The Sydney Morning Herald Good Food Month Participation Terms and Conditions

General terms that apply to all Events in the Festival


1. 2. 3. These terms and conditions relate to your holding an event/s or as part of The Sydney Morning Herald Good Food Month (Good Food Month). Good Food Month will take place from 1 October 2014 to 31 October 2014. Your event/s will take place on the date(s) and during the hours set and agreed to by Fairfax unless otherwise notified by Fairfax. Fairfax reserves the right to change the date and/or time of the event/s and/or Good Food Month or cancel Good Food Month or your participation in Good Food Month, provided it gives you 7 days written notice of the change and, in the event of cancellation, refunds your event/s registration fee to you. To host an event/s as part of Good Food Month, you must agree to these terms and conditions and pay the relevant registration fee/s. All Event registrations are subject to approval by Fairfax, and Fairfax may accept or refuse registrations in its sole discretion without the need to provide reasons. Fairfax may refuse a registration if your proposed event/s does not conform to the terms and conditions for the category of the event specified, and if your event cannot be tailored to fit into another appropriate category of event. All Good Food Month registrants will be notified of approval of their participation in Good Food Month by August 12, 2014. The confirmation of your event registration/s will take the form of an email tax receipt for the registration fee/s, which will be sent to you upon completion of your on-line event registration/s. If your participation in Good Food Month is ultimately refused pursuant to condition 4 above, your registration fee/s will be refunded to you. All cancellations must be notified to Fairfax in writing. If you cancel your registration/s 4 weeks or more prior to the launch of the official Good Food Month programme, you will be entitled to a full refund of the event/s registration fee. You are not permitted to cancel your registration/s less than 4 weeks prior to this date. If you purport to cancel your registration within 4 weeks prior to the Good Food Month programme launch, you will not be entitled to any refund of your registration fee/s. Your event must be open to the public, but may be subject to any capacity restrictions that apply to your premises or require members of the public to make reservations in order to attend your event/s. Four promotional tickets must be made available to Good Food Month organisers for PR and VIP hospitality opportunities. Good Food Month and your event will be promoted by Fairfax through a marketing campaign which may include press, online and radio advertising. Your participation in the Good Food Month and your event will be included in the official Good Food Month programme which will be published in The Sydney Morning Herald and online at www.goodfoodmonth.com (the Website). The extent of such promotion will be at the sole discretion of Fairfax. You must promote your involvement with Good Food Month and your event by using the Good Food Month logo on your website, on event displays and in your own marketing. The Good Food Month logo can be downloaded from the Website and must be used in accordance with the Fairfax Media Guidelines which will also be available on the Website. To assist you with promoting your involvement in Good Food Month and your Event/s, you will be supplied with official Good Food Month and/or event marketing materials. You are expected to display these materials in conjunction with your event/s to the extent that is appropriate in your circumstances. The Good Food Month logo and any other Good Food Month and/or event marketing materials may only be used by you until the closing date of Good Food Month. After that date, the Good Food Month logo must be removed from your website, any marketing materials which contain the logo must be withdrawn from distribution and circulation, and you must cease display of any other Good Food Month and/or event marketing materials. You acknowledge that you do not acquire any intellectual property rights or goodwill in the names Sydney Morning Herald, Good Food Month or in the name of any event that is part of Good Food Month. Any use by you of Fairfax logos, trademarks or other intellectual property is subject to Fairfaxs prior written approval. You consent to Fairfax sharing your contact information with official Good Food Month partners, and to Fairfax and Good Food Month partners contacting you with promotional opportunities related to your event/s, Good Food Month and other similar events conducted by Fairfax.

