This ConsentAgreementisenteredintobyandbetweenBaldevS.Sekhon, M.D. [Dr.Sekhon],
andthe StateMedical Board ofOhio [Board], astateagencycharged withenforcingChapter
4731., OhioRevisedCode.
Dr. Sekhonenters intothis ConsentAgreementbeing fully informedofhisrights underChapter
119.,Ohio Revised Code, includingtherighttorepresentationbycounsel andtheright toa
formal adjudicativehearing onthe issues consideredherein.
BASISFORACTION
This ConsentAgreementisentered intoonthe basisofthefollowingstipulations,admissions
and understandings:
A. TheBoard isempoweredbySection 4731.22(B),Ohio Revised Code, tolimit,
revoke, suspendacertificate,refusetoregisterorreinstateanapplicant, orreprimand
orplace onprobationthe holder ofacertificatefor aviolationofSection
4731.22(B)(18), Ohio Revised Code, for "[v]iolationof any provisionof a code of
ethics ofthe Americanmedicalassociation,theAmericanosteopathicassociation,the
Americanpodiatricmedical association, oranyothernational professional
organizationsthat theboard specifies byrule."
B. The Boardenters intothis ConsentAgreementin lieuofformalproceedingsbased
uponthe violationsof Section4731.22(B)(l8),Ohio Revised Code,to wit: Principles
IIand IVoftheAmericanMedical Association'sPrinciplesofMedical Ethics,asset
forth inParagraphE,below. TheBoard expresslyreserves therighttoinstitute
formal proceedings based upon any otherviolationsof Chapter 4731. of the Revised
Code, whetheroccurringbeforeoraftertheeffectivedateofthisConsentAgreement.
C. Dr. Sekhon islicensedto practicemedicine andsurgery intheStateofOhio, license
number35.056073.
D. Dr.Sekhonstates that heisnot licensedtopracticeinanyotherstate orjurisdiction.
E. Dr. Sekhon admits that, inoraround November2006, heinvited aresidenttohis
office todiscuss with herhowherresidencywasprogressingandtocounsel and
mentorher. Afterthe discussion,Dr.Sekhon admitsthathegavethe residentahug

andakiss onthe cheek. Dr. Sekhonacknowledgesthatthe hug and kiss were
unwantedbytheresidentand madeher feel uncomfortable.
Dr. Sekhonfurtheradmitsthat,inoraroundDecember2005 orJanuary2006,he
interviewedaprospectivephysicianassistant. Dr. Sekhonadmitsthat the interview
beganwithlunchandthat, afterlunch,heandthe prospectivephysicianassistant
returnedto Dr. Sekhon'sofficetocontinuetheinterview. Atthe end ofthe interview,
Dr. Sekhonkissedthe cheekof the prospectivephysicianassistant. Dr.Sekhon
acknowledgesthatthe kiss was unwantedbythe physicianassistantand made her feel
uncomfortable.
Dr. Sekhonalso admitsthat, inor around2004 or 2005,ashe was leavingthe office,
he startedto give his officemanageragoodbyekiss. Atthe momentof the kiss, Dr.
Sekhonstatesthathelickedhis lipsand thathis tonguetouchedhis officemanager's
lips ormouth. Dr. Sekhonadmitsthathisoffice managerbelievedthatDr. Sekhon
hadgivenheraFrenchkiss. Dr. Sekhonacknowledgesthatthe kiss made the office
managerfeel uncomfortable.
Dr. Sekhonadmitsthatthe resident,the physicianassistantand the officemanager
identifiedaboveare his colleagues. Dr. Sekhonfurtheradmitsthatthe residentand
the physicianassistantidentifiedabove arehealthprofessionals. Additionally,Dr.
Sekhonadmitsthat he didnot behaveprofessionallytowardthese colleaguesand
healthprofessionalsandthathe did not respecttheirrights. Dr. Sekhonspecifically
deniesthatheeverhad aphysician-patientrelationshipwith anyof the
aforementionedindividuals.
AGREED CONDITIONS
Wherefore,inconsiderationof theforegoingand mutualpromiseshereinaftersetforth, and in
lieu ofany formalproceedingsatthistime, Dr. Sekhonknowinglyand voluntarilyagreeswith
the Boardto the followingterms, conditionsand limitations:
1. BaldevS. Sekhon,M.D. isherebyREPRIMANDED.
Further,Dr. Sekhonknowinglyand voluntarilyagreeswith the Boardtothe following
PROBATIONARYterms,conditionsand limitations:
2. Dr. Sekhonshall obey all federal, state,and local laws, and allrulesgoverningthe
practiceof medicineinOhio.
3. Dr. Sekhonshall submitquarterlydeclarationsunderpenaltyofBoarddisciplinary
actionorcriminalprosecution,statingwhethertherehas beencompliancewithallthe
conditionsof this ConsentAgreement. The firstquarterlydeclarationmustbe
receivedinthe Board'sofficesonthe first dayof the third monthfollowingthe month

