LEAVE AND LINCENCE AGREEMENT

THE AGREEMENT OF LEAVE AND LINCENCE IS MADE TODAY AT


PANCHGANI ON THIS DAY OF
BETWEEN
Shri. Bhiku Sitaram Parthe
Age -: 80 Yrs.
Occupation -: Farming
Resident of Panchgani, (Near Parasi Point)
Dist-: Satara, Tal -: Mahabaleshwar
Hereinafter referred to as
! THE LICENSORS!
OF THE FIRST PART

! THE LICENSEE!

OF THE SECOND PART

WHEREAS
The Property situated at Panchgani, included within the limits of Panchgani municipal council
and within limits of the Town planning scheme No III of Panchgani, bearing the Final Plot No.
530/A, Near Parasi point is owned and possessed by the Licensor
AND WHEREAS the said house property consists of three rooms with the following boundaries;
On the towards the East by ------------------------ Owner (Licensor)

On the towards the West by ------------------------ Open Space, Parasi Point


On the towards the North by ------------------------ Open Space and Boundary Taighat Gaon
On the towards the South by ------------------------ Surur-Mahabaleshwar Road

AND WHEREAS the licensor owns one block and eastern side consisting 4 rooms and Kitchen
AND WHEREAS the licensee is the resident of Panchgani C/O Modern Hardware, Panchgani
having a business of fabrication work
AND WHEREAS the licensee needs premises for the resident of his family and hence he has
approached licensor with request to grant the permission and to allow him to reside in the said

block at 530 Panchgani Near Parasi Point for 11 months Starting from 1st Dec 2005 to 31st
October 2006 on the leave and license basis
AND WHEREAS the licensor has agreed to grant the permission to occupy and to possess the
said property i.e. Block of 3 rooms for the residential purpose for him and for his family
members from 1st December 2005 till 31st October 2006 on the leave and license basis

AND WHEREAS both the parties have entered in to this agreement of leave and license on the
following terms and condition

1)

The licensor both hereby grant a licensee to leave and entered into and upon the said
property described in the scheduled written here under

2)

The license hereby shall remain in force from 1st December 2005 till 31st October 2006
and the licensee will pay in advance a license fees of Rs. 2000/- per month for the use of an
occupation of the said property

3) The license granted is personal and licensee shall use the said property only for the residential
purpose for himself and his family members only
4) This licensee shall have no rights to create any sub license or sub lease or to give the said
property to any of the friends or to any of third party.

5) The licensee shall not use or permit to be used the said property for any of the illegal or
immoral purpose and shall not do so or cause or permit to be done upon the said property or
any part there to anything which may become a nuisance or annoyance or cause any harm or
prejudicially effect the interest of the licensor or the neighboring occupiers,
6) The licensee shall not construct or permits to construct any person to obstruct to the licensor
or his agent at any time or interfere with the licensors pwemiaaion to inspect the said
property. It being agreed that the said property would be at all the time in the complete

possession and dominate of the licensor and the licensee will not claim any time in the
possession of any kind whatsoever of the said property.
7) The licensee shall use the said property and see that the same issued in a reasonable wear and
tear and careful manner and shall make good to the licensor all such damages or loss to the
licensor any of the damages sustain weather the same is caused by the licensee subject to the
reasonable wear and tear
8) The licensee shall pay the electrical and water charges of the said property and the licensor
would alone be responsible for the municipal taxes and other property taxes

9) The licensee shall keep the said property in good condition during the license period and also
shall maintain the fixtures and fitting in good condition. The licensee shall pay damages to
the fixture and fittings to the licensor
10) The licensee shall not make any of the alteration, addition, or make any improvements in the
said property or remove any of the fixtures and fittings without the written permission of the
licensor

11) The licensee by observing all the abovementioned stipulation and covenants all carefully and
quietly hold and enjoy the said property during the license period,
12) If licensee commit any of the breach of the abovementioned terms and conditions of this
leave and license agreement then the licensor shall be at liberty to revoke this license
forthwith by giving 15 days notice to the licensee

13) At all the time legal and judicial possession of the said property shall be that of the licensor
and licensee is merely granted the permission or a license to make the use and occupation of
the said property together with the fixture and fittings,

14) The licensee shall hand over the peaceful and vacant possession of the said property to the
licensor on the expiry of the license period i.e. 31st October 2006
15) The licensee hereby admit and acknowledges that it is the express intention of both the
parties to this agreement that the relationship of the !Landlord ! and ! Tenants ! shall not be

deemed to be created by or otherwise between them under any circumstances. This


agreement merely confirms bare permission of leave and license, It dose not create any
easementary rights or permission of leave and licensee, It is not agreed by this agreement to
create any lease, sub lease or any of the title into or upon the said property in favored of the
licensed the licensee hereby agrees that the under no circumstances he shall claim any right
of the tenancy, sub tenancy or any kind of other right of any nature in to or upon the said
property, The licensee herewith agrees that this is an adhoc arrangement and he is only
allowed temporarily to make the use of the said property,

16) This agreement of leave and license is signed by the Licensee in presence of the witnesses
without any fraud, coercions or misrepresentations
