SCHEDULE OF SALIENT FISCAL ASPECTS FOR CIVIL & INTERIOR WORKS FOR BP CASTROL PROJECT AT MUMBAI

SCOPE OF WORK: As per Conditions, Specifications and Bill of Quantities set forth in the Document and shall include the specifications, drawings and sketches issued to you and to be issued to you by the Architects or Project Managers during the duration of the Project. The quoted Rates hold firm for the entire Works plus the period upto the settlement of Final Bill. No escalation will be entertained towards labour, materials, petrol, diesel or any other account. Vendor to quote for as per the BOQ attached with the tender. Costs quoted need to include all applicable taxes, levies, Octroi and duties on duty-paid basis and, except in case of increase / change in any statutory levies, need to hold good for 12 months from the date of Order. 25% Mobilization advance against work order. 30% After completion of 60% work at site. (as approved by PM) 25% After completion of 90% work at site(as approved by PM) 20% After satisfactory completion of work and hand over to Castrol India Limited. 5% of the certified payment value of all running bills shall be deducted as the Retention Amount which shall be retained by M.Moser till the end of defects liability period of 12months from date of certified completion of works.

NON TENDER ITEMS:

The M Moser shall have the right to add / change / delete any item at its discretion. Payment for non-tender items shall be made as follows:

Rates for non-tender items will be derived from the quoted rate of similar items included in Bill of Quantities; Contractor will submit a rate analysis based upon cost of material and labour + 15% overheads & profits. Contractor will submit original proofs of purchase/invoices to support his rate analysis. The Quantities for the Rate analysis will be approved by Architect & the rates by Project Managers. The lower of rates between (i) and (ii) will prevail as certified by Architect. 0.5% per day subjected to maximum 5% of the total contract value for delay in completion of the work beyond the stipulated completion date. All-Inclusive in Contractors quoted rates. 1. Price of the material/product 2. Freight Charges 3. Insurance up to commissioning 4. Transportation till Project Site 5. Installation 6. Any other cost which is to be incurred in the process of execution of works. 7. All levies, taxes (by whatever name called) current and future levies that may be statutorily become payable during the process of execution of works.

PENALTY :

To be deducted on each invoice by M Moser as per applicable rates. All the suppliers will have to quote their P A N (Permanent Account Number) on all the bills. All the suppliers / contractors dealing in parallel sale or manufacture of material will also have to quote their Sales Tax Registration Nos. Net 30 days from receipt of certified running account bills/Final Bill with all supporting documents

PERFORMANCE

Vendor shall need to make its own arrangements for transportation, delivery of all material at Site till satisfactory completion of works and commencement of operations. All works not carried out in accordance with the drawings, specifications and instructions from M Moser or its authorized representatives will need to be removed and replaced by the Contractor at his sole cost within agreed timeline. The Contractor/ Supplier will provide and maintain security arrangements headed by a senior security officer for all persons working for the Contractor/ Supplier/SubContractor/ Suppliers and other agencies/Vendors including those appointed directly by the M Moser. The logistics of site security will have to be jointly worked in discussion with the M Moser /Project Managers. Contractor/ Supplier shall follow the relevant instructions in this matter. The Contractor/ Supplier shall be wholly and solely responsible for full compliance with the provisions under all labour laws and/or regulations such as Payment of Wages Act 1948, Employees Liability Act 1938, Workmen's Compensation Act 1923, Industrial Disputes Act 1947, the Maternity Benefit Act 1961, the Contract Labour (Regulation and Abolition) Act 1970 and the Factories Act 1948 or any modifications thereof or any other law relating thereto and rules there under introduced from time to time. The Contractor/ Supplier shall assume liability and shall indemnify the M Moser from every expense, liability or payment by reason of the application of any labour law, act, rules or regulations existing or to be introduced at a future date during the term of the Contract. Insurance cover towards the above shall be affected by the Contractor/ Supplier as called for in clause 10. In general, in respect of all labour directly or indirectly employed in the Work for the performance of Contractor/ Supplier's part of the Contract, the Contractor/ Supplier shall comply with all the rules framed by the Government authorities concerned from time to time for protection of the health and welfare of the workers. The Contractor/ Supplier shall obtain a valid license under the Contract Labour (R & A) Act 1970 and the Contract labour (Regulation and Abolition) Central Rules 1971 and under any other applicable rules before the commencement of the Work and continue to have a valid license until the completion of the Work. The Contractor/ Supplier shall pay to labour employed by him either directly or through Sub-Contractor/ Suppliers wages not less than fair wages as defined in the relevant local labour regulations or as per the provisions of the

LABOUR REGULATIONS:

OVERTIME WORK

Contract Labour (Regulation and Abolition) Act 1970 and the Contract Labour Regulation and Abolition of Central Rules 1971, wherever applicable. He shall also abide by the minimum wages and other regulations applicable to the labour engaged in the Work, as laid down by the concerned local authorities (Central Govt, State Govt., District or other local Authorities). If it is necessary for the Contractor/ Supplier or any SubContractor/ Supplier to work on other than working days or outside the normal working hours in order to keep up to the time schedule and meet the Construction Program, the Contractor/ Supplier shall obtain the prior approval of the Project Manager in writing, which approval shall not be unreasonably withheld. The additional cost of wages and any other costs incurred as a result of overtime or any shift work (except supervision expenses incurred by the Project Manager) shall be borne by the Contractor/ Supplier. Have to be following as per M Moser Share the documents earlier.
