Pakistani security forces were slow to react to signs that militants were growing more aggressive from 2007 to 2009. Political instability played a major role in the governments inability to devise an effective counterterrorism policy, and the alliance of progressive political parties elected in February 2008 was overwhelmed by the Swat crisis, in which militants used violence and political manipulation to conquer major swaths of the Swat Valley and adjoining areas. Belated but effective military action in 2009 reasserted government control in the region, but it will be some time before things return to normal in the Malakand division of the NWFP, as the Swat, Malakand, Chitral, and Dir districts are known collectively. The crisis situation in the NWFP did not emerge overnight; the deterioration was a product of years of poor governance, regional tension, and economic distress, in addition to the gradual strengthening of militant forces, especially since the Taliban regime in neighboring Afghanistan fell in 2001. The prolonged presence of foreign troops in Afghanistan and over-dependence on military means to defeat insurgents in the region also negatively affected the residents of NWFP, and predictably so.

These provisions were removed recently, however, through a package of reforms collectively known as the 18th Amendment, which stripped the office of the president of the authority to dissolve parliament without the advice of the prime minister, impose unilateral emergency rule, appoint judges, and especially the power to appoint chiefs of the armed forces of Pakistan.
Political Structure
Pakistan is a federation and has a bicameral parliament, where a prime minister is elected by the majority party or coalition in the National Assembly, while the president is elected by the four provincial assemblies and parliament. The NWFP is one of the four provinces of Pakistan, but there are a few regions that are governed according to special rules, including the FATA, Frontier Regions in the NWFP, Gilgit-Baltistan (earlier known as Northern Areas) and Pakistani-controlled Kashmir. Behind the well-developed state structure and democratic setup, Pakistans army has extraordinary influence. Four periods of martial law, spanning more than 32 years total, have entrenched the militarys role in the countrys security and foreign policy.2 Additionally, the Pakistani constitution (as amended during military rule) provided the president with a variety of tools to suspend ordinary legislative processes

Pervez Musharrafs martial law in October 1999 removed Sharif as prime minister and the PML-N split into two factions in 2001, when a group under Chaudhry Shujaat Hussain decided to break away and launch the Pakistan Muslim League Quaid-i-Azam (PML-Q) to support Musharraf.4

The MMA is a coalition formed in 2002 of five religious political parties: the Deobandi-dominated Jamiat Ulema-eIslam (JUI), Barelvi-oriented Jamiat Ulema-e-Pakistan, the traditionally Islamist Jamaat-e-Islami (JI) founded by Abul

Ala Maududi, the Shiite Tehrik-e-Jafaria Pakistan, and the Wahhabi-inspired Jamiat Ahle Hadith. The JUI was founded by Maulana Shabbir Ahmed Usmani in 1945. In the 1970s, it was revived by Mufti Mahmud, whose son Maulana Fazlur Rehman took over in the early 1980s. The party split into two factions in the mid-1980s JUI-F, led by Fazlur Rehman, and JUI-S, led by Maulana Sami-ul-Haq following disagreements over political strategy. JUI played an important role during the Afghan
NWFP. In another first, in the 2008 elections ANP captured a couple of seats in the Sindh provincial assembly from Karachi, where large Pashtun pockets exist.

