Agreement Terms and Conditions
Purpose
#his agreement contains the entire ,nderstanding bet.een the Photographer and the Client. 't s,persedes
all prior and sim,ltaneo,s agreements bet.een the contracting parties. #he only .ay to add or change to
this agreement is to do so in .riting4 signed by both parties.
Reservation
5pon yo,r signat,re4 the Photographer .ill reser!e the time and date agreed ,pon and .ill not ma*e other
reser!ations for that time and date. /or this reason4 the reser!ation deposit is non-refundable e!en if the
date is changed or the e!ent is cancelled for any reason4 incl,ding acts of 6od4 fire4 stri*e and e1treme
.eather. #he reser!ation deposit is to be paid at the time of signing the contract. #he reser!ation deposit is
applied to.ards the contracted e!ent pac*age. Client ,nderstands and agrees that the entire amo,nt o.ed
for the e!ent pac*age described in the contract is d,e no less than ! "eeks before the event or on the
o,tstanding balance d,e date specified. Client agrees that if the balance is not paid by this time4 the
Photographer reser!es the right to ref,se to photograph the e!ent4 res,lting in a loss of the reser!ation
deposit to the client and no liability to.ards the photographer.
Pre-Event Consultation
#he contracting parties agree to a pre-e!ent cons,ltation before the e!ent in order to finalise the act,al
shooting times4 locations4 and clients re7,est list (in .riting) for specific photographs. #he client .ill be
responsible for4 or ha!e someone designated4 to identify people of .hom specific photographs are desired.
#he photographer .ill not be held acco,ntable for not photographing desired people if there is no one to
assist in identifying people or gathering people for gro,p photographs.
#hooting Time/Additions
#he photography sched,le is designed to accomplish the goals and .ishes of the client in a manner
en8oyable by all parties. #he client and the photographer agree that cheerf,l co-operation and p,nct,ality by
all members of the e!ent staff are therefore essential to that p,rpose. "hooting commences at the sched,led
start time agreed by both parties. "ho,ld additional photography time4 that is not incl,ded in the agreed
pac*age4 be re7,ested by the client it .ill be charged at the rates specified in the assignment pac*age4
ro,nded to the nearest ho,r.
Copyright
#he photographer remains the sole o.ner of copyright4 ,nless a C% is p,rchased (at 0933) .hich then
shares copyright e7,ally bet.een the photographer and the client. Any prints prod,ced by the photographer
are protected by the Copyright4 %esigns and Patents Act 9:;;. #he client agrees to obtain .ritten permission
from the photographer prior to selling or p,blishing the photographers images for profit.
$odel Release
#he client hereby grants the photographer the irre!ocable and ,nrestricted right to ,se and p,blish
photographs from the e!ent4 its g,ests4 attendees4 and officials for editorial4 trade4 ad!ertising4 commercial
,se and any other p,rpose. #he client hereby releases the photographer the ,se of all said photographs.
E%clusivity/&uest Photography
'f the photographer is the sole professional photographer at the e!ent4 it is ,nderstood by the client that the
photographer .ill be the only one allo.ed to photograph the e!ent. 'n .hich case4 amate,r photographers
may ta*e photos d,ring the e!ent if they do not interfere .ith the contracted photographer and are not
shooting the photographers same posed shots. 'f a problem arises4 .ith any g,est4 the (n-"ite E!ent
Contact .ill be ad!ised to handle the sit,ation politely for the photographer by enforcing the conditions in this
agreement.
Penalty Charges
#here .ill be a 0<3 charge for e!eryday the o,tstanding balance is o!erd,e.
'imit of 'iability
'n the ,nli*ely e!ent that photographs are lost4 stolen or destroyed for reasons beyond the photographers
control4 the photographers liability is limited to the ret,rn of all payments recei!ed for the e!ent pac*age.
(on-&uarantee
Altho,gh e!ery possible care .ill be ta*en to to prod,ce special and important photographs d,ring the e!ent4
the photographer cannot place an ,nconditional g,arantee on the abo!e. #he photographer .ill not be held
responsible for any r,ined photographs d,e to g,ests' flashes= or any other r,ined photographs d,e to any
ca,se in or o,tside of the photographers control.
