Obiectul cererii
Toate informaiile referitoare la fapte, capetele de cerere i respectarea de ctre reclamant a cerinelor epuizrii cilor de recurs
interne i a termenului de ase luni (articolul 35 paragraful 1 din Convenie) trebuie s figureze la rubricile E, F i G ale formularului
de cerere (articolul 47 paragraful 2 a) din Regulamentul Curii). Reclamantul are posibilitatea de a completa aceste informaii
anexnd la formularul de cerere un document de maximum 20 de pagini (articolul 47 paragraful 2 b) din Regulament). n acest
numr de pagini nu sunt incluse deciziile i documentele anexate la formular.

E. Expunerea faptelor
34.

Subsemnatul ZAHARIA GEORGE EMIL, am fost disponibilizat in data de 08.08.2011 ca urmare a

restructurarii si reorganizarii Autoritatii Nationale a Vamilor.
________________________________________________________________________________________________
Situatia aparuta ca urmare a aceastei reorganizari si testari profesionale, pe care le contest, este
________________________________________________________________________________________________
urmatoarea:
________________________________________________________________________________________________
In cadrul Directiei pentru Accize si Operatiuni Vamale Constanta - Serviciului Antifrauda Fiscala si
Vamala (SAFV) au existat inainte de restructurare :

- doua posturi de consilieri
________________________________________________________________________________________________
- trei posturi de inspectori principali
________________________________________________________________________________________________
- un post de inspector asistent
________________________________________________________________________________________________
In noua organigrama a serviciului nou creat, Supraveghere Fiscala si Coordonare Echipe Mobile,
________________________________________________________________________________________________
figureaza urmatoarea structura:

- trei posturi de consilieri
________________________________________________________________________________________________
- doua posturi de inspectori principali
________________________________________________________________________________________________
- un post de asistent
Astfel, ca urmare a noii organigrame (care nu a facut decit sa transforme un post de inspector
________________________________________________________________________________________________
principal intr-unul de consilier, fapt intilnit si la celelalte compartimente si servicii, neavind loc o
________________________________________________________________________________________________
reorganizare reala ci numai una de fatada, motiv de disponibilizari) patru inspectori principali, printre care si
________________________________________________________________________________________________
subsemnatul, am fost nevoiti sa optam pentru posturile de inspectori principali ramase si sa sustinem
________________________________________________________________________________________________
examen de departajare .
________________________________________________________________________________________________
Ocupantii celorlalte posturi din cadrul serviciului, nu au primit preaviz si nu au dat examen chiar
________________________________________________________________________________________________
daca s-a mentionat ca este un examen organizat in scopul testarii profesionale in vederea mentinerii pe
________________________________________________________________________________________________
posturi numai a persoanelor pregatite profesional, existind posibilitatea ca acestea sa nu promoveze
examenul daca obtineau punctaje sub 50 puncte. In concluzie nu au existat sanse egale pentru toti
________________________________________________________________________________________________
functionarii publici pentru ocuparea posturilor publice , aferente serviciului in cauza, cuprinse in noua
________________________________________________________________________________________________
organigrama. Dintre functionarii publici incadrati in acest serviciu, numai inspectorii principali au primit
________________________________________________________________________________________________
preaviz, cu toate ca , conform legii, as fi putut opta pentru un post echivalent sau inferior in noua
________________________________________________________________________________________________
organigrama.
________________________________________________________________________________________________
In urma examenului dat am obtinut 72 puncte la proba scrisa fiind declarat admis in vederea
________________________________________________________________________________________________
sustinerii celei de-a doua probe, interviul.
________________________________________________________________________________________________
Proba de interviu s-a desfasurat pe parcursul a aproximativ 5 minute, prin adresarea a doua intrebari
din legislatia mentionata in bibliografie, raspunsurile fiind consemnate de secretara pe o foaie ce urma sa
________________________________________________________________________________________________
fie semnata de candidat.
________________________________________________________________________________________________
Evaluarea probei de interviu a avut loc in baza a trei criterii relative si total subiective astfel:

1. abilitati de comunicare 30%
________________________________________________________________________________________________
2. capacitatea de analiza si sinteza 40%
________________________________________________________________________________________________
3. abilitati impuse de functie 30%
________________________________________________________________________________________________
In urma sustinerii probei de interviu am obtinut 80 de puncte.

