tearing documents. Remember, during heat of UP elections in a speech, how he tore
apart the election manifesto of Samajwadi Party. He would have done the same to the Ordinance on convicted law makers now in the court of the President. Wonder why the nonsense ordinance was meant only for Rashtripati Bhawan. There was more to it than meets the eye. Congress has mastered the art of the dubious to a subtle finesse. It is hard to believe what will come out of its Banumati ka Pitara. Curiously, when the ordinance was sent to President he held his pen and paused. In the meantime, Manmohan Singh spread his wings and flew to his perhaps last state tour of USA with wife and other entourage in tow. New York this time is pleasant, the sound of Samba gunfire or Presidents holding back on the ordinance do not matter. Suddenly, he is startled in the afternoon of 27th September when Rahul makes his nonsense comment on the ordinance. Back in New Delhi, the high point of Rahuls press conference was Ajay Maken who accompanied him said that what Rahul expressed was in conformity with the party line. Funny people and funny loyalty, forked tongues and double speak at its best. If it was the line of Rahul Gandhi that the Ordinance was not good move of the government then why was it passed by the cabinet without his approval. Now Rahul having rubbished it and admitting that the government had done wrong there is a stir in the UPA.

It was to ensure secrecy of neutral/negative votes in the age of EVMs that the EC made this proposal first to the law ministry, former CEC N Gopalaswami told TOI. He said the government, however, sat on the proposal, which then became the matter of a PIL filed by PUCL. The government, however, submitted in the apex court that the writ was not maintainable as 'right to vote' was neither a fundamental nor a constitutional right, but only a statutory right. "The government had probably sensed the potential of the proposal being upgraded to a 'right to reject' all candidates in the future, which would invalidate any election where the negative voting option has been exercised in over 50% cases," a former bureaucrat pointed out. The EC, on its part, backed the PUCL prayer to the apex court. This was in line with the view taken by its proposal submitted in 2004, recommending that the law be amended to specifically provide for negative/neutral voting. "For this purpose, Rules 22 and 49B of the conduct of election rules, 1961, may be suitably amended, adding a proviso that in the ballot paper and the particulars on the ballot unit, in the column relating to names of candidates, after the entry relating to the last candidate, there shall be a column 'none of the above' to enable a voter to reject all the candidates," the EC proposed. However, Gopalaswami said the "right not to vote" was different from "right to reject" as the neutral votes cast would be set aside while deciding the result of an election. "At most, neutral voting is a step closer to 'right to reject', which may necessitate a re-election if a majority of candidates choose to reject all the candidates," he noted spy agencies of Israel and Germany. Before Rahul intervened during the press meet, Maken had dismissed opposition criticism of the ordinance and downplayed the remarks of some Congress leaders including Digvijaya Singh, Sandip Dikshit and Milind Deora, who opposed the measure. He slammed the BJP for opposing the ordinance saying that it "should not try and make it a political blame game and take advantage of both the situations", noting that the opposition party does not have moral right to change its stand after backing all proposals at an allparty meeting in August. Maken even credited the "collective wisdom" of Congress President Sonia Gandhi, vice-president Rahul Gandhi and Prime Minister Manmohan Singh for UPA's actions. He, however, later justified the U-turn saying "the situation with any issue evolves with time and it has evolved. Rahul has given an opinion on the issue and now it is the Congress view." When asked whether the Prime Minister will now withdraw the ordinance that seeks to negate a Supreme Court verdict that struck down the provision in the Representation of the People Act deferring disqualification of convicted lawmakers, Maken refused to answer. "I do not think I have an answer to a hypothetical question," he said, adding "Rahul Gandhi has aired the views of the common man. Rahul Gandhi is our leader and he had put across his views before you without any ambiguity". He added that the Congress vice-president has spoken out his mind on a moral plane. "Times have changed and people do not want to see any convicted person to be their representative. Rahul ji has aired the views of the common man. He does not want a convicted person to become a public representative," Maken said. To a specific question on whether Gandhi's remarks has reinforced that there are two power centres in Congress, He said, "Rahul has taken this stand on a high moral ground. He has not spoken just any technical thing. Gandhi has expressed his views on moral and ethical ground." Asked whether the Congress vice-president was not consulted
