letter directly to the Head of State
if a plan by the Postal Corporation of Kenya and the Oce of the
President comes to fruition.
The letter writing platform
whose date of launch is yet to be
announced, is at an advanced stage
and according to the corporation,
President Kenyatta is very optimistic about it.
The Postmaster General, Dr
Enock Kinara, said the idea was
mooted after a realization that
many Kenyans could not access
the digital platform to communicate with the President. He said
there would be a special mailbox
for that purpose.

of Parents through secretary-general Musau Ndunda said governors
should only be allowed to control the
development and infrastructure fund
and leave the other weighty sections
to be managed by the Ministry of
Education.
The governors can build more
classrooms and any other infrastructure that the schools would
want, but managing the students
and the teachers is rather sensitive
and should remain with the national
government, Mr Ndunda said.
But he warned that the move by the
governors to have education devolved
was a ticking tribal bomb.
The governors will start controlling the number of students going to
the schools in their counties and will
most likely end up locking students
from other counties. So you will have
students from one county admitted
to schools in that county only, that
is basically brewing tribalism, he
warned.

inertia. When a few people
tried to say that the green
grass on the other end of
the referendum was not
quite so lush, they were
promptly attened by the
sheer volume and visibility
of those who could already
see their names inscribed
in the 1,001 oces that the
new Constitution was made
to create.
Now, a little over three
years since the reality of implementing the Constitution
begun, there is a din of dissatisfaction everywhere you
turn. From listless counties
to over-taxed citizens and
laggardly interventions from
the battery of commissions
sired by this Constitution,
things are slowly grinding to
a crunch.
In the run-up to the 2005
referendum, then vice-president Moody Awori pleaded
that the Wako Draft was
70 per cent good and that
if we voted to adopt it, the
sketchy 30 per cent would
be amended afterwards. Of
course it is possible that Mr
Awori was pulling wool over
our tired eyes. Whatever the
case, we shouted him down
and voted a resounding
No to a draft constitution
that was not going to give
us everything we wanted.
And what do we have now?
Is it working?
Recent events signal what
may yet turn out to be much
more than teething problems. What we have in the
current stand-o between
the Judiciary and the Legislature and between the
Judiciary and the Executive
raises some hard questions.
We now have a situation in which the Judiciary
is giving rulings that the
Legislature is promptly
ignoring. Last year when
Parliament sought to
discuss the proposal that
a tribunal be appointed to
investigate members of the
Judicial Service Commission (JSC), the High Court
issued orders to halt that
debate. Parliament promptly

reformed courts have
put themselves in

resources and few teachers, too many children are being left behind. Public-private
partnerships are helping to change this.
So Novartis has formed a partnership
with the Earth Institute, the United Nations, and private-sector groups to train
and deploy by 2015 a million community
health workers in sub-Saharan Africa to
deliver basic treatment and preventive
care, and to track disease outbreaks. The
idea is that local people will learn how to
support their communities rather than
rely on handouts, and thereby lift themselves out of poverty permanently.
Africa is increasingly showing signs of
its promise, but innovative solutions to
improve its peoples health are essential if
the continent is to approach its potential.
This will require more than philanthropy:
It will demand new commercial models
that solve health care issues, help the
economy to grow, and benet those who
invest in Africas future.

raising their pay timely
The ruling by the High Court
declaring the National Assemblies
Remuneration Act unconstitutional
is welcome. The judges did a great
job in ensuring that there is no abuse
of the Constitution by MPs.
The Act, which gives MPs powers to set their own pay, is not only
unconstitutional but also immoral.
You can never trust our greedy MPs
to debate and set their own pay. We
have already witnessed in the past
how they can forge a united front
when it comes to matters to do with
their pay.
The legislators are always out to
satisfy their own selsh interests at
the expense of the voters who put
them where they are.

