Agreement To Rent Or Lease

All pl mbing, heating and electrical s$stems are operati,e and deemed satisfactor$. 3. O%%E%%(O# OF REM(%E%. 8n the e,ent #wner is nable to deli,er possession of the premises to Resident for an$ reason not within #wner/s control, incl ding, b t not limited to fail re of prior occ pants to ,acate as agreed or re: ired b$ law, #wner shall not be liable to Resident e)cept for the ret rn of all s ms pre,io sl$ paid to #wner in the e,ent Resident chooses to terminate this Rental Agreement. 4. ET%5 6ATER7F(LLE* F'R#(T'RE0A#TE##A% A#*0OR %ATELL(TE *(%.E%. 3o animal, pet, antenna'satellite dish or water2filled f rnit re shall be %ept on or abo t the premises witho t the prior written consent of the #wner. Resident shall ta%e appropriate meas res to protect their own propert$, and report to the *olice an$ s spicio s acti,ities, persons or e,ents occ rring on or abo t the general premises. 11. 9'(ET E#:O)ME#T 0 '%E. All residents shall be entitled to : iet en"o$ment of the premises. Resident shall not se the premises in s ch a wa$ as to ,iolate an$ law or ordinance, commit waste or n isance, anno$, dist rb, incon,enience, or interfere with the : iet en"o$ment of an$ other resident, incl ding b t not limited to ha,ing lo d or late parties or pla$ing lo d m sic. Resident shall ens re that their g ests also compl$ with this pro,ision. ;iolations constit te a breach of the Agreement, and #wner ma$ ta%e legal action to terminate the Agreement and remo,e Resident. 1". :O(#T A#* %E;ERAL L(A<(L(T) =&O7RE%(*E#T>. 8f more than one Resident enters into this Agreement (roommates/), the obligations are "oint and se,eral< each s ch Resident is indi,id all$, as well as "ointl$, liable for f ll performance of all agreed terms and pa$ment of all s ms re: ired here nder as long as an$ one of the Residents remain in possession of the premises. An$ breach or abandonment b$ an$ one or more of the Residents shall not terminate the Agreement nor shall it relie,e the remaining Resident from f lfilling the terms of this Agreement. !ho ld one or more of the Residents terminate their residenc$ apart and separatel$ from other Resident, no right to ha,e another person s bstit ted in their stead shall e)ist. 1$. &ARE A#* MA(#TE#A#&E. Resident agrees to %eep the premises clean, in good order and repair, and free of trash, mold, mildew and nsightl$ material and to immediatel$ notif$ #wner, in writing, of an$ defects or dangero s conditions in or abo t the premises, partic larl$ an$ water penetration. Resident shall reimb rse #wner for the cost to repair damage b$ Resident thro gh mis se or neglect incl ding b t not limited to pl mbing stoppages. =)cept as pro,ided b$ law, no repairs, decorating or alterations shall be done b$ the Resident witho t the #wner/s prior written consent, which ma$ re: ire that onl$ a licensed and bonded contractor perform s ch wor%. 1+. R(/.T OF E#TR). #wner or #wner/s agents shall ha,e right to enter the premises for p rposes of performing inspections< to ma%e necessar$ or agreed repairs, alterations or impro,ements< s ppl$ing agreed ser,ices< to e)hibit the propert$ to prospecti,e residents< when the Resident has abandoned or s rrendered the premises< in case of emergenc$, and p rs ant to co rt order or state law. =)cept in cases of emergenc$, #wner shall gi,e Resident at least "+ hours notice of intent to enter. Resident ma$ be present, howe,er s ch entr$ shall not be conditioned pon s ch presence, and Resident agrees to indemnif$ and hold #wner free and harmless for s ch entr$. 1,. ;E.(&LE% A#* AR1(#/. #wner reser,es the right to control par%ing and to tow awa$, at Resident/s e)pense, an$ ,ehicle ca sing an nsafe'ha4ardo s condition or par%ed in na thori4ed spaces. 3o a tomobile or other motor2dri,en ,ehicle or c$cle ma$ be bro ght onto the premises nless s ch ,ehicle complies with go,ernmental noise limitations, is free of an$ lea%ing fl ids, ins red for p blic liabilit$' propert$ damage, operable, and c rrentl$ register. 1-. %'<LEA%(#/ 0 A%%(/#ME#T. 12. E%T &O#TROL. >pon demand b$ #wner, Residents shall temporaril$ ,acate the premises for a reasonable period of time to allow pest or ,ermin control wor% to be done. Resident shall compl$ with all instr ctions, forthwith, from pest controller, f migator and'or e)terminator regarding the preparation of the premises for the wor%, incl ding the proper bagging and storage of food, perishables and medicine. 13. L(A<(L(T) 0 *AMA/E RE% O#%(<(L(T). Resident agrees to hold #wner harmless from all claims of loss or damage to propert$, and of in" r$ or death to persons ca sed b$ the intentional acts or negligence of the Resident, his g est or in,itees, or occ rring on the premises rented for Resident/s e)cl si,e se. Resident expressly a?sol@es Owner from any and all lia?ility for any loss or damage to ResidentAs property or effe!ts arising out of water leaBage or ?reaBing pipes5 or theft5 or other !ause ?eyond the reasona?le !ontrol of Owner. This incl des damage to Resident/s or g est/s ,ehicles while par%ed on the propert$. 8n the e,ent the premises are damaged b$ fire or other cas alt$, #wner shall ha,e the option either to (6) repair s ch damage, this Agreement contin ing in f ll force and effect, or (+) gi,e notice to Resident terminating this Agreement. #wner shall not be re: ired to repair or replace an$ propert$ bro ght onto the premises b$ Resident. Resident agrees to accept financial responsibilit$ for an$ damage to the premises from fire, water or cas alt$ ca sed b$ Resident/s negligence. Resident is en!ouraged to !arry a standard renterAs poli!y or as an alternati,e, warrants that the$ will be financiall$ responsible for losses not co,ered b$ #wner/s fire and e)tended co,erage ins rance polic$. 8n no e,ent shall Resident be entitled to an$ compensation or damage d e to an$ e)tra e)pense, anno$ance or incon,enience for loss of se d e to a cas alt$ be$ond the control of the #wner. 14. TERM(#AT(O#: &LEA#(#/ 0 RE A(R%. >pon termination of the tenanc$, Resident shall lea,e the premises in a clean and orderl$ condition, free of trash and personal propert$. 8f this is not done, Resident e)pressl$ agrees that #wner shall perform all cleaning ser,ices, incl ding carpet cleaning and'or repair, which ma$ be re: ired in #wner/s discretion to restore the premises to OwnerAs standards for new o!!upan!y. The costs inc rred b$ #wner for s ch ser,ices shall be ded cted from Resident/s sec rit$ deposit. 8f #wner is re: ired to perform a pre2mo,e o t inspection, or an$ repair or reno,ation as a res lt of Resident/s decoration, modification or damage, regardless of the ca se, the cost of s ch inspection repair and'or reno,ation shall be ded cted from Resident/s sec rit$ deposit. 8n the e,ent the deposit is not s fficient to pa$ all the lawf l e)penses and charges at the termination of this residenc$, Residents shall immediatel$, pon written notice, pa$ #wner an$ additional s ms necessar$ to pa$ all s ch charges in f ll. "8. R'LE% A#* RE/'LAT(O#%. Resident ac%nowledges receipt of, and has read a cop$ of the Apartment R les and Reg lations, which are hereb$ incorporated into this Agreement b$ this reference. #wner ma$ terminate this Agreement, as pro,ided b$ law, if an$ of these R les and Reg lations are ,iolated. ! ch R les and Reg lations ma$ be amended from time to time pon gi,ing notice to Resident. 8f the propert$ is located within a common interest de,elopment, Resident agrees to compl$ with and abide b$ an$ ?eclaration of &o,enants, &onditions and Restrictions (&& @ R/s) and Association R les and Reg lations. A cop$ of these doc ments (if applicable) are made a part of this agreement. Residents shall compl$ with an$ ,alid order of the Association and shall pa$ to #wner an$ charge assessed b$ reason of Resident/s breach. "1. %MO1E *ETE&T(O# *E;(&E. The premises are e: ipped with a smo%e detection de,ice(s), and: (a) Resident ac%nowledges the smo%e detector(s) was tested and its operation e)plained b$ management, in the presence of Resident, at time of initial occ panc$, and the detector(s) in the nit was wor%ing properl$ at the time, (b) Resident shall test the smo%e detector at least once a month to determine if the smo%e detector(s) is operating properl$, and immediatel$ inform the #wner, in writing, of an$ malf nction. TERM(#AT(O# 0 .OL*(#/ O;ER. 8f this Agreement is a periodic tenanc$, either part$ ma$ terminate the tenanc$ b$ the ser,ice of at least 01 da$s written notice, if the tenanc$ is less than one $ear, or b$ the ser,ice b$ either part$ of at least A1 da$s written notice if the tenanc$ is one $ear or longer at the time of ser,ice of the notice. 8f this Agreement is a (i)ed Term Bease, it shall a tomaticall$ con,ert to a periodic tenanc$ pon the e)piration date of the (i)ed Term Bease. 8n the absence of an$ written comm nication between the parties, the residenc$ shall contin e on a periodic tenanc$ basis, incl ding an$ changes, i.e. rent ad" stments, ha,ing been made b$ #wner with proper written notice.

