QUESTION a) Clara contracted to purchase 10 pieces of 1 cent coins which were used during the British occupation for the price of RM 300 and grass for the price of RM 200 per kilogram from Naomi. Are the contracts between Clara and Naomi valid? b) Explain with examples, implied terms embodied in Section 17 of the Sales of Goods Act 1957.

LEARNING OUTCOMES This assignment will assess your ability to: 1. Address issues relevant to the provisions of the Sale of Goods Act 1957 (SOGA); 2. Conduct directed research into the rights of a purchaser under the Sale of Goods Act 1957 ; 3. Analyse the given problem situation; and 4. Apply relevant legal authorities to provide appropriate solutions.

TASK 1. You are required to write your answer within the word limit of 500 words. This word limit excludes citations and bibliography. 2. In the event the maximum word limit of 500 words is exceeded, any part or parts of the answer in excess of the word limit will be disregarded. 3. The following is a general guide as to the report layout: (a) Introduction: general identification of the SOGA ; (b) Body: elaboration of the legal issues (identified at the Introduction stage) and application of those legal issues to provide a feasible solution; (c) Conclusion: persuasive conclusion based on earlier arguments. 4. Your attention is also drawn to APUs regulations on plagiarism; these regulations apply to this coursework. Any information taken from another source (e.g. lecture notes, text books, academic journals, e-books or any Internet sites) must be cited and referenced using the Harvard Referencing method. 5. MARKING SCHEME Research Credibility (15 marks) Students are expected to refer to credible sources for the purposes of their research, discussion and reasoning for the assignment. Students are also expected to use the Harvard Referencing method when quoting relevant sections and case laws. Overall impact/persuasiveness (10 marks) Students must be able to demonstrate their ability to justify their answer with the correct quotation, references of the relevant sections and authorities to support their arguments in their assignment in particular the relevancy and the applicability of implied terms provided by the SOGA 1957 to the problem question. Quality of Documentation (20 marks) The assignment must reflect coherence and link between introduction, body and conclusion. Student must be able to demonstrate an understanding on the importance of the law. Others (5 marks) Students work as a whole must be neat, free from spelling mistakes and a reflection of their effort placed in answering the assignment.

ASSESSMENT CRITERIA This assessment will be marked based on the following criteria:(a) Research Credibility Use of academic research materials and credible sources for the purpose of discussion and reasoning; use of Harvard Referencing method for citation and references (b) Overall impact/ persuasiveness Ability to convince the examiner with the reasoning presented (c) Quality of Documentation Answer to reflect coherence and link between introduction, body and conclusion as well as the ability to use and apply correct legal terms and legal authorities to justify advice given. PERFORMANCE EXPECTATION Marks are awarded based on the following guidelines: Grade Distinction 38-50 marks Description of performance level Good analysis of the problem situation. Clear and convincing application of legal issues and legal authorities to solve the issues identified. Citations must have at least 3 solid references. Legal arguments are coherent and convincing, based on reflective reading. Points are supported with valid explanation and good reasoning. Shows analysis, understanding, thought and reflection of subject matter. Sufficient points are raised and valid explanations are provided based on accurate identification of legal issues. Arguments presented are adequate, based on selected text and relevant areas of legal research. There is adequate understanding of subject matter. Basic requirements fulfilled, reflecting some understanding of legal issues and possible solutions. Basic examples are used to illustrate points. Arguments given are elementary and explanations may either be unclear or unhelpful in clarifying points. No understanding of the subject matter and failure to address the needs of the question. Points are off-topic and are not related to selected text or areas of legal research. No understanding of theories and concepts taught. Weak or no referencing of sources.
