Higher Education Commission Employees (Service, Appointment, Promotion and Transfer) Rules, 2009

In exercise of the powers conferred by Section 21 of the Higher Education Commission Ordinance, No.LIII of 2002, the following Service Rules are hereby laid down for making appointment, promotion and transfer of HEC employees:1. Short title, Application and Commencement - (i) these rules may be called the Higher Education Commission Employees (Service, Appointment, Promotion and Transfer) Rules, 2009. ii) They shall come into force at once and shall apply to all the employees in whole time employment of the Commission working in the Head office, Regional Centers, MP Scales and Projects. 2. Definitions (1) In these rules, unless there is anything repugnant in the subject or context:a)Government means Government of Pakistan. b)Ordinance means Higher Education Commission Ordinance, No.LIII of 2002. c) Commission means the Higher Education Commission; established under HEC Ordinance (No. LIII of 2002) d) Chairperson means the Chairperson of the Commission, appointed under Section 5 of the Ordinance. e)Executive Director means Executive Director of the Commission having the status of ex-officio Federal Secretary, appointed under Section 6 (2) of the Ordinance and duly notified under Rule 18(1) of the Rules of Business 1973 (amended to date) of the Federal Government and also the Principal Accounting Officer of the Commission. f)Appointing Authority, in relation to a post, means the person authorized under Rule(6) by the Commission to make appointments to that post. g) Employee means a person employed by the Commission but does not include:i) a person who is on deputation to the Commission from the Federal Government or any Province or other authority or autonomous body ; or ii) a person who is employee on work charge basis or who is paid from the heads Contingent Paid Staff /Consultancies/contingencies of the projects. h)ad-hoc appointment means appointment of a duly qualified person made otherwise than in accordance with the prescribed method of recruitment;

i)Scale means Basic Pay Scales and other Management Professional Pay Scale as prescribed by the Federeal Government from time to time j)Initial appointment means appointment made other than by promotion or transfer; k) Pay means the amount drawn monthly by an employee as pay and includes, technical pay, special pay, personal pay and any other emoluments decided by the Prescribed authority to be pay; l)Permanent Post means a post sanctioned without limit of time; m)Prescribed means prescribed by rules; n)Rules means the Higher Education Commission Employees (Service, Appointment, Promotion and Transfer) Rules, 2009. o) Selection Authority means the Selection Board, or Departmental Selection Committee or Departmental Promotion Committee or other authority or body on the recommendation of, or in consultation with which any appointment or promotion, as may be prescribed, is made; p)"Selection Board" means a Board constituted by the Commission, for the purpose of selection for initial appointment, promotion or transfer to posts in BPS-19 & above and equivalent including MP Scales, consisting of such persons as specified in schedule IV to these rules. q) Selection Committee means a Committee constituted for the purpose of making selection for initial appointment, promotion or transfer to posts in BPS-1 to BPS-18 and selection for appointment(s) to project funded posts. r) Departmental Promotion Committee means a Committee constit uted for the purpose of making promotion to posts in BPS 2 to 18. s)Temporary Posts means a post other than a permanent post; (2) For the purpose of these rules an appointment whether by promotion or otherwise, shall be deemed to have been made on regular basis if it is made in the prescribed manner. 3. Terms and Conditions (i) The terms and conditions of service of an employee shall be as prescribed under these rules. (ii) The terms and conditions of service of any employee to whom these rules apply shall not be revised to his/her disadvantage.

4. Method of Appointment (I) Appointments to posts in the Commission shall be made by any of the following methods, namely:a) by transfer in accordance with Rule 7 b) ) by initial appointment in accordance with Rules 8 & 9., c) by promotion in accordance with Rule 20 (2) The method of appointment, qualifications, experience and other conditions for various posts shall be as laid down in Schedules I, II & III to these rules. (3) The Commission may amend, modify, add, or delete any condition laid down in the Schedules I, II and III from time to time. However, the action taken by the Commission shall be notified in the Gazette of Pakistan. 5. (1) Composition of Selection Board and Departmental Selection Committees/ Departmental Promotion Committees for recommendation for appointment /promotion to various posts in the Commission shall be as specified in Schedule-IV to these rules. (2) Where an appointing authority for BPS-18 & below does not accept the recommendations of the Selection Committee, it shall record reasons therefor and obtain orders of the next higher authority. 6. Appointing Authority - The authorities competent to make appointment to the various posts in the basic pay scales, MP Scales and to project funded posts, shall be as follows:S.# Scale Appointing Authority Commission Chairperson Executive Director Member (O&P)

1. MP-Scales and BPS-19/equivalent and above. 2. BPS-17 to 18 and equivalent. 3. BPS -11 to 16 and equivalent. 4 BPS -1 to 10 and equivalent.

7. Appointments by transfer (i) Appointments by transfer shall be made on the recommendations of the Selection Board /Departmental Selection Committee as specified in Schedule-IV to these rules. (ii) Appointments by transfer shall be made from amongst the persons holding appointment on regular pay scale or equivalent to or identical with the post to be filled. (iii) Only such persons who possess the qualifications and meet the conditions laid down for the purpose of transfer to the post shall be considered by the Departmental Selection /Promotion Committee for appointment by transfer. 8. Initial appointments Initial appointment to the posts in MP Scale, BPS 19 and above shall be made on the basis of interview and recommendations by the Selection Board after the vacancies have been advertised in the newspapers. 9. Initial appointments to post in BPS 3 to 18 shall be made on the basis of interview or test and recommendations of the Departmental Selection Committee after the vacancies have been advertised in the newspapers. Vacancies in posts in basic pay scales 1 and 2 and equivalent shall ordinarily be filled on local basis after advertisement in the newspapers. 10. Conditions of initial appointments: (i) A candidate for initial appointment to a post must possess the educational qualifications and experience and, except as provided in the rules framed for the purpose of relaxation of age limit, must be within the age limit as laid down in Schedule-III these Rules. Provided that unless otherwise specified in the method of appointment, qualifications and other conditions applicable to a post as laid down in Schedule-III, the experience prescribed for initial appointment shall be the post-qualification experience]. (ii). A candidate for appointment shall be a citizen of Pakistan; Provided that this requirement may be relaxed with the approval of the Commission: (iii). A candidate for appointment must be in good mental and bodily health and free from any physical defect likely to interfere with the discharge of his duties. A candidate who after such medical examination as Commission may prescribe is found not to satisfy these requirements, shall not be appointed. (iv) No person who is less than 18 years shall be appointed to a post by initial recruitment.