inwhichthis ConsentAgreementbecomeseffective,orasotherwiserequestedbythe
Board. Subsequentquarterlydeclarationsmustbe receivedinthe Board'sofficeson
orbefore the first dayofevery thirdmonth.
4. Dr. Sekhonshall appearinpersonforaninterviewbefore thefull Boardorits
designatedrepresentativeduringthethirdmonth followingtheeffectivedateof this
ConsentAgreementotherwiserequested bytheBoard,exceptthat subsequent
personalappearanceswhichwouldroutinely occureverythreemonthsthroughoutthe
durationof theConsentAgreementshall be waivedbytheBoardprovidedthat Dr.
SekhonisotherwiseinfullcompliancewiththisConsentAgreement. If an
appearanceismissedorisrescheduledforanyreason,ensuingappearancesshall
revertto beingrequiredevery three monthsandshallbescheduledbasedonthe
appearancedate asoriginallyscheduled.
5. In the eventDr.Sekhonisfound bythe Secretaryof the Boardtohave failed to
complywithanyprovisionof thisConsentAgreement,and issonotifiedof that
deficiencyinwriting,suchperiod(s)ofnoncompliancewill notapplytothereduction
ofthe probationaryperiodunderthis ConsentAgreement.

6. Beforethe end ofthefirst six monthsofprobation,orasotherwiseapprovedbythe
Board,Dr. Sekhonshallprovideacceptabledocumentationofsuccessfulcompletion
ofacourseorcoursesdealingwith professionalboundaries. Theexactnumberof
hoursandthe specificcontentof thecourseorcoursesshall besubjecttothe prior
approvalof the Boardorits designee.
Inaddition,atthe time Dr. Sekhonsubmitsthedocumentationofsuccessful
.completionof thecourseorcoursesdealingwithprofessionalboundaries,he also
shall submitto the Board awrittenreport describingthe course,settingforth what he
learnedfrom thecourse,and identifyingwithspecificityhowhewill apply what he
has learnedtohis practiceofmedicineand surgery inthe future.

7. Withinthirtydays ofthe effectivedate of this ConsentAgreement,Dr. Sekhonshall
provideacopyof thisConsentAgreementto allemployersorentities with whichhe
isundercontracttoprovidehealthcare services (includingbut notlimitedtothird
party payors)or is receiving training. and theChief of Staff at each hospital where he
has privilegesorappointments. Further, Dr. Sekhonshall promptlyprovideacopyof
this ConsentAgreementtoallemployersorentitieswithwhich hecontractsto
providehealthcare services,orapplies fororreceivestraining, andtheChief of Staff
ateachhospitalwhere he appliesfororobtainsprivilegesor appointments. Inthe
eventthat Dr.Sekhonprovidesanyhealth careservicesorhealthcare directionor

