Before You Apply


Permanent Residence under the Business Immigration Program
The Business Immigration Program Canada welcomes successful business people who are seeking new opportunities and challenges. The Business Immigration Program is designed to encourage and facilitate the admission of these individuals. Both the federal and provincial/territorial governments welcome business immigrants and offer services to help immigrants start a business and settle in Canada.

Types of Business Immigrants


Canada has four classes of business immigrants: start-up business, investors , entrepreneurs, and self-employed persons. This guide will help you to apply under the Start-up Business Class. Please read carefully the definitions and the instructions below.

What is a start-up business?


A new business intended to be operated in Canada which has received a commitment from a designated angel investor group, venture capital fund or business incubator. Start-up Business Definitions Designated angel investor group/venture capital fund/business incubator An entity designated by the Minister as eligible to issue commitments under the Start Up Business program. Consult the full list (/english/immigrate/business/start-up/eligibility/entities.asp).

Qualifying business A business that will operate in Canada and is, or will be, incorporated in Canada. Specific requirements related to percentage of ownership will be identified by the Minister and may change from time to time. Qualified participant A person who has been issued a permanent residence document based on their application as a member of the Start Up Business class Or A designated angel investor group Or A designated venture capital fund. Essential person A person who is considered to be essential to the business and who has been identified as essential by the designated angel investor group or venture capital fund on the commitment certificate and Letter of Support. Commitment An agreement between an applicant and a designated angel investor network, venture capital fund or business incubator. Commitment Certificate A commitment sent electronically to CIC from the designated angel investor group, venture capital fund or business incubator. Letter of Support A letter given to the applicant by the designated angel investor group, venture capital fund or business incubator.

Do you intend to reside in Quebec?


Individuals who intend to reside in Quebec are not eligible to apply under the Start-up Business Class. Under the Canada-Quebec Accord on Immigration, Quebec establishes its own immigration requirements and selects immigrants who will adapt well to living in Quebec. If you intend to come to Canada as a Quebec-selected permanent resident, you must first contact the Ministre de lImmigration et des Communauts culturelles (MICC) at: www.micc.gouv.qc.ca/fr/index.asp (http://www.micc.gouv.qc.ca/fr/index.asp) (in French only). Eligibility criteria
For your application to be eligible for processing, you must: have received a Letter of Support from a designated entity AND meet the language requirements AND meet the education requirements AND have sufficient settlement funds Note: A maximum of 2,750 applications will be processed per year under the Start-up Business Class. No more than five persons may be part of a single commitment from a designated business entity. If your commitment has more than one person related to the business proposal, an application for each person named in the Commitment Certificate must be received. This means that if a husband and wife are both named in the Commitment Certificate, then an application and supporting documents must be submitted for the husband and a separate application with supporting documents must be submitted for the wife.

The following information will help you determine if you meet the eligibility criteria indicated above.

Note. If you do not meet all of the criteria described above, do not submit an application under the Start-up Business Class, as your application will be refused. Check the other classes (/english/immigrate/index.asp) to see if you satisfy their eligibility criteria. Important information. It is important that you make a careful assessment before you apply because certain fees, such as the processing fee, are non-refundable, even if your application is refused.

What are the requirements for applicants under the Start-up Business Class?
Your application to come to Canada under the Start-up Business Class will be assessed on a pass/fail basis against four requirements. The four requirements are: Requirement 1: Commitment from a Designated Entity Requirement 2: Ability in English, in French or both Requirement 3: Education Requirement 4: Settlement Funds If you meet all four requirements indicated above, then you may qualify to immigrate to Canada under the Start-up Business Class. Below are detailed descriptions of all the requirements that are to be assessed. Carefully review the following information and then decide if you want to apply under this class.

Requirement 1: Commitment from a Designated Entity


Private sector organizations demonstrate their support of your business idea by providing you with a Letter of Support which details the commitment they are willing to make towards your new business. They will send further details in the form of a Commitment Certificate directly to CIC (Citizenship and Immigration Canada) for assessment, based on the Ministerial Instructions (/english/department/mi/index.asp). For your application to be eligible for processing, you must have received a Letter of Support from: a designated angel investor group confirming that it is investing at least $75,000 in a qualifying business or two or more designated angel investor groups confirming that they are together