In consideration of Fairfax permitting you to participate in Good Food Month, you release Fairfax and its related bodies corporate, affiliates, officers, agents and employees (the Released Parties) from all claims, demands and proceedings relating to your participation in Good Food Month and your event/s and you agree to indemnify the Released Parties against any liabilities, losses, damages, outgoings, costs and expenses incurred by the Released Parties arising out of or as a result of your participation in Good Food Month and your event/s, including but not limited to the sale or service of any product at the Event and any breach by you of these terms and conditions. 16. You must maintain for the duration of the Good Food Month all necessary and appropriate business insurance policies, including public and product liability insurance to cover liability for any injury, loss, death or damage whatsoever arising out of or as a result of your participation in Good Food Month and your event/s, and also workers compensation insurance as required by law. 17. You acknowledge that Fairfax does not give any guarantee in respect of the success or profitability of your participation in Good Food Month or your Event/s. 18. You participate in Good Food Month at your own risk. You acknowledge that Fairfax is not responsible for, and accepts no liability in relation to, your participation in Good Food Month. Fairfaxs liability to you will be limited to your event registration fee/s. In no circumstances will Fairfax be liable to you for any indirect, incidental, special and/or consequential losses or damages (including loss of profits or opportunity) in connection with Good Food Month. 19. You acknowledge that you are responsible for the safety of your employees, contractors and other individuals attending your premises during your Event and you agree to comply with all statutory obligations in respect of the Work, Health & Safety Act NSW and any other policies or directions issued by Fairfax or its nominated representatives. You must notify Fairfax or its nominated representatives immediately of safety concerns. 20. You warrant that you will comply with all applicable laws in relation to your Event/s. In particular this includes, without limitation, all laws relating to the preparation, sale and service of food and beverage items and fair trading laws. 21. You will retain all intellectual property rights in Your Recognition and you hereby grant to Fairfax a nonexclusive licence to reproduce and publish Your Recognition for the purpose of Fairfax carrying out its obligations under this agreement. In this clause Your Recognition means trade marks, names, logos, slogans or other intellectual property owned or developed by you relating to you or your businesses. 22. You warrant that the supply, use and publication of any material you supply to us in connection with Good Food Month or your event/s will not infringe the intellectual property rights of any other person. 23. You agree to at all times to act in good faith in relation to Good Food Month. Fairfax reserves the right to direct you to immediately cease participation in Good Food Month and conduct of your event/s if Fairfax reasonably believes your actions are causing, or are likely to cause, disruption to Good Food Month, embarrassment to Fairfax or a safety risk to the public. 24. Neither party to this agreement will be liable to the other party for delay or failure to perform an obligation under this agreement due to Force Majeure. You acknowledge that you are not entitled to any reimbursement in respect of any matter disrupting or leading to the postponement or cancellation of Good Food Month including, without limitation, inclement weather. In this clause Force Majeure means an event or circumstance beyond the reasonable control of a party, including acts of God, war, rain, hail, fire, explosion, civil disobedience, legislation not in force at the date of this agreement or labour disputes.

Additional terms that apply to specific Events in the Festival Barbecue Madness The following terms apply to the Barbecue Madness Event: Your event must take place on Saturday October 4, 2014 There is no set price but it should be good quality and good value

The Breakfast Club The following terms apply to The Breakfast Club Event: Set price $20 per person including first tea or coffee Your menu must be available to all diners during breakfast trading hours (early is good!) on weekdays throughout October

Lets Do Lunch The following terms apply to the Lets Do Lunch Event: Your restaurant must be featured in The Sydney Morning Herald Good Food Guide 2014 Your event menu is offered at a set price of $38 per person including coffee/tea, a glass of wine from our event partner or Coopers Beer or a glass of sparkling or still mineral water Any Good Food Month Sponsor beverage inclusion requirements will be advised by end of April Your event menu must be available during lunch trading hours Monday to Friday, with the option to extend your offer on weekends in Sydney and regional NSW.

Sunday Family Lunch The following terms apply to the Sunday Family Lunch Event: Your event can be held on any or all Sundays throughout October

Surprise Saturday Lunch The following terms apply to the Surprise Saturday Lunch Event: Your event must be a one-off concept designed to surprise Your event can be held on any or all Saturdays throughout October

Good Dinner Under $30 The following terms apply to the Good Dinner Under $30 Event: Your venue must be featured in The Sydney Morning Herald Good Food Under $30 Guide 2014 Your event menu must be offered at a set price of under $30 per person and feature two or more courses Your event menu must be available throughout October

Hats Off The following terms apply to the Hats Off Event: Your event must be held during October Your restaurant must have been awarded a least 1 Chefs Hat in The Sydney Morning Herald Good Food Guide 2014 Your menu must be creative and unusual, different from your daily offering The maximum price is $160 per person (this may or may not include wine) You must serve a Tanqueray gin and tonic to each guest upon arrival

World Dinners The following terms apply to the World Dinners Event: Your dinner must have an authentic cuisine theme There is no set price but it must be good quality and good value

Private Dining The following terms apply to the Private Dining Event: Your restaurant must be featured in The Sydney Morning Herald Good Food Guide 2014 Your head chef must be in attendance There is no set price but it must be good quality and good value

Supper Club The following terms apply to the Supper Club Event: Your restaurant must be featured in The Sydney Morning Herald Good Food Guide 2014 There is no set price but it must be good quality and good value