The ANP is a secular and nationalist Pashtun party that is associated with the legendary Abdul Ghaffar Khan, also known as Frontier Gandhi due to his political affinity and relationship with the renowned Mohandas Gandhi. Ghaffar Khans son, Wali Khan, revived what had been the National Awami Party (NAP) from 1957 to 1975 (when it was outlawed by Zulfikar Ali Bhuttos government under controversial sedition charges) with the slightly different name, Awami National Party, in 1986; now his son, Asfandyar Wali Khan, leads the party. NAP also had support in the former East Pakistan (now Bangladesh), and in the late 1960s and early 1970s it was deemed as sympathetic to the Soviet Union. The partys leftist orientation and manifesto remained intact over the years, though NAP had a broader national support base than the ANP and it garnered support from other provinces as well. Although ANP was part of coalition governments in NWFP as well as in Islamabad during the late 1980s and 1990s, not until 2008 was it able to install a chief minister in The NWFP is quite diverse. percent of the population of NWFP.9 Politics in the province, however, are dominated by Pashtuns. In Urdu, the NWFP is also called Sarhad, meaning border region, which, like the name NWFP, suggests it is ancillary to the core of Pakistan. This formulation has been unsatisfactory to many Pashtuns, who are proud of their ethnic and tribal identity. These ethno-nationalist sentiments are reflected in the Pashtun-dominated Awami National Partys effort to rename the province Pukhtunkhwa.10 The effort largely succeeded with the compromise of adding the word Khyber despite stiff opposition from non-Pashtun areas, which are generally represented by the Pakistan Muslim League (PML-N). This debate over nomenclature delayed finalization of President Asif Ali Zardaris constitutional amendment package.11 Zardaris Pakistan Peoples Party has been supportive of the ANPs position on Pukhtunkhwa as a way of enhancing secular rather than religious identity in the region. However, the name change has deeply troubled some segments of non-Pashtuns in the Hazara division of NWFP, protests.

With stronger governance, the NWFP could have developed a strong economy and become self-sufficient. The area has many natural resources, attractive tourist spots, and agricultural land. But the literacy rate is low, health care is scarce, and law enforcement capacity is weak. Illegal trade, smuggling, and inadequate infrastructure undermine the economy. The provincial Finance Department last year described the economic conditions in stark terms: NWFP has very limited tax base and relies for 92% of its revenues on the Federal Government. All the vital socio-economic indicators of the Province are lowest among the other Provinces. The Province is also confronted with war on terror, causing huge losses to human life, business and property.13 Since 2001, three factors have played critical roles in the destabilization and radicalization of NWFP: first, the politics and performance of the MMA government from 2002 to 2007; second, the lack of reform in NWFPs madrassas; and three, the insurgency in neighboring FATA, which is largely a consequence of decades of negligence on the part of the state and persistent conflict across the border in Afghanistan. The MMA government was formed after an electoral victory in 2002, but was swept out of office in 2008. It turned out to be a huge disappointment, even for its supporters. Corruption, nepotism, and incompetence were rampant under MMA rule problems that the religious leaders and politicians in the MMA were supposed to eliminate.14 The MMA failed to make good on its campaign promises to provide better access to fair justice and accountability for public servants. Instead, MMA policies restricted civil liberties, slowed progressive legal reforms, and undermined religious tolerance. Womens rights were set back, as was madrassa reform, which was to include teaching science and registering foreign students.15 The MMA instead moved to Islamize the public education system in the province, and banned music on public transportation. The

Tribal affiliations determine political association less in the NWFP than in the FATA. Unlike in the FATA, where tribes tend to have distinct geographic strongholds, tribes in the NWFP are dispersed across different districts, and urban and rural areas. Class identity is comparatively more important in shaping political outlooks in the NWFP, and religious and sectarian affiliations are increasingly relevant. Relative to the FATA, the NWFP (or settled areas) is more mainstream and driven by progressive political forces. Indeed, pro-Soviet leftist parties have historically attracted strong support.