(v) Character and antecedents of candidates other than one, who is already in the service of the Commission or holding a post in the Federal Government or Provincial Government, shall be made only if, in the opinion of the authority, the Character and antecedents are satisfactory. (vi) No person shall be substantively appointed to a permanent post without Medical Certificate of health from authority prescribed by the Commission. 11.Vacancies:in the under mentioned posts shall be filled on All-Pakistan basis in accordance with the merit and provincial or regional quotas prescribed by Government from time to time: (i) All posts in basic pay scales 16 and above and equivalent. ii) Posts in basic pay scales 3 to 15 and equivalent in offices, which serve the whole of Pakistan. iii) Vacancies in posts in basic pay scales 3 to 15 and equivalent in offices which serve only a particular province or region shall be filled by appointment of persons domiciled in the province or region concerned. iv) Vacancies in posts in basic pay scales 1 and 2 and equivalent shall ordinarily be filled on local basis. 12. Ad-hoc and temporary appointments (i) When the Executive Director considers it to be in the public interest to fill a post falling within the purview of the Selection Board urgently, pending nomination of a candidate by the Selection Board, he may proceed to fill it on adhoc basis for a period not exceeding six months. The post shall be advertised within four months of the date of falling vacant and the same procedure as laid down for initial appointment shall be followed. (i) The vacancies falling under the purview of the selection committee will be filled with the approval of the Executive Director. 13. Short-term, vacancies: In the posts and vacancies occurring as a result of creation of temporary posts for a period not exceeding six months, may be filled by the appointing authority on purely temporary basis after advertising the vacancy.

Short-term appointments: under the budget head Contingent Paid staff shall be made with the approval of the Executive Director, HEC as per following laid down procedure:a) b) Such appointments will be made equivalent to the salary package of the relevant pay scale of the post in BPS. The incumbents who possess the minimum educational qualification, experience or length of service prescribed in Schedule-III of the Rules be eligible for appointment in the relevant category of staff. Such appointments will be made for a short period not exceeding a financial year subject to availability of budget. Fresh appointment under these budget heads will be made with the approval of the Executive Director, HEC.

15. Contract appointment Contractual appointment shall be made in accordance with the procedure and policy prescribed by the Commission from time to time. 15 (a). Contractual appointment against Project Funded Posts:- (i) Contractual Appointment against project funded posts will be made by the appointing authority initially for a period upto one year, which could be extended for a period as deemed appropriate upto the life of the project, keeping in view the recommendations of the sub-committee, so constituted for the purpose, and after the vacancies have been duly advertised in newspapers. (ii) (iii) The Executive Director may make appointment of persons on contract basis under the budget head Contingencies of the project as per procedure laid down in the Rule - 14. The Executive Director may transfer employees, from one project to another on need basisagainst an equivalent post, subject to the condition that the terms and conditions of such transferred employees shall remain the same.

16.Appointment of Consultants: The appointment of Consultants in the Commission shall be regulated under the relevant policy instructions of the Federal Government, issued from time to time.

17. Probation: (1) Persons appointed by initial appointment, promotion or transfer shall be on probation for a period of one year. (2) The period of probation may be curtailed for good and sufficient reasons, to be recorded, or, if

considered necessary, it may be extended for a period not exceeding one year as may be specified at the time of appointment. (3) On the successful completion of probation period, the appointing authority shall, by specific

order, terminate the probation. (4) If no order is issued under sub-rule (3), on the expiry of the first year of probation period, the

period of probation shall be deemed to have been extended for one year under sub-rule (2). Provided that in the absence of an order under sub-rules 3, the period of probation shall, on the expiry of the extended period under sub-rule 2, be deemed to have successfully been completed (5) If an employee fails to show satisfactory progress during the initial and even the extended

period of probation shall:(a) (b) if he was appointed to such service or post by initial recruitment, be discharged; or if he was appointed to such service or post by promotion or transfer, be reverted to the service or post from which he was promoted or transferred and against which he holds a lien or, if there be no such service or post, be discharge.

18. Confirmation (i) A person appointed on probation shall on satisfactory completion of his probation, be eligible for confirmation in a post or service as may be prescribed. ii) iii) iv) An employee promoted on regular basis shall be eligible for confirmation after rendering satisfactory service for the period prescribed for confirmation therein. There shall be no confirmation against any temporary post. An employee, who during the period of his service was eligible to be confirmed but retires from service before being confirmed shall not, merely be by reasons of such retirement, be refused confirmation or any benefit occurring therefrom. (v). Confirmation of an employee shall take effect from the date of occurrence of permanent vacancy in the post or from the date of continues officiating in such posts, which ever is later.

19. Seniority.(1) For proper administration of a service, cadre or post the appointing authority shall cause a seniority list of the members for the time being of such service, cadre or post to be prepared, but nothing herein contained shall be construed to confer any vested right to a particular seniority in such service, cadre or post, as the case may be. (2)Subject to the provisions of sub-rule (1), the seniority of an employee shall be reckoned in relation to other employees belonging to the same service or cadre. (3)Seniority on initial appointment to a service, cadre or post shall be determined as may be prescribed. (4)Seniority in a post, service or cadre to which an employee is promoted shall take effect from the date of regular appointment to that post: Provided that employees who are selected for promotion to a higher post in one batch shall, on their promotion to the higher post, retain their inter se seniority as in the lower post.

Promotion:(i) An employee possessing such minimum qualifications as may be prescribed shall be eligible for consideration of promotion to a higher post, for the time being, reserved under rules for departmental promotion. (ii) A post referred to in Sub-Rule (i) may either be a selection post or a non-selection post to which promotions shall be made as may be prescribed. (a) (b) In the case of a selection post, on the basis of selection on merit; and In the case of a non-selection post, on the basis of seniority-cum- fitness: Posts in BPS-20 & above are selection posts and posts in BPS-19 &

Explanation:

below are non-selection posts. 20(2) Promotion Policies: (i) Promotion to posts in BPS-19 and above shall be made by the Appointing Authority on

the recommendations of the Selection Board.

(ii)

Promotion to posts in BPS-2 to BPS-18 shall be made by the Appointing Authority on the

recommendations of the Departmental Promotion Committee. (iii) The Selection Board or the Departmental Promotion Committee, as the case may be,

shall consider the case of eligible employees in the order of seniority and a meeting of the Appointing Authority shall be held at least once in a year to finalize the promotion cases of the employees; a. Fulfillment of prescribed minimum length of service in BS-17 and above for promotion to various scales. b. Should possess qualification/experience and other conditions as prescribed in the relevant Recruitment Rules. c. An officer superseded earlier shall be considered after earning Performance Evaluation Report (PER) for one full year. For example, an officer superseded on the basis of his PERs up to 2004, will become eligible for consideration after earning PER for 2005. d. Annual Performance Report will be given due importance for promotion. e. Performance Evaluation Reports shall be quantified according to prescribed formula and weightage shall be given to more recent appointments; f. Promotions to departmental quota to be made first and direct recruitment made later. g. Promotions of incumbents of technical/professional post will be within their own line of specialization. The criteria for promotion in their case would continue to be the technical qualifications and experience.
h. Placement criteria for posts in Scale-16 and below will be as follows:-

