AN ACT STRENGTHENING THE COMPREHENSIVE AGRARIAN REFORM PROGRAM (CARP), EXTENDING
THE ACQUISITION AND DISTRIBUTION OF ALL AGRICULTURAL LANDS, INSTITUTING NECESSARY
REFORMS, AMENDING FOR THE PURPOSE CERTAIN PROVISIONS OF REPUBLIC ACT NO. 6657,
OTHERWISE KNOWN AS THE COMPREHENSIVE AGRARIAN REFORM LAW OF l988, AS AMENDED, AND
APPROPRIATING FUNDS THEREFOR

Sectiol. Sction 2 of Rpublic Act No. 6657, as amndd, othrwis known as th Comprhnsiv Agrarian
Rform Law of l988, is hrby furthr amndd to rad as follows:
"SEC. 2. Dec/arat|n l Pr|nc|p/es and P/|c|es. - lt is th policy of th Stat to pursu a Comprhnsiv
Agrarian Rform Program (CARP). Th wlfar of th landlss farmrs and farmworkrs will rciv th
highst considration to promot social justic and to mov th nation toward sound rural dvlopmnt and
industrialization, and th stablishmnt of ownr cultivatorship of conomic-siz farms as th basis of
Philippin agricultur.
"Th Stat shall promot industrialization and full mploymnt basd on sound agricultural dvlopmnt and
agrarian rform, through industris that mak full and fficint us of human and natural rsourcs, and which
ar comptitiv in both domstic and forign markts: Prv|ded, That th convrsion of agricultural lands into
industrial, commrcial or rsidntial lands shall tak into account, tillrs' rights and national food scurity.
lurther, th Stat shall protct Filipino ntrpriss against unfair forign comptition and trad practics.
"Th Stat rcognizs that thr is not nough agricultural land to b dividd and distributd to ach farmr
and rgular farmworkr so that ach on can own his/hr conomic-siz family farm. This bing th cas, a
maningful agrarian rform program to uplift th livs and conomic status of th farmr and his/hr childrn
can only b achivd through simultanous industrialization aimd at dvloping a slf -rliant and indpndnt
national conomy ffctivly controlld by Filipinos.
"To this nd, th Stat may, in th intrst of national wlfar or dfns, stablish and oprat vital industris.
"A mor quitabl distribution and ownrship of land, with du rgard to th rights of landownrs to just
compnsation, rtntion rights undr Sction 6 of Rpublic Act No. 6657, as amndd, and to th cological
nds of th nation, shall b undrtakn to provid farmrs and farmworkrs with th opportunity to nhanc
thir dignity and improv th quality of thir livs through gratr productivity of agricultural lands.
"Th agrarian rform program is foundd on th right of farmrs and rgular farmworkrs, who ar landlss, to
own dirctly or collctivly th lands thy till or, in th cas of othr farmworkrs, to rciv a just shar of th
fruits throf . To this nd, th Stat shall ncourag and undrtak th just distribution of all agricultural lands,
subjct to th prioritis and rtntion limits st forth in this Act, taking into account cological, dvlopmntal,
and quity considrations, and subjct to th paymnt of just compnsation. Th Stat shall rspct th right
of small landownrs, and shall provid incntiv for voluntary land-sharing.
"As much as practicabl, th implmntation of th program shall b community-basd to assur, among
othrs, that th farmrs shall hav gratr control of farmgat prics, and asir accss to crdit.
"Th Stat shall rcogniz th right of farmrs, farmworkrs and landownrs, as wll as cooprativs and
othr indpndnt farmrs' organizations, to participat in th planning, organization, and managmnt of th

program, and shall provid support to agricultur through appropriat tchnology and rsarch, and adquat
financial, production, markting and othr support srvics.
"Th Stat shall rcogniz and nforc, consistnt with xisting laws, th rights of rural womn to own and
control land, taking into considration th substantiv quality btwn mn and womn as qualifid
bnficiaris, to rciv a just shar of th fruits throf, and to b rprsntd in advisory or appropriat
dcision-making bodis. Ths rights shall b indpndnt of thir mal rlativs and of thir civil status.
"Th Stat shall apply th principls of agrarian rform, or stwardship, whnvr applicabl, in accordanc
with law, in th disposition or utilization of othr natural rsourcs, including lands of th public domain, undr
las or concssion, suitabl to agricultur, subjct to prior rights, homstad rights of small sttlrs and th
rights of indignous communitis to thir ancstral lands.