An$ s ch arbitration shall be held and cond cted in the co nt$ in which the premises are located before three arbitrators, who shall be selected as follows: The claimant and respondent shall each select one arbitrator. The two selected arbitrators will then select a third arbitrator, and the three arbitrators shall constit te the panel. The pro,isions of the American Arbitration Association r les shall appl$ and go,ern s ch arbitration, s b"ect, howe,er, to the following: (a) An$ demand for arbitration shall be made in writing and m st be made within 6C1 da$s after the claim, disp te or other matter in : estion has arisen. 8n no e,ent shall the demand for arbitration be made after the date that instit tion of legal or e: itable proceedings based on s ch a matter wo ld ha,e been barred b$ the applicable stat te of limitations. Any Resident !on@i!ted of or arrested for a sex !rime must dis!lose this information to the Owner ?efore or during the appli!ation pro!ess or immediately upon arrest or !on@i!tion for a sex !rime. This !an ?e !onsidered as !ause for termination of the rental agreement.

"2. /E#ERAL. =ach and e,er$ term, co,enant and agreement herein contained shall be deemed a condition hereof. 3o oral agreements ha,e been entered into, and this Agreement shall not be modified nless s ch modification is red ced to writing. The terms of a periodic tenanc$ ma$ be modified b$ the #wner b$ the ser,ice of a 01 da$ written notice. Fai,er of an$ breach of an$ term or condition of this Agreement shall not constit te a wai,er of s bse: ent breaches. The in,alidit$ or partial in,alidit$ of an$ pro,ision of this Agreement shall not render the remainder of the Agreement in,alid or nenforceable. The breach of an$ of the co,enants or terms of this Agreement shall be deemed to be a material and total breach of this entire Agreement and shall gi,e rise to all rights of termination.