i) An employee who has completed 5 years service in the same scale and fulfills the qualifications requirements of the higher posts; and

ii) His performance was very good during the last three years and is not involved in any disciplinary cases.
i. Placement criteria for posts in scale 17 and above will be as follows:

i) Officers in scale 17 having 5 years continuous service and required qualifications may be considered for promotion in scale 18 on the basis of performance. ii) Officers in scale 18 having 12 years continuous service in scale 17 and above or 7 years continuous service in scale 18 and required qualifications may be considered for promotion in scale 19 on the basis of performance. iii) Officers in scale 19 having 17 years continuous service in scale 17 and above or 5 years continuous service in scale 19 and required qualifications may be considered for promotion in BPS-20 on the basis of performance; and iv) Officers in scale 20 having 22 years continuous service in BPS-17 and above or 5 years continuous service in scale 20 and having required qualifications may be considered for promotion in BPS-21 on the basis of performance; and v) Officer in Scale-21 having 25 years continuous service in BPS-17 and BPS-22 on the basis of

above or 5 years continuous service in BPS-21 and having required qualifications may be considered for promotion in performance. j. An employee of HEC, on deputation to Federal or Provincial Government, institution, foreign government, international agency or private organization abroad will be considered for promotion only on his return to Commission and earning at least one good Performance Evaluation Report for one full year, before s/he is considered for promotion. S/He will be given intimation and asked to return to Commission before his case comes up for consideration for

promotion in accordance with his seniority position, if s/he fails to return will not be considered for promotion. k. The promotion of an employee shall be deferred due to the following reasons:i) Non submission of Part-I and Part-II of the PER by the concerned officer to his reporting officer in respect of his service in the present scale and the preceding scale. ii) When the Selection Board/Departmental Promotion Committee considers the record is incomplete, or wants to further watch the performance of the officer or for any other reason to be recorded in writing. iii) Pendency of criminal case, involving moral turpitude. iv) Disciplinary or departmental proceedings are pending against the officer/official. v) The officer/officials inter se seniority is subjudice. vi) Whenever an officer, particularly of small cadres, is recommended for deferment, the Selection Board/Departmental Promotion Committee may also decide as to whether a vacancy be reserved or not, depending upon public interest vs officers right for consideration. l. An officer superseded earlier, shall be re-considered for promotion, after earning a good Performance Evaluation Report (PER) for one full year. vi) The Competent Authority may approve the promotion of an officer or official from the

date, on which the recommendation for promotion was made by the Selection Board or, as the the case may be, the Departmental Promotion Committee. v) Notwithstanding anything contained in Rule 20, the officer or official, who expires or

superannuates after the recommendations of the Selection Board or the Departmental Promotion Committee and before the issuance of the notification, shall stand exempted from assumption of the charge of the higher post. The Officer so authorized will give a certificate to the effect that the officer or official has expired or superannuated.

vi)

Only such persons, who possess the required qualifications and meet the conditions laid

down for the purpose of promotion or transfer to a post, shall be considered by the Departmental Promotion Committee or the Selection Board, as the case may be. (a). No promotion, on regular basis shall be made to posts in BPS 17 to 22 and equivalent, unless the officer concerned has completed such minimum length of service, attended such training, as may be prescribed by the Commission from time to time. (b) (1) Where the Appointing Authority considers it to be in the public interest, to fill a post reserved under the rules for departmental promotion and the most senior officer belonging to the cadre or service concerned, who is otherwise eligible for promotion does not possess the prescribed length of service, the Authority may appoint him to that post on acting charge basis. (2) In the case of a post in BPS 17 to 22 and equivalent, reserved under the rules to be filled in by initial appointment, where the Appointing Authority is satisfied that no suitable officer, drawing pay in BPS in which the post exists, is available in that category to fill the post and it is expedient to fill the post, it may appoint to that post on acting charge basis, the most senior officer, otherwise eligible for promotion in cadre or service, as the case may be, in excess of the promotion quota. (3) Acting charge appointment, may be made against posts which are likely to fall vacant for a period of six months or more. Against vacancies occurring for less than six months, current charge appointment may be made subject to the orders issued by the authority from time to time. (4) Appointment on acting charge basis /current charge shall be made by the Chairperson on the recommendations of the Executive Director. (5) Acting charge appointment, shall not amount to appointment by promotion on regular basis or for any other purpose including seniority. (6) Acting charge appointment shall not confer any right for regular promotion to the post held on acting charge basis.

21. Termination of Service.(1) The service of an employee may be terminated without notice (a) during the initial or extended period of his probation: Provided that, where such employee is appointed by promotion on probation or, as the case may be, is transferred from one cadre or post to another cadre or post, his/her service shall not be so terminated so long as he/she holds a lien against his former post in such cadre or post but he /she shall be reverted to his/her formal cadre or post as the case may be; (b)on the expiry of the initial or extended period of his/her employment; or (c)if the appointment is made adhoc terminable on the appointment of a person on the recommendation of the selection authority of such person. (2) Where, on the abolition of a post or reduction in the number of posts in a cadre the services of an employee is required to be terminated, the person whose services are terminated shall ordinarily be the one who is the most junior in such cadre. (3) Notwithstanding the provisions of sub-rule (a), but subject to the provisions of sub-rule (b), the service of an employee in temporary employment or appointed on contract basis shall be liable to termination on fourteen days' notice or pay in lieu thereof. 22. Reversion to a Lower Grade.-Any employee appointed to a higher post or grade on ad-hoc, temporary or officiating basis shall be liable to reversion to his lower post or, grade without notice. 23. Retirement from Service. (1)An employee shall retire from service. (i) on such date after s/he has completed twenty five years of service qualifying for pension or other retirement benefits as the appointing authority may, in public interest, direct; or (ii) Where no direction is given under clause (i), on the completion of the sixtieth year of his age. (2) No direction under clause (i) of sub-section (1) shall be made until the employee has been informed in writing of the grounds on which it is proposed to make the direction, and has been given a reasonable opportunity of showing cause against the said direction. (3). After a service of five years or more but less than ten years, a gratuity not exceeding one months emoluments for each completed year of service. If an employee dies in service, the rate shall be one and a half months emoluments for each completed year of service. If the emoluments of an employee have been reduced during the last twelve months or thirty six months of his service, as the case may be, otherwise than as a penalty, average emoluments