"Th Stat may rsttl landlss farmrs and farm workrs in its own agricultural stats, which shall b
distributd to thm in th mannr providd by law.
"By mans of appropriat incntivs, th Stat shall ncourag th formation and maintnanc of conomic-
siz family farms to b constitutd by individual bnficiaris and small landownrs.
"Th Stat shall protct th rights of subsistnc fishrmn, spcially of local communitis, to th prfrntial
us of communal marin and fishing rsourcs, both inland and offshor. lt shall provid support to such
fishrmn through appropriat tchnology and rsarch, adquat financial, production and markting
assistanc and othr srvics. Th Stat shall also protct, dvlop and consrv such rsourcs. Th
protction shall xtnd to offshor fishing grounds of subsistnc fishrmn against forign intrusion.
Fishworkrs shall rciv a just shar from thir labor in th utilization of marin and fishing rsourcs.
"Th Stat shall b guidd by th principls that land has a social function and land ownrship has a social
rsponsibility. Ownrs of agricultural land hav th obligation to cultivat dirctly or through labor administration
th lands thy own and thrby mak th land productiv.
"Th Stat shall provid incntivs to landownrs to invst th procds of th agrarian rform program to
promot industrialization, mploymnt and privatization of public sctor ntrpriss. Financial instrumnts usd
as paymnt for lands shall contain faturs that shall nhanc ngotiability and accptability in th marktplac.
"Th Stat may las undvlopd lands of th public domain to qualifid ntitis for th dvlopmnt of
capital-intnsiv farms, and traditional and pionring crops spcially thos for xports subjct to th prior
rights of th bnficiaris undr this Act."
Sectio 2. Sction 3 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 3. Del|n|t|ns. - For th purpos of this Act, unlss th contxt indicats othrwis:

"(f) Farmr rfrs to a natural prson whos primary livlihood is cultivation of land or th production of
agricultural crops, livstock and/or fishris ithr by himslf /hrslf , or primarily with th assistanc of his/hr
immdiat farm houshold, whthr th land is ownd by him/hr, or by anothr prson undr a lashold or
shar tnancy agrmnt or arrangmnt with th ownr throf.

"(l) Rural womn rfr to womn who ar ngagd dirctly or indirctly in farming and/or fishing as thir
sourc of livlihood, whthr paid or unpaid, rgular or sasonal, or in food prparation, managing th
houshold, caring for th childrn, and othr similar activitis."
Sectio 3. Sction 4 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 4.Scpe. -Th Comprhnsiv Agrarian Rform Law of l988 shall covr, rgardlss of tnurial
arrangmnt and commodity producd, all public and privat agricultural lands as providd in Proclamation No.
l3l and Excutiv Ordr No. 229, including othr lands of th public domain suitabl for agricultur: Prv|ded,
That landholdings of landownrs with a total ara of fiv (5) hctars and blow shall not b covrd for
acquisition and distribution to qualifid bnficiaris.
"Mor spcifically, th following lands ar covrd by th CARP:
"(a) All alinabl and disposabl lands of th public domain dvotd to or suitabl for agricultur. No
rclassification of forst or minral lands to agricultural lands shall b undrtakn aftr th approval of

this Act until Congrss, taking into account cological, dvlopmntal and quity considrations, shall
hav dtrmind by law, th spcific limits of th public domain;
"(b) All lands of th public domain in xcss of th spcific limits as dtrmind by Congrss in th
prcding paragraph;
"(c) All othr lands ownd by th Govrnmnt dvotd to or suitabl for agricultur; and
"(d) All privat lands dvotd to or suitabl for agricultur rgardlss of th agricultural products raisd
or that can b raisd thron.
"A comprhnsiv invntory systm in consonanc with th national land us plan shall b institutd by th
Dpartmnt of Agrarian Rform (DAR), in accordanc with th Local Govrnmnt Cod, for th purpos of
proprly idntifying and classifying farmlands within on (l)yar from ffctivity of this Act, without prjudic to
th implmntation of th land acquisition and distribution."
Sectio 4. Thr shall b incorporatd aftr Sction 6 of Rpublic Act No. 6657, as amndd, nw sctions to rad
as follows:
"SEC. 6-A. Fxcept|n t Petent|n l|m|ts. - Provincial, city and municipal govrnmnt , units acquiring privat
agricultural lands by xpropriation or othr mods of acquisition to b usd for actual, dirct and xclusiv
public purposs, such as roads and bridgs, public markts, school sits, rsttlmnt sits, local govrnmnt
facilitis, public parks and barangay plazas or squars, consistnt with th approvd local comprhnsiv land
us plan, shall not b subjct to th fiv (5)-hctar rtntion limit undr this Sction and Sctions 70 and
73(a) of Rpublic Act No. 6657, as amndd: Providd, That lands subjct to CARP shall first undrgo th land
acquisition and distribution procss of th program: Providd, furthr, That whn ths lands hav bn
subjctd to xpropriation, th agrarian rform bnficiaris thrin shall b paid just compnsation."