NWFP Assembly legislated that women could be treated only by a female doctor, which, given the lack of trained female health care professionals, would have been very dangerous, particularly in rural areas.16
Another context to these developments is provided by writer Brian Cloughley, who argues: Unfortunately Musharraf, as Byron had it, nursed the pinion that impelled the steel, in that in 2002 he endorsed the election efforts of the religious crackpots in the interests of sidelining the two mainstream political parties.19 Consequently, as one of the International Crisis Groups insightful reports maintains, In return for helping Musharraf consolidate power, the MMA was allowed to pursue its Islamisation agenda in NWFP. 20
The most significant development, however, was the Assemblys passage in July 2005 of the Hisba Bill, which amounted to strict imposition of sharia, or Islamic law, as understood and interpreted by the MMAs leaders.17 Despite major objections by opposition parties and even by the federal government in Islamabad, MMA leadership in the NWFP went ahead with the controversial sharia project. The most onerous provision of the law created new institutions in NWFP in which clerics associated with the MMA religious alliance could be given government jobs equivalent to judgeships. The new position of Mohtisib (Ombudsman) was tasked with investigating public corruption and monitoring individuals moral behavior. Vigilante action, such as the blackening of billboards in Peshawar that featured female models, created an environment of fear in the province. Though the Supreme Court of Pakistan declared various aspects of the law unconstitutional, the MMA government was able to defy that ruling indirectly by renaming provisions of the law and changing procedural rules, allowing it to bypass checks and balances. President Pervez Musharraf ignored some of the MMAs excesses because he needed its votes to support his efforts to compel the national legislature to allow him to serve both as army chief and president. This behind-the-scenes alliance with Gen. Musharraf inspired critics to call the MMA government a Mullah-Military Alliance. According to Afrasiyab Khattak, former chair of Pakistans Human Rights Commission and current peace envoy of the NWFP government, the MMAs phenomenal rise in October 2002 elections was not just coincidental, but a part of the political plans of the military. Without the threat of religious extremism, the military would have lost its utility for Western powers.18

For instance, many bureaucrats with extremist religious views were given important positions and developed extensive connections within government departments. The impact on madrassas was also important. These religious schools proliferated in the 1980s under the patronage of Gen. Zias military government, and many were established in NWFP to recruit, groom, and train Afghan refugees for fighting in Afghanistan.21 According to an International Crisis Group report, the madrassas run by Jamiat Ulema-e-Islam (JUI) were instrumental in encouraging Jihad culture for religious as well as political ends in Pakistans tribal belt.22 The trend continued in the 1990s. A few half-hearted attempts to rein in the extremist madrassas were made in the last decade, but the MMA government (2002-2007) ensured that such efforts remained limited. According to a credible study of Pakistani

law enforcement, some suicide bomber training camps in the Malakand division were destroyed only during 2009 military operations in the Swat area.23 Most likely these were established during MMA years as militancy in the area gained momentum. Some madrassas in the NWFP continue to create an environment conducive to religious bigotry and extremism.24
The MMA government did not adopt defensive measures to monitor the movement of militants from FATA to NWFP. The militants and the Islamist political parties in Pakistan share some ideas and social support. Component parties of MMA, especially Jamiat Ulema-e-Islam (both the Sami and Fazlur factions), run madrassas that provide recruits for militant training camps in FATA. Analyzing the situation in 2009, journalist Talat Farooq argued that: After 9/11 the Taliban and Al-Qaeda elements, supported by their Pakistani sympathizers, crossed over into FATA as a result of Musharrafs two-faced policy that strengthened the Pakistani Taliban. This particular policy was never criticized
by either the religious or the conservative parties with the result that the militants have grown in power with the help of local criminals, drug mafia, arms dealers and foreign hands that have joined them along the way.28 Bureaucrats in the six transitional areas wedged between FATA and NWFP districtscollectively known as the Frontier Regionsalso failed to alert national authorities about the growing militancy.29 Both incompetence and sympathy with militants were at play.

especially between 2004 and 2007, allowed the Taliban to establish networks in the NWFP.25 The NWFP government did not listen to political and social groups that favored strong action against extremism. As the Taliban groups strengthened, they attacked military and government infrastructure in the FATA. But in the NWFP, the Taliban did not directly confront the government initially, instead focusing on ideological targets, such as girls schools, ancient Buddhist shrines, womens rights activists, video and music shops, and barbershops (which shave beards against Islamist wishes).26 In the NWFP, militants began warning women as early as 2005 not to appear in public without a veil. The movement started in the southern areas of NWFPTank, Dera Ismail Khan, Lakki Marwat, and Bannuthat bordered South and North Waziristan, hotbeds of Taliban activity in the FATA. Later the activity spread north into Kohat, Charsadda, Mardan, Dir, Swat, and the provincial capital, Peshawar areas bordering Kurram, Orakzai, Khyber, and Mohmand agencies in the FATA.27 It was obvious that militant activity in NWFP was linked to developments in adjoining parts of the FATA. For example, the so-called peace deals in Waziristan and the Khyber agency in 2004-06 were followed by more aggressive actions by extremists in NWFP.