may, at the discretion of the authority which has the power to sanction gratuity, be substituted for emoluments. (4) If the employees are unable to work and retire on account of invalidation due to illness, accident, earthquake or terrorism will get complete pension benefits, and the condition of ten years service shall not apply to such cases. 24. Employment after Retirement.- (i) A retired employee shall not ordinarily be re-employed under the Commission, unless such re-employment is necessary in the public interest and is made with the prior approval of the Appointing Authority (ii) Subject to the provisions of law on the subject in force, an employee may, during L.P.R. or after retirement, seek any private employment: Provided that, where employment is sought by an employee while on L.P.R. 25. Pay. - (i) An employee appointed to a post or scale shall be entitled in accordance with the rules, to the pay sanctioned for such post or scale. Provided that when the appointment is made on a current charge basis or by way of additional change, his pay shall be fixed in the prescribed manner: (ii) The scales prescribed by the Federal Government shall be applicable to the employees of the Commission. Provided that Commission may, frame its own pay scales for the employees of the Commission at any stage. 26. 27. Allowances.-An employee shall be entitled to such compensatory and other allowances as may be sanctioned by the Commission from time to time. Honorarium.--The Executive Director may sanction a grant as an honorarium to an employee for such work performed by him /her which is laborious or of such nature as justifies a special reward. 28. Personal Staff Subsidy Officers of the Commission shall be entitled for personal staff subsidy as determined by the Commission from time to time. This subsidy shall freeze on the retirement. 29. Medical Allowance. - The employees of the Commission shall be entitled to medical allowance as admissible under the existing Medical Attendance Rules. 14

Housing Subsidy: An employee shall be eligible for housing subsidy as determined by the Commission from time to time.

Utility Bills: An employee shall be entitled to 10% of basic pay on account of utility bills. Increments.- (1) The annual increment will accrue only on the 1st day of the month of December following the completion of at least six months of such service at the relevant stage in that scale and will be allowed as a matter of course unless with held under a specific order. 2) Leave without pay shall not count towards annual increment and increment in the pay of an employee who is granted leave without pay shall be postponed by the period or periods of such leave : Provided that the competent authority may, in any case if it is satisfied that the leave was taken on account of illness or for any other cause beyond the employee's control, direct that leave without pay shall be counted for increment.

Leave. - An employee shall be allowed leave in accordance with the Higher Education Commission Leave Rules, 2009 provided that the grant of leave will depend on the exigencies of service and be at the discretion of the competent authority.

34.

Provident Fund, Benevolent Fund and Group Insurance.- Employees and their families shall be entitled to the benefits admissible under the Higher Education Commission Provident Fund, Benevolent Fund and Group Insurance Rules, 2009.

35.

Any change or revision to the Federal Governments rules by the government shall be effective for the purpose of these rules and stand adopted for the employees of the Commission w.e.f. the same date as it is applicable to the government employees.

36.

Other Terms and Conditions of Service etc. The rules and orders of the Federal Government for the time being in force shall also apply mutatis mutandis to the employees of the Commission with regard to the following matters and shall be entitled to the same grant and rate as admissible to Federal Government servants in the corresponding grades of pay scales. 1. 2. 3. 4. 5. Retirement, pension and commutation. Deputation and Foreign Service. T.A/D.A. Conduct Rules. Removal from service.

Financial Assistant Package for the families of deceased employees who die in service is given as under:

In Service Deaths 75% pension to the spouse or eldest son till the youngest child attains the age of 18 years. Normal pension to the spouse after that for life. Accommodation Retention of Government house or payment of rent for hired house for 05 years or till the age of superannuation, which ever is earlier but for a minimum period of 03 years. Employment Education Health Plot of Land Employment for posts in BS-01 to BS-15 on two years contract without advertisement. Free education to one child up to the age of 18 years. Free health facilities to widow for life and for children upto age of 18 years in Government hospitals. The widow would also be eligible to be considered for allotment of plot by FGEHF as per policy applicable to serving Federal Government employees. In case of advance against salaries sanctioned by the HEC, the unpaid balance to be waived.

7. Any other matter related to service conditions which Commission may adopt. Provided that all powers for implementation of these rules shall be exercised by the Commission/Chairperson/Executive Director or Officer(s), who are authorized by the Commission. If Commission frames its own scales, other terms and conditions of service will stand modified accordingly. 37. Reservation of Quota for Appointment of Children of Retiring Employees on Superannuation/ Invalidation. A quota of 5% falling to the share of initial recruitment in BPS-1 to BPS-16 shall be reserved for appointment of one of the children of a retiring employee on superannuation/invalidation; provided that:1) the appointment shall be made subject to the availability of vacancy. 2) A waiting list showing the name, designation and date of retirement/invalidation of the employee shall be maintained in the department/office. The merit shall be determined from the date of retirement/invalidation of the employee. 3) The child possesses qualification prescribed for the post; 4) In case, the date of retirement/invalidation of two employees is the same, the child of the employee older in age shall be considered first for appointment.

5) Under age child of the said employee shall be included in the waiting list from the date of retirement/invalidation. However, he shall be considered for appointment after he attains the age prescribed for the posts. 38. Notwithstanding any thing inconsistent with these rules Commission may add, amend or modify any of the rules from time to time. Appeals of employees of the Commission shall be regulated under the Civil Servants Appeal Rules, 1977. Saving.-Nothing in these Rules or in any rule shall be construed to limit or abridge the power of the Commission to deal with the case of any employee in such manner as may appear to the Commission to be just and equitable. Indemnity - No suit, prosecution or other legal proceedings shall lie against an employee for any thing done in his official capacity which is in good faith done or intended to be done under these rules, instructions or directions made or issued there under. Removal of Difficulties.-(i) If any difficulty arises in giving effect to any of the provisions of these Rules, the Commission may make such order, not inconsistent with the provisions of these rules. as may appear to be necessary for the purpose of removing the difficulty. (ii) Any orders or instructions in respect of any terms and conditions of service of any employee duly made or issued by an authority competent to make them and in force immediately before the commencement of these rules shall, in so far as such orders or instructions are not inconsistent with the provisions of these rides, be deemed to be orders or instructions made under those rules.

Relaxation.-Any of these rules may, for reasons to be recorded in writing be relaxed by the Chairperson, provided that where the appointing authority is the Commission, the relaxation shall be got approved by the Commission as soon as practicable. Where these Rules, do not contain provisions relating to any matter and are silent, the relevant Federal Government Rules shall deem to be effective. Repeal:-University Grants Commission employees (Service, appointment, Promotion and Transfer) Rules, 1975 are hereby repealed.

HIGHER EDUCATION COMMISSION (Leave Rules, 2009).


