Section 1-7: These sections mention the name of the organization in Bengali Bangladesh Sagharja Bhikkhu Mahsabh, in English The Bangladesh Sagharja Bhikkhu Mahsabh, establishment, permanent office, head office, area of the organization, emblem, and the rights, ideals, and objectives. Section 8-9: They deal with the eligibility and ineligibility of acquiring membership. Section 10: This section consists of the categories of members, namely general member, permanent member and founder member. Section 11: It deals with the rights of the members. Among them, the one of the important rights is that all members except the patrons can take part and vote in the elections of the executive committee. Section 12: This section mentions the duties and responsibilities of the members. Section 13: This section deals with the cancellation of membership with a provision for self-defense. Section 14: This sections deals with regaining membership. Section 15: This section explains the structure of the organization and their responsibilities. There are three councils, namely, general council, executive council and advisory council. The general council is responsible for the selection of the executive members and will approve the annual plan and budget. The executive council is responsible for the implementation of the aims and objectives of the organization. The duration or validity of the executive council is 5 years. The advisory committee consists of seven highly dignified mahtheras of the executive council to give counsel and suggestions and one of them will be president of the advisory council. The members of the advisory

council do not have voting power. Section 16: This section deals with the structure of the executive council. It consists of thirty-one or forty-five members. Section 17: It deals with the duties and responsibilities of the officials of the executive council. There are fifteen sub-sections with the details of the officials. The president is the chief of the executive council and presides over, controls, and maintains law and order at all the meetings. He can settle any decision if there are equal votes between two groups by casting a conclusive vote. The secretary general is the chief executive officer of the council. He issues notices with the advice of the president to hold meetings. He supervises the divisional secretariat to activate the organization. The members of the executive council cooperate in the council. Section 18: In this section the duties of His Holiness Supreme Patriarch and Deputy Supreme Patriarch are explained. In Sagharja-nikya, there is a Sagharja and a Deputy Sagharja. HH Sagharja will be selected by the executive council and he will be the Supreme Patriarch and highest dignitary monk. The Deputy Sagharja will be selected within seven to fifteen days after passing away of the Sagharja. There will be a personal advisory committee for Sagharja. He exercises supreme power regarding Sagha affairs but about organizations and any national, international and critical decision-making HH Sagharja will take the opinion of three members from the advisory committee and two members from the executive committee totaling five members opinions. The retrenchment of HH Sagharja will be if any kinds of anti-religious activities against the Dhamma and Vinaya, any separation and lack of discipline in the Sagha. The responsibilities of HH Sagharja are to protect original Theravda Buddhism and all the members have to follow him. He will look after the Mahsabh activities and give suggestions to the Executive council. His Holiness Sagharja will be the leader of the delegation in national and international conferences and will elect the delegation team through discussions with the Executive council. The birth celebration or funeral of HH Sagharja will be done at his residential monastery by the Mahsabha with cooperation of the devotees. After the demise of HH Sagharja, his property will belong to the Bangladesh Sagharja Bhikkhu Mahsabha. HH Sagharja will reside at a monastery which can take proper care of his status. Section 19: This section deals with the details about the Deputy Sagharja. The Deputy Sagharja is the next Sagharja who is selected by the executive council. The qualification of the Deputy Sagharja is to be capable in Dhamma and Vinaya, experienced and wise, efficient in running an