"SEC. 6-B. Pev|ew l l|m|ts l land S|ze. - Within six (6) months from th ffctivity of this Act, th DAR shall
submit a comprhnsiv study on th land siz appropriat for ach typ of crop to Congrss for a possibl
rviw of limits of land sizs providd in this Act."
Sectio 5. Sction 7 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 7. Pr|r|t|es. - Th DAR, in coordination with th Prsidntial Agrarian Rform Council (PARC) shall plan
and program th final acquisition and distribution of all rmaining unacquird and undistributd agricultural lands
from th ffctivity of this Act until Jun 30, 20l4. Lands shall b acquird and distributd as follows:
"Phas On: During th fiv (5)-yar xtnsion priod hraftr all rmaining lands abov fifty (50) hctars
shall b covrd for purposs of agrarian rform upon th ffctivity of this Act. All privat agricultural lands of
landownrs with aggrgat landholdings in xcss of fifty (50) hctars which hav alrady bn subjctd to
a notic of covrag issud on or bfor Dcmbr l0, 2008; ric and corn lands undr Prsidntial Dcr
No. 27; all idl or abandond lands; all privat lands voluntarily offrd by th ownrs for agrarian rform:
Prv|ded, That with rspct to voluntary land transfr, only thos submittd by Jun 30, 2009 shall b allowd
Prv|ded, lurther, That aftr Jun 30, 2009, th mods of acquisition shall b limitd to voluntary offr to sll
and compulsory acquisition: Prv|ded, lurthermre, That all prviously acquird lands whrin valuation is
subjct to challng by landownrs shall b compltd and finally rsolvd pursuant to Sction l7 of Rpublic
Act No. 6657, as amndd: Prv|ded, l|na//y, as mandatd by th Constitution, Rpublic Act No. 6657, as
amndd, and Rpublic Act No. 3844, as amndd, only farmrs (tnants or lsss) and rgular farmworkrs
actually tilling th lands, as crtifid undr oath by th Barangay Agrarian Rform Council (BARC) and attstd
undr oath by th landownrs, ar th qualifid bnficiaris. Th intndd bnficiary shall stat undr oath
bfor th judg of th city or municipal court that h/ sh is willing to work on th land to mak it productiv
and to assum th obligation of paying th amortization for th compnsation of th land and th land taxs
thron; all lands forclosd by govrnmnt financial institutions; all lands acquird by th Prsidntial
Commission on Good Govrnmnt (PCGG); and all othr lands ownd by th govrnmnt dvotd to or
suitabl for agricultur, which shall b acquird and distributd immdiatly upon th ffctivity of this Act, with
th implmntation to b compltd by Jun 30, 20l2;
"Phas Two: (a) Lands twnty-four (24) hctars up to fifty (50) hctars shall likwis b covrd for
purposs of agrarian rform upon th ffctivity of this Act. All alinabl and disposabl public agricultural
lands; all arabl public agricultural lands undr agro-forst, pastur and agricultural lass alrady cultivatd
and plantd to crops in accordanc with Sction 6, Articl Xlll of th Constitution; all public agricultural lands
which ar to b opnd for nw dvlopmnt and rsttlmnt: and all privat agricultural lands of landownrs
with aggrgat landholdings abov twnty-four (24) hctars up to fifty (50) hctars which hav alrady bn
subjctd to a notic of covrag issud on or bfor Dcmbr lO, 2008, to implmnt principally th rights
of farmrs and rgular farmworkrs, who ar landlss, to own dirctly or collctivly th lands thy till, which

shall b distributd immdiatly upon th ffctivity of this Act, with th implmntation to b compltd by Jun
30, 20l2; and
"(b) All rmaining privat agricultural lands of landownrs with aggrgat landholdings in xcss of twnty-four
(24) hctars, rgardlss as to whthr ths hav bn subjctd to notics of covrag or not, with th
implmntation to bgin on July l, 20l2 and to b compltd by Jun 30, 20l3;
"Phas Thr: All othr privat agricultural lands commncing with larg landholdings and procding to
mdium and small landholdings undr th following schdul:
"(a) Lands of landownrs with aggrgat landholdings abov tn (l0) hctars up to twnty- four (24)hctars,
insofar as th xcss hctarag abov tn (l0) hctars is concrnd, to bgin on July l,20l2 and to b
compltd by Jun 30, 20l3; and
"(b) Lands of landownrs with aggrgat landholdings from th rtntion limit up to tn (l0) hctars, to bgin
on July l, 20l3 and to b compltd by Jun 30, 20l4; to implmnt principally th right of farmrs and rgular
farmworkrs who ar landlss, to own dirctly or collctivly th lands thy till.