Urmare contestatiilor, subsemnatul nu am primit nici un punct in plus, fiindu-mi respinsa contestatia,
In cadrul acestei restructurari nu s-a tinut cont de nici un criteriu de performanta si nici de alt fel de
________________________________________________________________________________________________
criterii,
pentru a mentine in functii persoanele care isi indeplineau cu adevarat sarcinile de serviciu si care
________________________________________________________________________________________________
aveau
realizari
reale in activitatea pe care o desfasurau, performantele mele profesionale fiind cu mult
________________________________________________________________________________________________
peste
ale
altor
colegi.
________________________________________________________________________________________________
In conformitate cu prevederile art. 7 din Legea nr. 554/2004, Legea contenciosului administrativ, cu
________________________________________________________________________________________________
modificarile si completarile ulterioare, am depus contestaie mpotriva deciziei de eliberare din functia
________________________________________________________________________________________________
publica ordinului nr. 7427 din 02.08.2011, cit si a O.p.ANAF nr. 2407/04.07.2011, pentru urmtoarele
________________________________________________________________________________________________
motive:
________________________________________________________________________________________________
1. Prin O.p.ANAF nr. 2407/04.07.2011 s-au nclcat prevederile art. 100 alin. 2 din Legea nr.
________________________________________________________________________________________________
188/1999 , aplicarea prevederilor alin. (1) se face cu respectarea urmtoarelor criterii:
________________________________________________________________________________________________
a) categoria, clasa i, dup caz, gradul profesional ale funcionarului public;
________________________________________________________________________________________________

b) ndeplinirea criteriilor specifice stabilite pentru funcia public;

in sensul ca distribuirea functionarilor publici pe noile functii nu s-a facut potrivit acestor criterii, trecndu-se
________________________________________________________________________________________________
direct la departajarea prin examen, potrivit art. 100 alin. 3 din Legea nr. 188/1999. In acest sens nu s-a inut
________________________________________________________________________________________________
cont nici de metodologia propusa si aprobata de ctre Agenia Naional a Funcionarilor Publici referitoare
________________________________________________________________________________________________
la modalitatea de reorganizare a activitii instituiilor publice prin reducerea posturilor ocupate de
________________________________________________________________________________________________
funcionarii publici;
________________________________________________________________________________________________
Deasemenea, examenul de testare profesionala nu este reglementat de lege ca modalitate de
________________________________________________________________________________________________
selectie
si departajare in cazul reorganizarii.
________________________________________________________________________________________________
Toata procedura de efectuare a reorganizarii Autoritatii Nationale a Vamilor si a departajarii
functionarilor
publici pentru ocuparea noilor functii, este contrara atit prevederilor legale de la art. 100 din
________________________________________________________________________________________________
Legea
nr. 188 /1999 si Codul Muncii, dar si procedurii prezentate de ANFP pe site-ul acesteia, spre a fi
________________________________________________________________________________________________
aplicata
in cazul reorganizarii institutiilor publice prin reducerea posturilor ocupate de functionarii publici.
________________________________________________________________________________________________

