SUBLET AGREEMENT

This agreement made this _____________________________________, 20 _____________ BETWEEN: _____________________________________________________________________________ Hereinafter called the TENANTS of the first part. AND: __________________________________________________________________________________ Hereinafter called the SUB-TENANTS of the second part. Whereas the Tenants are signatories of a certain Tenancy Agreement dated ________________________, 20____________ BETWEEN: ______________________________________________________________ TENANTS AND: ______________________________________________________________ LANDLORD And whereas the Tenants are desirous of subletting their premises and whereas the Sub-Tenants are desirous of occupying the premises now currently rented by the Tenants, municipally known as __________________________________, Toronto, Ontario and the parties hereto agree as follows: 1. The Sub-Tenants tenancy shall commence on __________________________, 20____ and shall be completed and ended on _____________________, 20_____. 2. The Tenants may direct the Sub-Tenants pay the aforementioned rent directly to the Landlord or to whomever the Tenants direct. 3. The Sub-Tenants shall abide by all terms and conditions in the Tenancy Agreement dated ______________________________, 20____ as if they were the signatories thereto. 4. The Sub-Tenants and Tenants agree that all terms and conditions existing in the Tenancy Agreement dated ______________________________, 20 ____ shall govern the relationship between the Tenants and the Sub-Tenants, and the Tenants and the Sub-Tenants agree that the Sub-Tenants shall be bound by all of the terms and conditions in the aforementioned Tenancy Agreement. SUBLETTING
According to the Tenant Protection Act, Section 18: With the consent of the landlord, a tenant may sublet a rental to another person, thus giving the other person the right to occupy the rental unit for a term ending on a specified date before the end of the tenants term or period and giving the tenant the right to resume occupancy on that date. A landlord shall not arbitrarily or unreasonably withhold consent to the sublet of a rental unit to a potential subtenant. A landlord may charge a tenant only for the landlords reasonable out of pocket expenses incurred in giving consent to a subletting. If a tenant has sublet a rental unit to another person, (a) the tenant remains entitled to the benefits, and is liable to the landlord for the breaches, of the tenants obligations under the tenancy agreement or this Act during the subtenancy; and (b) the subtenant is entitled to the benefits, and is liable to the tenant for the breaches, of the subtenants obligations under the subletting agreement or this Act during the sub-tenancy. A subtenant has no right to occupy the rental unit after the end of the sub-tenancy.
