FOR IMMEDIATE RELEASE IN MASSACHUSETTS, RED FLAGS RAISED BY FORECLOSED HOMEOWNER AS DOCUMENTED CRIMINAL MISCONDUCT IS SEEMINGLY IGNORED BY STATE

PROSECUTORS.
Lowell, MA, March 8, 2014 Serious questions and concerns are now being raised by foreclosed homeowner, Mohan A. Harihar, as filed criminal complaints are seemingly being ignored by the Massachusetts Office of the Attorney General. Since the pro se efforts to battle a wrongful foreclosure began over 3 years ago, new evidence and information has steadily come forth in support of Mr. Harihars consistent claims, which in addition to ongoing civil litigation in the MA Appeals Court, documents support criminal misconduct against the referenced lenders, the associated securitized mortgage trust, and their retained counsel*. As previously reported, criminal complaints are filed at both state and federal levels.** Documented criminal infractions stated within the complaint(s) are entirely fact based and include, but are not limited to: Fraud, Deceptive practices, fraudulent concealment, fraudulent misrepresentation, aiding and abetting fraud and perjury. It has been revealed that Mr. Harihars case(s) coincides with the Attorney Generals 3+ year ongoing investigation of Harmon Law Offices PC***, and additional misconduct is believed to exist with respect to SEC and IRS violations, requiring further investigation. Mr. Harihar has made it clear of his intention to bring these complaints to criminal charges against ALL referenced parties, at both state and federal levels. However, despite multiple email communications delivered directly to, and received by Attorney General Martha Coakley (see attached email below), filed complaints and associated communications are seemingly being ignored. Considering the stance you have publicly made with regard to this Foreclosure Crisis, it is both disappointing and concerning that a response has not been received, especially since the documented civil and criminal misconduct associated with my case(s) irrefutably aids your offices 3+ year ongoing investigation of Harmon Law Offices PC. As one of the last Attorney Generals to join the National Mortgage Settlement, you also made it clear that your office reserves the right to bring criminal charges against those parties associated with this Foreclosure Crisis. While the language in both the National Mortgage Settlement and the Federal Bank Regulators Settlement clearly states that impacted homeowners have the right to seek additional compensation for associated misconduct, it is becoming increasingly clear, at least in the Commonwealth of Massachusetts, that this is not true. The clearly documented legal action I have taken as a pro se homeowner (by necessity) over the past 3 years is proving to be a design set up for failure, despite the now overwhelming amount of evidence and information in support of my consistent claimsIf it is the decision by MA State Prosecutors NOT to bring these filed complaints to criminal charges, or if this communication is again seemingly ignored, it will become necessary to address this

entire matter with a higher authority.. Mr. Harihar has made it clear of his intentions to expose this FACT-BASED information to the public****. Mark Harmon, founder & President of Harmon Law Offices PC, served as Director of DJSP Enterprises, a company created by Stern, and considered one of America's largest foreclosure servicers. Harmon Law Offices has been under investigation by the MA Office of the Attorney General since 2010, for infractions related to foreclosure and eviction practices. Attorney General Coakley, As of this Morning, March 6, 2014, I have not received a response to the multiple requests made with regard to filed criminal complaints, wrongful displacement, etc...articulated in communications sent to your attention. I understand your office has a tremendous amount of issues to address on a daily basis. I have been respectful, exemplified complete transparency, and allotted ample time for parties to respond. Considering the stance you have publicly made with regard to this Foreclosure Crisis, it is both disappointing and concerning that a response has not been received, especially since the documented civil and criminal misconduct associated with my case (s) irrefutably aids your office's 3+ year ongoing investigation of Harmon Law Offices PC. It should be clear to understand at this point, that with the magnitude of this Foreclosure Crisis throughout the Commonwealth and the Nation, non-response sends a message that this matter is being intentionally ignored, and raises serious questions and concerns, about the Office of the Attorney General, and additionally about a candidate in the race for Governor of the Commonwealth of Massachusetts. I again state for the record that I wish to bring criminal charges against the following parties: Wells Fargo NA, US Bank NA, the Securitized Mortgage Trust CMLTI 2006-AR1, Harmon Law Offices PC, Nelson Mullins LLP, Attorney David E. Fialkow and Managing Partner Peter Haley, both of Nelson Mullins Riley and Scarborough, LLP. Documented misconduct includes (but is not limited to) : Fraud, Deceptive Practices, Fraudulent Concealment/Misrepresentation, Aiding and Abetting Fraud,

and Perjury. Additional misconduct is believed to exist with respect to SEC violations and also with the IRS, requiring further investigation. It is well documented that these parties have been afforded numerous opportunities to seek a settlement agreement, and have chosen instead to continue causing harm and accruing damages to Mohan A. Harihar. I am also requesting for the record, supporting communication from your office to the MA Board of Bar Overseers/Bar Counsel, for the related documented misconduct by counsel and their respective law firms. If it is the decision by MA State Prosecutors not to bring these filed complaints to criminal charges with the Court, or if this communication is again seemingly ignored, it will become necessary to address this entire matter with a higher authority. Attorney General Coakley, It is with considerable concern that this email communication is sent to you today, Sunday, March 2, 2014. On Tuesday, February 25, 2014, I was forced to vacate my home, due to an eviction order issued by the Northeast Housing Court, with virtually no notice, and after attempts to STAY the order through an Emergency motion were unsuccessful. This order should never have been issued, for the many reasons stated to you in prior email communication, but it was.