Attacks on schools in Peshawar and its suburbs in the early months of 2010 are a disturbing new trend.30 In the aftermath of the military offensive in South Waziristan in October 2009, 221 people were killed and nearly 500 were wounded in bombings from mid-October to mid-November.31 Some of this violence is spillover from troubles in FATAs Khyber agency between Lashkar-eIslam, led by Mangal Bagh, and Ansar-ul-Islam.32 But the

Tehrik-e Taliban Pakistan (TTP) is active as well and has claimed that many of the terrorist attacks in NWFP were retaliatory. For instance, it declared that the June 2009 attack on Peshawars luxury Pearl Continental Hotel was to avenge the attack on a madrassa in the FATAs Orakzai agency.33 Irrespective of the TTPs claims, its activities are dependent on the strength of its logistical networks in a given area and there is increasing evidence that terrorists who strike in Peshawar are based in adjacent Khyber agency.34 Another potent reason behind TTP attacks in Peshawar is the emergence of local lashkars (militias) in suburban Peshawar through a jirga, or tribal assembly, in collaboration with the local police and the provincial administration, to fight Taliban encroachments.

the militants. Nonetheless, many questions about the Swat situation remain unanswered. For instance, why was Fazlullahs FM radio station, which he used for propaganda and communication with supporters, not disabled in 200708? He had used radio announcements to threaten teachers and students at girls schools in the region.38 Moreover, Fazlullah was seemingly allowed to escape after being surrounded by police in 2008. Some ascribe it to sheer incompetence, while others believe that Fazlullah cut a deal with elements in the security forces during the early phase of his militancy campaign.39 The Pakistani army has recently responded to such concerns by training NWFP police, with around 5,000 being educated in counterterrorism and combat techniques.40 The Swat conflict was also deeply influenced by the Panjpirs of Swabi district, adjacent to the Malakand division of NWFP. The Panjpirs follow a localized version of Saudi Wahhabism that was introduced in Pakistan by Maulana Tahir, father of Major Amir, an Inter-Services Intelligence operative who allegedly helped topple Benazir Bhuttos first government.41 The madrassa at Panjpir, administered by Maulana Tayyab, Major Amirs brother, is associated with a whos who of Pakistans extremist leaders, including TNSM chief Sufi Muhammad, Bajaur Taliban commander Maulvi Faqir Muhammad, and the Khyber agencys notorious militant leader Mangal Bagh. TNSM military chief Fazlullah also adhered to the Panjpir group.42 This madrassa was an important recruitment camp that also performed the role of a think tank for strategic planning during the Afghan war of the 1980s.

Operation Rah-e-Raast (The Right Path) pushed the TNSM out of Swat and has largely eliminated its ability to regain control over the area, though human rights groups claim the Pakistani Army committed violations during this campaignwhich the Army denies.55 The entire episode, however, damaged the ANPs reputation, and fractures have appeared in its political support base. This raises the possibility that religious parties could stage a comeback in the next election or that a new hard-line nationalist Pashtun party will emerge.56 Whatever the political impact, anti-Taliban sentiment in NWFP is on the rise. According to a Gallup poll in November-December 2009, only 1 percent of NWFP residents said that the Taliban have a positive influence, down from 11 percent in June 2009.57 Public frustration with NWFP suicide bombings has risen significantly from late 2009 to early 2010, concurrent with an expansion of military operations. Still, in the absence of economic opportunities and development, the frustrated younger generation of the province (especially in districts bordering FATA) is susceptible to radicalization and joining militant groups rather than the religious political parties that are still seen as part of the countrys political system.
Public expectations were high when the ANP-PPP alliance took power in March 2008. But the euphoria was shortlived, as ANP almost immediately began negotiating with the TNSM leadership to stabilize Swat district. ANP leaders were facing an assassination campaign by the TTP in FATA and by the TNSMs allies in the Swat Valley.46 ANP workers and legislators were systematically targeted, forcing many to disappear from the public arena altogether.47 Such threats and attacks continue today.48 The ANP explained its decision to negotiate with TNSM by arguing that if the army is not interested in challenging the expanding writ of Taliban, why should we continue to sacrifice our lives.49 Interestingly, Asfandyar Wali Khan, the president of the ANP, secretly visited Washington in May of 2008 to brief the U.S. government about the prospective deal.50 ANP leaders ultimately cut a deal in 2008 with Sufi Muhammad, who was in prison at the time, thinking he might be able to moderate the fighters led by his son-in-law, Maulana Fazlullah. Hopelessness and frustration among Pashtuns must be treated through better governance and security before the state can realistically expect to engage reconcilable opposition groups. The Pashtuns history is rife with internal conflicts and brutal tribal rivalries, but they would not have survived as an ethnic group if they were incapable of resolving their internal feuds through negotiations. However, for such negotiations to be effective, the writ of the state is critical.

