DISSOLUTION OF THE CARE TRUST: FUTURE ARRANGEMENTS FOR MANAGING ADULT SOCIAL CARE COMPLAINTS Purpos o! R por" To seek approval of Full Council for the Chief Executive to delegate the statutory complaints role associated with the adult social care complaints. #$%&'rou() Full Council at its meeting on 12th Octo er approved the dissolution of the !artnership "greement etween the Council and the Care Trust under which the delivery of adult social care services was undertaken y the Care Trust. "s part of the arrangements with the Care Trust all complaints relating to "dult #ocial Care were handled y the Care Trust. $hen the responsi ility for delivering "dult #ocial reverts to the Council% the responsi ility for complaints will also return to the Council. M$"" rs !or Co(s+) r$"+o( The statutory complaints function relating to "dult #ocial Care is governed y regulations. The 'egulations appoint the Chief Executive as the 'esponsi le !erson with responsi ility for ensuring compliance with the arrangements prescri ed in the 'egulations. The Council is permitted to authorise an individual other than the Chief Executive to act on ehalf of the 'esponsi le !erson in the discharge of the functions imposed y the 'egulations. The Chief executive will remain as the 'esponsi le !erson and ultimately responsi le for the arrangements for the handling and consideration of complaints relating to adult social care. "ny complaints received will follow the statutory complaints process. The nominated individual will handle and consider any complaints and will report the outcome to the Chief Executive. The are no identified Financial )mplications 1.5 1.*.1 R+s& I.p-+%$"+o(s )t is proposed that the Corporate 'isk +anagement "pproach will e used to identify and mitigate risks during the transition to the new organisational arrangements for adult social care. This will take account of the existing red risks to ensure no slippage in progress.

The Corporate 'isk +anagement "pproach has een complied with to identify and assess the significant risks associated with this decision , pro-ect. This includes . ut is not limited to/ political% legislation and reputation risks. The "pproach is not intended to eliminate all risks and not all the risks identified can e managed all of the time. "lso% risks will still exist that have not een identified. 0owever% ased on the information provided% it is the officers1 opinion that the significant risks have een identified% assessed and arrangements are in place to manage them effectively.
