International maritime news for seafarers
EC clarifies rules on cabotage & reports on
developments in maritime transport
The European Commission (EC has pro!ided new "uidan#e on the interpretation of the
re"ulation to pro!ide #a$ota"e within a mem$er state, thus pro!idin" an internal mar%et for the
pro!ision of maritime transport ser!i#es& Competent authorities will now ha!e more le"al
#ertainty when awardin" pu$li# ser!i#e #ontra#ts and imposin" pu$li# ser!i#e o$li"ations&
'hipowners will also $enefit from more le"al #larity, allowin" them to $etter or"anise their
$usiness in Europe&
European Commission (i#e)*resident 'iim +allas, responsi$le for ,o$ility and Transport, said-
.The internal mar%et for maritime transport ser!i#es is important to the performan#e of the
European e#onomy and for the /uality of life and prosperity of maritime re"ions& ,em$er 'tates0
authorities need #lear rules on how to ensure ade/uate lin%s to islands and peripheral re"ions
that are parti#ularly dependent on maritime transport&.
.We ha!e e1plained !ery #arefully where!er #larifi#ation was needed& These updated
interpretati!e "uidelines pro!ide #larity and will enhan#e le"al #ertainty for all maritime #a$ota"e
a#tors in the E2,. +allas said in a press release&
The new "uidan#e updates the pre!ious EC0s "uidan#e in order to ali"n it to re#ent E2 law and
#ase)law of the Court of 3usti#e& In future, there will $e more fle1i$ility in definin" the duration of
pu$li# ser!i#e #ontra#ts& The new "uidan#e is presented in the interest of transparen#y and le"al
#ertainty to help e1plain the E2 rules to all a#tors who wish to ma%e use of it&
Amon"st other thin"s the interpretati!e #ommuni#ation adopted pro!ides updated "uidan#e on-
the s#ope of the freedom to pro!ide ser!i#es in the maritime #a$ota"e se#tor4 who en5oys that
freedom and whi#h ser!i#es the 6e"ulation #o!ers4 the award pro#edure for pu$li# ser!i#e
#ontra#ts4 the duration of pu$li# ser!i#e #ontra#ts4 the mannin" rules on !essels pro!idin"
maritime #a$ota"e, the appli#ation of 6e"ulation (EC 7o 138092008 of the European
*arliament and of the Coun#il on pu$li# passen"er transport ser!i#es $y rail and $y road and
repealin" Coun#il 6e"ulations (EEC 7o 11:19;: and 1108980 to maritime #a$ota"e ser!i#es
and transitional arran"ements for Croatia&
SAFETY STUDY
OIL SPILL DURIN !UN"ERIN
What was thou"ht to $e 5ust a minor indentation after #onta#t with a #on#rete wall turned out to
$e a near)disaster in the ma%in" for a tan%er !essel&
N#RR#$I%E
When enterin" a #anal lo#% with a pilot on $oard, a tan%er !essel hit the #on#rete wall 5ust
outside the lo#%, #ausin" an indentation aft of star$oard 5ust outside the 7o; fuel oil tan%& The
dama"e was inspe#ted $y the master, the pilot and lo#% personnel, who a"reed the only
dama"e !isi$le was an indentation& 7o #ra#% was o$ser!ed& There was no dama"e to the lo#%&
They a"reed there was only minor dama"e and no further reportin" to shore authorities was
needed& <urin" the #anal transit, the master informed the !essel mana"er, who a"reed that it
was a minor matter without need for further a#tion& The #lass so#iety was not informed&
Appro1imately one wee% later the !essel was s#heduled to load hea!y fuel oil (=>? and marine
"as oil (,@?& The only a!aila$le tan% for the =>? was the 7o; star$oard tan%& A total of :0
#u$i# metres =>? and 30 #u m of ,@? was to $e loaded& The operation was #ondu#ted $ased
on the 'hip$oard ?il *ollution Emer"en#y *lan& When the =>? $un%erin" was a$out A0B
#ompleted, the duty AC o$ser!ed an oil film on the water aft&
The master immediately stopped the pumps usin" the normal stop on the $rid"e& It was
dis#o!ered that =>? was lea%in" from a #ra#% star$oard side aft& An oil $oom was deployed and
the =>? already re#ei!ed was transferred to other oil tan%s& An estimated 400)D00 litres lea%ed&
A pollution #ontrol !essel inspe#tion and a heli#opter aerial sur!ey re!ealed no further
en!ironmental pollution&
#N#L&SIS #ND CONCLUSION
The #onta#t with the the #on#rete wall when enterin" the lo#% #aused an indentation $ut no
#ra#% in the ship0s side& =owe!er, the dama"e #aused a deterioration of the stru#tural stren"th in
this area& The stresses of the steel #aused $y the mo!ement of the sea durin" su$se/uent
!oya"es #aused a #ra#% to de!elop&
The #lass sur!eyor inspe#ted the dama"e to the ship0s side ori"inatin" from hittin" the lo#%
entran#e& =e found a #ra#% in hull outside the 7o; star$oard =>? tan%& The #ra#% was