organization, efficient in giving plans and their implementation for the further development of the Sagha and Buddhist community. His power and responsibilities are to help to HH Sagharja in his work, to be the acting Sagharja in absent of HH Sagharja, to give the advice and suggestions to the Mahsabh, and to be Sagharja after the death of HH Sagharja. Section 20: This section is concerned with meetings and there are five types of meeting in this organization, namely: a) Annual General Meeting, b) Executive Meeting, c) Emergency Meeting, d) Postponement Meeting, and e) Called up Meeting. The Annual meeting takes place once a year, the Executive meeting every two months, the Emergency meeting can be any time but there should be twenty-four hours prior notice to the meeting, the Postponement meeting can be next day, and the Called up meeting of Executive committee to solve any complicated problem can be arranged by the two thirds of the applicant members if the president and secretary general fail to solve the problem. The decision should be approved by two thirds of the members of the meeting and other matters cannot be discussed. Section 21: This section discusses the provision of rejection of membership of the executive committee. An executive member will be rejected if he is absent for three meetings but his general membership will remain. Section 22: It mentions the provision of filling up the vacant membership of the executive committee. According to section 21if any of the member of executive committee loses his membership, death, resigns, or leaves the area and thus the membership post becomes vacant, according to section 13/1 for filling the vacant or left position the executive committee can appoint any energetic and organized sympathetic person as the member through co-opt. Section 23: This section deals with the provision of forming a subcommittee. The executive committee can form a sub-committee consisting of the general secretary as convener along with seven more members for performing various development works, like implementation of planning or implementation national and international religious-cultural seminars, etc. Subcommittees will report to the president and general secretary on their work. Section 24: It deals with the appointment of officials. If the executive committee will appoint any official staff for performing office work, according to the decision of the committee they will form an appointment committee consisting of five members. The appointment committee will make the decision of recruiting officials through making advertisements and conducting interviews. In this committee, the general secretary will be the member secretary according to his post. The formation of appointment/recruitment

committee is give below: 1) President one person, 2) Member Secretary one person, 3) Member three persons. The decision made by the appointment committee will be considered as the final decision. They will place their decision before the executive committee and the executives will respect their decision. Section 25: This section explains the agenda selection committee. The executive committee will send a letter mentioning the meeting venue, date, time, and agenda at least one month prior to the annual general meeting taking place. Section 26: It deals with the dispute solving or positive board. If any dispute takes place within the Sagha which is under the supervision of the Bangladesh Sagharja Bhikkhu Mahsabha, or within the executive committee, or householders for monastery-related matters only, with the permission and advice of the president and general secretary of the executive committee a dispute solving board will be formed. The committee will be formed with five or seven members. Among them there will be one chairman, one member secretary and others will work as members. Section 27: This section mentions about the extension of the time of the executive committee members which can be extended if the general members re-elect them. Section 28: It mentions the provision of withdrawal of membership or self-resignation. If any member wants to withdraw his membership or take leave from his post, he has to submit a written application to the president explaining the appropriate/exact reason. If the president wants to resign then he has to give a resignation letter to the general secretary. Section 29: It deals with the inter system. If under the claim of twothirds of the members or disregard of general members for resignation of executive committees president and general secretary before the expiration of time and thus a dead lock situation arises, the members of the advisory committee will form a interim committee consisting of seven members to carry on the activities of the organization until the expiration of time. Section 30: It deals with the provision for notice of meeting. The annual general meeting and executive committees meeting will be held with a prior notice of a minimum of twenty-four (24) hours. Section 31: It deals with the quorum of the meetings. In the case of a

