ORAL DECISION OF THE IMMIGRATION JUDGE The respondent is a 23-year-old female, native and citizen of Guatemala who has admitted the factual allegations in the Notice to Appear. That is tantamount to a concession of removal. Based upon those admissions, removal has been established by clear, convincing, and unequivocal evidence according to Woodby v. INS, 35 U.S. 276. The Court is going to grant her the privilege of voluntary departure. However, the respondent shall leave the United States of America no later than January 7, 2014, the failing of which an immediate of removal and deportation will be entered against her,
she will be fined $5,000, and there will be a 10-year bar from coming back to the Untied States or applying for any relief.
