Contract for event photography services

This constitutes an agreement for photographic services, it is also understood t

hat any and all digital images remain property of the photographer, Brayden Sher
ban, Brayden Sherban Photography and may be used for advertising, display or any
purpose thought proper by Brayden Sherban Photography.
Brayden Sherban Photography and its representatives shall not be held accountab
le for any unseen delays in the processing/colour balance problems with the imag
es due to improper or inadequate lighting at the event site that is beyond the c
ontrol of the photographer. Brayden Sherban Photography reserves the right to di
spose of any images as they see fit.
If the photographer cannot perform this contract due to fire or other casualty,
theft, denial of admission on to property, denial to allow photography by owner/
manager at location, inadequate set up space, equipment failure, lighting or co
lour problems, or other causes beyond control of the parties, or due to the phot
ographers illness or emergency, then the photographer shall return the retainer
to the client but shall have no further liability with respect to the contract.
This limitation on liability shall also apply in the event that photographic mat
erials are damaged in processing, lost through camera or computer malfunction, l
ost due to memory card malfunction, corrupt digital files or otherwise lost or d
amaged without fault on the part of the photographer, although all care will be
taken with the digital media and photographs taken at the event, the client agre
es that the photographer limits any liability for loss, damage, or failure to de
liver pictures, for any reason, no more than the return of all payments made to
Brayden Sherban Photography.
A non-refundable retainer is due at the signing of this contract unless other ag
reements have been made. At the photographers discretion, a partial retainer may
be accepted to hold the date with the balance due no later than one week prior
to the event date. No part of any order, including previews, if any, will be del
ivered until the balance* is paid in full. This agreement may be executed in any
number counterparts confirmed by the facsimile signatures transmitted by teleph
one, each of which shall be deemed a duplicate to the original.