In exercise of the powers conferred by section 21 of the Higher Education Commission Ordinance, 2002 (LIII of 2002), the Commission is pleased to make the following rules with the approval of the Controlling Authority, namely:1. Short Title, Commencement and Application.- These rules may be called the Higher Education Commission Leave Rules, 2009. They shall come into force at once and shall apply to all employees of the Commission. Leave: (i) Leave is admissible to an employee and granted to him by the competent authority. An employee of the Commission shall earn leave only on full pay. It is to be calculated at the rate of four days for every calendar month of the period of duty rendered and credited to the leave account as Leave on full pay; duty periods of 15 days or less in a calendar month being ignored and those of more than 15 days being treated as a full calendar month for the purpose. If an employee proceeds on leave during a calendar month and returns from it during another calendar month and the period of duty in either month is more than 15 days, the leave to be credited for both the incomplete months will be restricted to that admissible for one full calendar month only. Accumulation There is no maximum limit on the accumulation of such leave. Application for earned leave must be made in advance to enable the competent authority to make necessary administrative arrangement.

No employee shall proceed on earned leave without prior approval of the competent authority in writing. Leave Preparatory to Retirement: i) ii) iii) An employee may, at his option avail leave preparatory to retirement on full pay upto 365 days subject to availability. Such leave may be taken, subject to availability, either on full pay, or partly on full pay and partly on half pay, or entirely on half pay, at the discretion of the employee. If in case of retirement on superannuation or voluntary retirement on completion of thirty years qualifying service, an employee cannot for reasons of public service, be granted leave preparatory to retirement duly applied for in sufficient time, he will in lieu thereof be granted lump-sum leave pay for the leave subject to a maximum of one hundred and eighty days leave on full pay.

iv)

Such leave can be refused partly and sanctioned partly but the cash compensation shall be admissible for the actual period of such leave so refused not exceeding one hundred and eighty days. The payment of leave pay in lieu of such leave may be made to the employee either in lump-sum at the time of retirement or may, at his option, be drawn by him month-wise for the period of leave so refused. For the purpose of lump-sum payment in lieu of such leave, only the Senior Post Allowance will be included in Leave Pay so admissible. In case an employee on leave preparatory to retirement dies before completing one hundred and eighty days of such leave his family shall be entitled to lump-sum payment equal to the period falling short of one hundred and eighty days.

Leave can not be claimed as a right, when the exigencies of service or official business or the interest of the Commission so require, the discretion to refuse or revoke leave of any kind is reserved to authority empowered to grant it. Leave on half pay: Leave on full pay may be converted into leave on half pay, at the option of the employee of the Commission; the debit to the leave account will be at the rate of one day of the former for every two days of the latter, fraction of one-half counting as one full days leave on full pay. The request for such conversion will be specified by the HEC employee in his application for the grant of leave.

Counting of Leave: Leave may be applied for, expressed, and sanctioned, in terms of days. Leave not due: It may be granted to permanent employees of the Commission on full pay, to be offset against leave to be earned in future, for maximum period of 365 days in the entire period of service, subject to the condition that during the first 5 years of service it shall not exceed 90 days in all. Such leave may be converted into leave on half pay. It will be granted only when there are reasonable chances that the employee will resume duty. Such leave will be granted sparingly and to the satisfaction of sanctioning authority. Overstayal after sanctioned leave: (i) Unless the leave of an employee is extended by the competent authority, an employee who remains absent after the end of his leave shall not be entitled to any remuneration for the period of such absence, and without prejudice to any disciplinary action that may be taken against him, double the period of such absence shall be debited against his leave account.

Such debit shall, if there is insufficient credit in the leave account, be adjusted against future earning. Leave Encashment: An employee shall be entitled to encash his accumulated leave subject to a leave balance of 90 days at his credit. Casual leave: Casual leave for a maximum period of 20 days in a calendar year shall be admissible to an employee which may be availed of on the basis of written application . i) ii) iii) iv) Casual leave at one time shall not ordinarily exceed to 10 days. In case of appointment of person in Commission in second half of the calendar year, the maximum limit of 20 days shall be reduced to 10 days. Casual leave may be prefixed or suffixed to Sunday or any other gazetted holiday. Unavailed casual leave shall be encashed at the end of each calendar year.

Maternity leave: (i) Maternity leave may be granted on full pay, outside the earned leave account, to a female employee to the extent of ninety days in all from the date of its commencement. (ii) (iii) Such leave may not be granted for more than three times in the entire service of a female employee. For confinements beyond the third one, the female employee would have to take leave from her leave account maintained for earned leave and in the case of non-availability of earned leave, the leave availed of by her shall be treated as leave without pay. Maternity leave may be granted in continuation of, or in combination with, any other kind of leave as may be due and admissible to a female employee.

Iddat leave: (i) A Muslim female employee, on the death of her husband, may be granted iddat leave on full pay when applied for, for a period not exceeding 130 days. Such leave shall not be debited to her earned leave account. (ii) Iddat leave shall commence from the date of death of her husband and for this purpose she will have to produce death certificate issued by an appropriate authority either along with her leave application or, if not possible, the said certificate may be furnished to the competent authority separately. Such leave shall also be granted to a Muslim female employee who has been divorced which shall not be more than 40 days subject to production of a certificate of confirmation of divorce by the Chairman, Union Council or Union Committee or some other concerned agency, as the case may be. 20

Leave Ex-Pakistan: (i) Leave ex-Pakistan may be granted on full pay subject to the availability in the leave account maintained for each employee for the purposes of earned leave. (ii) The leave pay shall not be payable in foreign exchange.

Study leave: (i) An employee may be granted study leave with pay by the Executive Director for a period of four years during the entire service of employee; Provided that the employee has been in the service of the Commission for a continuous period of five years. Further provided that an employee having three years or more service shall be eligible for leave without pay. (ii) Such leave may be granted for study within or outside Pakistan; Provided that such a study may increase the efficiency of the employee and may be in the benefit of the Commission. (iii) Study leave shall not be granted to an employee who obtains scholarship without approval from the competent authority. The employee shall have to provide sufficient evidence of his admission in a recognized institution, at the time of applying for leave. The employee shall have to furnish an undertaking to the effect that on completion of studies he shall be bound to serve the Commission for a minimum period of five years. The employee shall also have to furnish a bond in prescribed form, for an amount of two hundred thousand rupees or such amount as may be specified from time to time, to the effect that he / she or his /her surety or sureties shall be liable to pay the specified amount to the commission if the employee violates any terms and conditions of the bond. The competent authority shall have the right to pend, approve or reject study leave to an employee.

(viii) The competent authority may relax any of the clause of these rules in deserving cases by stating the reason in writing.

16. Recreation Leave: Recreation leave shall be admissible to the employees for a period of 15 days once in a calendar year, the debit to the leave account may, however, be for ten days leave on full pay or on casual leave.

Extra Ordinary Leave (Leave without pay): Extra ordinary leave may be granted in special circumstances (i) when no other leave is by rule admissible or (ii) when other leave being admissible, the employee concerned applies in writing for the grant of extra-ordinary leave. Such leave is not debited against the leave account. No leave pay is admissible during such leave. Leave without pay cannot be converted into any other kind of leave. Recall from leave: (i) If an employee is recalled to duty compulsorily with the approval of the competent authority from leave of any kind that he is spending away from his headquarters, he maybe granted a single return fare as per entitlement from the station where he is spending his leave to the place where he is required to report for duty. (ii) In case the employee is recalled to duty at headquarters and his remaining leave is cancelled, the fare then admissible shall be for one way journey only.