"Th schdul of acquisition and rdistribution of all agricultural lands covrd by this program shall b mad in
accordanc with th abov ordr o f priority, which shall b providd in th implmnting ruls to b prpard
by th PARC, taking into considration th following: th landholdings whrin th farmrs ar organizd and
undrstand , th maning and obligations of farmland ownrship; th distribution of lands to th tillrs at th
arlist practicabl tim; th nhancmnt of agricultural productivity; and th availability of funds and
rsourcs to implmnt and support th program: Providd, That th PARC shall dsign and conduct
sminars, symposia, information campaigns, and othr similar programs for farmrs who ar not organizd or
not covrd by any landholdings. Compltion by ths farmrs of th aformntiond sminars, symposia, and
othr similar programs shall b ncouragd in th implmntation of this Act particularly th provisions of this
Sction.
"Land acquisition and distribution shall b compltd by Jun 30, 20l4 on a provinc-by- provinc basis. ln
any cas, th PARC or th PARC Excutiv Committ (PARC EXCOM), upon rcommndation by th
Provincial Agrarian Rform Coordinating Committ (PARCCOM), may dclar crtain provincs as priority
land rform aras, in which cas th acquisition and distribution of privat agricultural lands thrin undr
advancd phass may b implmntd ahad of th abov schduls on th condition that prior phass in
ths provincs hav bn compltd: Providd, That notwithstanding th abov schduls, phas thr (b)
shall not b implmntd in a particular provinc until at last ninty prcnt (90%) of th provincial balanc of
that particular provinc as of January l, 2009 undr Phas On, Phas Two (a), Phas Two (b),, and Phas
Thr (a), xcluding lands undr th jurisdiction of th Dpartmnt of Environmnt and Natural Rsourcs
(DENR), hav bn succssfully compltd.
"Th PARC shall stablish guidlins to implmnt th abov prioritis and distribution schm, including th
dtrmination of who ar qualifid bnficiaris: Providd, That an ownr -tillr may b a bnficiary of th land
h/sh dos not own but is actually cultivating to th xtnt of th diffrnc btwn th ara of th land h/
sh owns and th award ciling of thr (3) hctars: Providd, furthr, That collctiv ownrship by th
farmr bnficiaris shall b subjct to Sction 25 of Rpublic Act No. 6657, as amndd: Providd,
furthrmor, That rural womn shall b givn th opportunity t o participat in th dvlopmnt planning and
implmntation of this Act: Providd, finally, That in no cas should th agrarian rform bnficiaris' sx,
conomic, rligious, social, cultural and political attributs advrsly affct th distribution of lands."
Sectio 6. Th titl of Sction l6of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as
follows:
"SEC. l6. Prcedure lr Acqu|s|t|n and D|str|but|n l Pr|vate lands."
Sectio 7. Sction l7of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. l7. Determ|nat|n l Just Cmpensat|n. - ln dtrmining just compnsation, th cost of acquisition of
th land, th valu of th standing crop, th currnt: valu of lik proprtis, its natur, actual us and incom,
th sworn valuation by th ownr, th tax dclarations, th assssmnt mad by govrnmnt assssors, and
svnty prcnt (70%) of th zonal valuation of th Burau of lntrnal Rvnu (BlR), translatd into a basic
formula by th DAR shall b considrd, subjct to th final dcision of th propr court. Th social and
conomic bnfits contributd by th farmrs and th farmworkrs and by th Govrnmnt t o th proprty as
wll as th nonpaymnt of taxs or loans scurd from any govrnmnt financing institution on th said land
shall b considrd as additional factors to dtrmin its valuation."