(NCA 7 and above)

The bank, however, grew its net
interest income by four per cent to

in 2012.
Bad debts increased by 747 per cent
to Sh1.2 billion from Sh144 million in
2012 while lay os hit the bottom line
by Sh788 million.
For the industry, we have a situation
where the growth of non-performing
loans is twice the level of overall loan
growth This becomes a key area of
focus for us to ensure we continue our
prudent risk management guidelines,

Central Bank of Kenya had in its
Credit Survey for 2013 warned that
banks were facing a higher risk of
non-performing loans in 2013 as the
cost of living and interest rates in
the period took a toll on households,
undermining their capacity to service
loans.
This was compounded by the
governments delay in settling fees
owed to contractors for completed
projects greatly aecting repayment
patterns of customers in the building
and construction sector.

This week the Central Bank of Kenya offered 91-day Treasury Bills for a total of Kshs. 3 Billion. The total
number of bids received was 178 amounting to Kshs 1.68 Billion, representing a subscription of 56%. Total bids
accepted amounted to Kshs.1.28 Billion. The market weighted average rate was 9.230 %, and the weighted
average of accepted bids which will be applied for non-competitive bids was 9.182% down from 9.187% in the
previous auction. The other auction statistics are summarised in the table below.

conformity with international standards on Audit and International Financial Reporting Standards
2) Its partners must be of good standing with the Institute of Certified Public Accountants of Kenya (ICPAK)

4) The Firm and its Partners should not have been liable to any disciplinary action from any professional body
in the last five years.

Background and introduction
Modern agricultural biotechnology has been identied as one of the technologies that can help Africa revive and boost its
falling agricultural productivity and reduce food insecurity. However, biotechnologyattracts controversies and isopposed by
some groups, negatively inuencing public perceptions.
Such uncertainties can only be avoided by building the condence of policy makers and the general public on the benets and
safety of biotechnology and its products. It is against this background that the Open Forum on Agricultural Biotechnology in
Africa (OFAB) was established by AATFwith an aim to enhance understandingof agricultural biotechnology and contribute
to building an enabling environment for decision making.

directors who were called in
to direct the movie. Apparently most suggested a sci-
plot which I too would have

Because of that sheer fact,
Nimrod Antal ended up earning the rights to direct the
show. He was inspired by the
emergence of current world
protests such as the Arab
Spring and the very message of
rebellion in albums like Kill em
all and Ride the lightning.
Even with the protest concept having been well accepted,
the question of why they
chose a stage show plot still
remained. The plain reason is
not too dicult to understand.
Metallica basically slays fans
when they get on stage. Their
performances are a serving of
pure adrenaline from start to
end. But could this live action
be packaged into a non-live
experience with the help of
3-D technology? The person
to answer this was Through
the nevers producer Charlotte
Huggins.
She was at rst resistant to
the oer to be involved with
the project but when Metallicas manager Cliff
Burnstein
rephrased
the proposal
in a twisted,
mind-screwing form, she
accepted. Apparently,
they
were
not
trying to
do a concert lm;

objective sounded, it cost them
18 million dollars in hard cash.

have a stage which can shift
into a pool of blood, a cemetery
with luminous crosses, and accommodate an entire statue of

justice.
At rst, it was exciting to
think of how the entire lm
would play out. The movies

GROWTH after 10 years, Facebook has hit its peak. Growth has
signicantly slowed down over the last 2 years. As it has been noted,
Facebook already lost the app wars to smaller companies, and with that, it
lost some segments of users. The more users Facebook gains and retains,
the more potential it has to sell advertisements and mine business data.

This has been a struggle, and
after 10 years, Facebook has
hit its peak. Growth has signicantly slowed down over
the last 2 years. As it has been
noted, Facebook already lost
the app wars to smaller companies, and with that, it lost some
segments of users. The more
users Facebook gains and retains, the more potential it has
to sell advertisements and mine
business data, both lucrative
businesses needed to keep the
balance sheet looking healthy.
So, how does a company giving
its product ideally for free keep
growing? The keyword there is
innovation. And while Facebook
possesses the ability to remain

enemy. However, its greatest
driver has been exibility. The
Facebook ecosystem has not
been as exible as they may
have wanted, and this has also
been its downside and the last
bastion of hope for Google
and other competitors. At the
end of the day, Facebook has

much you can do outside of
Facebook. When it looked at
companies like Feedly and
Flipboard, Facebook saw an

apps making a bigger splash,
Facebooks Paper platform is
simply not seen as worthy to

doesnt it scare competitors?
For one, this is Facebook at
its best but outside its core
business, and even though this
sounds a bit confusing, since
they make apps and help deliver user generated content,
it also shows a bit of creeping
desperation from Facebook.
It has been a brilliant 10 years
for Facebook. While the company looks towards being more
intuitive by trying to achieve its
users expectations, one does
wonder if it will even be around
in the next 10 years and if it is,
whether it will still be the powerhouse it currently is.

