Client shall be responsible for+ within 5$U.*E&6 b:siness days fro0 the date of this Agree0ent+ providing &egistrant with a list of 5$U.*E&6 and no 0ore than 5$U.*E&6 desired do0ain na0es+ listed in order of preference. Upon receipt of the above referenced list of desired do0ain na0es+ &egistrant shall search s:ch na0es for availability in order of preference stated by the Client. &egistrant shall search s:ch desired na0es :ntil the first s:ch na0e is shown to be available. Upon deter0ining that the first s:ch na0e is available+ &egistrant is hereby given the a:thority as Client@s agent and attorney in fact+ to taAe all steps necessary to register s:ch do0ain na0e.

PAYMENT

n consideration of the services to be perfor0ed by the &egistrant here:nder+ Client agrees to pay :pon e9ec:tion of this Agree0ent and prior to the &egistrant perfor0ing any services here:nder+ an a0o:nt eB:al to 5A.(U$!6 as a service fee for perfor0ing the do0ain na0e search and registration on behalf of Client. Additionally+ :pon e9ec:tion hereof+ Client shall pay &egistrant an a0o:nt eB:al to 5A.(U$!6 to cover the fee for initial registration of s:ch do0ain na0e.

1.

RIGHTS

&egistrant acAnowledges and agrees that the &egistrant shall not own any right+ title or interest in and to any registered do0ain na0e p:rs:ant to this Agree0ent and that the do0ain na0e registered for Client shall be owned by the Client and not by the &egistrant. Client acAnowledges that this agree0ent can only be 0ade as between the potential rights of Client and &egistrant and that &egistrant cannot represent that a third party will not have or clai0 right in and to any do0ain na0e that is registered :nder the ter0s of this Agree0ent.

AVAILABILITY OF THE DOMAIN NAMES

n the event that none of the do0ain na0es on Client@s list are available for registration+ &egistrant shall infor0 Client of this fact. !hereafter+ Client shall be responsible for providing another listing of 5$U.*E&6 to 5$U.*E&6 desired na0es. Upon receiving the second list of desired na0es+ &egistrant shall search s:ch na0es and register the first available na0e based :pon the Client@s ordered preference. f no na0e is available following the search of the second list of na0es+ &egistrant shall so infor0 the Client and the &egistrant shall have no f:rther obligations to the Client with respect to the do0ain na0e. Upon receipt of s:ch notification+ Client shall elect whether to contin:e with the search process+ in which event another service fee shall be payable to the &egistrant+ less any a0o:nt paid to the registrant for the price of the do0ain na0e. Upon election to contin:e with the process+ Client shall s:b0it another list of desired na0es listed in order of preference along with pay0ent of the second service fee. Upon receipt of the new preference list and the second services fee+ the registration process described above shall be reinitiated. f Client does not wish to go forward :pon receipt of the notice that the desired na0es are not available after providing two desired lists+ the service fee shall be retained by the &egistrant for services %o0ain $a0e &egistration Agree0ent Page 2 of ?

rendered and the Client shall be entitled to a ref:nd of any a0o:nt paid to &egistrant for the act:al cost of paying for the registration to a third party. ,ollowing registration of a desired do0ain na0e+ &egistrant shall infor0 the Client and provide the Client with all relevant registration infor0ation+ n:0bers and passwords. Client represents+ warrants+ acAnowledges and agrees that &egistrant cannot g:arantee that any desired na0e will be available for registration. &egistrant is not responsible for any third party who 0ay have registered or in the f:t:re 0ay register any of the na0es desired by the Client or the assertion of any rights in and to s:ch na0es by any third party.

INFRINGEMENT

!he Client represents and warrants to the &egistrant that the na0es provided on any preference list shall not infringe :pon the trade0arAs or other proprietary rights of any other party and that the Client is the bona fide owner of all proprietary rights associated with each s:ch na0e. Client acAnowledges that &egistrant has infor0ed Client that a co0prehensive co00on law trade0arA search sho:ld be perfor0ed prior to selecting any do0ain na0e for registration to deter0ine whether s:ch na0e co:ld infringe :pon the proprietary or trade0arA rights of any third party. !he Client hereby represents+ warrants and agrees that it has had a trade0arA search perfor0ed with respect to s:ch na0e and that Client ass:0es any and all responsibility or liability that 0ay arise fro0 the registration and;or :se of any do0ain na0e registered. Client shall inde0nify and hold registrant har0less fro0 and against any assertion of potential proprietary rights by any third party+ incl:ding b:t not li0ited to attorney fees in addressing any s:ch sit:ation. $otwithstanding the above+ &egistrant does not ass:0e any responsibility for addressing any clai0ed infringe0ent that 0ay arise fro0 the registration or :se of any do0ain na0e that is registered.

RENEWAL

Client shall be responsible for renewing any do0ain na0e registered here:nder and &egistrant shall have no obligation to provide renewal services or to infor0 Client of any necessary renewals.
