Adjudication is a form of dispute resolution between claimant and respondent. Adjudicator is authorized by Singapore Mediation Center (SMC).

Adjudication is conducted by accordance with SOP (Security of Payment) act. Adjudicators determination is binding to both parties. Although they may pursue their rights further to Court <or> Arbitration. Right to apply adjudication 1. 2. 3. 4. Fail to respond payment by respond due date. Responds to payment claim but dispute responds amount. Respond to payment claim, claimant accept but fail to pay by due date. Pay less than claim.

Adjudication Application i. ii. May apply within 7 days after payment due date. Within 7 days after last day of settlement because dispute remains unresolved.

Adjudication Procedure 1. Application to be made by an adjudicator who will be appointed by ANB (Authorized Nominating Body). 2. Respondent to lodge adjudication respond within 7 days after received the copy of adjudication application. 3. Adjudication commences immediately after the end of the 7-day adjudication response period. 4. Adjudicator determine in three ways:
For construction contract, determine 7 days after commencement of adjudication. For any other cases, 14 days after commencement of adjudication. Any longer time required by the adjudicator and agreed by the parties.

Determination and Review Respondent must pay the adjudicated amount with 7 days after determination or a later date determined by adjudicator. Respondent may apply for adjudication review within 7 days after determination only if the respondent has paid fully. Enforcement of adjudication determination 1. Suspension of work 2. Lien on materials <or> goods delivered. 3. The determination may be enforced as judgment for the unpaid amount.

Retention Monies (RM) 1. Retention money is provided for general protection of the employer. A sum of money held by employer as safeguard against defective/non-conforming work /materials provided by the contractor. Its intention is to protect the employer against latent defects which may develop subsequently and the contractors possible failure to complete the contract. 2. It is deducted from the valuation of works done progressively at each certificate. 3. The sum is calculated by a percentage of the gross value of works included in a valuation. 4. It is normally 10% of the value of the valuation at that month. 5. The amount of retention monies is also subjected to a maximum fixed amount <or> a percentage of the Contract sum. Normally 5% of the Contract Sum. 6. Retention Monies shall be released to contractor when the job is substantially completed and all defects are rectified.