Reasons may not be specified: (i) It shall not be necessary to specify the reasons for which leave has been applied so long as that leave is due and admissible to an employee. (ii) Leave applied for on medical certificate other than the extra sick leave may not be refused.

Provided that the authority competent to sanction leave may, at its discretion, secure a second medical opinion. 20. Combination of different types of leave, etc: One type of leave may be combined with joining time or with any other type of leave otherwise admissible to the employee, except the casual leave which shall not be prefixed or suffixed with earned leave. Leave account: Leave account in respect of each employee shall be maintained as part of his/her service record. In-service death: In case an employee of the Commission dies, or is declared permanently incapacitated for further service by a Medical Board while in service, a lump-sum payment equal to leave pay upto 90 days out of the leave at his credit will be made to him or his family the case may be. Joining Time: (1) The joining time is granted to an employee in order to enable him:a) to join a new post which he is appointed while on duty in his old post; or b) to join a new post : (i) while returning from leave on average pay not exceeding 4 months; or

if he was not given sufficient notice regarding his appointment to the new post, on return from any leave other than that specified in (i) above; or.

c)

to travel from the port of debarkation or in case of air journey from first airport of call in Pakistan to organize his domestic establishment, on return from leave out of Pakistan for more than 4 month. (i) to proceed from a specified station to join a post in a remote locality, which is not easy of access; or (ii) to proceed on relinquishing charge of a post in a remote locality to a specified station.

The Chairman may in a case of hardship, relax all or any of the provision of these rules. Provided such relaxation shall not be less favourable to any benefit available to an employee.

HIGHER EDUCATION COMMISSION Provident Fund, Benevolent Fund and Group Insurance Rules
In exercise of the powers conferred by section 21 of the Higher Education Commission Ordinance, 2002 (LIII of 2002), the Commission is pleased to make the following rules with the approval of the Controlling Authority, namely:1. Short title, commencement and application :- (i) These rules my be called the Higher Education Commission Employees Provident Fund, Benevolent Fund and Group Insurance Rules 2009. They shall come into force at once and shall apply to all employees. ii) 2. They shall come into force at once and shall apply to all employees.

Definitions:- In these rules, unless there is anything repugnant in the subject or context:a) (b) (c) (d) (e) (f) Chairman means the Chairman of the Commission. Board of Trustee means Board of Trustee of the Commission. Commission means the Higher Education Commission. Director General Finance means Director General Finance of the Commission. Director Finance means the Director Finance of the Commission. Family means:(i) In the case of a male subscriber, the wife or wives and child or children of a subscriber and the widow or widows, and children of a deceased son of a subscriber, provided that if a subscriber proves that his wife has been legally separated from him or has ceased under the customary law of the community to which he belongs to be entitled to maintenance. She shall be deemed to be no longer a member of the subscribers family in matters to which these rules relate, unless the subscriber subsequently indicates by express notification in writing to the Director General Finance that she shall continue to be so regarded; In the case of a female subscriber, the husband and children of a subscriber and the widow or widows and children of a deceased son of a

subscriber, provided that if a subscriber by notification in writing to the Director General Finance expresses her desire to exclude her husband from her family, the subscribers family in the maters to which these rules relate unless the subscriber subsequently cancels formally in writing her notification excluding him. Note No.1 Children means legitimate children. Note No.2 Any adopted child shall be considered to be a child only in case when the Director General Finance or if any doubt arises in the mind of the Director General Finance. The Chairman, is satisfied that under the personal law of the subscriber adoption is legally recognized as conferring the status of a natural child. (g) (h) (i) (j) Executive Director means Executive Director of the Commission. Pay includes personal pay, deputation pay and special pay, but it does not include any allowance. Subscriber means a Servant on whose behalf a deposit is made under these rules. Year means a Financial Year.

Subscriber:- Persons who have been appointed to permanent posts in the service of the Commission shall subscribe every month to the Commissions Provident Fund except when on leave without pay. Nominations:- A subscriber shall send a nomination conferring one or more persons, the right to receive the amount. Rate of Subscription and Conditions:- The amount of subscription and conditions as determined by the Federal Government shall be deducted from the pay of each subscriber every month and paid into the provided fund Account. Interest:- The Commission shall pay interest to the subscriber at such rates as be determined by the Federal Government from time to time. Advance from Fund:- A temporary advance may be granted to a subscriber as permissible under Federal Government Rules.

Statement of Accounts:- Each subscriber shall receive from the Director Finance not later than 1st September of each year a statement of his account in the form as in Appendix B showing the opening balance. The deposits closing balance after the addition of interest allowed under Rules-6. Subscribers are required to satisfy themselves as to the correctness of these statements and unless errors in them are brought to the notice of the Director Finance within three months from the date of their receipt the statement issued by the Director Finance shall be deemed to be correct.

Subscription during Leave:- A subscriber who is on leave with salary and allowances shall continue to subscribe during leave. Advance and Loans:- Temporary advances or loans may be granted to subscribers from the sums to their credit in the provident Fund under conditions as provided under Rule 20, and sub-rules to be framed there under. Period for payment Accumulation:- Payment of accumulation of provident Fund contribution will be made within three months from the date of retirement, resignation, termination of service, or death and if payment is not claimed before the expiry of three months, no interest shall accrue beyond that period. Declaration as to disposal of Fund on death of subscriber:- Each subscriber shall, as soon as he joins the Fund be called upon by the Director Finance to furnish a form of Declaration as in Appendix C showing how he wishes the amount of his accumulation to be disposed of on his death. (i) A subscriber may in his declaration provide for the distribution a portion only of the amount. Thus the form of declaration may mention specific sum of a specific portion of the total amount. The disposal of the balance will be governed by Rule-15 (b) below, accordingly as the subscriber leaves a family or not. (ii) Any form of declaration submitted by a subscriber is revocable at any time. If minors are nominated in a form of declaration the person (persons to whom sums intended for their benefit are to be paid should be state in the Form of Declaration). (iii) The payment shall be made to the guardian of the nominee if the latter is minor, but if no guardian has been appointed the payment shall be made to the mother of the nominee. (iv) In case the mother of the nominee is not alive or was judicially separated from the subscriber or has remarried or is otherwise unqualified or un-suitable for the purpose, the Director General Finance will make payment to any person who in the opinion of the Director General Finance is considered suitable. In case the subscriber is a female, the Director General Finance will make payment to the father of the minor or his guardian as the case may be.

