of these Official Rules. ELIGIBILITY: Open to individuals who are legal residents of the United States or Canada and who are 18 years of age or over as of the date of entry. During the time period beginning on October 23, 2013 at 12:01 a.m. Pacific Time and ending on November 23, 2013 at 11:59 Pacific Time. All followers of ATEN on Spiceworks at https://community.spiceworks.com/pages/aten can enter to win and who provides a working contact telephone number or valid email address, will be entered into a drawing to win an ATEN C533 valued at $89.95 MSRP. WINNERS: The winner will be determined based on compliance with specified guidelines by an ATEN employee panel. All decisions of ATEN are final and binding. Odds of winning depend on the number of eligible entries received. The winner will be contacted with details on how to collect the prize via telephone or email. If ATEN cannot reach the winner via telephone or email by 5:00 p.m. Pacific Time on January 10, 2014, ATEN reserves the right to conduct a second drawing for a new winner. In the event of a dispute regarding who submitted the entry, the entry will be deemed submitted by the individual whose name appears on the entry. Winners are solely responsible for all taxes and fees which may result from winning. GENERAL TERMS AND CONDITIONS: By entering, each participant agrees to be bound by these Official Rules and the decisions of ATEN, which shall be final. ATEN, its agents and representatives, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of ATEN that may disrupt or corrupt this drawing; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the drawing; or (vi) any printing or typographical errors in any materials associated with the drawing. By participating in the drawing, each participant agrees to release and hold ATEN and the employees, officers, directors, shareholders, agents, representatives of ATEN, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the drawing or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. RESOLUTION OF DISPUTES: Any and all disputes and claims relating to this drawing shall be resolved by a court of competent jurisdiction in Orange County, California. California law shall apply to the resolution, award, enforcement and collection relating to any dispute or claim as such law is applied between California residents and without resorting to the principles of the conflicts of laws.