Future Prospects
The future of NWFP will be determined by many factors, not just fluctuating support for various political parties. The success or failure of the political reforms proposed in 2009 for the FATAwhich aim to increase political participation and limit collective judicial punishmentswill be critical.59 So will security operations in South Punjab, where many militants fled after military operations in South Waziristan in late 2009.60 If those fighters are not neutralized, they are likely to stoke further militancy in the region. Moreover, government pressure in Punjab may push them back to the FATA and NWFP. Likewise, police reform in the NWFP is critical for containing local militancy, as are the ongoing military campaigns in FATA. impact in the NWFP.

Kundi tribe are challengers to JUI-F. In the 2008 national elections, PPP candidate Faisal Kundi, who is currently deputy speaker of the NA, defeated Fazlur Rehman (who contested seats in various regions, as is permitted under Pakistans election laws).

important Pashtun tribes: the Bangash and the Khattak. The Bangash occupy the central, northern, and northwestern parts of the district. The Khattaks are divided into Teri, Akora, and Sagri Khattaks. The Akora Khattaks reside mostly in the districts northeast, but also in the adjoining parts of Peshawar. Kohat city is primarily a military town, with an air force base. Prominent politicians include Syed Iftikhar Hussain Gilani, Imtiaz Gilani, and reside in the area including Mashwani, Shinwari, Yousafzai, Shahkhel, Mastkkhel, Umerkhel, Dushkhel, Mayar, Anikhel, Sultankhel, and Aka Khel. There are also non-Pashtun Syed and Gujjar communities. Politically, it is a JI stronghold. Former JI chief Qazi Hussain Ahmed (though based in Nowshera district) contested elections in Lower Dir in 2002. ANP is the second most popular party in the area. Siraj ul Haq, a hard-line member of JI, and Zahid Khan, the central information secretary of ANP, are

very active in district as well as provincial politics. However, in a surprise electoral shift, PPP won the NA seat from the district in 2008.

Peshawar is more cosmopolitan and diverse than other areas of NWFP. Residents of the city are known as Peshawarites (who mostly speak Hindko). Politics in the district have been dominated by the Bilours, long affiliated with Khan Abdul Ghaffar Khan and ANP. The PPP traditionally is also strong, and the late Benazir Bhutto won elections in Peshawar in 1988. In the 2008 NA elections, the ANP and PPP split the districts four seats.

(PML-N) has expanded its influence in these areas, and in the 2008 elections did well in these districts. 56 The PML-N (despite recently losing a special election to a JUI representative) is expected to draw support because it has not criticized religious and conservative elements in the NWFP. The PPP may lose some seats due to anti-incumbency sentiment in NWFP and Islamabad. The MMAs religious parties are unlikely to benefit from the ANPs decline because militants in the NWFP (including TTP) have cut into the support base of these parties. The signals so far are mixed, however. For instance, in early 2010 the JUI-F surprisingly won a seat in Mansehra (a stronghold of PML-N), but analysts blamed it on PML-Ns failure to field a strong candidate.56 JUI-F also won a seat in Lakki Marwat (where Taliban activity has been significant in recent months) with a big margin in February 2010, but in its stronghold Dera Ismail Khan, it lost by-polls (late March 2010) to PPP.
