Lease Agreement/Contract for Commander'

THIS DOCUMENT IS NOT A BILL OF SALE

LEASE TERMS
Lease Price: $0.00/Month
The Owner agrees to lease the horse described and identified herein to the Lessee for ZERO Dollars ($0.00) per month.

Owner Warranties and Responsibilities


Owner warrants that he is the lawful owner of said horse and has the right to Lease said horse (Commander). Owner is responsible for retrieving said horse within a minimum of two weeks (2 weeks) written notice by Lessee that Lessee wishes to return said horse to the Owner, providing transportation costs are paid by Lessee. Lessee can also deliver said horse back to the Owner if they choose after written notice has been received by the Owner and arranged have been made for delivery.

Lessee Warranties and Responsibilities


Lessee warrants that he/she will provide the said horse with care above and beyond that which the province of Saskatchewan deems minimal humane treatment of an Equine. This care includes paying for board and/or providing board and providing food, water, and shelter for said horse. Lessee MUST provide regular maintenance of the said horses hooves via regular and routine farrier work by a certified farrier at least once every 6 months. Lessee must provide regular grooming and administrations of deworming medications twice a year (spring and fall), health care and vaccinations must be kept up to date including all yearly vaccinations recommended by veterinarians in the area. If said horse is with Lessee for over one year, Lessee must have teeth checked yearly, and have any recommended work done by Lessees veterinarian. Exercise, nutrition and displays of kindness and care necessary to maintain the said horse in his/her prime state of physical and emotional health is expected. Lessee warrants that she/he does NOT have the right to sell, lend, sub-lease, move, or otherwise dispose of the said horse. Lessee warrants that she/he has substantial experience working with and handling horses and warrants that he/she will be the primary caretaker and handler of said horse. If anyone else handles, rides, grooms, and/or cares for said horse, Lessee is responsible for said people and said horse and any injuries or damage that may occur to anyone or anything from interacting with said horse. Lessee warrants that she is aware of the substantial risk of personal injury that can be sustained while riding or working around horses and agrees to hold Owner harmless of all liability of any injury to persons or property caused by the horse while the said horse is in the Lessees care.

Lessee warrants that he/she will use best judgment in emergency situations and will inform the Owner as soon as possible first by phone then in writing if such situations arise. The Owner reserves the right to make all decisions regarding the health and welfare of the horse, including decisions about life saving or on-going treatments.

Care
Lessee agrees to care for said horse as outlined in this agreement/contract. Farrier work must be done by a licensed farrier at least once in every six (6) months. Veterinary health examinations must be done by a licensed veterinarian at least once in every one (1) year and any work/care/medication recommended by the veterinarian must be followed up by Lessee. Any and ALL vaccinations that are recommended by a licensed veterinarian must be done as often as the licensed veterinarian recommends. This includes West Nile Virus and Tetanus. Teeth checkups and routine work must be done by a licensed veterinarian or equine dentist at least once in every two (2) years. A coggins test (equine infectious anemia) must be done at least once in every two (2) years by a licensed veterinarian. Lessee will provide access to adequate and sufficient shelter from sun, wind, snow and rain at all times to said horse. Adequate and sufficient feed will be provided to said horse. Clean water must be available to said horse twenty four hours a day, seven days a week (24/7), at all times. Regular grooming and health/soundness check (at least weekly) must be provided. A daily checkup on said horse to ensure good health must be provided. If any injuries should occur to said horse for any reason it is up to Lessee to use best judgment and care for the horse and get immediate medical attention by a licensed veterinarian. If medication and/or ongoing treatment are needed for the said horse, it is up to Lessee to provide care and pay for all costs including treatment, surgery, medication, etc.

Term
The terms of this Lease Agreement are renewable automatically every month; however, Lessee may terminate this agreement with a minimum of two weeks notice to the Owner at any time. The Owner of said horse Commander reserves the right to retrieve the said horse Commander without any notice to the Lessee and terminate this lease agreement at any time for any reason.

Lessee shall not, transfer or relocate the Horse without the express written consent of the Owner. If said horse will be away from Lessees property/boarding stable/pasture for more than 24 hours, written consent must be sent to the Owner. Lessee can take said horse away from its boarding place for riding/showing/experience purpose without notice if horse will not be gone for more than twenty four (24) hours.

Breach and Cure


1. Owner reserves the right to terminate this agreement immediately if the horse is not maintained by the Lessee according to the terms of this agreement. 2. Cure: If Lessee has breached the terms of this agreement the Owner of said horse can choose to give Lessee 15 days to remedy said breech. Any form of negligence is cause for breech. If said horse Commander dies during the term of this lease, lessee must be responsible for getting a licensed veterinarian to examine the cause of death. If death is confirmed by the licensed veterinarian that is was preventable by Lessee, Lessee must pay the Owner the value of the horse at two thousand dollars ($2000.00) within one month of confirmed death by a licensed veterinarian. If Lessee fails to get a licensed veterinarian to confirm cause of death Lessee must automatically pay the Owner valued amount for said horse commander two thousand dollars ($2000.00). Lessee m ust have written proof from a veterinarian the cause of death, time of death and if it was preventable by Lessee.

Notices
All notices must be sent to the Owner at the address listed herein. All notices may be sent to the Lessee at the address herein. Canada Post constitutes the mode of delivery of notices. Notices must be sent if said horse is sick, injured, lame, lost, leaving property for more than 24 hours, competing, and anything otherwise by the judgment of Lessee and the Owner. In emergency situations use best judgment and try to contact said person (Lessee/Owner) by phone number listed herein immediately before sending written notice. After you have contacted said person (Lessee/Owner) by phone, or if you cannot reach said person (Lessee/Owner) by phone, written notice must be sent by mail as soon as possible.

Entire Agreement
This agreement constitutes the entire agreement between the Owner and the Lessee. The invalidity or enforceability of any provision of this agreement shall not affect the validity or enforceability of any other provision of this agreement, which shall otherwise remain in full force and effect. This agreement may be executed in one or more counterparts, each of which shall be deemed to be an original but all of which together shall constitute one and the same instrument. The Laws of Saskatchewan, Canada shall govern this agreement. Any litigation will take place in North Battleford, Saskatchewan, Canada.