Sectio 8. Thr shall b incorporatd aftr Sction 22 of Rpublic Act No. 6657, as amndd, a nw sction to
rad as follows:

"SEC. 22-A. Order l Pr|r|ty. - A landholding of a landownr shall b distributd first to qualifid bnficiaris
undr Sction 22, subparagraphs (a) and (b) of that sam landholding up to a maximum of thr (3) hctars
ach. Only whn ths bnficiaris hav all rcivd thr (3) hctars ach, shall th rmaining portion of
th landholding, if any, b distributd to othr bnficiaris undr Sction 22, subparagraphs (c), (d), (), (f),
and (g)."
Sectio 9. Sction 24 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 24. Award t Benel|c|ar|es. - Th rights and rsponsibilitis of th bnficiaris shall commnc from
thir rcipt of a duly rgistrd mancipation patnt or crtificat of land ownrship award and thir actual
physical possssion of th awardd land. Such award shall b compltd in not mor than on hundrd ighty
(l80) days from th dat of rgistration of th titl in th nam of th Rpublic of th Philippins: Prv|ded, That
th mancipation patnts, th crtificats of land ownrship award, and othr titls issud undr any agrarian
rform program shall b indfasibl and imprscriptibl aftr on (l) yar from its rgistration with th Offic
of th Rgistry of Dds, subjct to th conditions, limitations and qualifications of this Act, th proprty
rgistration dcr, and othr prtinnt laws. Th mancipation patnts or th crtificats of land ownrship
award bing titls brought undr th opration of th torrns systm, ar confrrd with th sam
indfasibility and scurity affordd to all titls undr th said systm, as providd for by Prsidntial Dcr
No. l529, as amndd by Rpublic Act No. 6732.
"lt is th ministrial duty of th Rgistry of Dds to rgistr th titl of th land in th nam of th Rpublic of
th Philippins, aftr th Land Bank of th Philippins (LBP) has crtifid that th ncssary dposit in th
nam of th landownr constituting full paymnt in cash or in bond with du notic to th landownr and th
rgistration of th crtificat of land ownrship award issud to th bnficiaris, and to cancl prvious titls
prtaining thrto.
"ldntifid and qualifid agrarian rform bnficiaris, basd on Sction 22 of Rpublic Act No. 6657, as,
amndd, shall hav usufructuary rights ovr th awardd land as soon as th DAR taks possssion of such
land, and such right shall not b diminishd vn pnding th awarding of th mancipation patnt or th
crtificat of land ownrship award.
"All cass involving th cancllation of rgistrd mancipation patnts, crtificats of land ownrship award,
and othr titls issud undr any agrarian rform program ar within th xclusiv and original jurisdiction of
th Scrtary of th DAR."
Sectio l0. Sction 25 of Rpublic Act So. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC.25. Award Ce|/|ngs lr Benel|c|ar|es. - Bnficiaris shall b awardd an ara not xcding thr (3)
hctars, which may covr a contiguous tract of land or svral parcls of land cumulatd up to th
prscribd award limits. Th dtrmination of th siz of th land for distribution shall considr crop typ, ,soil
typ, wathr pattrns and othr prtinnt variabls or factors which ar dmd critical for th succss of th
bnficiaris.
"For purposs of this Act, a landlss bnficiary is on who owns lss than thr (3) hctars of agricultural
land.
"Whnvr appropriat, th DAR shall ncourag th agrarian rform bnficiaris to form or join farmrs'
cooprativs for purposs of affiliating with xisting cooprativ banks in thir rspctiv provincs or
localitis, as wll as forming blocs of agrarian rform bnficiaris, corporations, and partnrships and joining
othr farmrs' collctiv organizations, including irrigators' associations: Providd, That th agrarian rform
bnficiaris shall b assurd of corrsponding shars in th corporation, sats in th board of dirctors, and
an quitabl shar in th profit.
"ln gnral, th land awardd to a farmr- bnficiary should b in th form of an individual titl, covring on
(l)contiguous tract or svral parcls of land cumulatd up to a maximum of thr (3) hctars.
"Th bnficiaris may opt for collctiv ownrship, such as co-workrs or farmrs cooprativ or som othr
form of collctiv organization and for th issuanc of collctiv ownrship titls: Providd, That th total ara
that may b awardd shall not xcd th total numbr of co-ownrs or mmbrs of th cooprativ or
collctiv organization multiplid by th award limit abov prscribd, xcpt in mritorious cass as
dtrmind by th PARC.
