236 of the Immigation ad Natonality Act, 8 U.S.C. 1226. O November 18, 2009, the
Immigton Judge issed a bond memorandum, stg fr the rens fr his bond deision. The

We revew the fdings of fct made by the Immigaton Judge, including ay deteton of
crll>ilit, under a "clely eroneus" stdad. 8 C.F.R. 1003.l(d)(3)(i). We revew alothe
isse, including wether the pares have met the relevant burden of proot ad issue of disreton,
unde a d novo stadard. 8 C.F.R. 1003. l(d)(3)(ii); Mater of H-L-H- & Z-Y-Z, 25 I&N
De. 209, 211 (IA 2010).
On Septeber 9, 2009, the respondent was convicte in the Supeor Court of Aon Marcpa
Count, fr c impersonaton, a clas 6 felony, in volaton of seon 13-2006 of the Aona
Rese Stattes ("ARS") (xh. 3). That statute states, in relevat part, that
A A person commits c impersonation by:
1. Assuming a fse identty with the intent to defaud aother; or
2. Pretending to be a representatve of some persn or organizton with the intent
to defaud; or
3. Pretending to be, or assuming a fse identit ot a employe or a representatve
of some person or orgaon with the intent to induce aother person to provide

or allow access to property. This paragraph does not apply to peace ofcers in the
performance of their duties.
Section 13-2006 of the ARS.
We concur with the Immigration Judge's determination that section 13-2006 of the ARS is a
divisible statute, and that despite having been given multiple opportunities, the DHS failed to
establish under which specifc subsection of ARS 13-2006 the respondent was convicted (1.J. at
4, 7 n.2). Matter of Silva-Trevino, 24 I&N Dec. 687, 698-99 (A.G. 2008).
As it has not established that the respondent was convicted under a portion of the statute that is
turpitudinous or engaged in conduct of that nature, the DHS is "substantially unlikely" to prevail on
a charge of removability under section 212(a)(2)(A)(i)(I) of the Act. Matter of Joseph, 22 l&N
Dec. 799, 805 (BIA 1999). Thus, the Immigration Judge was corect in deterining that the
respondent was improperly included in the categor of aliens subject to mandator detention fr
bond purposes. 8 C.F .R. I 003 .19( d). Ou determination on this issue is based on the record U it
currently stands, ad does not constitute the law of the case or a rling on the merits.
Accordingly, the fllowing order will be issued.
ORDER: The appeal is dismissed.
