SOLID WASTE PROCESSING & STORAGE FACILITY DRAFT PERMITS

This fact sheet has been developed for the draft Solid Waste Processing Facility
Permit and the draft Solid Waste Storage Facility Permit (hereinafter referred to
as “draft Processing Permit” and “draft Storage Permit”) that the Guam
Environmental Protection Agency (hereinafter referred to as “Guam EPA”)
intends to issue to Tomson LLC (hereinafter referred to as “Permittee”) for their
Processing & Storage Facility located on Lot No. 2181-R2, Tiyan, Barrigada.

The Department of Land Management (DLM) has deemed the aforementioned


property as having no official zone. A Deed was filed with DLM, Document
Locator No. 664172, between the United States and the Guam Economic
Development and Commerce Authority with a condition that the Grantee’s use of
property is limited to industrial and commercial use. Furthermore, the Ancestral
Land Trust Commission returned this property to the original landowners or their
heirs and has been leased to the Permittee.

The draft Processing Permit is issued for the shredding and bagging of waste
tires. A separate draft Storage Permit is issued for the storage of waste tires and
computer waste. The maximum quantity to be processed is 30 tons of waste
tires. The maximum quantity to be stored is 75 tons of waste tires and 5 tons of
computer waste. Conditions for the processing and storage of these wastes are
described in the draft Processing Permit and the draft Storage Permit.

A. PURPOSE OF THE PERMITTING PROCESS


The purpose of the permitting process is to afford interested citizens,
governmental agencies, and private entities the opportunity to evaluate and
comment on the ability of the Permittee to comply with the applicable solid waste
management requirements promulgated under 10 GCA, Chapter 51, Solid Waste
Management and Litter Control Act and Guam EPA Solid Waste Disposal Rules
and Regulations.
Guam EPA is authorized to administer the Solid Waste Management Program
and is required to prepare a draft Processing Permit and draft Storage Permit
with all the applicable requirements and conditions. Guam EPA requires the
Permittee to comply with all permit terms and conditions during the term of the
permit. The public is given forty-five (45) calendar days to review and comment
on the Permittee’s applications, draft Processing Permit, and draft Storage
Permit conditions prior to Guam EPA taking any final action.

B. PROCEDURES FOR REACHING A FINAL DECISION


Under 10 GCA Chapter 51, Solid Waste Management and Litter Control Act, and
Guam EPA Solid Waste Disposal Rules and Regulations, Guam EPA is required
to give the public at least forty-five (45) calendar days to comment on the draft
Processing Permit and draft Storage Permit. The comment period begins on
June 30, 2006 and ends on August 13, 2006. Any person interested in
commenting on the application and draft Processing Permit and draft Storage
Permit must do so within this comment period and should submit their remarks in
writing to the following address:

Comments should include all accurate references, reasonable and relevant


concerns, and supporting information. Contacts for more information on the draft

If, within the comment period, Guam EPA receives written notice of opposition to
the Agency’s intent to issue such permit and a request for a hearing is made, the
Agency shall provide for a hearing in accordance with the Administrative
Adjudication Law, if requested by a substantially affected party, or an informal
public meeting if requested by any other person.

When Guam EPA makes a final permit decision to either issue, deny, or modify
these permits, notice will be issued to the applicant and each person who has
submitted written comments or requested notice of the final decision. If no
comments request a change in the draft Processing Permit and draft Storage
Permit, these permits shall become final and effective immediately upon
issuance.