"Th conditions for th issuanc of collctiv titls ar as follows:
"(a) Th currnt farm managmnt systm of th land covrd by CARP will not b appropriat for
individual farming of farm parcls;

"(b) Th farm labor systm is spcializd, whr th farmworkrs ar organizd by functions and not by
spcific parcls such as spraying, wding, packing and othr similar functions;
"(c) Th potntial bnficiaris ar currntly not farming individual parcls hut collctivly work on larg
contiguous aras; and
"(d) Th farm consists of multipl crops bing farmd in an intgratd mannr or includs non- crop
production aras that ar ncssary for th viability of farm oprations, such as packing plants, storag
aras, diks, and othr similar facilitis that cannot b subdividd or assignd to individual farmrs.
"For idl and abandond lands or undrdvlopd agricultural lands to b covrd by CARP, collctiv
ownrship shall b allowd only if th bnficiaris opt for it and thr is a clar dvlopmnt plan that would
rquir collctiv farming or intgratd farm oprations xhibiting th conditions dscribd abov. Othrwis,
th land awardd to a farmr-bnficiary should b in th form of a n individual titl, covring on (l)
contiguous tract or svral parcls of land cumulatd up to a maximum of thr (3) hctars.

th collctiv crtificats of land ownrship award. Th DAR shall prpar a prioritizd list of crtificats of
land ownrship award to b parclizd. Th parclization shall commnc immdiatly upon approval of this
Act and shall not xcd a priod of thr (3) yars. Only thos xisting crtificats of land ownrship award
that ar collctivly farmd or ar opratd in an intgratd mannr shall rmain as collctiv."
Sectio ll. Sction 26 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 26. Payment by Benel|c|ar|es. - Lands awardd pursuant to this Act shall b paid for by th bnficiaris
to th LBP in thirty (30) annual amortizations at six prcnt (6%) intrst pr annum. Th annual amortization
shall start on (l) yar from th dat of th crtificat of land ownrship award rgistration. Howvr, if th
occupancy took plac aftr th crtificat of land ownrship award rgistration, th amortization shall start on
(l) yar from actual occupancy. Th paymnts for th first thr (3) yars aftr th award shall b at rducd
amounts as stablishd by th PARC: Providd, That th first fiv (5) annual paymnts may not b mor than
fiv prcnt (5%) of th valu of th annual gross production as stablishd by th DAR. Should th
schduld annual paymnts aftr th fifth (5th) yar xcd tn prcnt (l0%) of th annual gross production
and th failur to produc accordingly is not du to th bnficiary' s fault, th LBP shall rduc th intrst rat
and/or rduc th principal obligation to mak th rpaymnt affordabl.
"Th LBP shall hav a lin by way of mortgag on th land awardd to th bnficiary; and this mortgag may
b forclosd by th LBP for non-paymnt of an aggrgat of thr (3) annual amortizations. Th LBP shall
advis th DAR of such procdings and th lattr shall subsquntly award th forfitd landholding to othr
qualifid bnficiaris. A bnficiary whos land, as providd hrin, has bn forclosd shall thraftr b
prmanntly disqualifid from bcoming a bnficiary undr this Act."
Sectio l2. Sction 27 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 27. Translerab|/|ty l Awarded lands. - Lands acquird by bnficiaris undr this Act or othr agrarian
rform laws shall not b sold, transfrrd or convyd xcpt through hrditary succssion, or to th
govrnmnt , or to th LBP, or to othr qualifid bnficiaris through th DAR for a priod of tn (l0) yars:
Prv|ded, hwever, That th childrn or th spous of th transfror shall hav a right to rpurchas th land
from th govrnmnt or LBP within a priod of two (2) yars. Du notic of th availability of th land shall b
givn by th LBP to th BARC of th barangay whr th land is situatd. Th PARCCOM, as hrin providd,
shall, in turn, b givn du notic throf by th BARC.

any violation of th conditions of th convrsion ordr du to th fault of th applicant shall caus th land to
automatically b covrd by CARP."
Sectio 23. Sction 68 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 68. lmmun|ty l Gvernment Agenc|es lrm Undue lnterlerence. - ln cass falling within thir
jurisdiction, no injunction, rstraining ordr , prohibition or mandamus shall b issud by th rgional trial courts,
municipal trial courts, municipal circuit trial courts, and mtropolitan trial courts against th DAR, th DA, th
DENR, and th Dpartmnt of Justic in thir implmntation of th program."