investing a total of at least $75,000 in such a business, or a designated venture capital fund confirming that it is investing at least $200,000 in a qualifying business or two or more designated venture capital funds confirming that they are together investing a total of at least $200,000 in such a business, or a designated business incubator which confirms that it accepting a qualifying business into its program What to do with the Letter of Support once you have it? You must include your Letter of Support with your application. If you do not, your application will be returned to you as incomplete. Where to obtain a Letter of Support? Consult the list (/english/immigrate/business/start-up/eligibility/entities.asp) of designated venture capital funds, angel investor groups and business incubators. How long is the Letter of Support valid for? Each Letter of Support is valid for a period of six months from the date it was issued. This means that CIC must receive your application for permanent residence under the Start-up Business Class within six months of the Letter of Support being issued.

Requirement 2: Ability in English, in French or both


The ability to communicate and work in one or both of Canadas official languages is very important to you as a business immigrant. Proficiency in English, French or both will help you in the Canadian labour market. You meet the language proficiency requirement for the Start-up Business Class if you have a level of proficiency of at least benchmark level 5 in either official language for all four language skill areas, as set out in the Canadian Language Benchmarks and the Niveaux de comptence linguistique canadiens. You will be assessed on the following language skill areas: listening,

speaking, reading, and writing. You must provide proof of your language proficiency with your application.

Proof of language proficiency


For your application to be eligible for processing, you must include original results of one of the following language tests from a testing agency designated by CIC with your application: English IELTS: International English Language Testing System (General Training test only) CELPIP: Canadian English Language Proficiency Index Program (General test only) French TEF: Test dvaluation de franais Note. If you do not submit the original results of your official language proficiency test with your application to the Central Intake Office (CIO), your application will not be processed and will be returned to you as incomplete. Your test results must not be more than two years old at the time that you submit your application.

Official language testing


To prove your language skills, you must take a language test given by an agency that is approved by CIC, and include the results with your application. Requirement 3: Education
You must have completed at least one year of post-secondary education during which you were in good standing at the educational institution, whether or not you obtained an educational credential. Proof of education You must provide proof of your education with your application. If you do not, your application will not be processed and will be returned to you as incomplete. You must provide proof of having completed at least one year of post-secondary education. You must also provide proof that you were in good standing for at least one year while you were attending a post-secondary institution, according to the standards of the institution.

Requirement 4: Settlement funds (money required to settle in Canada)


The Government of Canada does not provide financial support to business immigrants. You must show that you have enough money to support yourself and your family members after you arrive in Canada. The money must be available to support the costs of living for yourself and your family. The amount is an estimate of what you would require to support yourself and your family without employment or other income. You cannot borrow this money from another person. The amount of money you need to support your family is determined by the size of your family. These amounts are updated every year. Check our website (/english/immigrate/skilled/funds.asp) to make sure you have the most recent information. You must submit proof of settlement funds with your application. If you do not, your application will not be processed and will be returned to you as incomplete. We strongly recommend that you research the cost of living in the region of Canada where you intend to live. To make your establishment in Canada easier, bring as much money as possible with you to Canada. You should be aware that Canadian legislation requires persons entering Canada to declare cash funds of $10,000 CDN or more. You will have to disclose these funds to a Canadian official upon arrival. Cash funds means: money (coins or bank notes),

securities in bearer form (stocks, bonds, debentures, treasury bills, etc.), and negotiable instruments in bearer form (bank drafts, travellers cheques, money orders, etc.).

Step 1. Gather Documents


What documents are required?

Important information. If any of the required documents are missing, or photocopies are not clear, your application will be returned to you as incomplete.

Medical requirements
You and your family members, whether accompanying you or not, must undergo and pass a medical examination in order to come to Canada. To pass the medical examination you or your family members must not have a condition that: is a danger to public health or safety would cause excessive demand on health or social services in Canada. Examples of excessive demand include ongoing hospitalization or institutional care for a physical or mental illness. Instructions Information on medical instructions will be provided to you. When you receive your assessment notice you will also receive medical forms for yourself (and any accompanying dependants if applicable), instructions and how to access a list of doctors in your area who are authorized to conduct immigration medical examinations (see below). You are not required to have a medical examination before you submit your application forms. Exam validity

The medical examination results are valid for 12 months from the date of the first medical examination. If you are not admitted as a permanent resident during this time, you must undergo another complete medical examination. Authorized doctors Your own doctor cannot do the medical examination. You must see a physician on Canadas list of Panel Physicians (http://www.cic.gc.ca/pp-md/pp-list.aspx). Note that the physician is only responsible for conducting a medical examination; he or she cannot give you any advice on the immigration process.