general meeting two-thirds of the members presence ensure the fulfillment of quorum, while in the case of an executive committees meeting one-third of the members presence will fulfill the quorum. To change, alter, form a constitution, or to remove someones membership there must be two-thirds of the general members present to fulfill the quorum. Section 32: This section explains the financial administration provision. It mentions that the financial year will be counted from 1st July to the following 30th June. All income will be collected through receipts and all expenditures will be done through maintaining vouchers. To deposit money in the name of organization a three years validated account should be opened and maintained by the joint signature of three people namely the president, secretary general and finance secretary in any scheduled bank or post office. To withdraw money, among three persons, the secretary generals signature must be used. Section 33: This section concerns the source of funds such as admission/subscription fee, annual fee, life membership fee, one time/contemporary fee, donation from generous persons, donation from government, non-government individuals, and organizations, etc. It mentions that fees will be collected from the general secretary and finance secretary, regional monks, and especially members of executive committee who can be given the responsibility of collecting monthly fee, annual fee and life membership fee by the general secretary. Section 34: This section mentions about the areas of expenditures. Section 35: It deals with the budget-making as well as its approval. Section 36: It deals with the internal audit. An audit team will be formed consisting of three members. Section 37: This section deals with the final audit of accounts. It mentions that at the end of each financial year, the annual income-expenditure accounts will be audited by a government-approved audit firm or a registered audit firm appointed by the organization. Section 38: This section discusses the foundation of a permanent fund. For the overall welfare of humanity and the development of religion Bangladesh Sagharja Bhikkhu Mahsabh will form a permanent fund. To form a permanent fund, the devotees in every monastery supervised by Mahsabh will give a fixed amount of money through their abbot; that amount will be deposited to the general secretary or finance secretary through the receipt and that amount would not be less than TK. 500/-at any circumstances.

In no circumstances the money of the permanent fund can be spent. Only the interest can be drawn up and spent for various development work of Mahsabh. In this fund from TK. 5000 to TK. 100,000/- (five thousand to one hundred thousand) donors will be treated as the patrons of Mahsabh. If in the permanent fund over TK. 50, 00,000/- (fifty Lacs or five hundred thousand) is deposited, the profit of that money can be withdrawn upon approval of the general meeting of Mahsabh for purchasing land for the Bhikkhu Mahsabh and setting up a press. A permanent trust will be formed in the name of Mahsabh. Trustees will run this trust by their own sovereign power. Section 39: It deals with the monastery property. The monastery property will be considered as the Sagha sampatti (property of the Sagha). The full control over it will be by the Bangladesh Sagharja Bhikkhu Mahsabh. Donors only help in the protection and beautification of that property as the devotee under the advice and management of Mahsabh and the regional association. If any of the descendant son, daughter or relatives for any reason wants to capture the donated property for their own will, then it will be considered as illegal according to Buddhas law. Bangladesh Sagharja Bhikkhu Mahsabha will preserve the memory and pride of donors and give this more glory as the only complainant of the property. If anyone wants to establish any monastery under Sagharja-nikya, he has to do it by receiving the permission of Mahsabh through the regional organization. If any monk resides in any monastery without the permission of Mahsabha, and a dispute occurs due to that monk, Mahsabh will not be responsible for it. Section 40: It deals with the annual reports. The annual report should be prepared including an overview of the whole years activities and results and the report will be submitted to the meeting of the executive committee. On the approval of the executive committee it will be submitted to the annual general meeting for the final approval. Section 41: This section details the election procedure of the executive committee. Every five years the election of executive committee will take place. Elections will be monitored and managed by the election commissioner. Under the guidance of the election commission the election work will go on and make all the necessary decisions about the election. About the election and its results, the opinion of election commissioner will be considered as the final decision. The election commissioner and two other members will operate the election impartially. No partiality will be allowed and cannot take place in an election. The election commission will operate the election with secret ballot. The chief election commissioner will sign all the ballot papers at the time of issuing them, and besides the election commissioners signature there will be the members name, serial no. etc. in the ballot paper, but in the remaining portion there will

be only the name and seal of the chief election commissioner. Before forty-eight hours of commencement of an election no publication is allowed within two hundred yards. Section 42-47: These sections refer to the duration of the executive council, voting, impeachment, property of the Mahsabh, the preservation of the deeds, register books, etc. Section 48: This section deals with the local Sagha Association and meeting committee of the monastery consisting of 15 members where the president must be abbot and the duration of the committee is three years. It is responsible to appoint an abbot by the local Sagha Association but it must be approved by the Bangladesh Sagharja Bhikkhu Mahsabha. The devotees of the monastery will provide the four requisites of the monks. The abbot is responsible to perform all the religious activities in the monastery and to disseminate Theravda Buddhism to devotees. The monastery executive committee will cooperate for the monastery development with the abbot. All the properties of the monasteries will be Sagha properties. If any monk wants to be in the Sagharja-nikya, he must enter through the Vinaya way Dahi Kamma. After the formation, the monastery executive committee must send a request to the central and local Sagha Association for approval within one month. Section 49-50: These sections deal with the amendment of the constitutions, which need two-thirds of the members and the abolishment of the organization which would follow anonymous decision. 1

