ustomer"#$ desires to utili%e the services of S.Q.U.A.D. Engineering &&!.$ Doing 'usiness As Tune E(S$ (hereinafter collectively referred to as the !om)any"# to )erform diagnostic and )erformance testing of !ustomer*s motor vehicle and various com)onents thereof. !ustomer understands and agrees that the !om)any +ill utili%e a chassis dynamometer and various data ac,uisition devices to )erform this testing. A chassis dynamometer is a device that +ill -e used -y the !om)any to ac,uire )erformance data on !ustomer.s motor vehicle -y engaging and )lacing load on the )o+er train of the motor vehicle +hile the vehicle remains in a stationary )osition resting on to) of the chassis dynamometer. Data sam)les may include$ -ut shall not -e limited to$ Engine S)eed$ /ehicle S)eed$ 0orse)o+er and Tor,ue. !ustomer recogni%es and ac1no+ledges that modifications to their vehicle*s engine$ transmission and2or other com)onents of the vehicle*s )o+er train resulting in re)lacement of 3E( )arts on the vehicle may )lace additional stress u)on the vehicle not intended in the manufacturer*s engineering design. !ustomer recogni%es and ac1no+ledges that )erforming diagnostic and )erformance testing of the vehicle utili%ing a chassis dynamometer entails certain )eril and ris1 to the vehicle and its )o+er train com)onents. Such ris1s include$ -ut are not limited to damaging internal engine com)onents such as valves$ )istons$ connecting rods$ transmission failure$ drive shaft -rea1age$ clutch damage$ sus)ension damage$ and damage to -ody )anels. !ustomer ac1no+ledges a+areness of the aforementioned ris1s$ the )ossi-ility that diagnostic and )erformance testing of this ty)e could result in catastro)hic damage to !ustomer vehicle com)onents including$ -ut not limited to$ the )o+er train. 4n consideration for the !om)any rendering the foregoing services$ !ustomer here-y agrees to s)ecifically assume all ris1 of loss and damage to !ustomer*s vehicle and here-y +aives any and all claims for damages against the !om)any$ its officers$ directors$ shareholders$ agents and em)loyees in connection +ith the services rendered -y the !om)any to the !ustomer. This includes -ut is not limited to$ claims for )roduct lia-ility$ e5)ress or im)lied +arranty$ -reach of contract and negligence. The !om)any ma1es no e5)ress or im)lied +arranties or other+ise agrees to e5tend or su))lement any manufacturer*s +arranty on !ustomer*s vehicle. !ustomer further agrees to release and hold harmless the !om)any$ its officers$ directors$ shareholders$ agents and em)loyees from any and all claims for damages$ causes of action$ and chooses in e,uity that may arise in connection +ith services rendered to !ustomer -y the !om)any. This release is intended to -e as -road and inclusive as )ermitted -y la+$ and if any )ortion thereof is held invalid$ the -alance shall continue in full legal force and effect. !ustomer agrees to assume the ris1s descri-ed herein$ +aives )otential future claims for damages and to release the !om)any from any and all lia-ility arising from services )rovided -y the !om)any. This agreement is a condition )recedent to and consideration for agreement of the !om)any to allo+ use of its e,ui)ment and )rovide services to the !ustomer. This Agreement shall -e construed in accordance +ith the la+s +ithin the state of the service )rovided and venue for any civil action arising from this agreement$ its inter)retation and2or any service rendered -y the !om)any shall -e in a court of com)etent 6urisdiction in the State of (assachusetts.

(a5imum test s)eeds and engine 9P( must -e stated on this disclaimer form. A signed co)y of the form must -e su-mitted -efore the test session -egins. 3nly single a5le drive vehicles can -e tested. :All<=heel: or any other system that cannot isolate a single drive a5le cannot -e measured. Tires must -e in servicea-le condition and rated for o)eration +ithin the agreed s)eed limits of the test session. All safety devices must -e in )lace and o)erational$ as )er current >09A rules. i.e. driveshaft loo)s$ shields$ etc. on cars e,ui))ed +ith slic1s. 0earing )rotection is re,uired +ithin the test area. All dyno services must -e )aid for in full -efore any services are rendered. This form must -e filled out com)letely and filed -efore any services are rendered.

4 agree that 4 have read and com)leted the )re<tune chec1list and that my vehicle is in a tune ready state. 4f the tune cannot -e com)leted due to the car not -eing in a tune ready state$ the de)osit (?2@# for that tuning session +ill -e forfeited. Aou are )urchasing a slot of time on the dyno. 4f your car cannot -e on the dyno due to it not -eing in the )ro)er running condition$ your time is still e5)iring. (ost cars +ill -e smo1e tested to chec1 for vacuum lea1s )rior to -eing )laced on the dyno. This is included in the )rice of the tune. Any )arts$ chemicals$ lu-ricants$ hard+are and2or com)onents used -y The !om)any to successfully com)lete the dyno session +ill -e additional. Any vehicle on the chassis dyno that is in need of re)air or modification to com)lete a successful tuning session +ill -e su-6ect to an additional charge of the regular sho) hourly rate (?B@2hr# to correct the )ro-lem -efore dyno tuning can commence or resume.