Police certificates
You and your family members who are 18 years of age and older and are not permanent residents or Canadian citizens must provide: valid police certificate, or police clearance, or record of no information. These documents are to be provided for each country other than Canada, in which you have lived for six (6) consecutive months or longer since reaching the age of 18. Note: If you or your family members were under 18 years of age (16 years of age in certain jurisdictions) for the entire time you lived in a particular country, you do not need to provide a police certificate for that country.

The certificate must have been issued no more than three (3) months prior to submitting your application. If the original certificate is not in English or French, then you will need to submit both the certificate and the original copy of the translation prepared by an accredited translator. We will also do our own background checks to determine if there are grounds under which you and your dependants may be inadmissible to Canada. Please consult our website for specific and up-to-date information on how to obtain police certificates from any country (/english/information/security/police-cert/index.asp).

How to obtain police certificates


Step 1. Apply for certificates
It is your responsibility to contact the relevant authorities. Certificates are usually issued by the police of the country concerned, but in some countries you will have to apply to municipal, provincial, federal or other government authorities. The country's embassy or consulate in Canada may be able to give additional information. When applying for police certificates, you should include for each person: A completed Request for Police Certificates/Clearances and Authorization for Release of Information) (PDF (Portable Document Format), 59 KB (Kilobyte)) (/english/information/applications/guides/pdf/PC_LetterA_e.pdf) form (see Appendix A). Include photocopies for each applicant. A set of fingerprints, if required by the authority of the country. Your local police or RCMP may be able to tell you where you can get fingerprints done. Take the Fingerprint Request Letter (PDF (Portable Document Format), 56 KB (Kilobyte)) (/english/information/applications/guides/pdf/PC_LetterB_e.pdf) and your photo identification (passport, travel document, etc.) with you when you go to get fingerprints taken. You may have to pay a fee. Your complete mailing address (certificates will be sent directly to you).

Step 2. Submit the certificates


Include the police certificates with your application. If the police authorities notify you that they will submit the certificates directly to us, include this notice with your application. All police certificates must be originals; photocopies are not acceptable. If your certificates are in a language other than English or French, attach an original translation prepared by an accredited translator.

What if I cannot get the police certificates?

If you cannot get police certificates from any of the countries where you have lived, you must provide a written explanation with your application and an original letter from the police authority confirming that they will not issue a certificate.

Translation of documents
Any document that is not in English or French must be accompanied by: the English or French translation; and an affidavit from the person who completed the translation; and a certified copy of the original document. Note: An affidavit is a document on which the translator has sworn, in the presence of a commissioner authorized to administer oaths in the country in which the translator is living, that the contents of their translation are a true translation and representation of the contents of the original document. Translators who are certified members in good standing of one of the provincial or territorial organizations of translators and interpreters of Canada do not need to supply an affidavit.

Important information. Translations by family members are not acceptable.

Certified true copies


To have a photocopy of a document certified, an authorized person must compare the original document to the photocopy and must print the following on the photocopy: I certify that this is a true copy of the original document, the name of the original document, the date of the certification, his or her name, his or her official position or title, and

his or her signature.

Who can certify copies?


Persons authorized to certify copies include the following: In Canada: a commissioner of oaths a notary public a justice of the peace Outside Canada: a judge a magistrate a notary public an officer of a court of justice a commissioner authorized to administer oaths in the country in which the person is living Family members may not certify copies of your documents.

The following questions must be answered by the Principal Applicant. Question 1 Indicate your full family name (surname or last name) as it appears on your passport, travel or identity document. Note: If you are a parent of a child to be adopted in Canada who is not yet identified, indicate your family name(s).

Indicate all of your given name(s) (first, second or more) as they appear on your passport, travel or identity document. Do not use initials. Note: If you are a parent of a child to be adopted in Canada who is not yet identified, indicate Child or leave the given name field blank.

Nickname/Alias Check the box to indicate if you have ever used any other name than those indicated in question one. This could be your birth name, maiden name, married name, nickname, etc. If Yes, provide your nickname/alias by indicating it in the family name and given name(s) fields.