Only a fool would think that employing an ugly house help will keep
the partner on the straight and narrow. He meets beautiful women when
he is out on his own pray, what do
they do about that?
Do not let personal insecurities get
in the way of having the right person
look after your children, they are more
important than a cheating husband. If
you feel the need to hire an ugly house
help for the sake of the husband, then
you need to examine your relationship because with or without the

IHRM publishes
requirements for
HR practice

The Institute of Human Resource Management
(IHRM) has published guidelines that human
resource practitioners in the country must now
adhere to.
This follows the coming into eect of the Human
Resource Management Professionals Act, preceded
by the January 3 election of members of the IHRM
Council to oversee regulation of the industry.
Published on January 17, the Gazette Notice
277 names the members of the IHRM Council,
while notices 278 and 279 outline the criteria for
issuance of practicing certicates and registration
of HR practitioners.
A person seeking to obtain or renew a practicing
certicate must be a fully paid up fellow or member
of the IHRM, states Gazette Notice 278. That
person, it continues, must be the head of a human
resource function of an organisation, or head of
a sub-function of the human resource function,
or partner/principal shareholder of a registered
human resource firm, or performing human
resource management duties and responsibilities
of an organisation.
Such a person, according to the notice, must
have continuing professional development credit
points awarded by the IHRM. The credit points
must be of the year preceding the application for
a practicing certicate.
The regulations aim to weed out impostors
and to raise standards in the industry. They
are set in accordance with the Human Resource
Management Professionals Act 2012, which
provides a framework for training and regulations
of activities of HR practitioners in the country.
The gazette notices by IHRMs executive director
Samson Osero, implies that HR practitioners must
now pursue the activities necessary to make them
compliant with the law. Mr Oseros action follows
the expiry of the one-year grace period granted by
the act to allow practitioners to put their houses
and papers in order.
By law, all practitioners are required to register
with the IHRM, prior to applying for a practicing
certicate.
Gazette Notice 279 of January 17 prescribes the
requirements to be fullled by a person seeking to
register as a fellow, a member, or as an associate
member of IHRM.
To qualify as a fellow, the institute recognises
members of the IHRM who have practised
human resource for at least 15 years and rendered
outstanding service to the profession.
Ordinary members are required to have a
collection of standard qualications that range
from academic and professional training to
working experience.
On academics, a person seeking to be registered
as a member of IHRM must have a Bachelors or
Masters degree in any discipline, or a Bachelors
or Masters degree in human resource management
or its accepted equivalent from a recognised
university.
The professional requirement is either a higher
diploma in human resource management or its
accepted equivalent from a recognised certication
institution, or a postgraduate diploma in the
same.

To be an associate member of IHRM, at

Alternatively, one could qualify for this
category of membership with a Bachelors
degree in human resource management
or accepted equivalent, plus one year of
working experience.
One also qualifies if he or she has a
higher diploma in human resource from
a recognised university and at least a
years experience as a human resource
practitioner.
Should you possess a diploma in HR, then
at least two years working experience will
be enough to earn you a registration as an
associate member. The institute shall also
consider registration into this category, a
person who may have a diploma in any other
discipline but has acquired a certicate in
human resource management, plus at least
two years of work experience in HR.
Individuals found to be working as
human resource practitioners without
the regulators approval are liable to a jail
term of up to two years or a Sh200,000
ne or both.
Practitioners who engage in malpractices,
such as corruption, soliciting sexual favours
or benets, and tribalism among other
oensive acts could have their practicing
certicates withdrawn.
