The Board is revoking your pardon pursuant to Section 7 of the Criminal Records Act (CRA) for the following reasons. You received a pardon in 2009 relating to a number of convictions for offences including fail to comply with recognizance (1997); several counts of conspiracy to commit fraud (1997); attempt fraud over $5000 (1997); fraud over $5000 (1997); fraud under $5000 (1997) and uttering threats (2001). The pardon was granted on the basis that you met the legal criteria, including good conduct in the community. The Board reviewed correspondence received on May 24, 2013 from the Royal Canadian Mounted Police, Federal Policing Criminal Operations Division in Ottawa. It is noted on April 22, 2013, you, along with a co-accused, were arrested and charged for conspiring to carry out a terrorist attack against a Via Rail passenger train. You are charged with offences against Sections 248.235(1), 83.2, 83.18, and 83.21 of the Criminal Code of Canada, CCC. The Board has reviewed the written representations sent by counsel on your behalf, which were received on July 23, 2013, and finds that they do not provide sufficient justification for altering the initial recommendation to revoke your pardon. You provide insufficient information to convince the Board that you continue to meet the good conduct criterion set out in law and Board policy. You do not provide any information concerning the circumstances surrounding your conduct which caused you to incur the above-noted charges. Your counsel believes the Boards proposal to revoke your pardon to be unfair, an abuse of process, and suggests the presumption of innocence must be applied. Your counsel enclosed media accounts of the allegations. The Board in making this final determination has not relied on media reports of the alleged conduct but rather the documentation submitted by the authorities, the official information directly related to the criminal charges you face. It is important to note, as your counsel does acknowledge, according to the CRA, a pardon may be revoked by the Board if on evidence establishing to the satisfaction of the Board that the person to whom it was granted or issued is no longer of good conduct. The Board notes the extremely serious nature of these charges that represent a direct and grave threat to the public safety. The charges are outstanding and you

According to the ROMP information received, you were active in locations including Montreal and Toronto, where you conspired with a ccaccused to interfere with transportation facilities unlawfully for the benefit of, at the direction of or in association with a terrorist group. The Board finds the information received from the ROMP to be reliable and persuasive in making the determination that you no longer meet the good condut criteria.
