Outline for Complaint to Commission on Judicial Performance for Judicial Misconduct, Collusion and Bias Leading to Endangerment of a Child

(i.e. Cover Up of Sexual Abuse)

OUTLINE
1. MISCONDUCT a. Misconduct involving evidence i. Suppression of evidence 1. Keeping evidence off the record a. not allowing evidence on the record b. not allowing witnesses to testify (including the child) c. striking testimony supporting the abuse from the record 2. Denying access to evidence of abuse, e.g. forensic videotapes , inchamber interviews, witness testimony, etc. ii. Manipulation of evidence 1. Distortion to place blame on mom 2. Distortion to deflect blame from father iii. Fabrication of evidence 1. Fabrication of evidence against protector 2. Fabrication of evidence for abuser iv. Disregard of evidence 1. Ignore and minimize evidence which would easily meet preponderance for a member of the public/jury of peers b. Misconduct involving privacy laws and policies to avoid public scrutiny and silence mothers and children 1. Official gag orders 2. Unofficial verbal or covert threats/warnings to not speak about the abuse with loss of custody/visitation as punishment 3. Sealing records 4. Denying transcripts c. Misconduct involving severe punishment of mothers apparently to intimidate and silence i. Deprivation of custody/ visitation 1. Switch primary custody to father 2. Decreased parenting time 3. Supervised visits unwarranted ii. Abuse of contempt powers 1. Sanctions

2. Jail d. Misconduct involving collusion i. Ex parte communication 1. Between judges and minors counsels, opposing counsels, 730 evaluators, therapists, mediators, D.A.s etc. ii. Ex parte hearings 1. Hearings at which mom is not present or notified 2. Hearings at which major custody and visitation decisions are made without due process 2. BIAS a. Biased findings i. Use of the invalid Parental Alienation theory ii. Labeling mothers mentally ill or unstable without credible evidence iii. Contradictory findings, e.g. mother is alienating and mother believes the abuse occurred b. Appointment of childrens attorneys, psychologists and others i. Known by the judge/regularly used by the court in abuse cases to support rulings which favor abuser ii. Known for using alienation/mental illness against protective mothers iii. Known to be affiliated with fathers rights groups c. Derogatory and biased remarks and attitudes in court i. Favoritism to father 1. Respectful speaking to father e.g. Mr. 2. Praising father/embellishing ii. Disrespectful attitude towards mother 1. Not respectful addressing of mother/Talking down to her/minimizing strengths and accomplishments 2. Holding mother to higher standard iii. Praising of minors counsels and others who are siding with the abuser d. Campaign contributions or any financial motives for bias