In the event of subscriber ( as defined in rule (h) having dependents) he shall not be permitted, in his Form of Declaration to leave the amount of his accumulation or any part of it to anyone else but his dependent or dependents. Where a form of Declaration purports to leave money otherwise than to the subscribers dependent or dependents and if it is f ound that he has one, the form of Declaration shall not be accepted. A subscriber who has dependent or dependents has absolute discretion regarding the distribution of the amount at his credit at the time of his death among his dependents. He may exclude anyone or more of them in favour of another or others of them and the manner in which the distribution is to be made among them is also within his absolute discretion. On a subscribers death before retirement, the amount shall be disposed in the follo wing manner and in accordance with the sub-rules to be framed under this rule: (a) The accumulation or such portion of it as may be specified in an accepted form of declaration, will be divided among all or any members of his family in accordance with the terms of the declaration. If the declaration relates to a portion only of the amount the balance will be distributed in the manner described in paragraph (b) below: If the declaration does not state the person or persons to whom the sum intended for the benefit of a minor is to be paid, the sum due shall be paid to the minors legal guardian to be used for minors benefit, or failing a legal guardian, to such person or persons as the Commission may consider to be the proper person or persons to receive it on the minors behalf. (b) Where a subscriber leaves a dependent or dependents but no Form of Declaration in favour of anyone of them has been received from him, the amount shall be distributed among the legal heir or heirs of the subscriber by the Commission. (c) If there be any party to receive the amount under paragraph (a) or (b) it will be divided among or paid to such person or persons (whether related to the subscriber or not) as may be specific in the accepted form of declaration. If the from of declaration related to a portion only of the amount the balance shall be distributed in the manner described in paragraph (b) above. (d) if there be no party entitled to receive under paragraph (a), (b) or (c) above, the amount will be paid to the subscribers legal representative or such other person or persons as may, be determined, by a civil court competent to pass orders in this respect, provided that if the sum remaining at the credit of the subscriber does not exceed Rs. 500/00, it may be paid to such person or, persons as the Commission may consider to be the proper person: or persons to receive it.

The, ledger and other: account of the Provident Fund shall be kept by the Director, Finance in a form approved by the Commission. Subject, to the consent of the Commission and the subscribe concerned in each case, an employee migrating to this Commission from any other recognized Body shall be permitted to

transfer accumulations of his Provident fund account at any such Body to this Commission from the dare to be fixed in this behalf. (1) With the sanction. of the D.G. Finance, a subscriber may be permitted (for reasons to be recorded tin writing by the subscriber, and deemed satisfactory by the D.G. Finance temporary, to withdraw a sum not exceeding the limits prescribed hereunder and subject to the terms and conditions here in below mentioned. (2) Advances shall ordinarily be granted for the following reasons:i. ii. iii. iv. To pay expenses incurred in connection with the illness of a subscriber or a member of his family. To purchase or build a suitable house for subscriber personal residence. To pay obligating, expenses in connection with marriage, funeral ceremonies, Haj or pilgrimage undertaken by the subscriber or a family member dependent on him. To pay, the overseas passage for reasons of health or education of the subscriber or a member of his family dependent on him.

(3) (i) Ordinarily advance shall not exceed three months pay of a subscriber except in clauses-2 ii) in which 24 months pay of the subscriber or 80% of the amount at the credit of the subscriber, in the Fund whichever is lesser. (ii) No second advance shall ordinarily be allowed till the pervious advance has been fully paid.

(b)Subject to the rules to be framed in this behalf and except in case falling under clause 2 (ii) advances shall be in this behalf and except in case falling under cause 2(ii) advance shall be recovered from subscriber such number, of equal consecutive monthly installments as the sanctioning authority may direct, but number shall not be less than twelve unless the subscriber so elects or more than twenty four. In case falling under: clause 2 (iii) advances shall be recovered in 48 equal monthly installments unless the member elects to make repayment in a smaller number of installments than that prescribed. (4) An advance shall under no circumstances exceed the amount of a subscribers own accumulated subscription, without interest standing to his credit at the time the advance is made. (5) The D.G. (Finance) will have the power to sanction advance in special cases not falling under sub-rule 2 and shall have the power to sanction any advance in excess of the conditions in 3 (i) and 3 (ii) above but subject to the limitation provided under sub-rule 4 of this rule. (6)The amount of any advance to a subscriber under this rule shall be debited to the separate account of such subscriber as against his own subscription to the Fund and will operate to 28

reduce the amount standing to his credit in the fund from time to time until the advance shall be recovered. the recoveries being credited to the said account as and when made. No interest shall be credited to the said account of any subscriber to whom an advance has been made on any amount for the time being debited to his account and representing an outstanding advance. (7) After the principal of the advance has been fully repaid interest shall be paid thereon at the rate of one-fourth per cent on the principal for each month or broken portion of a month during the period between the withdrawal and complete repayment of the principal. It shall be recovered in one installment in the month after complete repayment of the principal. Payment shall be rounded to the nearest Rupee. 17. Benevolent Fund and Group Insurance. i).For purpose of Benevolent Fund, the employees of Commission shall be governed by the Federal employees Benevolent Fund and Group Insurance Act, 1969 (Act. No. II of 1969), as amended from time to time and by such other subsidiary orders and instruction as are issued by the Federal Government or by the board of Trustees. ii).Board of Trustees: There shall be set up of a board to be known as the Board of Trustees of the Commission Employees Benevolent Fund which will consist of five members to be appointed by the Chairman. iii).The Board shall have powers: a) to settle claims for benevolent grants under these Rules and all matters connected with such claims; b) to sanction grant from the benevolent Fund to the employees or their families in accordance with the provisions of these Rule; c) to do or cause to be done all Rules and things necessary for the proper administration and management of the money or properties in the Benevolent Fund; d) to sanction expenditure connected with the administration and management of the Benevolent Fund; e) to invest money held in the Benevolent Fund; f) to do or cause to be done all things ancillary or incidental to any of the aforesaid powers or to the purposes of the Benevolent Fund. (iv) The Benevolent Grant shall be released to the employees and their families out of the Benevolent Fund subject to change from time to time in the following cases:-