Section 1&2: These sections mention the name and headquarters of the organization. Section 3: This section mentions the aims and objectives which are to establish and oversee the monasteries, to train monks and novices, establish Tipiaka library and printing the books, recite the Patimokkha, sponsor to the monks and novices to study, create a Sagha fund, etc. Section 4: This section mentions how to form a regional branch. With the authorization of the executive committee, any regional branch in the district, sub-district (Thana) can be formed. Bangladesh Bauddha Bhikkhu Mahsabh can be member of any renowned international Buddhist organization that has been maintained. Section 5: This section mentions and shows the organizations logo and flag. Section 6: This section mentions that higher ordination can be given to a Mahsthavir-nikya novice by the approval of the Bangladesh Bauddha Bhikkhu Mahsabh. Section 7: This section mentions the qualifications for membership. One who wishes to gain membership has to pay 201 (two hundred and one) Takas and any monk from any other Nikya who wishes to be member of Mahsthavir-nikya must be ordained again under the Mahsthavir-nikya. Section 8: This section mentions disqualification for membership. Membership will be lost if one violates any major Vinaya rules, convicted by

the state, deformation in brain, or mad. Section 9: This section mentions that the validity of the executive committee is three (3) years. Section 10: This section mentions the organizational framework. There are four committees to run the activities, including (a) General committee, (b) Executive committee, (c) Advisory board, and (d) Steering committee. Section 11: This section describes the executive committee formation. It consists of twenty one (21) members. The posts are President, Vice-President, General Secretary, Joint Secretary, Assistant Secretary, Finance Secretary, Accounts Secretary, Office Secretary, Religious Secretary, Education and Cultural Secretary, Publicity and Publication Secretary, Organizing Secretary, Library Secretary, and Executive Member respectively. Section 12-24: These sections mention in detail the duties and responsibilities of the members of the executive committee. The president will preside over the executive meetings, give the final decision with his extra vote, and advise the secretary to convene the meetings. As for the general secretary, he will be the chief executive officer and convene all the meeting by consultation with the president. He will write all the proceedings of the meetings. He can sign any document as well as agreements on the approval of members of the committee. He will preserve valuable documents, records, cash book, check book, etc. Other executive members duties and responsibilities are explained in these sections. Section 25: This section mentions about demonstrates the selection of His Holiness Saghanyaka and Deputy Saghanyaka and their powers in the Sagha Assembly. His Holiness Saghanyaka is regarded as the supreme respected monk in the sect and would not be an executive president of the Sagha Assembly. After his death the Deputy Saghanyaka will be appointed as a Saghanyaka. His Holinesss qualifications are to be an elder, religious, learned, and have the capability to lead the monks. His Holiness will look after the activities of the Sagha Assembly and will give advice and orders. His Holiness will solve any serious problems with his own power and discussions with the Deputy Saghanyaka, President and Secretary General. He will preside over the national and international meetings. His Holiness will select the delegates to join any international conferences through discussions with the President and Secretary General. After the death of Saghanyaka, the holder of all of his properties will be Bhikkhu Mahsabh. The treatment costs will be bore during the His Holinesss illness.