before the decision and whether the flip-flop points to lack of communication between Rahul and the government, Maken said, "After Rahul Gandhi's views, the party has given its opinion. Let us see what action is taken after this." He also said that "... I am the communication department chief of Congress. There are others who look after the communication between Rahul Gandhi and the central government". Maken also said that Union minister Manish Tewari, V Narayanasamy or he himself were earlier placing the views of the government, when asked that whether Congress should also be now criticized for opposing the ordinance like BJP. "I had placed the view of Chidambaram. I also placed the view of the government. Rahul put forth the views of the party," he said. Without mincing words, Rahul had hit out at the ordinance, saying, "It is complete nonsense, it should be torn up and thrown away. It is my personal opinion." Rahul said that the arguments given in "my organization" is that "we need to do this because of political considerations. Everybody is doing this. The Congress does this, the BJP does this, the Samajwadi Party, and the JD (U) does this. It is time to stop this nonsense, political parties, mine and all others ..." Maken denied suggestions that Rahul came out with a changed response of Congress on the ordinance issue as President Pranab Mukherjee could be having reservations on the issue and his utterances today are a "political stunt". "I don't think so. Rahul ji is an independent person. He has his strong views ... Rahul has a thinking of his own and he puts forth his views strongly. He has expressed his very own opinion strongly," Maken said. He also expressed annoyance at journalists for giving their opinions on the issue telling them "you can ask questions but you cannot give opinion ... You are also giving opinions while you are asking questions." At the outset, Maken had attacked the BJP, saying, "On August 13, when an all-party meeting took place, the exact formulation of the ordinance was discussed and all parties agreed. "The formulation is not something on which anyone should disagree. The principal opposition party had agreed to the formulation of the ordinance." He also said BJP has "no moral right" to raise such issues, when they have "convicted" Babu Bokhiria in the cabinet of Narendra Modi in Gujarat and reminded it of the corruption scandal involving former BJP president Bangaru Laxman. "I do not think, BJP has a local standi or moral authority to oppose the ordinance as they had accepted all the formulation of ordinance earlier." He also downplayed played by some Congress leaders to the ordinance saying "we are a big political party" and added that "different opinions in the party" reflect internal democracy. Maken had at the same time asserted that "the decision taken by the government is perfect" and that "such ordinance are not decided keeping in mind one or two persons. Senior people from the government must have taken the decision after due consideration." He made the remarks while replying to question on whether the government took the ordinance route on this matter to help RJD chief Lalu Prasad, whose fate is to be decided by a special CBI court in the fodder scam on September 30 or help some Congress leaders facing similar problems. SYRIA, SEP 27: Bashar Assads decision to sign up Syria to the Chemical Weapons Convention (CWC) earlier this month committed his country to verifiably give up the possession of chemical weapons and their production capabilities. Other countries with chemical weapons Albania, India, Iraq, Libya, Russia, South Korea and the US have previously signed up to the CWC and similarly committed themselves to destroying the weapons and associated manufacturing facilities, and to do so within a set timescale. That the US and Russia have yet to complete the destruction of their chemical weapons, and have overrun their deadlines for doing so, places into context the significant challenges likely to be associated with such a process in Syria. The delay in the US and Russia is primarily explained by safety concerns, and the associated costs of destroying chemical agents
and related munitions in a safe and secure manner in specialised facilities. It will be the responsibility of the Hague-based Organisation for the Prohibition of Chemical Weapons (OPCW) the international organisation set up to verify signatory states compliance with the Convention to verify the process of disarmament in Syria. This process will involve a series of steps, similar to that performed by UN inspectors in Iraq in the 1990s when the Saddam Hussein regime was ordered by the UN Security Council to dis-
mantle all WMD and related production capability following the 1990-91 Gulf War. HOW THE PROCESS WORKS First of all Syria has to provide a declaration of its current chemical weapons holdings and production facilities. This declaration will provide the OPCW with the basis upon which to begin verifying and accounting for Syrias chemical weapons capability. India ready to address US Govt clears 15 FDI proposals concerns over trade, investment worth Rs 2,000.5 crore
