Abstract Federalism issues in the U.S have led to the division of powers between the states and the national government. However in some of the areas in America some of the responsibilities might be federal or state while others might be both. Thus there have been changes to the federal and state governments and these evolutions have led to the adoption of various acts including the healthcare reforms. Studies show that responsibilities of the government in healthcare have been vital over the years. This paper aims to give a critical view on the development of the American constitution through support from various scholars in relation to court cases, terms and concepts, an analysis on the adoption of the healthcare reform act and finally its application in the present day.

Scholars view and Analysis The adoption of the healthcare reform has not been easy. Such ideas brought about by federalists have since moved from the government to the courts. Scholars such as Thomas Hobbes and John Locke have cited that the ways these reforms are seen differ amongst the various states and therefore the courts are important to give an overview on the issue. These two scholars were quick to point out on the practical issues concerning the political and economic problems under the articles confederation as well as in their own beliefs (Richard, 2012). The two congressmen cited that human beings were entitled to equal healthcare and that there was no need for political selfishness. Studies in the US show that there is dominance of political individualism in contrast to the human rights that the politicians and governments are to give its citizens (Richard, 2012). Such individualism in politics acted as the way that the healthcare reforms which were part of the American constitution had to face several challenges in its adoption. Federalism is the main challenges whereby the responsibilities and powers of the state and government need to be equally divided seem to be taken care of. Lockes personal view on the federal challenges to the adoption of the healthcare reforms in the country is imminent. His intellectual view on this issue including the economic challenges is well supported by Thomas Hobbes. Lockes asserts that the concept of objectivism was seen as something new in the country and never found any support from the government (Richard, 2012). Just like Locke argued Thomas believes that the reality in society is based on the concept of phantasm and that the government is one that is created by contract (Richard, 2012).

The critics of these reforms cite the United States v. Lopez (1995) and United States v. Morrison (2000) cases as the main issues behind the removal of some clauses from it. However, the adoption of the healthcare reforms faces challenges from courts such as the Virginia General Assembly that wish to do away with part of the bill. However, the judgment form the Supreme Court is the final hope of the healthcare reform act (Richard, 2012). Applications Even though these reforms are receiving more challenges, they remain vital. This is because these reforms will help in elimination of healthcare minorities in the country and that all the communities are subject to the healthcare needs (Richard, 2012).
