CONTRACT OF LEASE

FOR A PARCEL OF LAND




KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of Naga, this day of
_______________, 20__, by and between:

LORNA A. ABAY, of legal age, Filipino citizen, single, with residence at Taban,
Libmanan, Camarines Sur, hereinafter referred to as the LESSOR

-AND-

(LESSEE), of legal age, single/married, Filipino, and with residence and postal address
at _____________________, hereinafter referred to as the LESSEE.

WITNESSETH:

WHEREAS, the LESSOR is the co-owner of a certain parcel of land situated in the
Municipality of Libmanan, Camarines Sur, Philippines, more particularly described as follows:
A PARCEL OF LAND WITH TRANSFER CERTIFICATE OF TITLE NO. 080-
2011000338 (LOT 1561, OF THE CADASTRAL SURVEY OF LIBMANAN,
CADASTRAL CASE NO. N-L-1, L.R.C. CADASTRAL RECORD NO. N-513), WITH
THE IMPROVEMENTS THEREON, SITUATED IN THE MUNICIPALITY OF
LIBMANAN, CAMARINES SUR. BOUNDED ON THE NE., POINTS 2 - 3 BY LOT 1562;
POINTS 3 - 4 BY LOT 1563, AND POINTS 4 5 BY LOT 1560; ON THE SE., POINTS 5
6 BY LOT 6118; ON THE SW., POINTS 6 1 BY LOT 1560; AND ON THE NW.,
POINTS 1 2 BY LOT 6076, BEGINNING AT A POINT MARKED 1 ON PLAN
BEING S. 16 DEG. 37E., 124.52 M. FROM B.L.L.M. NO. 1, THENCE N. 82 DEG. 59E.,
13.34 M. TO PPOINT 2; S. 7 DEG. 06E., 8.50 M. TO POINT 3; S. 11 DEG. 16E., 2.87 M.
TO POINT 4; S. 4 DEG. 18E., 8.40 M. TO POINT 5; S. 80 DEG. 27W., 13.15 M. TO
POINT 6; N. 6 DEG. 06W., 20.34 M. TO THE POINT OF BEGINNNING;
CONTAINING AN AREA OF TWO HUNDRED AND SEVENTY ONE (271) SQUARE
METERS, MORE OR LESS.

WHEREAS, attached herein are the Waivers of Rights by the co-owners of said property
subject of the lease;

WHEREAS, the LESSOR desires to lease the afore-described property in favor of the
LESSEE and the latter accepts the lease subject to the terms and conditions herein set forth.

NOW, THEREFORE, for and in consideration of the terms and conditions mutually
agreed upon by the parties, the LESSOR hereby lease unto the LESSEE, his heirs, successors
and assigns, the above-described parcel of land subject to the following terms and conditions, to
wit:

TERMS AND CONDITIONS:

PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE for
________________ purposes only and shall not be diverted to other uses. It is hereby expressly
agreed that if at any time the premises are used for other purposes, the LESSOR shall have the
right to rescind this contract without prejudice to its other rights under the law.

TERM: This term of lease is for one (1) year only, from _______ to ________. Upon its
expiration, this lease may be renewed under such terms and conditions as my be mutually agreed
upon by both parties, written notice of intention to renew the lease shall be served to the
LESSOR not later than _________ days prior to the expiry date of the period herein agreed
upon.

RENTAL RATE: The monthly rental rate for the leased premises shall be THREE
THOUSAND FIVE HUNDRED PESOS (Php 3,500.00). All rental payments shall be payable to
the LESSOR.

DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this contract and
prior to move-in an amount equivalent to the rent for _______ months or the sum
of ___________________________ wherein said deposit shall cover
for______________________.


DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent, such
as when the checks are dishonored, the LESSOR at its option may terminate this contract and
eject the LESSEE. The LESSOR has the right to fence and padlock the premises when the
LESSEE is in default of payment for ______________ month and may forfeit whatever rental
deposit or advances have been given by the LESSEE.

SUB-LEASE: The LESSEE shall not directly or indirectly sublet, allow or permit the
leased premises to be occupied in whole or in part by any person, form or corporation, neither
shall the LESSEE assign its rights hereunder to any other person or entity and no right of
interest thereto or therein shall be conferred on or vested in anyone by the LESSEE without the
LESSOR'S written approval.

TAXES: The LESSOR shall pay the real property taxes levied of the leased premises
corresponding to the aforementioned parcel of land while the LESSEE shall pay the real
property taxes levied on the building and other improvements that shall be introduced by the
latter.

LESSOR'S RIGHT OF ENTRY: The LESSOR or its authorized agent shall after giving due
notice to the LESSEE shall have the right to enter the premises in the presence of the LESSEE
or its representative at any reasonable date to examine the same or for any other lawful purposes
which it may deem necessary.

EXPIRATION OF LEASE: At the expiration of the term of this lease or cancellation
thereof, as herein provided, the LESSEE will promptly deliver to the LESSOR the leased
premises and it is expressly agreed by the parties herein that any fixed improvements or
renovations that will be introduced to the subject property and not removed upon the expiration
or cancellation of the lease shall become the property of the LESSOR after the expiration of the
term of this Contract.

This CONTRACT OF LEASE shall be valid and binding between the parties; their successors-
in-interest and assigns.