Nu
s-a respectat legea n ceea ce privete acordarea preavizului de 30 de zile calendaristice de la
________________________________________________________________________________________________
reducerea
postului. Practic, mi s-a dat preaviz nainte ca postul s fie redus. La data comunicrii
________________________________________________________________________________________________
preavizului,
postul pe care l ocupam nu a fost desfiinat i nici alte posuri din compartimentul n care eram
________________________________________________________________________________________________
ncadrat.
Emiterea
preavizului era justificat din momentul n care se reducea postul ocupat de mine sau in
________________________________________________________________________________________________
urma
procesului de reorganizarea si aplicare a criteriilor, respectiv examenului de selecionare sau
________________________________________________________________________________________________
departajare,
nu as fi fost repartizat pe un post corespunztor studiilor i pregtirii profesionale.
________________________________________________________________________________________________
Potrivit preavizului, posturile au fost radiate incepind cu data de 08.08.2011, neexistind temei de drept
________________________________________________________________________________________________
pentru
comunicarea preavizului inainte de desfiintarea posturilor si distribuirea angajatilor pe noile functii
________________________________________________________________________________________________
potrivit
art. 100 din Legea nr. 188 / 1999.
________________________________________________________________________________________________
3. Decizia de concediere trebuia s cuprind durata preavizului.
________________________________________________________________________________________________
4. Prin decizia de concediere nu mi s-a comunicat lista tuturor locurilor de munc disponibile n unitate
________________________________________________________________________________________________
i termenul n care urmeaz s optez pentru a ocupa un loc de munc vacant
________________________________________________________________________________________________
5. Prin regulamentele pentru organizarea i desfurarea examenului de testare profesional nu s-a
________________________________________________________________________________________________
prevzut efectuarea unei selectri i departajri a angajailor dintr-un compartiment supus reorganizrii
________________________________________________________________________________________________
astfel
nct, n ordinea mediilor s fie ncadrai n noile funcii, ci s-a stabilit un barem minim de promovare,
________________________________________________________________________________________________
care
poate conduce, fie la declararea ca fiind admii mai muli dect numrul de posturi, fie vor eliberai din
________________________________________________________________________________________________
funcie,
mai muli dect posturile desfiinate. Acest lucru este prevzut n art. 12 din Anexele 11 i 12 ale
________________________________________________________________________________________________
O.p.ANAF
2407/04.07.2011, fapt ce este n contradicie cu prevederile art. 99 i 100 din Legea nr. 188/1999.
Regulamentele
anexe ale Ordinului presedintelui Agentiei Nationale de Administrare Fiscala nr.

au fost publicate pe site-ul Autoritatii Nationale a Vamilor in doua variante diferite, fara sa
________________________________________________________________________________________________
existe
un
alt
ordin
de modificare.

6. O.p.ANAF 2407/04.07.2011 nu a fost publicat in Monitorul Oficial al Romaniei, conditie necesara
________________________________________________________________________________________________
pentru a intra in vigoare si a produce efecte, potrivit art. 11 alin. (1) din Legea nr. 24/2000 si art. 55 alin (1)
________________________________________________________________________________________________
din
HG nr. 561/2009.
________________________________________________________________________________________________
Mentionez
faptul ca , in cazul reorganizarii Ministerului Administratiei si Internelor, regulamentul pentru
________________________________________________________________________________________________
organizarea
si desfasurarea examenului pentru departajare in vederea numirii pe functie a personalului, a
fost
publicat in Monitorul Oficial al Romaniei, Partea I nr. 448/ 27.06.2011.
________________________________________________________________________________________________
7. Bibliografia pentru examen a fost aprobat prin O.p.ANAF nr. 2589/12.07.2011, deci cu cinci zile
________________________________________________________________________________________________
nainte
de examen. Precizez faptul c, potrivit art. 39, alin. 2 din H.G. nr. 611/2008 bibliografia se afieaz
________________________________________________________________________________________________
cu
cel puin 30 de zile nainte de desfurarea examenului.

8. Nu s-au respectat prevederile art. 6 alin. (3) din Anexele 11 i 12 ale O.p.ANAF nr.

- In cadrul ANV sunt un nr. 2925 de functii publice, din care doar 2804 sunt ocupate. Din acestea sunt 271

functii de conducere, din care 172 sunt ocupate iar 99 sunt libere.

De asemenea, sunt 2654 functii de executie, din care 2632 ocupate si 22 sunt vacante.

Posturile vacante de conducere vor fi ocupate prin recrutare (cele 99 ), iar cele 22 de executie, prin
redistribuire.

Tot in planul de ocupare a functiilor publice pe anul 2012 se mentioneaza ca vor fi infiintate si

In cadrul Autoritatii Nationale a Vamilor, Directia pentru Accize si Operatiuni Vamale Constanta,

Serviciul Antifrauda Fiscala si Vamala, am detinut functia publica de executie inspector grad profesional

principal,
gradatia 3, clasa de salarizare 46, fiind eliberat din functie la data de 08.08.2011, in baza

Ordinului nr. 7427/02.08.2011 ca urmare a reducerii postului ocupat in urma reorganizrii activitii
________________________________________________________________________________________________
acesteia,
si avand in vedere faptul ca ma aflu in prezent in corpul de rezerv, potrivit prevederilor art. 105

prin care am fost eliberat din functia publica, cit si pentru anularea O.p.ANAF

2407/04.07.2011 privind Regulamentul de organizare si desfasurare a examenului de testare profesionala,

Incalcarea dreptului la ocuparea unei functii publice si la o testare