Section 26: This section mentions that the executive members will elect two deputy Saghanyakas from the seniority, learned, capable and competent monks. The responsibilities and power of the Deputy Saghanyaka have been mentioned. The Deputy Saghanyaka will help the acting Saghanyaka and Bhikkhu Mahsabh. He will give members advice, instruction, etc. Section 27: This section mentions about the regulations of meetings. In this organization there will held four types of meeting: (1) Annual General meeting which will be held every year, (2) Executive committees meeting held every two months, (3) Emergency meeting of that executive committee which can be called up in any emergency situation, (4) Postponement meeting can be held on the next working day or the next week on the same agenda. Section 28: This section deals with the cancellation of membership from the executive committee and the regulation of fulfilling the vacant post. Section 29: It deals with the formation of sub-committees. It mentions that sub-committees can be made by the executive committee consisting of seven members for the need of executing various development works of the organization. Section 30: This sections deals with the subject selection committee. Section 31: This section deals with the renewal of validity of the executive committee which can be extended two more years by the general meetings. Section 32: This section mentions about the notice of meetings. The notice of the general and executive meetings should be sent to each member fifteen days prior and notice of emergency meetings should be sent twenty-four hours prior, mentioning the date, venue, and agenda. Section 33: This section mentions the quorum of the meetings. Onethird of the members will make the quorum in the general and executive meetings. To form the executive committee, correction, addition, change, expansion or rejection in the constitution, the quorum must be filled up by the presence of two-thirds of the general members in the meeting. Section 34: This section mentions about the source of income such as admission fees of members, annual fee, life membership, donation from Saghadna and the Kahina Cvara Dna of each monastery, donation of the

generous persons, and other fees. Section 35: This section explains the matter of the bank account in which is deposited the collected money, on the joint authorization signature of president, secretary general and finance secretary in a commercial bank or post office, and money can be withdrawn by the decision of executives and with the joint signature of these three persons. Section 36: This section is about the expenditures and mentions that money can be spent to develop organizations in accordance with the aims and objectives. Section 37: This section explains the formation of the monk welfare trustee board. This project is to help monks monetarily for their various necessities will be formed by five or seven monks of Bhikkhu Mahsabh. Section 38: This section mentions about the formation of a permanent fund for establishing a religious institute and office, upholding the religion, development of monks, and social and human welfare. For this purpose, to form a permanent fund, donations of devotees will be collected from all the monasteries under the supervision of Bhikkhu Mahsabh. Section 39: This section describes the appointment of an abbot of a monastery. The abbot will be appointed by the Bhikkhu Mahsabh after receiving the written application from the devotees or monastery committee. It is also mentioned in this section that regarding any dispute between devotees and monks, a written application should be sent to Bhikkhu Mahsabha and the decision it gives that should be accepted by the both parties. Section 40: This section explains elections. Members cannot use their voting right and compete for a post if their fee remains due. There will be a chief election commissioner and two assistant election commissioners for the election. Voters should prepare fifteen days before the election and the election will be in secret ballot system. The executive committee can be formed either by voice vote, raising up of hands, ballot paper or selection by the unanimous opinion of the present general members in a general meetings, and at least four sessions of executive committee in year. Section 41: This section explains the annual general conference/meeting. A senior monk in Bangladesh Bauddha Bhikkhu Mahsabh will preside over the annual meeting and various programs will be undertaken such as publishing magazines, etc.

Section 42: This section deals with the property of Bhikkhu Mahsabh. All the property of deceased monks will be regarded as the property of Bhikkhu Mahsabh. All monasteries and institutions under the supervision of Mahsthavir-nikya, land and other properties will be considered as the permanent property of the Bhikkhu Mahsabh. If any monks establish a monastery, he needs permission from Bhikkhu Mahsabh and the property will be considered as Sagha property. Section 43: This section deals with the rules of constitution revision/correction procedure. Any section or sub-section may be changed or reviewed by a committee consisting of five or seven members and should approved by the executive committee meeting. Section 44: This is the last section of the constitution of Bangladesh Bouddha Bhikkhu Mahsabha and deals with the preservation in the office such as the register, accounts book, notebooks, documents, etc. this constitution ends with two Pli stanzas, Cra Tihatu Saddhamma, and Sabbe Satta Sukhita Hontu.