This eviction clearly could have been avoided. One week ago, I respectfully reached out to you directly via email (Attached below for reference) to address this matter, requesting a supporting communication from your office with respect to criminal complaints filed and also the relationship to the ongoing investigation of Harmon Law Offices PC. I additionally made a similar request for a supporting communication to Christina Sterling with the US Attorney's office, since criminal complaints are additionally filed with the Fraud Investigations Unit of the FBI. Due to the serious nature of this matter, I additionally copied Senator Warren's office, Senator Markey's office, the CFPB and Vice President Biden, as ALL parties are aware that this matter has far more to do than a single foreclosure or eviction. I have received a response from no one. Equally concerning, with the list of valid reasons submitted in support of the Stay order, the denials in the Northeast Housing Court, Appeals Court, and SJC have come with no explanation. I have now been wrongfully displaced from my home, have had to borrow money from my family in order to put belongings into storage, and am forced to stay in a hotel, as I do not currently have another option. This of course is in addition to an ongoing job search and a 3+ year pro se effort to fight a wrongful foreclosure. There are understandably now multiple red flags which have gone up. I have since filed with the Court motions for clarification, reconsideration, and have additionally filed a motion for new trial since the amount of evidence and information available since the initial decisions are overwhelmingly in support of my consistent claims. I am respectfully requesting from you again, and additionally from the US Attorney's office, supporting communication regarding criminal complaints against ALL associated parties on file, including Counsel, and also supporting communication stating this matter coincides with the ongoing investigation of Harmon Law Offices PC. I am also requesting next steps for complaints to now proceed to criminal charges against ALL parties. I have consistently made it clear to ALL, of my intentions to expose this misconduct publicly, as the associated lenders and their counsel have made it clear of their intentions to continue causing me harm. Due to the serious nature of this matter, it has become necessary to reach out to you directly, and to additionally copy multiple parties on this communication including: The Executive Office of Vice President Biden, The Office of US Senator Elizabeth Warren, The Office of US Senator Ed Markey, Deputy Assistant Director Tim Sheehan (CFPB) and State Senator Eileen Donoghue. First, I wish to say Thank You, for the work and effort, put forth every day by you, and your office in addressing the many challenges faced by the Commonwealth of Massachusetts. Specifically, your efforts pertaining to the US Foreclosure Crisis, which have been recognized throughout the Nation. As you know, while some significant progress has been made with the National Mortgage Settlement, Federal Bank Regulators Settlement, etc, the national impact from this crisis is far from over, and the next chapter of addressing Lender misconduct has begun, with recent settlements involving JP Morgan Chase, Ocwen Financial, and forthcoming Lender Fraud cases scheduled in early 2014, as announced by the US DOJ and AG Holder. Which brings us to the reason(s) for this email. The FCS* project, which over the past two (2) years has been presented to multiple parties** including your office, has additionally been sent to Vice President Biden (at his request), most recently to Senator Warrens Office (Senior Economic Advisor Bruno Freitas, at his request) and Senator Markeys Office (Chief of Staff Mark Bayer) for their review. I have consistently stated that - In addition to seeking accountability for the misconduct associated with my personal foreclosure, the FCS project has been designed to: a. Harihar. Despite many opportunities afforded to the associated lender(s) and their retained counsel to cease and desist, they have chosen instead to ignore these opportunities. As you know, I have regularly updated your office, the US Attorneys Office, the media and the public, through numerous press releases. Criminal complaints are filed with your office, the Fraud Investigations Unit of the FBI, the Consumer Financial Protection Bureau (CFPB), The Federal Trade Commission (FTC), The Securities and Exchange Commission (SEC), and complaints are now being prepared for the Internal Revenue Service. This matter coincides with your offices 3+year ongoing investigation of HARMON LAW OFFICES PC and the relationship to recently disbarred FL foreclosure kingpin David Stern. Additional factors include the Ocwen financial admission to fraud and settlement details, and Court cases/decisions from Washington state and Rhode Island as detailed in the attached (below). Tomorrow morning, Monday February 24, 2014, I will be appearing in the Middlesex Superior Court in Lowell, regarding an Emergency Motion I filed on Friday, February 21, 2014 (attached for reference), in effort to obtain a Stay of Execution on an Eviction order, for reasons stated, as well as related matters which are still pending in the MA Appeals and MA Supreme Judicial Court. I have respectfully requested that communication and support from your office, and from the US Attorneys

Office be provided. The communication received however from Ms. McBride on Friday, is a concern. This matter is well beyond contacting the HomeCorps Hotline, Ms. McBride is well aware of that, the response below is disappointing, and therefore this request is respectfully being made to you now directly. Unless there is a significant change of events by these parties, I am also requesting that next steps be taken in bringing criminal charges against: US Bank NA, Wells Fargo NA, Nelson Mullins LLP and Harmon Law Offices PC, for documented misconduct already in possession and on file with the Court(s).