Sectio 24. Sction 73 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 73. Prh|b|ted Acts and Om|ss|ns. - Th following ar prohibitd:
"(a) Th ownrship or possssion, for th purpos of circumvnting th provisions of this Act, of
agricultural lands in xcss of th total rtntion limits or award cilings by any prson, natural or
juridical, xcpt thos undr collctiv ownrship by farmr-bnficiaris;
"(b) Th forcibl ntry or illgal dtainr by prsons who ar not qualifid bnficiaris undr this Act to
avail thmslvs of th rights and bnfits of th Agrarian Rform Program:
"(c) Any convrsion by , any landownr of his/ hr agricultural' land into any non-agricultural us with
intnt to avoid th application of this Act to his/hr landholdings and to dispossss his/hr bonafid
tnant farmrs:
"(d) Th malicious and willful prvntion or obstruction by any prson, association or ntity of th
implmntation of th CARP;
"() Th sal, transfr , convyanc or chang of th natur of lands outsid of urban cntrs and city
limits ithr in whol or in part aftr th ffctivity of this Act, xcpt aftr final compltion of th
appropriat convrsion undr Sction 65 of Rpublic Act No. 6657, as amndd. Th dat of th
rgistration of th dd of convyanc in th Rgistr of Dds with rspct to titld lands and th dat
of th issuanc of th tax dclaration to th transfr of th proprty with rspct to unrgistrd
lands, as th cas may b, shall b conclusiv for th purpos of this Act;
"(f) Th sal, transfr or convyanc by a bnficiary of th right to us or any othr usufructuary right
ovr th land h/sh acquird by virtu of bing a bnficiary, in ordr to circumvnt th provisions of
this Act;
"(g) Th unjustifid, willful, and malicious act by a rsponsibl officr or officrs of th govrnmnt
through th following:
"(l) Th dnial of notic and/ or rply to landownrs;
"(2) Th dprivation of rtntion rights;

"(3) Th undu or inordinat dlay in th prparation of claim foldrs; or

"(h) Th undu dlay or unjustifid failur of th DAR, th LBP, th PARC, th PARCCOM, and any
concrnd govrnmnt agncy or any govrnmnt official or mploy to submit th rquird rport ,
data and/ or othr official documnt involving th implmntation of th provisions of this Act, as rquird
by th partis or th govrnmnt, including th Hous of Rprsntativs and th Snat of th
Philippins as wll as thir rspctiv committs, and th congrssional ovrsight committ cratd
hrin;
"(i) Th undu dlay in th complianc with th obligation to crtify or attst and/or falsification of th
crtification or attstation as rquird undr Sction 7 of Rpublic Act No. 6657, as amndd; and
"(j) Any othr culpabl nglct or willful violations of th provisions of this Act.
"ln th cas of govrnmnt officials and mploys, a conviction undr this Act is without prjudic to any civil
cas and/or appropriat administrativ procdings undr civil srvic law, ruls and rgulations. "Any prson
convictd undr this Act shall not b ntitld to any bnfit providd for in any agrarian rform law or program."
Sectio 25. Sction 74 of Rpublic Act No. 6657, as amndd, is hrby furthr amndd to rad as follows:
"SEC. 74. Pena/t|es. - Any prson who knowingly or willfully violats th provisions of this Act shall b punishd
by imprisonmnt of not lss than on (l) month to not mor than thr (3) yars or a fin of not lss than On
thousand psos (Pl,000.00) and not mor than Fiftn thousand psos (Pl5,000. 00), or both, at th
discrtion of th court : Providd, That th following corrsponding pnaltis shall b imposd for th spcific
violations hrundr:
"(a) lmprisonmnt of thr (3) yars and on (l) day to six (6) yars or a fin of not lss than Fifty
thousand psos (P50, 000.00)and not mor than On hundrd fifty thousand psos (Pl50,000.00), or
both, at th discrtion of th court upon any prson who violats Sction 73, subparagraphs (a), (b), (f),
(g), and (h) of Rpublic Act No. 6657, as amndd; and
"(b) lmprisonmnt of six (6) yars and on (l) day to twlv (l2) yars or a fin of not lss than Two
hundrd thousand psos (P200, 000.00) and not mor than On million psos (Pl,000,000. 00), or both,
at th discrtion of th court upon any prson who violats Sction 73, subparagraphs (c), (d), (), and
(i) of Rpublic Act No. 6657, as amndd.

Sectio 26. Congressional Oversigh Commiee. - A Congrssional Ovrsight Committ on Agrarian Rform
(COCAR) is hrby cratd to ovrs and monitor th implmntation of this Act. lt shall b composd of th
Chairprsons of th Committ on Agrarian Rform of both Houss of Congrss, thr (3) Mmbrs of th Hous of
Rprsntativs, and thr (3) Mmbrs of th Snat of th Philippins, to b dsignatd rspctivly by th
Spakr of th Hous of Rprsntativs and th Prsidnt of th Snat of th Philippins.