Question 3

Indicate your Unique Client Identifier number (UCI) or Client Identification number (Client ID), if known (8-digit number). Otherwise, leave it blank. If this is your first application with CIC (Citizenship and Immigration Canada) you will not have a UCI (Universal Client Identification) or a Client ID (Identification). From the list, select your sex (male, female or unknown). Note: If you are a parent of a child to be adopted in Canada who is not yet identified, select Unknown.

Question 10

Current country of residence

From the list, select the appropriate information to indicate: The name of your current country of residence. Your country of residence is the country in which you are residing, provided that you have been lawfully admitted to that country. For refugee claimants in Canada only: select Canada whether you have been lawfully admitted or not. Your immigration status in that country (indicate one of the following): Citizen Permanent resident Visitor Worker Student Other Protected Person Refugee Claimant Foreign National Other: This section must be completed if you selected "Other" as a status. The dates (From To) you have been living in your current country of residence. Your spouse or common-law partner does not have to complete a separate request and must sign in the box provided under question 10.

What is a representative?

A representative is someone who has provided advice, consultation, or guidance to you at any stage of the immigration application process, or in an immigration proceeding. If someone represented or advised you to help you submit your application, then that person is your representative. A representative is also someone who has your permission to conduct business on your behalf of Citizenship and Immigration Canada (CIC) and the Canada Border Services Agency (CBSA). When you appoint a representative: you also authorize CIC (Citizenship and Immigration Canada) and CBSA (Canada Border Services Agency) to share information from your case file with this person; your application will not be given special attention nor can you expect faster processing or a more favourable outcome; the representative is authorized to represent you only on immigration matters related to the application you submit with this form; you can appoint only one (1) representative for each application you submit; you are not obliged to hire a representative. Types of representatives
Family, friends, and non-profit groups often help applicants who feel the need for support and advice on immigration matters. You can appoint a representative who does not charge fees or receive any other compensation for providing immigration advice or services to represent you before CIC (Citizenship and Immigration Canada) or the CBSA (Canada Border Services Agency). There are two (2) types of representatives. Uncompensated representatives include: friends and family members who do not, and will not, charge a fee or receive any other consideration for their advice and services; organizations that do not, and will not, charge a fee or receive any other consideration for

providing immigration advice or assistance (such as a non-governmental or religious organization); consultants, lawyers and Quebec notaries, and students-at-law under their supervision, who do not, and will not, charge a fee or receive any other consideration to represent you. Compensated representatives: Compensated representatives charge a fee or receive some other form of consideration in exchange for the advice and representation that they provide. If you want us to conduct business with a compensated representative then they must be authorized by CIC (Citizenship and Immigration Canada). Release of information to other individuals


To authorize CIC to release information from your case file to someone other than a representative, you will need to complete the form Authority to Release Personal Information to a Designated Individual (IMM 5475) (PDF, 1.75 MB (Megabye)) (/english/pdf/kits/forms/imm5475e.pdf). The form is also available from Canadian embassies, high commissions and consulates abroad. The person you designate will be able to obtain information on your case file, such as the status of your application. Payment method options

Complete the Fee Payment Form - Application for Permanent Residence (IMM 5620) and include it with your application to the CIO. On-line payments are not accepted by the CIO. In Canadian funds only, you may pay by certified cheque, bank draft or money order made payable to the "Receiver General for Canada." or with a credit card (Visa, MasterCard, American Express) Note: Certified cheques, bank drafts and money orders may have expiry dates. When you submit your application to the CIO, the expiry date must be at least five months into the future. If there is no expiry date on your certified cheque, money order or bank draft and it is drawn on a foreign bank, it can only be cashed for 6 months from the date of issue. To ensure it can still be cashed when the fee payment is processed at the CIO, it must be issued no more than 30 days before you send your application to the CIO. If you are paying by credit card, please ensure that your credit card will be valid for at least nine months from your submission date. If we are unable to process your payment, your application will be returned to you. Important information. Each application from a principal applicant must include a fee payment form. This form must include the fees for the principal applicant and any accompanying family members. The same fee payment form may not be used for more than one principal applicant. Do not enclose cash. What Happens Next?

Travel documents and passports Copy of the pages of your passport or travel documents for you, your spouse or common-law partner and your dependent children, showing: the passport number, date of issue and expiry, the photo, name, date and place of birth, pages showing any amendments in name, date of birth, expiration, etc. You must hold a valid regular passport. Education Requirement For the Principal Applicant Secondary education documents: secondary school (high school) diploma.