WASHINGTON, SEP 27: India on Friday expressed keenness in addressing concerns of the US with regard to investments and economic reforms in a "candid, open and transparent" manner but wants Washington to take care of visa issues which have implications for its IT sector. Indian Ambassador Nirupma Rao said the country will take care of the US concerns in "a candid manner, open and transparent manner. We would like US to understand the development challenges that India faces, the situation in which we live in terms of the environment around us". The US side, she added, "has some issues that it has raised from time to time, related to investments and economic reforms process in India". Among the major pending issues, the US has been pressing for further opening progress made in the relationship but also set the pace and scope of the ties between the two largest democracies of the world and help accelerate the momentum of the cooperation, Rao said at a media briefing. With regard to the proposed changes in the non-immigrant visa rules that would affect H1B visas, she said though the issue is "still work in progress", the Indian side has voiced concern with US lawmakers. She said if these restrictions become a reality, then the Indian IT professionals will be affected considering the kind of business module Indian companies have. "We have been candid. Our concern is understood by our interlocutors but don't know what will happen... We don't know what the final shape will be," she added. NEW DELHI, SEP 27: The Finance Ministry on Friday said it has approved 15 foreign investment proposals totalling Rs 2,000.5 crore and recommended two FDI applications, including that of US drug major Mylan, for final Cabinet clearance. The 15 proposals were cleared following recommendations by Foreign Investment Promotion Board (FIPB) on August 27. "In addition, two proposals viz., M/s IDFC Trustee Company Ltd, as proposed Trustee for India Infrastructure Fund II, Mumbai and M/s Mylan Inc. USA amounting to Rs 10,668 crore, have been recommended for consideration of Cabinet Committee on Economic Affairs," the Finance Ministry said. MUMBAI, SEPT 27: The Indain Army's Naoshera Brigade organised a educational-cum-motivational tour named CARVAN-E-HIND for the 20 students from the remote border areas of Naoshera Tehsil, Rajouri District (J&K). The students visited Mumbai last week. During the tour, the students visited Gateway of India,Elephanta Caves, Mahalakshmi temple, Haji Ali Dargah, Nehru Planetarium & Taraporevala Aquarium. All these places are rich with national heritage and educational value. The tour provided the students a great opportunity to see development in Mumbai and also instill a sense of awareness and national pride. Parents of these students expressed their gratitude towards the Indian Army for giving an opportunity to their children to see other parts of the country which would otherwise not have been possible.

INDORE, SEPT 27: Indian Institute of Management, Indore (IIM-I) will organize a two-day conference on 'creating and sustaining institutions in the country'. The purpose of the conference is to reflect on institutions that have come up in this country from a broad spectrum of ownership and domain of operations. The conference will open with a tutorial on institutional building. Also, faculties from specialized institutions, central universities and institutions of social sciences will share their experiences in the experience sharing sessions. Evolution of three top management institutions in India would be discussed in the conference. Also, a special expectations from the institute. On the last day of the conference, heads of academic activities of the institute would also make presentations. The conference is yet to get confirmation from secretary, Union ministry of human resources and development to inaugurate the conference. The chief guest for the second day would be member of board of governors of IIM-I, M N Buch. IIM-A professor TV Rao would address the valedictory session. LUCKNOW, SEPT 27: The Uttar Pradesh government has cleared setting up of three private medical colleges in the state, an official said on Friday. A decision to allow these medical colleges at Mathura, Lucknow and Mainpuri was taken at the steering committee meeting presided over by the chief secretary Jawed Usmani. Officials said initial objections were made on naming the Mathura medical college as SN medical college but the differences between officials were ironed out. The objection was that SN medical college is the name of
the government medical college, operating in Agra for many decades. All formalities of opening a medical college in Mainpuri - the parliamentary constituency of the Samajwadi Party (SP) chief Mulayam Singh Yadav, were also completed. A proposal to open the MC Saxena medical college in Lucknow also got the approval of the committee. Owing to the ban on opening up of dental colleges, the proposal to increase the seats of BDS was kept in abeyance and would be taken up at the next meeting of the steering committee.
