As mandated by state law, per diem fees are now $280.00 for each half-day on a pro rata basis. For purposes of this
section, "one-half day" means any period of judicial time during the morning or afternoon court session or after 5:00 PM
where:
a) Any proceeding involving the testimony of any witnesses, regardless of the length of the proceeding, or the number
of proceedings heard in the court during that half day;
b) Any proceeding which requires more than one hour of judicial bench time, regardless of whether there is testimony,
and regardless of the number of other proceedings heard by the court in the same half day;
c) Cases which are assigned to a court for trial, but settle, only if the settlement does not occur until after the second
half day begins, at which time the parties owe for a full day.
These costs shall be recoverable as taxable costs at the conclusion of trial. The fees mandated under this section are
paid to the state. For the first day of court or jury trials, per diem fees must be posted at the beginning of the PM
session for the first day and at the beginning of the second day and each succeeding day's court session. If court goes
beyond 5:00 PM, fees will be required for another half-day session.