a. A monthly grant equal to 30 per cent of the pay with a minimum limit of Rs. 2000/- p.m. and maximum limit of Rs. 5000/- p.m. i) for life to an employee who is removed from service on medical grounds; ii)for life to the spouse of an employee who dies during service or before attaining the age of 70 years. However in the case of a deceased employee who has no spouse or whose spouse has died, the grant will be distributed amongst one or more of eligible family members for a period upto 15 years or the date on which the deceased would have attained the age of 70 years, whichever is earlier. b) A lump sum amount of Rs. 30,000/- shall be paid to an employee having a service of ten years or more for the marriage of his daughter/son subject to maximum for two children only. c) A lump sum payment of Rs. 1000/- per child subject to a maximum of three children shall be made to the employees of BPS-1 to 15 for purchase of books etc. in every academic year. d) A lump sum payment of Rs. 5000/- , Rs. 3,000/- and Rs. 2,000/- on acquiring first, second or third position in the class respectively shall be awarded to the children of an employee. e) Farewell grant equal to one months pay to an employee who proceeds on retiring pension after twenty five years continuous service out of the federal Employees Benevolent Fund. f) Lump sum grant out of the Federal Employees Group Insurance Fund to employees who retire on medical grounds at the rates prescribed in the Fifth schedule to the federal Employees Benevolent Fund & Group Insurance Rules, 1972 (Annex-I). 18. Subscription to and benefits from Group Insurance Fund.(1) Every employee shall make a monthly payment to the Group Insurance Fund at the rate specified in column 3 of Annex III. No deduction on account of Group Insurance Premia is to be made in respect of BPS-1 to BPS-15 and BPS-16 (non-gazatted) employees. (2) A sum specified in column 4 of Annex- III shall be paid to the family of an employee who dies while in service. The rules in this chapter and matters not specified in this chapter are subject to the provisions of the Federal Employees Benevolent Fund and Group Insurance Act, 1969 as amended from time to time. The Executive Director may, in exceptional cases for reasons to be recorded in writing, relax any of these rules.

(Medical Attendance Rules) Short Title, Commencement and Application.-(i) These rules may be called the Higher Education Commission Medical Attendance Rules, 2009. (ii) They shall come into force at once and shall apply to all employees and such other persons in temporary or tenure service of the Commission who are declared eligible as such by the Chairperson.

Definitions:a) Employee means a person:i) serving in basic pay scales on regular/deputation basis. ii) serving in MP-Scales and iii) drawing pension /family pension from HEC. b) Family means parents, husband, wives, legitimate children, step children and sisters and minor brothers, residing with and wholly dependent on the employee. c) "Hospital" means any government hospital and the panel hospital approved as such by the Chairperson for the treatment of the employees. d) "Medical Attendant" means a registered medical practitioner of any government. Hospital/ panel hospitals, approved by the Chairperson and General Medical practitioner. e) Patient means an employee to whom these rules apply and who has fallen ill. f) "Treatment" means the use of all medical, surgical, radiological and other facilities available at any government hospital / panel hospital in which an employee is treated and include:i) ii) iii) The employment of such pathological, bacteriological radiological or other methods as are considered necessary by the authorized medical attendant; The supply of such medicines, vaccines, sera or other therapeutic substances as are ordinarily available in the hospital; The supply of such medicines, vaccines, sera or other therapeutic substances not ordinarily so available as the authorized medical attendant may certify in writing to

be essential for the recovery or for the prevention of serious deterioration in the condition of the employee or his/her family member; iv) Such accommodation as is ordinarily provided in the hospital and is suited to his/her status. In case of retired HEC employee his/her status will be determined by the last appointment held; Such nursing as is ordinarily provided to a patent by the hospital; Dental Treatment (which includes treatment of alveolar (gum & jaw bone) disease, extraction of teeth, treatment of dental caries, gingivitis pyorrhea and filling (temporary or permanent) of dental cavities including root canal treatment/scaling, dental implants, orthodontic appliances, bridging, crowning, provision of dentures, etc. The facility of circumcision.

Medicines during OPD. The expenditure on the medicines prescribed by the doctor during the outdoor treatment will be borne by the patient himself. Ceiling of medical allowance to employees.-The employees shall be entitled to medical allowance as determined by the Commission from time to time. This allowance shall be stand frozen on retirement. Hospitalization.- (i) In case of hospitalization on account of medical, surgical, or, gynecological cases on the advice of a medical attendant, the Commission will reimburse the actual expenditure to the panel hospital (in case the treatment is done in the panel hospital) or to the employee (in case the treatment is done in any govt. hospital and expenditure was made by the employee from his own pocket) on production of original prescriptions and receipts duly verified by the doctor concerned. (ii) Treatment after discharge from hospitalization: The cost of medication, tests and consultation fee in connection with the same illness, if it is part of hospitalization of an employee or any member of his/her family discharged from the hospital but require treatment as an outdoor patient, shall be reimbursed. Treatment for prolonged illness: The cost of medication, tests and consultation fee in connection with a prolonged illness of an employee or his/her wives/husband/children, which is certified by the medical specialist of any govt. hospital /panel hospitals, shall be reimbursable as an outdoor patient.

Indoor Medical Treatment facilities after retirement: The HEC pensioner/ family pension will be entitled to the benefit of indoor medical treatment at par with regular employees, if he/she is not re-employed. i) Cost of medicines if purchased while admitted in the hospital shall be reimbursable subject to production of original prescription and receipt duly verified by the Doctor concerned.

Indoor medical treatment facilities to employees parents: The parents of an employee wholly dependent upon him/her shall be allowed indoor medical treatment from any government hospital /panel hospital subject to the provision of advice from General Medical practitioner alongwith application for permission to get indoor medical treatment. i) The employee will have to furnish a declaration that his/her parents are wholly dependent upon him/her.

ii) The attested copy of CNIC of the parents of the employee should also be furnished. The employee shall be required to obtain the requisite Reference Letter from HEC for indoor medical treatment from the panel hospital during OPD/Consultation timing of the Hospital. (vi) 6. Diet charges during the indoor medical treatment of a patient, will be reimbursed.

Scales of Accommodation. The scale-wise accommodation for indoor medical treatment in the

Hospital will be as under: a) For Officers BPS-17 &above and equivalent Private Room

b) For employee in BPS-11 to 16 and equivalent Semi Private Ward c) For employees in BPS-01 to 10 and equivalent General Ward.

Treatment in Emergency: HEC employee shall be entitled, free of charge; i) to treatment ; a) in such Government hospital being a hospital maintained by government, at or near the placed where he/any family member falls ill as can, in the opinion of the authorised medical attendant provide the necessary and suitable treatment; or

b) if there is no such hospital as is referred to in sub-clause(a), in such other Government hospital at or near that place as can in the opinion of the authorised medical attendant, provide the necessary and suitable treatment; ii) to get medical treatment from any hospital/clinic other than Government and Panel Hospitals/Clinics in emergency if in the opinion of the authorised medical attendant it was necessary. 8. Delivery Charges: In case of delivery cases at home, delivery charges will be paid at the rate as determined from time to time on production of payment receipt of midwife dully verified from any officer in BPS-17 or above. 9. Residuary provision.- Where these rules do not contain provision relating to any matter affecting medical attendance and treatment a relevant Federal Government rule or rules if any shall be deemed to be effective. 10. Relaxation:- The Executive Director may, in exceptional cases for reasons to be recorded in writing, relax any of these rules.
