Dear Mr. Karl Fry, This letter serves as an official take-down request under the Digital Millennium Copyright Act (DMCA) codified at 17 U.S.C. 512(c). Pursuant to 17 USC 512(c)(3)(A), this communication serves as a statement that: 1. I am the exclusive rights holder for the Author Linda Ellis photograph (hereafter Photograph), which is a copyrighted photograph of me, Linda Ellis, a Georgia state resident. 2. These exclusive rights are being violated by material available upon your site at the following URL(s): http://rankexploits.com/musings/2013/dont-post-linda-elliss-the-dash/ Screenshots of the use at issue and a copy of the Photograph are included to assist with the removal from the rankexploits.com website. 3. The above URL shows the Photograph and derivative works of the Photograph displayed on your website without permission of the copyright holder. Enclosed is a declaration confirming same. 4. I may be contacted at the address on this letterhead. This notice is directed at DreamHost as the domain registrant of the website rankexploits.com. The website rankexploits.com fails to provide DMCA notification information

on its website or in its terms of service. In addition, rankexploits.com does not have a registered agent with the United States Copyright Office. As such, rankexploits.com and its related companies are not compliant with the terms of the DMCA and therefore may not avail itself of the safe-harbor provisions provided therein. DreamHost also fails to outline its DMCA notice requirements on its website, instead only providing the name and address of its DMCA agent. The above notification shall serve as a cease and desist request as required by the DMCA and provides sufficient information for DreamHost to identify and remove the offending content. See 17 U.S.C. 512(c)(3). I also notified you of my removal request on December 30, 2013 and in further communication on January 6, 2014. Despite those requests, DreamHost has failed to remove the offending content. I hereby demand that DreamHost remove the offending content from the website rankexploits.com within the next 7 days. Failure to do so may subject DreamHost to claims of willful copyright infringement and void any safe harbor available to it under the DMCA. The United States Court of Appeals for the Ninth Circuit has also held that willful copyright infringement creates personal jurisdiction in the forum state. Washington Shoe Company v. A-Z Sporting Goods, Inc., 704 F.3d 668 (9th Cir. 2012). This means that an out-ofstate willful copyright infringer cannot escape litigation in Georgia by claiming lack of personal jurisdiction. The above statements are made without prejudice to my legal rights and remedies available under law, all of which are expressly reserved. I look forward to your prompt action.