medicaloversightto any emergencymedicalservicesorganizationoremergency
medicalservicesprovider,withinthirty daysoftheeffectivedate of this Consent
AgreementDr. Sekhonshall provideacopy ofthisConsentAgreementto the Ohio
DepartmentofPublicSafety,DivisionofEmergencyMedicalServices. Further,Dr.
Sekhonshallprovidethe Boardwith oneof the followingdocumentsasproofof each
requirednotificationwithinthirtydaysof thedateofeachsuchnotification: (1)the
returnreceiptofcertifiedmail within thirtydaysof receivingthatreturnreceipt,(2)an
acknowledgementofdeliverybearingtheoriginalink signatureof the personto
whomacopyof the ConsentAgreementwashanddelivered,(3) theoriginal
facsimile-generatedreportconfirmingsuccessfultransmissionofacopy ofthe
ConsentAgreementtothepersonorentitytowhomacopy ofthe ConsentAgreement
wasfaxed, or(4)an originalcomputer-generatedprintoutof electronicmail
communication documenting the email transmissionof a copy ofthe Consent
Agreementtothe personorentityto whomacopy of the ConsentAgreementwas
emailed.
8. Withinthirtydaysofthe effectivedate ofthis ConsentAgreement,Dr. Sekhonshall
provideacopyofthis ConsentAgreementtothe properlicensingauthorityofany
state orjurisdictioninwhichhecurrentlyholds any professionallicense,aswell as
anyfederalagency orentity,includingbut not limitedto the DrugEnforcement
Agency,throughwhichhecurrentlyholdsanylicenseorcertificate. Dr. Sekhon
furtheragreesto provideacopyofthis ConsentAgreementattime ofapplicationto
the properlicensingauthorityof any state inwhichhe appliesfor anyprofessional
licenseorfor reinstatementofanyprofessionallicense. Further, Dr.Sekhonshall
providethe Boardwith one of the followingdocumentsasproof ofeachrequired
notificationwithinthirtydaysof the date ofeachsuchnotification: (1) the return
receiptof certifiedmail withinthirtydaysof receivingthatreturnreceipt,(2) an
acknowledgementofdeliverybearingthe originalink signatureof the personto
whomacopyof the ConsentAgreementwas handdelivered,(3)the original
facsimile-generatedreportconfirmingsuccessful transmissionofacopyof the
ConsentAgreementto the personorentity towhomacopy of the ConsentAgreement
was faxed,or(4) anoriginalcomputer-generatedprintoutofelectronicmail
communicationdocumentingthe email transmissionofacopy ofthe Consent
Agreementtothe personorentitytowhomacopy oftheConsentAgreementwas
emailed.
9. Dr. Sekhonshall notifytheBoardinwritingofany changeof principalpractice
addressorresidenceaddresswithinthirtydays ofsuch change.
FAILURE TO COMPLY
If, in the discretionof the Secretary and Supervising Memberofthe Board, Dr. Sekhon appears
to haveviolatedorbreachedany termor conditionof this ConsentAgreement,the Board

reserves the right to institute formal disciplinary proceedings for any and all possible violations
or breaches, including, but not limited to, alleged violations of the laws of Ohio occurring before
the effective date of this Consent Agreement. .
If the Secretary and Supervising Member of the Board determine that there is clear and
convincing evidence that Dr. Sekhon has violated any term, condition or limitation of this
Consent Agreement, Dr. Sekhon agrees that the violation, asalleged, also constitutes clear and
convincing evidence that his continued practice presents a danger ofimmediate and serious harm
to the public for purposes of initiating a summary suspensionpursuant to Section 4731.22(G),
Ohio Revised Code.
DURATIONIMODIFICATION OF TERMS
The Reprimand of Dr. Sekhon shall not terminate. Dr. Sekhon shall not request termination of
this Consent Agreement for a minimum ofone year. In addition, Dr. Sekhon shall not request
modification to the probationary terms, limitations, and conditions contained herein for at least
one year. Otherwise, the above-described terms, limitations and conditions may be amended or
terminated in writing at any time upon the agreement of both parties.
In the event that the Board initiates future formal proceedings against Dr. Sekhon, including but
not limited to issuance of a Notice of Opportunity for Hearing, this Consent Agreement shall
continue in full force and effect until such time that it is superseded by ratification by the Board
of a subsequent Consent Agreement or issuance by the Board of a final Board Order.
ACKNOWLEDGMENTSILIABILITY RELEASE
Dr. Sekhon acknowledges that he has had an opportunity to ask questions concerning the terms
of this Consent Agreement and that all questions asked have been answered in a satisfactory
manner.
Any action initiated by the Board based on alleged violations of this Consent Agreement shall
comply with the Administrative Procedure Act, Chapter 119., Ohio Revised Code.
Dr. Sekhon hereby releases the Board, its members, employees, agents, officers and
representatives jointly WId severally from any and all liability arising from the within matter.
This Consent Agreement shall be considered a public record as that term is used in Section
149.43, Ohio Revised Code. Further, this information may be reported to appropriate
organizations, data banks and governmental bodies. Dr. Sekhon acknowledges that his social
security number will be used ifthis information is so reported and agrees to provide his social
security number to the Board for such purposes.