Th Chairprsons of th Committs on Agrarian Rform of th Hous of Rprsntativs and of th Snat of th
Philippins shall b th Chairprsons of th COCAR. Th Mmbrs shall rciv no compnsation; howvr,
travling and othr ncssary xpnss shall b allowd.
ln ordr to carry out th objctivs of this Act, th COCAR shall b providd with th ncssary appropriations for its
opration. An initial amount of Twnty-fiv million psos (P25,000,000.00) is hrby appropriatd for th COCAR for
th first yar of its opration and th sam amount shall b appropriatd vry yar thraftr.
Th trm of th COCAR shall nd six (6) months aftr th xpiration of th xtndd priod of fiv (5) yars.
Sectio 27. Powers and Puncions oI he COCAR. - Th COCAR shall hav th following powrs and functions:
(a) Prscrib and adopt guidlins which shall govrn its work;
(b) Hold harings and consultations, rciv tstimonis and rports prtinnt to its spcifid concrns;
(c) Scur from any dpartmnt, burau, offic or instrumntality of th govrnmnt such assistanc as may
b ndd, including tchnical information, prparation and production of rports and submission of
rcommndations or plans as it may rquir, particularly a yarly rport of th rcord or prformanc of ach
agrarian rform bnficiary as providd undr Sction 22 of Rpublic Act No. 6657, as amndd;

(d) Scur from th DAR or th LBP information on th amount of just compnsation dtrmind to b paid or
which has bn paid to any landownr;
() Scur from th DAR or th LBP quartrly rports on th disbursmnt of funds for th agrarian rform
program;
(f) Ovrs and monitor, in such a mannr as it may dm ncssary, th actual implmntation of th
program and projcts by th DAR;
(g) Summon by subpona any public or privat citizn to tstify bfor it, or rquir by subpena duces tecum
to produc bfor it such rcords, rports, or othr documnts as may b ncssary in th prformanc of its
functions;
(h) Engag th srvics of rsourc prsons from th public and privat sctors as wll as civil socity
including th various agrarian rform groups or organizations in th diffrnt rgions of th country as may b
ndd;
(i) Approv th budgt for th work of th Committ and all disbursmnts thrfrom, including compnsation
of all prsonnl;
(j) Organiz its staff and hir and appoint such mploys and prsonnl whthr tmporary, contractual or on
constancy subjct to applicabl ruls; and
(k) Exrcis all th powrs ncssary and incidntal to attain th purposs for which it is cratd.
Sectio 28. Periodic Reors. - Th COCAR shall submit to th Spakr of th Hous of Rprsntativs and to
th Prsidnt of th Snat of th Philippins priodic rports on its findings and rcommndations on actions to b
undrtakn by both Houss of Congrss, th DAR, and th PARC.
Sectio 29. Access o lnIormaion. - Notwithstanding th provisions of Rpublic Act No. l405 and othr prtinnt
laws, information on th amount of just compnsation paid to any landownr undr Rpublic Act No. 6657, as
amndd, and othr agrarian rform laws shall b dmd public information.
Sectio 30. Resoluion oI Case. - Any cas and/or procding involving th implmntation of th provisions of
Rpublic Act No. 6657, as amndd, which may rmain pnding on Jun 30, 20l4 shall b allowd to procd to its
finality and b xcutd vn byond such dat.
Sectio 3l. lmlemening Rules and Regulaions. - Th PARC and th DAR shall provid th ncssary
implmnting ruls and rgulations within thirty (30) days upon th approval of this Act. Such ruls and rgulations
shall tak ffct on July l, 2009 and it shall b publishd in at last two (2) nwspaprs of gnral circulation.
Sectio 32. Reealing Clause. - Sction 53 of Rpublic Act No. 3844, othrwis known as th Agricultural Land
Rform Cod, is hrby rpald and all othr laws, dcrs, xcutiv ordrs, issuancs, ruls and rgulations, or
parts throf inconsistnt with this Act ar hrby likwis rpald or amndd accordingly.
Sectio 33. Searabiliy Clause. - lf, for any rason, any sction or provision of this Act is dclard unconstitutional
or invalid, th othr sctions or provisions not affctd thrby shall rmain in full forc and ffct.
Sectio 34. EIIeciviy Clause. - This Act shall tak ffct on July l,2009 and it shall b publishd in at last two (2)
nwspaprs of gnral circulation.