Bar Hop The following terms apply to the Bar Hop Event: You must offer a cocktail and matched bar snack at a set price of $20 per person Your cocktail creation must use Tanqueray Gin Your Bar Hop offer must be available for the whole month of October

Drink and Dine The following terms apply to the Drink and Dine Event: Your event must have a drink theme and incorporate an eating experience/meal There is no set price but it must be good quality and good value

Good Pub Grub The following terms apply to the Good Pub Grub Event: Your pub must be featured in The Sydney Morning Herald Good Pub Guide Your venue must have Cooper's Pale Ale on tap Your event menu must be offered at a set price of $25 per person including your inventive pie dish and a schooner of Cooper's Pale Ale

Instant Expert The following terms apply to the Instant Expert Event: You may offer one or a number of classes with registration fees set accordingly Your class must be unique to The Sydney Morning Herald Good Food Month program There is no set price but it must be good quality and good value You must indicate whether this is a hands-on experience (preferred) or demo only

Talk and Taste The following terms apply to the Talk and Taste Event: These are guided food or drink tastings, not cooking/cocktail classes or wine-matched dinners (see Instant Expert or Drink and Dine for these events). Please note that we can only promote sponsor beverages or generic varietals, wine styles, NSW wine regions, not individual brands. You may offer one or a number of events, with registration fees varying accordingly. There is no set price but it must be good quality and good value

Art and Food The following terms apply to the Art and Food Event: The event has a focus on the arts, as well as food There is no set price but it must be good quality and good value

Community and Other Outdoor Festivals The following terms apply to the Community and Other Outdoor Festivals Event: Your event must have a strong food focus You are a community or local government group/chamber of commerce Existing food festivals must feature special The Sydney Morning Herald Good Food Month programming and make mention of this in their programming

Markets The following terms apply to the Markets Event: You must be a growers/farmers or organic fresh produce market Existing markets must feature special The Sydney Morning Herald Good Food Month programming for October

Pop-ups and Parties The following terms apply to the Pop-ups and Parties Event: This must be held in a pop-up or temporary venue or be a temporary pop-up within an existing venue or location There is no set price but it must be good quality and good value for the customer Any Good Food Month Sponsor beverage inclusion requirements will be advised by end of April

Rooftops and Laneways The following terms apply to the Rooftops and Laneways Event: This must be held in a laneway or on a rooftop There is no set price but it must be good quality and good value

Signature Dish The following terms apply to the Good Signature Dish Event: There is no set price but it should be good value This promotion should not conflict with other Festival categories (i.e. Let's Do Lunch) You must register a group of 4 or more restaurants/venues to participate Streets of Sydney... Highways of NSW The following terms apply to the Streets of Sydney...Highways of NSW Event: Your event must have a strong food focus There is no set price but it must be good value The tour must be different from existing offerings (ie. Custom made for Good Food Month) The Regional Table The following terms apply to The Regional Table Event: The event must feature local produce and wine There is no set price but it must be good quality and good value

Down to Earth The following terms apply to the Down to Earth Event: Your event must have a green theme There is no set price but it must be good quality and good value

Kitchen Gardening The following terms apply to the Kitchen Gardening Event:

Your event must include a talk/workshop and tour of a kitchen garden and incorporate an eating experience/meal There is no set price but it should be good quality and good value

Thinking Food The following terms apply to the Thinking Food Event: You may offer one or a number of events, with registration fees varying accordingly. There is no set price but it must be good quality and good value

Family Table The following terms apply to the Family Table Event: Your event must be held at family friendly hours and offer a shared menu for all the family (no nuggets and chips!) Your restaurant must be featured in The Sydney Morning Herald Good Food Guide 2014 There is no set price but it should be good value Interactive elements, special printed menus, fresh produce on display can make this an event to remember

Kids in the Kitchen The following terms apply to the Kids in the Kitchen Event: Please indicate the ideal age range for your class (i.e. 4-8 years old, 12-16 years) Your event must be open to the public and include a hands-on element No set price but must be good value

The Ultimate High Tea The following terms apply to the Ultimate High Tea Event: No set price limit but offer has to be different from your usual High Tea menu All wine served must be from our event partners sparkling wine range Any Good Food Month Sponsor beverage inclusion requirements will be advised by end of April

Lets Do Dessert The following terms apply to the Lets Do Dessert Event: There is a set price of $20 per person Your dessert must be unique to the Lets Do Dessert offering and represent good value for money Your menu must include a glass of dessert wine from our event partners range Any Good Food Month Sponsor beverage inclusion requirements will be advised by end of April
